Appellate Court Modifications Extraction consists of, given an Appellate Court decision, identifying the proposed modifications by the upper Court of the lower Court judge’s decision. In this work, we propose a system to extract Appellate Court Modifications for Portuguese. Information extraction for legal texts has been previously addressed using different techniques and for several languages. Our proposal differs from previous work in two ways: our corpus is composed of Brazilian Appellate Court decisions, in which we look for a set of (...) modifications provided by the Court; and to automatically extract the modifications, we use a traditional Machine Learning approach and a Deep Learning approach, both as alternative solutions and as a combined solution. We tackle the Appellate Court Modifications Extraction task, experimenting with a wide variety of methods. In order to train and evaluate the system, we have built the KauaneJunior corpus, using public data disclosed by the Appellate State Court of Rio de Janeiro jurisprudence database. Our best method, which is a Bidirectional Long Short-Term Memory network combined with Conditional Random Fields, obtained an \ score of 94.79%. (shrink)

Bottom of the Pyramid organizations are the ones that develop a set of capabilities that contribute to create short- and long-term sustainability values inside and outside the boundaries of BoP ecosystems. Capabilities have an important role in BoP organizations’ strategies that aim to solve BoP issues. Notwithstanding its developments, BoP research still lacks theoretical contributions for the analysis of organizations. We suggest special attention to the need of advancing knowledge on capabilities of BoP organizations because this field is scattered and (...) fragmented, misinterpreted, and still underdeveloped in the literature. We oriented our research formulating and seeking answers to our main question on what are the capabilities needed to enable organizations to create sustainability values in BoP ecosystems? We conducted an integrative review of BoP research for the period from 1998 to 2019, and we found 22 key capabilities of BoP organizations. We organized the capabilities into four major categories including BoP Responsible Consumption, BoP Responsible Business Model, BoP Responsible Management, and BoP Responsible Innovation. We advanced propositions and discussions regarding the capabilities and major categories’ popularity, interdependence and combination, short- and long-term temporal functions, sustainability roles, and effectiveness to address BoP issues. Our article organizes the field of capabilities of BoP organizations; advances contributions and implications for management, organizations, and policymaking; and opens fruitful avenues for future research. Neste trabalho apresentamos os resultados de uma pesquisa desenvolvida por uma aluna de graduação durante a realização de seu estágio docência. O objetivo da pesquisa foi investigar a relação entre trabalho e ensino de matemática em uma escola do campo na região sudeste do estado do Pará, na região norte do Brasil. A metodologia utilizada foi de inspiração etnográfica e os dados foram registrados no caderno de campo da pesquisadora. Também constitui material de análise as produções dos alunos e as (...) observações realizadas em sala de aula. Ao longo do texto apresentamos o contexto de realização da pesquisa, listando, de maneira breve, as principais características do curso de graduação no qual a pesquisadora está matriculada, bem como o contexto geográfico da comunidade onde está localizada a escola no qual a pesquisa foi realizada. Em seguida apresentamos nossa compreensão de duas noções centrais para nossa análise: conhecimento e trabalho. A primeira é tomada de um referencial teórico produzido no interior da Educação Matemática brasileira, conhecido como Modelo dos Campos Semânticos e a segunda é assumida em consonância com um referencial teórico marxista. Após o referencial teórico apresentamos a metodologia da pesquisa, destacando de modo geral as atividades que foram realizadas no estágio docência que se configurou como locus da produção dos dados da pesquisa. Nas análises, apresentamos as compreensões elaboradas pela pesquisadora a partir da articulação do referencial teórico com as atividades desenvolvidas durante o estágio. Colocamos em evidência que a compreensão de trabalho apresentada pelos alunos da escola investigada leva em consideração apenas o aspecto financeiro de algumas atividades realizadas por eles em seu dia a dia. Essa compreensão é colocada em contraste com a definição de trabalho apresentada pelos referenciais teóricos adotados. Por fim, tecemos algumas considerações sobre o uso de categorias tomadas da vida cotidiana nos processos de ensino e aprendizagem de Matemática. Apontamos que essa perspectiva teórica abre a possibilidade de uma ação didática que coloca em evidência a não centralidade da Matemática nos processos de produção de conhecimento, bem como viabiliza a utilização de outras categorias no processo de produção de conhecimento de modo não hierárquico em relação à ciência ocidental. The development of educational technologies is enhancing a distinctive feature of learning environments: the learner’s personalized environment. However, the current literature in e-learning seems to neglect an important discussion: will individuals and organizations face an enhancement concerning ethical dilemmas due to this evolution? To promote this discussion, this paper builds on a consideration of