After coming into force of the Treaty of Lisbon it is acknowledged that better control and respect of the principle of subsidiarity is one of the most important and innovative goals of the Treaty. To achieve this goal, the Treaty introduces a mechanism which, apart from checking compliance of draft legislative acts with that principle, may eventually lead to a draft act to be deleted from the legislative agenda of the European Union on grounds of violation of subsidiarity. Within this (...) mechanism, crucial role is attributed to the national parliaments of the Member States. In this article, the reasons for overall inclusion of national parliaments in the European Union (hereinafter EU, the Union) activities are analysed. The role of national parliaments in the EU according to the specific provisions of the EU treaties is also discussed and the largest part of the work is devoted to the ex ante subsidiarity principle control mechanism (the Early Warning System), which gives the right for the national parliaments to influence the EU legislative process. This article focuses on hyperreality as a phenomenon used in fashion communication. The paper elaborates on the philosophical approach of Jean Baudrillard towards hyperreality, and Georg Simmel’s ideas about fashion’s role in society. The continuity of these authors’ ideas in later works highlights their cultural longevity. From a philosophical perspective, both fashion and hyperreality derive from dualism. Jean Baudrillard defines hyperreality as a condition in which what is real and what is simulated are seamlessly blended together. Hence, it becomes complicated (...) to distinguish them. Fashion, according to Georg Simmel, is also firmly based upon dualism – one power pushes us to bind ourselves to others while another pushes us to distinction. In fashion communication, hyperreality is often used to create a sense of desire and excitement around the brands and products. The effect of passion and the edge of reality combine and evoke many philosophical approaches. We discuss hyperreality as a new reality dialectically – looking for the opposing ideas that would contribute to answering the main question – do we unconsciously want to be deluded? This paper reveals the link between hyperreality as a philosophical approach and fashion communication uncovering the delusion as a human desire. (shrink)

Tyrimų duomenys rodo, kad šiuolaikinė tranzicijos į suaugystę patirtis neatitinka so­cialinių normatyvinių tvarkaraščių, o suaugystės samprata prarado didelę savo vaid­menų struktūros ir tradicinės prasmės dalį, tapo daug labiau psichologiniu reiškiniu, siejamu su vėlyvosios modernios visuomenės individualizacija. Šiame straipsnyje analizuojamos suaugystės sampratų sąsajos su tranzicijos į suaugystę patirtimi Lietuvoje XXI a. Siekiama atsieti šias sąsajas formuojančius ar jų nebuvimą lemiančius veiksnius. Tam pasitelkta 1990­ųjų pradžioje gimusių dviejų skirtingų lyčių jaunuo­lių suaugystės atvejų analizė, paremta kokybine gyvenimo istorijų interviu medžiaga. Sociological theory on the phenomenon of suicide continues to rely heavily upon the Durkheimian perspective. While such accounts are valuable additions to the field, engagement with alternative theoretical traditions may likewise be stimulating and provide distinct concepts to delve into the issue. This article contributes to expanding sociological understanding of suicide by drawing upon Pierre Bourdieu’s theory, a relatively untapped resource in the study of suicide. I suggest that the concept of hysteresis – a mismatch between embodied and objectified structures (...) – enables an understanding of under what circumstances agents may become vulnerable to suicide. I then theorise how socioeconomic, political, and cultural dynamics may deepen the hysteresis effect and increase the chances that individuals in specific social positions experience it. Finally, I argue that individuals’ responses to such distress depend on their space of possibles: the culturally laden idea of suicide and alternatives to it. (shrink)

The cyber domain is one of the newest and most rapidly evolving fields of knowledge which has led to the development of a new area of law—cyber law, that regulates the use of the Internet and activities performed over the Internet and other networks. The cyber domain is particularly dynamic: new concepts are constantly developed and need new terminological designations, which in turn need new counterparts in other languages. Formation of these designations and their counterparts often raises terminological issues that (...) are important to deal with in order to develop a coherent system of the cyber domain terms. The given paper focuses on the terminology that includes the lexical item cyber which may be considered as the main signifier of the cyber domain indicating its specific nature. The aim of the paper is threefold: to analyse the origin and development of the lexical item cyber, to investigate conceptual categories of the EU legislation terminology that includes the lexical item cyber and to establish the Lithuanian counterparts that are used for translation of the lexical item cyber in the Lithuanian equivalents of the English terms. For the purposes of the study, the ad hoc English and Lithuanian corpora of the EU legislative documents were compiled. Corpus-driven methodology was used to extract and investigate the terminology used in the corpora. The results of the research are believed to provide useful information to learners and teachers of the legal language and legal translation, as well as drafters of legislative and administrative documents and other professionals engaged in cybersecurity matters. This article presents the conception of negligent account management, analyses the rules of the criminal act that govern criminal liability for negligent account management, by focussing on the form of guilt and the problem of its content. The plenary session’s conclusion that the two offences – failure to administer bookkeeping and failure to protect the bookkeeping documents – can be committed both intentionally and negligently is disputed in this article. The adoption of the new Criminal Code in 2000, setting the (...) form of guilt and its content in criminal cases for negligent account management, posed no significant problems – the court practice and legal literature followed the attitude that this crime could be committed only negligently. According to Article 16(4) of the Criminal Code 2000, a person is punished for negligent commission of a crime or a misdemeanour only in individual cases stipulated in the Special Part of the Criminal Code. The problem was that no “individual case” was foreseen in Article 223 of the Criminal Code that imposed liability for negligent bookkeeping. This created preconditions for deviating from pre-existing case-law under which this crime could be qualified as negligent. Only in 2009 the Criminal Division of the Lithuanian Supreme Court concluded in its plenary session that Article 223 of the Criminal Code provided liability for criminal record-keeping and accounting only if committed negligently as a form of guilt, and other activities pursuant to this Article might be committed intentionally and recklessly. The plenary session identified a loophole of criminal law and created preconditions for the formation of uniform court practice. Only the legislator can remove the loophole of criminal law identified by the Supreme Court of Lithuania. The author states that all of the acts named in Article 223 of the Criminal Code can be committed negligently and suggests applying the rule contained in Article 16(4) of the Criminal Code to Article 223 of the Criminal Code. All of these findings are based on historical, grammatical and logical interpretation of the “neglect” concept and the analysis of Articles 222 and 223 of the Criminal Code. (shrink)
