Data management raises a number of issues, both regulatory and non-regulatory. Researchers should understand how data are defined by their particular institutions and regulatory authorities. Data are the bases of scientific communication and provide a strong defense against allegations of scientific misconduct. Authorization is often necessary before collection of data can commence. Proper handling, retention, and storage of data, especially that involving humans, are crucial for the researcher. The rate at which women and girls have been ‘butchered’ in Africa before and during the COVID-19 pandemic suggests that violence against women in patriarchal settings is more tolerable. According to Exodus 21:12, Leviticus 24:17, Deuteronomy 12:312, 2 Kings 17:31 and Isaiah 66:3, murder and human sacrifice are an abomination and defile the land. Unfortunately, it is heartbreaking to note how the murder of women finds justification, as shown in Judges 11:31–40. Ironically, in Genesis 22:13, the sacrifice of Isaac is (...) prevented through the provision of a sacrificial lamb. In this conversational platform, an African women’s hermeneutical lens to Judges 11:31–40 enables one to reimagine female bodies and motherhood as a theological phenomenon. It is proposed that ‘Sharon’s blood’ presents murdered women as Mother Earth’s sacrificial lambs of Africa, whose lives do not go unnoticed by God. Reimagining female bodies and motherhood as a theological phenomenon arguably enables the voices of murdered women to cry for justice from beyond the grave. If ‘the Sharons’ and their unborn babies do not receive justice, the ground continues to be defiled by human blood and remains ‘cursed’ (Mi 6:15). We will plant but not harvest; hence, there is a direct relationship between female bodies, motherhood and Mother Earth. One therefore asks: can scholarly conversational platforms enable murdered women of African descent to cry for justice from beyond the grave, allowing for life to flourish ‘again’? Contribution: This article contributed new knowledge to feminist studies by presenting murdered female victims of gender-based violence (GBV) as the sacrificial lambs of Mother Africa, whose innocent blood continues to cry for justice from beyond the grave. From an African hermeneutical lens, this research article reimagined female bodies and motherhood as a theological phenomenon in order to arguably enable the voices of murdered women to cry for justice from beyond the grave. Research shows people confront social marginalization through work, yet this scholarship largely ignores people working in illicit markets. We address this gap by investigating how and to what end men in street prostitution “borrow” privilege from their more structurally advantaged clients. Drawing from interviews with men of color in street sex work, we show how they “status maneuver” to offset stigmatized identities tied to prostitution and to construct a masculinity that offers a greater sense of social worth within constrained circumstances. These men ironically rely on status differences between themselves and their white, wealthy men clients to undermine their own oppression and to create possibilities for momentary associations with hegemonic masculine privilege. This research shows how barriers between the powerful and powerless are permeable, and how social hierarchies serve as resources to cope with the inequitable conditions and stigma under which some people live and work. Kant's theory of punishment is commonly regarded as purely retributive in nature, and indeed much of his discourse seems to support that interpretation. Still, it leaves one with certain misgivings regarding the internal consistency of his position. Perhaps the problem lies not in Kant's inconsistency nor in the senility sometimes claimed to be apparent in the Metaphysic of Morals, but rather in a superimposed, modern yet monistic view of punishment. Historical considerations tend to show that Kant was discussing not one, (...) but rather two facets of punishment, each independent but nevertheless mutually restrictive. Punishment as a threat was intended to deter crime. It was a tool in the hands of civil society to counteract human drives toward violating another's rights. In its execution, however, the state was limited in its reaction by a retributive theory of justice demanding respect for the individual as an end and not as a means to some further social goal. This interpretation of Kant's theory of punishment maintains consistency from the earliest through the latest of his writings on moral, legal, and political philosophy. It provides a good reason for rejecting current economic analyses of crime and punishment. Most important of all, it credits Kant's theory in its clear recognition of the ideals intrinsic to libertarian government. (shrink)

Sharon Street has argued that we should reject theism because we can accept it only at the cost of having good reason to doubt the reliability of our judgments as to what moral reasons there are. The success of her argument depends on the assumption that no realist account of normative reasons that validates commonsense morality has a tenable secular epistemology. I argue that even given this assumption Street’s argument does not succeed.