e-learning definition and its ethical dilemmas, and human-centred learning concept and its dimensions, to examine the implications of integrating social and cultural contexts. By examining the evolution (...) of e-learning management systems the argument progresses to a discussion of the relationships between pedagogy and ethics. By framing evidence at different scales, the authors critically reflect on the ethical dilemmas embedded in e-learning systems. The discussion concludes with advocating the adoption of an extension of “three P” mode of pedagogy to become the “P3E” model: personalization, participation, productivity, lecturer’s ethics, learner’s ethics, and organizational ethics. SummaryFrom 1996 to 2006, Nepal experienced a substantial fertility decline, with the total fertility rate dropping from 4.6 to 3.1 births per woman. This study examines the associations between progress towards universal primary and secondary schooling and fertility decline in rural Nepal. Several hypotheses regarding mechanisms through which education affects current fertility behaviour are tested, including: the school environment during women's childhood; current availability of schools; knowledge of educational costs; and women's own educational attainment. Data for the analysis come from (...) the 2003–04 Nepal Living Standards Survey, a nationally representative random sample of households, which includes detailed data on fertility, household expenditure, educational attainment, demographic characteristics and the use of social services. Census and administrative data are also used to construct district-level gross enrolment ratios for primary and secondary schools during the women's childhood. Discrete dependent variable modelling techniques are used to estimate the effects of the following variables on the probability of women giving birth in a given year: district-level gross enrolment ratios for primary and secondary schools during women's childhood; having had a child previously in school; women's own educational level; current school availability; and other covariates. Separate models are estimated for the overall sample of rural women of reproductive age, and for parity-specific sub-samples. The results suggest that district-level gross enrolment ratios for secondary schools and, in some instances, having had a previous child enrolled in school are significant determinants of fertility in rural areas. These results are highly independent of women's own educational levels. Overall, the results suggest that, in the rural Nepal context, mass schooling influences the fertility transition through both community- and household-level pathways. (shrink)

IntroductionElements mark the reality of reading the female body in symbolic constructions and social symbols in the exercise of their reproductive health. The study aims to identify elements that characterize the female condition while analyzing the reproductive health of Brazilian and French women.Materials and MethodsA qualitative, multicenter, international study was conducted in Brazil and in France between 2016 and 2019. Data were produced through the use of semi-structured scripts. Focus group discussions and individual interviews were conducted with women who gave (...) birth, hetero-female couples who lived the experience of gestation and birth of a baby, and professionals of maternal and childcare services or members of the associations concerned with the health of mothers and babies. It was guided by the theoretical-methodological framework of institutional analysis in line with the French Institutional Socioclinics.ResultsSexual and reproductive health in the realities researched in Brazil and France are sometimes close and sometimes far apart. In what involves the Brazilian health system, abortion is criminalized and often performed illegally. Furthermore, pregnancy, childbirth, and the postpartum period are highly medicalized. In addition, childbirth is not assured as an experience for a woman and her family. This aspect is confirmed by high numbers of cesarean sections performed or by maternal and infant mortality indicators. The French health system prioritizes vaginal deliveries and seems to assure more autonomy to women, but at the same time, it is worn out by the logic of profit, the efficiency of actions, and the rationalization of practices. In association with these, there are other intrinsic elements in the functioning of the institution that delineates the format of each country: notion of women's rights, violence against women, and discussion regarding the oppression markers of race, gender, sexuality, and social class.ConclusionsBoth countries reveal aspects related to the social role of women's bodies. The established logic reflects in the decision to have children, motherhood, women's autonomy over their own bodies, and in the core values linked to the termination of pregnancy and the professional practices developed in prenatal care, childbirth, and postpartum. Esta análise objetiva entender se existe reconhecimento às conjugalidades/parentalidades LGBTQIA+ pelo conceito de família da Política Nacional de Assistência Social e se há subsídios satisfatórios para abonar proteção estatal as genealogias e/ou pessoas LGBTQIA+ por meio dos benefícios, serviços, planos, programas e projetos da Norma Operacional Básica de 2005. Com a análise documental da referida legislação, evidenciou-se que o conceito de família ainda não superou o modelo patriarcal, inserido no sistema capitalista de minimalismo das políticas públicas.

