It has been estimated that U.S. companies with global business operations can reduce their U.S. tax bill by up to 10 percentage points if they reincorporate in a zero or low tax offshore jurisdiction. But this activity, at a time of national crisis following the September 11 terrorists' attacks and recent spate of corporate scandals, has received a less than sympathetic response from the U.S. media, ordinary taxpayers, shareholders and politicians as concerns are raised about the reduction of the tax (...) base and the lack of oversight and regulation in offshore centres. Offshore reincorporation has been condemned as immoral, unconscionable, dishonest and unpatriotic, accusations that cast doubt on the legitimacy of the companies concerned. In question is their right to conduct business in the U.S. and in particular, their right to still be viewed as American. Their legitimacy once bestowed so readily by the company's shareholders is now being questioned not only by shareholders but also the media, politicians, government regulators, pension funds and labour unions. Expatriate companies have been slow to respond to questions of their legitimacy, viewing their offshore move as a financial decision needing only the consent of their shareholders. However, times have changed and corporate legitimacy is now in the hands of all the company's stakeholders. Companies will need to explicitly consider the determinants of their legitimacy and the implications of the implied social contract under which they operate, to remain relevant in the days ahead. Friedrich Nietzsche is often depicted in popular and scholarly discourse as a lonely philosopher dealing with abstract concerns unconnected to the intellectual debates of his time and place. Robert C. Holub counters this narrative, arguing that Nietzsche was very well attuned to the events and issues of his era and responded to them frequently in his writings. Organized around nine important questions circulating in Europe at the time in the realms of politics, society, and science, Nietzsche in the Nineteenth (...) Century presents a thorough investigation of Nietzsche's familiarity with contemporary life, his contact with and comments on these various questions, and the sources from which he gathered his knowledge. Holub begins his analysis with Nietzsche's views on education, nationhood, and the working-class movement, turns to questions of women and women's emancipation, colonialism, and Jews and Judaism, and looks at Nietzsche's dealings with evolutionary biology, cosmological theories, and the new "science" of eugenics. He shows how Nietzsche, although infrequently read during his lifetime, formulated his thought in an ongoing dialogue with the concerns of his contemporaries, and how his philosophy can be conceived as a contribution to the debates taking place in the nineteenth century. Throughout his examination, Holub finds that, against conventional wisdom, Nietzsche was only indirectly in conversation with the modern philosophical tradition from Descartes through German idealism, and that the books and individuals central to his development were more obscure writers, most of whom have long since been forgotten. This book thus sheds light on Nietzsche's thought as enmeshed in a web of nineteenth-century discourses and offers new insights into his interactive method of engaging with the philosophical universe of his time. This book provides the first detailed account of Gramsci's work in the context of current critical and socio-cultural debates. Renate Holub argues that Gramsci was ahead of his time in offering a theory of art, politics and cultural production. Gramsci's achievement is discussed particularly in relation to the Frankfurt School (Adorno, Horkheimer, Benjamin, Bloch, Habermas), to Brecht's theoretical writings and to thinkers in the phenomenological tradition especially Merleau-Ponty. This review essay expands on two excellent collections dealing with Nietzsche and Wagner and is drawn from the proceedings of conferences in the bicentennial year of Wagner’s birth. It points to four areas underplayed in the contributions. The first involves Nietzsche’s adoption of Wagnerian ideology, especially anti-Judaism, in the late 1860s and early 1870s. The second deals with Nietzsche’s actual activities and sentiments regarding the inaugural Bayreuth festival in 1876 and his later reports of these activities and sentiments. A third (...) topic concerns the break from Wagner, its likely causes, and its stylization in Nietzsche’s recollections from the 1880s. And lastly the essay examines the ambivalence toward Wagner in Nietzsche’s writings from 1888 as part of an autobiographical imperative. In general, the collections reviewed place too much trust in Nietzsche’s own accounts of the relationship with Wagner and fail to recognize that, especially in the 1880s, the philosopher is engaged in a process of self-fashioning to bring his current views into harmony with a history embellished and manipulated to give the appearance of linear development and consistent beliefs. This article is about the method of philosophizing employed by Karol Wojtyła. He worked out his main ideas concerning the human person within a Thomistic framework, but at the same time made extensive use of the method typical of phenomenology. The article sets out to demonstrate that these two approaches do not exclude each other, but can instead be considered complementary. Phenomenology, in the version employed by Wojtyła, aims to do justice to the experience of the person, and its analysis (...) helps us understand the richness of the latter. At the same time, all of the phenomena that pertain to the person demand further explanation, and this can be supplied by Thomistic metaphysics. The method devised by Wojtyła can be expressed in the formula “from phenomenon to foundation.”. (shrink)