First, this article considers Kant's rather odd requirement that every contract consist of four declarations of will: an offer, an approval of the offer, a promise and an acceptance of this promise. It explains Kant's theory as a stepping stone for Savigny's later development of the principle of abstraction, a principle which separates the contract of obligation from the contract of ownership transfer and makes the validity of each independent of the validity of the other. Second, the article interprets Kant's (...) "Dogmatic Division of All Rights Acquirable through Contracts," contained in section 31 of the Doctrine of Right. It claims that the table consists of aspects of contractual relationships and is dynamic rather than static in that these aspects can be intermingled to produce a wealth of different types of contracts. The 17th Century English philosopher Thomas Hobbes is now widely regarded as one of a handful of truly great political philosophers, whose masterwork Leviathan rivals in significance the political writings of Plato, Aristotle, Locke, Rousseau, Kant, and Rawls. Hobbes is famous for his early and elaborate development of what has come to be known as “social contract theory”, the method of justifying political principles or arrangements by appeal to the agreement that would be made among suitably situated rational, free, and (...) equal persons. He is infamous for having used the social contract method to arrive at the astonishing conclusion that we ought to submit to the authority of an absolute— undivided and unlimited—sovereign power. While his methodological innovation had a profound constructive impact on subsequent work in political philosophy, his substantive conclusions have served mostly as a foil for the development of more palatable philosophical positions. Hobbes's moral philosophy has been less influential than his political philosophy, in part because that theory is too ambiguous to have garnered any general consensus as to its content. Most scholars have taken Hobbes to have affirmed some sort of personal relativism or subjectivism; but views that Hobbes espoused divine command theory, virtue ethics, rule egoism, or a form of projectivism also find support in Hobbes's texts and among scholars. Because Hobbes held that “the true doctrine of the Lawes of Nature is the true Morall philosophie”, differences in interpretation of Hobbes's moral philosophy can be traced to differing understandings of the status and operation of Hobbes's “laws of nature”, which laws will be discussed below. The formerly dominant view that Hobbes espoused psychological egoism as the foundation of his moral theory is currently widely rejected, and there has been to date no fully systematic study of Hobbes's moral psychology. Drawing on Christopher Boorse's Biostatistical Theory (BST), Norman Daniels contends that a genuine health need is one which is necessary to restore normal functioning – a supposedly objective notion which he believes can be read from the natural world without reference to potentially controversial normative categories. But despite his claims to the contrary, this conception of health harbors arbitrary evaluative judgments which make room for intractable disagreement as to which conditions should count as genuine health needs and therefore which needs (...) should be met. I begin by offering a brief summary of Boorse's BST, the theory to which Daniels appeals for providing the conception of health as normal functioning upon which his overall distributive scheme rests. Next, I consider what I call practical objections to Daniels's use of Boorse's theory. Finally I recount Elseljin Kingma's theoretical objection to Boorse's BST and discuss its impact on Daniels's overall theory. Though I conclude that Boorse's view, so weakened, will no longer be able to sustain the judgments which Daniels's theory uses it to reach, in the end, I offer Daniels an olive branch by briefly sketching an alternative strategy for reaching suitably objective conclusions regarding the health and/or disease status of various conditions. It is predicted that the rapid acquisition of new genetic knowledge and related applications during the next decade will have significant implications for virtually all members of society. Currently, most people get exposed to information about genes and genetics only through stories publicized in the media. We sought to understand how individuals in the general population used and understood the concepts of ???genetics??? and ???genes.??? During in-depth one-on-one telephone interviews with adults in the United States, we asked questions exploring their (...) basic understanding of these terms, as well as their belief as to the location of genes in the human body. A wide range of responses was received. Despite conversational familiarity with genetic terminology, many noted frustration or were hesitant when trying to answer these questions. In addition, some responses reflected a lack of understanding about basic genetic science that may have significant implications for broader public education measures in genetic literacy, genetic counseling, public health practices, and even routine health care. This study focuses on multiple masculinities conceptualized in terms of sociality, a concept used to refer to nonsexual interpersonal attractions. Through male homosocial heterosexual interactions, hegemonic masculinity is maintained as the norm to which men are held accountable despite individual conceptualizations of masculinity that depart from that norm. When it is understood among heterosexual men in homosocial circles that masculinity means being emotionally detached and competitive and that masculinity involves viewing women as sexual objects, their daily interactions help perpetuate a (...) system that subordinates femininity and nonhegemonic masculinities. Nonhegemonic masculinities fail to influence structural gender arrangements significantly because their expression is either relegated to heterosocial settings or suppressed entirely. (shrink)