Conservatism about perceptual justification tells us that we cannot have perceptual justification to believe p unless we also have justification to believe that perceptual experiences are reliable. There are many ways to maintain this thesis, ways that have not been sufficiently appreciated. Most of these ways lead to at least one of two problems. The first is an over-intellectualization problem, whereas the second problem concerns the satisfaction of the epistemic basing requirement on justified belief. I argue that there is at (...) least one Conservative view that survives both difficulties, a view which has the further ability to undercut a crucial consideration that has supported Dogmatist views about perceptual justification. The final section explores a tension between Conservatism and the prospects of having a completely general account of propositional justification. Ironically, the problem is that Conservatives seem committed to making the acquisition of propositional justification too easy. My partial defense of Conservatism concludes by suggesting possible solutions to this problem. (shrink)

The Venezuelan poet and philosopher Ludovico Silva argues that much of the confusion around Marx's work results from a failure to understand his mode of expression. Through meticulous readings of key passages in Marx's oeuvre, Silva isolates the central elements of his style: the search for an architectonic unity at the level of the text, his capacity to express himself dialectically at the level of the sentence, and, above all, his great gift for metaphor.

This monograph offers a fresh perspective on the applicability of mathematics in science. It explores what mathematics must be so that its applications to the empirical world do not constitute a mystery. In the process, readers are presented with a new version of mathematical structuralism. The author details a philosophy of mathematics in which the problem of its applicability, particularly in physics, in all its forms can be explained and justified. Chapters cover: mathematics as a formal science, mathematical ontology: what (...) does it mean to exist, mathematical structures: what are they and how do we know them, how different layers of mathematical structuring relate to each other and to perceptual structures, and how to use mathematics to find out how the world is. The book simultaneously develops along two lines, both inspired and enlightened by Edmund Husserl’s phenomenological philosophy. One line leads to the establishment of a particular version of mathematical structuralism, free of “naturalist” and empiricist bias. The other leads to a logical-epistemological explanation and justification of the applicability of mathematics carried out within a unique structuralist perspective. This second line points to the “unreasonable” effectiveness of mathematics in physics as a means of representation, a tool, and a source of not always logically justified but useful and effective heuristic strategies. South Africa shared with the world the warning of a new strain of SARS-CoV2, Omicron, in November 2021. As a result, many high-income countries (HICs) instituted complete travel bans on persons leaving South Africa and other neighbouring countries. These bans were unnecessary from a scientific standpoint, and they ran counter to the International Health Regulations. In short, South Africa was penalized for sharing data. Data sharing during pandemics is commonly justified by appeals to solidarity. In this paper, we argue that (...) solidarity is, at best, an aspirational ideal to work toward but that it cannot ground an obligation to share data. Instead, low-and-middle income countries (LIMCs) should be guided by the principle of reciprocity, which states that we ought to return good for good received. Reciprocity is necessarily a conditional principle. LMICs, we argue, should only share data during future pandemics on the condition that HICs provide enforceable assurances that the benefits of data sharing will be equitably distributed and that LMICs won’t be penalized for sharing information. When a belief is self-fulfilling, having it guarantees its truth. When a belief is self-defeating, having it guarantees its falsity. These are the cases of “self-impacting” beliefs to be examined below. Scenarios of self-defeating beliefs can yield apparently dilemmatic situations in which we seem to lack sufficient reason to have any belief whatsoever. Scenarios of self-fulfilling beliefs can yield apparently