In most areas of medicine, the physician's primary task is to diagnose the patient's presenting problem by correctly identifying the underlying pathology causing that problem. Diagnoses are established through a process of correlating the information obtained from an interview with the patient about his history of illness and circumstances, with additional evidence of the underlying disease derived from physical examination findings and/or the results of laboratory investigations and diagnostic imaging. L'importance que les défenseurs du Research Domain Criteria (RDoC) accordent aux circuits du cerveau dans la compréhension des désordres mentaux a conduit certains chercheurs à suspecter qu'on avait affaire à un programme de recherche foncièrement réductionniste. Puisque le RDoC devrait éventuellement affecter la psychiatrie clinique, on a craint qu'elle ne se transforme en une science neuro-comportementale appliquée sans tenir compte de l'esprit (mindless). Cet article montre en quoi le projet du RDoC s'éloigne du réductionnisme classique et comment il en évite (...) les écueils. Pour cette raison, du moins en principe, le RDoC pourrait enrichir plutôt qu'appauvrir la psychiatrie clinique. Pour conclure, les effets néfastes produits par le réductionnisme de façade des défenseurs du RDoC seront soulignés. (shrink)

Concerns have been expressed about adult behaviour at children’s sporting events in New Zealand. As a consequence, covert observation was identified as the optimal research method to be used in studies designed to record the nature and prevalence of adult sideline behaviour at children’s team sporting events. This paper explores whether the concerns raised by the ethics committee about the use of this controversial method, particularly in relation to the lack of informed consent, the use of deception, and researcher safety, (...) were effectively managed. This is achieved by reflecting on the conduct and findings of the research and by drawing on the perspectives of research assistants who carried out the covert observation. The authors argue that in the context of these studies, the ends have justified the means and with careful attention to the design of the study the complex ethical tensions arising from the use of this method can be managed. A standard criticism of utilitarianism is that it is only indirectly concerned with the distribution of welfare between individuals and, therefore, does not take adequate account of the separateness between individuals. This has led some to conclude that the utilitarian must either downplay the moral significance of distinct identities (e.g. Parfit) or concede that justice represents a prior and independent constraint on the pursuit of the good (e.g. Rawls). An intriguing alternative presents itself if we accept that intrinsic value for (...) the world is independently generated by the receipt of welfare and the degree to which receipt accords with the demands of justice. Fred Feldman, for example, argues that an action is right if and only if it maximizes the sum of both these sources of intrinsic value. The proposal retains the aggregative structure of utilitarianism and takes into account the morally relevant differences between individuals. In response I argue that justice-adjusted utilitarianism collapses into a deontological theory because (i) the axiology assigns lexical priority to justice and (ii) the alleged intrinsic value of justice is entirely derivative. My purpose is to defend Augustine's doctrine of original sin against Joseph Fitzpatrick in his series of articles in New Blackfriars (July 2009–Jan 2010). I begin by arguing that Fitzpatrick's criticisms of it as psychologically inadequate fail because they do not take seriously enough the metaphysical structure of this doctrine, viz, creation from nothing. The second part begins with a critique of Fitzpatrick's interpretation of Genesis 3 and continues with a critical analysis of his proposed alternative to Augustine on original (...) sin (‘original sinfulness’) with reference to the scriptural passages he cites in its support. The conclusion I reach is that ‘original sinfulness’ is not an acceptable biblical hermeneutic. In the third section, I discuss Fitzpatrick's concept of ‘prototypical action’ and, using recent work of Carol Harrison on Augustine's early theological writings, I argue that, far from being incompatible with Augustine's theology of original sin, as Fitzpatrick maintains, this concept enables us to understand Augustine's position in a way that overcomes Fitzpatrick's objections to it. This article concerns two of the last great metaphysical thinkers: Austin Farrer and Alfred North Whitehead. It also concerns a fundamental cosmological question: does the world point inexorably to God? Often, attempts to formulate and answer this question still stand firm on the Aristotelian categories of scholastic theology. Confronting these head-on, Farrer and Whitehead offered an antidote to Aristotle’s outdated metaphysics. They re-conceived being in active terms. This deployment of action-concepts was designed to overcome the logical and ontological inertia of (...) divine Ipseity and so heal the breach between God and Creation. By exploring the ways Farrer and Whitehead addressed these matters, I hope to remind readers of a fertile alternative to realist/anti-realist conflicts currently dominating philosophical theology. This paper responds to an article by Kevin Thompson (in the same volume) which argued that a systematic reading of the _Philosophy of Right requires that it be ontologically grounded. In response I argue that such an approach to the _Philosophy of Right is essentially based on a precritical metaphysics which Hegel could not support and that his "Logic" excludes as a viable interpretation of his thought.