Hannah Arendt's critique of education in 1950s USA provides an important way of understanding the development of citizenship education. Her theory on the nature of childhood and her concepts of natality and authority give insight into both the directions of current policies and practices, and the possible future states into which these elements may crystallise. It is argued that education for citizenship is an expression of the hope that children will ‘save’ us from ourselves and that there are two distinct (...) directions that this hope is taking, one representing an orientation to the past and the other to the future. Arendt's critique focuses on what she argues is the proper relationship to both past and future that the educator must maintain. Kierkegaard's well‐known analysis of the self, in the first part of his work The Sickness unto Death (1849), presents, even if only in passing, the somewhat enigmatic notion of “divine name.” In this article I offer an interpretation of Kierkegaard's analysis and suggest that the notion of a divine name be understood as expressing the conception of human beings as possessing (what I call) “individual essence.” I further demonstrate that it is this quality that makes a human being a self, (...) namely, the individual that he or she is. In addition to defending the exegetical and substantial plausibility of this conception, I show how it opens the way to affirming the feasibility of universal love. (shrink)

Since the outbreak of COVID-19, governments have turned their attention to digital contact tracing. In many countries, public debate has focused on the risks this technology poses to privacy, with advocates and experts sounding alarm bells about surveillance and mission creep reminiscent of the post 9/11 era. Yet, when Apple and Google launched their contact tracing API in April 2020, some of the world’s leading privacy experts applauded this initiative for its privacy-preserving technical specifications. In an interesting twist, the tech (...) giants came to be portrayed as greater champions of privacy than some democratic governments. This article proposes to view the Apple/Google API in terms of a broader phenomenon whereby tech corporations are encroaching into ever new spheres of social life. From this perspective, the advantage these actors have accrued in the sphere of the production of digital goods provides them with access to the spheres of health and medicine, and more worrisome, to the sphere of politics. These sphere transgressions raise numerous risks that are not captured by the focus on privacy harms. Namely, a crowding out of essential spherical expertise, new dependencies on corporate actors for the delivery of essential, public goods, the shaping of public policy by non-representative, private actors and ultimately, the accumulation of decision-making power across multiple spheres. While privacy is certainly an important value, its centrality in the debate on digital contact tracing may blind us to these broader societal harms and unwittingly pave the way for ever more sphere transgressions. Inner speech emerges in early childhood, in parallel with the maturation of the dorsal language stream. To date, the developmental relations between these two processes have not been examined. We review evidence that the dorsal language stream has a role in supporting the psychological phenomenon of inner speech, before considering paediatric studies of the dorsal stream’s anatomical development and evidence for its emerging functional roles. We examine possible causal accounts of the relations between these two developmental processes, and consider their (...) implications for phylogenetic theories about the evolution of inner speech and the accounts of the ontogenetic relations between language and cognition. For Emily Dickinson, perhaps no more so than for the rest of us, there was a powerful discrepancy between what was "inner than the Bone"1 and what could be acknowledged. To the extent that her poems are a response to that discrepancy—are, on one hand, a defiant attempt to deny that the discrepancy poses a problem and, on the other, an admission of defeat at the problem's enormity—they have much to teach us about the way in which language articulates our (...) life. There is indeed a sense in which these poems test the limits of what we might reveal if we tried and also of what, despite our exertions, will not give itself over to utterance. The question of the visibility of interior experience is one that will concern me in this essay, for it lies at the heart of what Dickinson makes present to us. In "The Dream of Communication," Geoffrey Hartman writes: "Art represents a self which is either insufficiently present or feels