dilemmatic situations in which we seem to lack reason to have any one belief over another. Both scenarios have been used (...) independently to challenge Evidentialism, on which what we may rationally believe is all and only what fits our current evidence. This article intends to explore the philosophical potency in the work of the black writer Carolina Maria de Jesus (1914-1977). Carolina de Jesus is best known for her work Quarto de Despejo, diary of a favelada (1960), our approach, however, focuses specifically on her short story “Socrates Africano”, in which she deals with her experience with her grandfather Benedito and the relationship between her wisdom and that of the Greek philosopher Sócrates (5th century BC). Her reflection starts from the attempt (...) to understand the reason why her grandfather was compared to Socrates and called “African Socrates”. In this sense, we intend to expand the idea of an African Socrates and the origins of one of the African philosophical matrices, the Yoruba tradition, dialoguing with the thought of the Nigerian philosopher Sophie Oluwole (1935-2018) and her approximation between Socrates and Orunmilá, as a motto to think about the philosophical potentialities of Carolina's work and the traits of an Afro-Brazilian philosophy. Dentro de las tesis que definen la metafísica de Leibniz, destaca aquella según la cual las esencias encierran una pretensión a la existencia. Esta tesis ha despertado un singular interés entre los comentaristas de Leibniz, dando origen a un debate que enfrenta a aquellos que defienden una interpretación metafórica con aquellos que profesan una interpretación literal: si el primer grupo sostiene que tal pretensión ha de entenderse como una atribución metafórica en virtud de la cual las esencias, desprovistas de tal (...) característica, son susceptibles de alcanzar la existencia al ser actualizadas por Dios, para el segundo grupo, las esencias son portadoras en sí de tal característica, la que debe entenderse entonces como una cualidad real e inherente presente en ellas. A partir de un examen de diversos manuscritos de Leibniz, nuestro propósito es reivindicar una interpretación literal de la tesis de la pretensión de las esencias a la existencia, explicando por qué la interpretación metafórica, además de carecer de fundamento, entraña contradicciones. A group of philosophers suggests that a sense of mineness intrinsically contained in the phenomenal structure of all conscious experiences is a necessary condition for a subject to become aware of himself as the subject of his experiences i.e. self-awareness. On this view, consciousness necessarily entails phenomenal self-awareness. This paper argues that cases of delusions of thought insertion undermine this claim and that such a phenomenal feature plays little role in accounting for the most minimal type of self-awareness entailed by (...) phenomenal consciousness. First, I clarify the main view endorsing this claim i.e. the Self-Presentational View of Consciousness and formulate the challenge from thought insertion. After, I offer a systematic evaluation of all the strategies used by the advocates of this view to deal with this challenge. Finally, I conclude that most of these strategies are unsatisfactory for they rest in unwarranted premises, imprecisions about the agentive nature of cognitive experiences, and especially, lack of distinction between the different ways in which subjects can become aware of their own thoughts. We can, furthermore, be ignorant of such objects. Awareness is quite clearly related to knowledge, consciousness, and ignorance. But how? This entry explores some of the ways that awareness is (not) related to knowledge, consciousness, and ignorance. It also explores some of the ways that awareness might be required by, and thus fundamental (...) to, these other relations. The emerging insight is that additional clarity on the nature of awareness stands poised to add clarity to a wide range of philosophical issues in both epistemology and the philosophy of mind. Ronald de Sousa is one of the few analytic philosophers to have explored the ineffability of emotion. Ineffability arises, for de Sousa, from attempts to translate experience, which involves non-conceptual content, into language, which involves conceptual content. As de Sousa himself rightly notes, such a characterization construes all perceptual experience as ineffable and does not explain what might set emotional ineffability apart. I build on de Sousa’s