In an earlier article, it was established that the rules which govern the relations between universities and their students may find their legal source in prescription, royal charter, parliamentary legislation or contract. This article compares judicial review of student rules according to these different sources, whether this review forms part of public law (the review of byelaws, delegated legislation or the expression of other statutory rule‐making powers) or of contract law (as a matter of the fairness of the rules as (...) terms of the student contract or by the inherent qualification of any contractual rule‐making power in a university by reference to reasonableness). Both similarities and differences in these different types of review are identified and their implication in the student context assessed (notably, as to the exclusivity of the visitorial jurisdiction in the case of chartered universities). Finally, it is argued that the compatibility of student rules with students' human rights may be relevant to review in contract law as well as in public law as a result of the very inclusive nature of the grounds of this review. This essay explores Étienne Balibar’s treatment of the conceptual development of a notion of the super-ego in Freud as crucial to Balibar’s own thinking of the connection between politics and psychoanalysis. Via Balibar’s writing, however, it traces the antinomic forces at work in the question of a psychoanalytic supplement of politics, in the process examining not only the psychic conditions of the "political" but also the "politics" of different forms of psychological discourse and debate.

This essay reads Derrida’s Geschlecht III: Sex, Race, Nation, Humanity in the context of the philosophical and political legacies associated with the motif of leaping. Surveying the philosophical and textual ‘politics’ of this figure of the leap in the work of Kierkegaard, Hegel, Marx, Freud, Heidegger and others, the essay tracks its connection to the question of philosophical nationalism (and associated images of place, ground and gathering) explored by Derrida in Geschlecht III, speculating on the ambivalent resonances that ‘leap’ across (...) the political spectrum. In L'Arrêt de mort, as Derrida suggests, an ‘epochal suspension’ manifests itself, compulsively pulsating so as to conjure a certain spectrality beyond all consciousness, perception, or ordinary attentiveness. Re-reading Blanchot's text, I argue that it is on the borderlines of sleep that the ‘arrythmic pulsation’ of the arrêt de mort happens as impossible event – ‘the state of suspension in which it's over – and over again, and you'll never have done with that suspension itself’, to quote Derrida once more. (...) While ‘Living On’ makes little of sleep, however, I take this cue to follow a pathway which leads from Blanchot to Levinas. Blanchot's writing exposes the sleep of reason which occurs in the very promise of perfect day, a promise which mutates in the dream he associates with the ‘other night’, a dream which harbours the irrepressible return of ‘time's absence’, and which opens on to the very ‘outside’ which the world – and the self – lacks or wants (as much as ‘world’ or ‘self’ seek to overcome this ‘outside’ as such). Levinas, meanwhile, wants to think irremissible pure existing (il y a) in terms of insomnia; in contrast, consciousness seeks to assert itself over the unremitting presence of the ‘there is’ through its capacity for unconsciousness or sleep. This essay seeks to attend to the complexities of a certain ‘fatality of being’ that threatens to sweep away the ‘ego’ as consciousness's capacity to sleep is confronted by the radical vigilance of insomnia and the deep anonymity of the night (Existence and Existents). The enormous popularity of his pamphlet Common Sense made Thomas Paine one of the best-known patriots during the early years of American independence. His subsequent service with the Continental Army, his publication of The American Crisis (1776-83), and his work with Pennsylvania's revolutionary government consolidated his reputation as one of the foremost radicals of the Revolution. Thereafter, Paine spent almost fifteen years in Europe, where he was actively involved in the French Revolution, articulating his radical social, economic, and political vision (...) in major publications such as The Rights of Man (1791), The Age of Reason (1793-1807), and Agrarian Justice (1797). Such radicalism was deemed a danger to the state in his native Britain, where Paine was found guilty of sedition, and even in the United States some of Paine's later publications lost him a great deal of his early popularity. Yet despite this legacy, historians have paid less attention to Paine than to other leading Patriots such as Thomas Jefferson. In Paine and Jefferson in the Age of Revolutions, editors Simon Newman and Peter Onuf present a collection of essays that examine how the reputations of two figures whose outlooks were so similar have had such different trajectories. In recent papers, Elizabeth Finneron-Burns and Johann Frick have both argued that it is not a wrong-making feature of human extinction that it would cause many potential people with lives worth living never to be born, and hence that causing human extinction would be, in at least one way, less wrong than many have thought. In making these arguments, both assume that merely possible future people cannot be harmed by their nonexistence, and thus do not have any claim to be (...) brought into existence. In this paper, we raise objections to their arguments and suggest that there is nothing inherent in the moral theories they put forward that implies future people cannot have this sort of ‘existential’ claim. In doing so, we draw on the work of Derek Parfit, who argued, in a recent paper, that coming into existence benefits a person in that it is ‘good for’ them, even if it is not ‘better for’ them than non-existence. We also find that many of their objections to the view that it is wrong not to bring future people into existence rest on the assumption that, were these people to have claims on us, these must be equivalent to the claims that existing people have to be benefitted. However, we show that Parfit’s work demonstrates how this is not the case. (shrink)