itself as not presentable."2 On both counts one thinks of Dickinson, for her poems disassemble the body in order to penetrate to the places where the feelings lie as if hidden, and they tell us that bodies are not barriers the way we sometimes think they are. Despite the staggering sophistication with which we discuss complex issues, like Dickinson we have few words, if any, for what happens inside us. Perhaps this is because we have been taught to conceive of ourselves as perfectly inexplicable or, if explicable, then requiring the aid of someone else to scrutinize what we are explicating to validate it. We have been taught that we cannot see for ourselves—this despite the current emphasis on our proprioceptive functions. But Dickinson tells us that we can see. Drawing on their extensive research, Nichols and Berliner document and categorize the ways that high-stakes testing threatens the purposes and ideals of the American education system. For more than a decade, the debate over high-stakes testing has dominated the field of education. This passionate and provocative book provides a fresh perspective on the issue and powerful ammunition for opponents of high-stakes tests. Their analysis is grounded in the application of Campbell’s Law, which posits that the greater the social consequences associated (...) with a quantitative indicator, the more likely it is that the indicator itself will become corrupted—and the more likely it is that the use of the indicator will corrupt the social processes it was intended to monitor. Nichols and Berliner illustrate both aspects of this “corruption,” showing how the pressures of high-stakes testing erode the validity of test scores and distort the integrity of the education system. Their analysis provides a coherent and comprehensive intellectual framework for the wide-ranging arguments against high-stakes testing, while putting a compelling human face on the data marshalled in support of those arguments. Timothy Williamson has famously argued that the principle should be rejected. We analyze Williamson's argument and show that its key premise is ambiguous, and that when it is properly stated this premise no longer supports the argument against. After canvassing possible objections to our argument, we reflect upon some conclusions that suggest significant epistemological ramifications pertaining to the acquisition of knowledge from prior knowledge by deduction.

In thinking about the relationship between the sexed body and the state, it is worth recalling that both have a history. This essay, divided into two sections, uses the example of nineteenth-century England, which has had an exemplary status in scholarship on both the state and sexuality, to highlight the variability of law and government with respect to the body. The first section shows how a particular state during a key historical period produced sexuality through its decisions to protect and (...) regulate some bodies and not to regulate and protect others through the state's marriage laws and sodomy laws. The second section of this essay looks beyond sexuality to explore state oversight in the second sense of the term: as an omission or lapse in attention. What were the intimate matters to which the state was relatively indifferent? (shrink)

Methodologists in political science have advocated for causal process tracing as a way of providing evidence for causal mechanisms. Recent analyses of the method have sought to provide more rigorous accounts of how it provides such evidence. These accounts have focused on the role of process tracing for causal inference and specifically on the way it can be used with case studies for testing hypotheses. While the analyses do provide an account of such testing, they pay little attention to the (...) narrative elements of case studies. I argue that the role of narrative in case studies is not merely incidental. Narrative does cognitive work by both facilitating the consideration of alternative hypotheses and clarifying the relationship between evidence and explanation. I consider the use of process tracing in a particular case (the Fashoda Incident) in order to illustrate the role of narrative. I argue that process tracing contributes to knowledge production in ways that the current focus on inference tends to obscure. (shrink)

In this paper I will argue that Tait’s axiomatic conception of mathematics implies that it is in principle impossible to be justified in believing a mathematical statement without being justified in believing that statement to be provable. I will then show that there are possible courses of experience which would justify acceptance of a mathematical statement without justifying belief that this statement is provable.