Renate Holub provides a critical introduction to the philosophical foundations of human rights as developed by the Italian philosopher Giambattista Vico [1668-1744]. She demonstrate the profoundly innovative principles he contributed to and his contemporary relevance for a global theory of justice. Leading twentieth century transatlantic intellectuals, like Joseph Schumpeter, Arthur Nussbaum, Robert Cox who, though for quite different ultimate purposes, were variably working at the intersections between sociology, economic analysis, and international legal thought, squarely recognized the gravitas of the (...) unprecedented conceptual reach of the principles governing Vico’s social science. What is central to Vico’s international philosophy is an understanding of civilizational history not marked by permanent violence between individuals or groups of people. Rather, it is an understanding which outlines a broad historical tendency towards the reduction of violence in the internal and external organizations of social relations of peoples in all global regions. Vico’s political thought developed significant elements for a global theory of justice based not on legitimations of violence, as ‘just war’ theories, but for structuring, however minimally, the conditions of ‘permanent just global peace.’. The article is primarily concerned with the ambiguities which surround the concept of the person. According to the philosophical tradition taking its roots from Locke's definition, personhood depends on consciousness. Therefore, “personhood” can be ascribed to different entities, and only these entities acquire a moral standing. This can entail that a human being may or may not be considered as a person, as well as higher animals and even artificial machines. Everything depends on manifest personal characteristics. In order to sort (...) out different meanings ascribed to “person,” I distinguish between being a person and acting as a person. Genetic engineering promises to change the human condition by changing certain human characteristics. Why not take control of such changes and secure positive outcomes, making use of our progressing knowledge about human genetic make-up and our increasingly sophisticated skills? This paper elaborates the meanings of the word “change,” a cornerstone of the enhancement debate, focusing not on technicalities of genetic engineering but on philosophical implications of its implementation. The paper then turns to some of the complexities and difficulties of the (...) debate. Finally, it takes up a strictly philosophical investigation of what we mean by “change” as far as a basic structure of the human being (the human person) is concerned, and examines what conclusions can be drawn for genetic enhancement. The paper deals with a possible interdependence between bioethics and transhumanism. It seems that nowadays transhumanism is a separate discipline and we can say at most about bioethical aspects of that. However, a more in-depth investigation reveals that transhumanism is a rival of the contemporary bioethics and tends to take control over it. So, this paper tried to prove that this is not a necessity. There are still vital differences between bioethics and transhumanism and they justify keeping the former separate. (...) The main difference concerns the object of investigation: bioethics is about ethical enquiry of the existing, bodily human being, whereas transhumanism is directed toward a future creature called posthuman. Thus, although there are attempts within transhumanism to replace bioethics, they are still two separate fields of investigation and hence the former is not a new and fully-fledged face of the latter. Jewish Nietzscheans have traditionally shied away from any detailed examination of Nietzsche’s comments on contemporary Jewry or the Jewish religion. Scholars who have examined Jewish Nietzscheans have therefore sought to connect Nietzsche with some dimension of Jewish thought through similarities in views between Nietzsche and the Jewish intellectuals who were purportedly influenced by him. The two books under consideration in this essay strain to find solid connections between Nietzsche’s philosophy and the writings of eminent Jewish writers. Daniel Rynhold and Michael (...) Harris examine how selected Nietzschean concepts can also be found in the work of the noted Jewish thinker Rabbi Joseph Soloveitchik. David Ohana, by contrast, examines a variety of Jewish writers who at some point exhibited an enthusiasm for Nietzsche, ranging from Hebrew scholars and translators to German-Jewish intellectuals. Both books suffer from many of the shortcomings of general Nietzschean influence studies: there is often no sound philological evidence of influence, or the “connection” is so general that it is difficult to see Nietzsche as the source of influence, or the alleged influence was of short duration, and it is difficult to understand what remains Nietzschean in the individual influenced. Ken Gemes's “The Biology of Evil” makes significant advances over previous discussions in its recognition of the centrality of the Jews in Nietzsche's account of the rise of slave morality, and in its differentiation between Nietzsche's virulent opposition to the anti-Semitic movements of his era and his embrace of prejudice regarding Jews and Jewry. There are three areas in which his claims are deficient, however. He does not realize Nietzsche's lifelong interest in the contemporary Jewish Question in Germany. He disregards (...) Nietzsche's avid interest in eugenics and eugenic solutions in the discussion of degeneration; Nietzsche knew the works of Francis Galton and others, and he himself wrote explicitly about positive and negative eugenics. Finally, Gemes believes Nietzsche advocated a mixture of slave and master morality, while it is clear from his rhetoric and his substantive remarks that he envisions no harmony of these two antagonistic value systems.