insights regarding what makes emotional ineffability distinctive by highlighting that in the case of (...) emotion the content in question is, crucially, evaluative. Evaluative content has normativity that makes the ineffability of emotion both particularly salient as well as particularly relevant, as the way in which an object is valuable is felt to be merited despite the experience’s ineffability. After proposing an improved working definition of emotional ineffability, I move to the question of how language and emotional experience interact, and whether these interactions can be evaluated in any systematic way. While de Sousa is pessimistic regarding the prospects of such an evaluation, I argue that if we move beyond an individual level of analysis it is possible to characterize cases where the ineffability of emotion leaves members of particular social groups vulnerable to a range of epistemic and affective injustices. I argue that we can similarly characterize cases where the ineffability of emotion holds radical potential to challenge and transform unjust social arrangements. I end by proposing that the representational content of emotion involves what I call ‘modal complexity’ and that this makes emotions particularly well-suited to play such radical roles. (shrink)

The article proposes to analyse whether the current configuration of national migration legislation from Arendt's perspective on the universalization of human rights and Agamben's reflections on bare life and the state of exception demonstrates its capacity to protect the human rights of people undergoing forced migration. To this end, a literature review of a bibliographical nature was used, using the historical procedure method. In order to interpret the effectiveness of the current configuration of the human rights of this vulnerable group, (...) an analysis of international and national legislation on migration was carried out, focusing mainly on the case of the New Brazilian Migration Law. To this end, a theoretical discussion was built to understand how human rights are framed considering the situation of migration and statelessness in the face of an increasingly prevalent state of exception. It was noted that the constitutive fragility of forced migrants is a perennial situation, aggravated by the political inaction of nation states. It has also been noted that there is a need for states and international organizations to adopt new practices to promote the human dignity of forced migrants. (shrink)

Esta é uma filosofia que promove o diálogo entre disciplinas, autores e culturas e supera divisões teóricas em ordem a enfrentar as exigências da praxis. O desafio da praxis fez assim emergir um pensamento exigente e, simultaneamente, capaz de dialogar com diversas áreas do saber como: a psicoterapia, a história, as neurociências, a bioética, as ciências sociais e os estudos literários. At the occasion of the Paul Ricoeur’s centenary this volume joined in tribute several scholars, young researchers, and Ph.D students around the main themes that marked the reception of the philosopher’s work in Portugal and, especially in the University of Coimbra. Each chapter demonstrates the vigour Ricoeur’s thought as it is rooted in the "reflexive tradition", as it assumed the "existentialist" horizon, as it articulated Phenomenology and Hermeneutics. This philosophical project as, today, an enormous range of influence. This is a project that promotes dialogue between disciplines, authors, and cultures, overcoming theoretical divisions in face the demands of praxis. Agents know some but not all logical consequences of what they know. Agents seem to be neither logically omniscient nor logically incompetent. Yet finding an intermediate standard of minimal rationality has proven difficult. In this paper, I take suggestions found in the literature (Lewis, 1988; Hawke, Özgün and Berto, 2020; Plebani and Spolaore, 2021) and join the forces of subject matter and impossible worlds approaches to devise a new solution to this quandary. I do so by combining a space of (...) FDE worlds (Berto and Jago, 2019) with a Lewisian (1988) understanding of subject matters as partitions. By doing so, I show how subject matters impose some order in the anarchic space of FDE worlds, while the worlds allow for distinctions between contents which would not otherwise be available. Combining the two approaches, then, brings us closer to the desired closure principles for knowledge of minimally rational agents. (shrink)
