Recent financial fraud legislation such as the Dodd–Frank Act and the Sarbanes–Oxley Act (U.S. House of Representatives, Dodd-Frank Wall Street Reform and Consumer Protection Act of 2010, [H.R. 4173], 2010 ; U.S. House of Representatives, The Sarbanes–Oxley Act of 2002, Public Law 107-204 [H.R. 3763], 2002 ) relies heavily on whistleblowers for enforcement, and offers protection and incentives for whistleblowers. However, little is known about many aspects of the whistleblowing decision, especially the effects of contextual and wrongdoing attributes on organizational (...) members’ willingness to report fraud. We extend the ethics literature by experimentally investigating how the nature of the wrongdoing and the awareness of those surrounding the whistleblower can influence whistleblowing. As predicted, we find that employees are less likely to report: (1) financial statement fraud than theft; (2) immaterial than material financial statement fraud; (3) when the wrongdoer is aware that the potential whistleblower has knowledge of the fraud; and (4) when others in addition to the wrongdoer are not aware of the fraud. Our findings extend whistleblowing research in several ways. For instance, prior research provides little evidence concerning the effects of fraud type, wrongdoer awareness, and others’ awareness on whistleblowing intentions. We also provide evidence that whistleblowing settings represent an exception to the well-accepted theory of diffusion of responsibility. Our participants are professionals who represent the likely pool of potential whistleblowers in organizations. (shrink)

Objective: To develop an approach for seeking informed consent to examine tissues retained from a previous study of sudden infant death syndrome as part of a study on asthma, and to document responses and participation rate.Design: Pilot open-ended approach to 10 volunteer SIDS parents, followed by staged approach to seek consent from the target SIDS families for the asthma study.Participants: Parents of SIDS infants known to SIDS and Kids Victoria and parents of SIDS infants from the 1991–2 SIDS in Victoria (...) case–control study.Main outcomes: Qualitative responses of the piloted parents and study parents, and participation rates.Results: The pilot group responses were used to refine the written material to be provided. Of the 72 families for which contact details were available, 45 gave verbal consent for contact by the Victorian Institute of Forensic Medicine regarding the asthma study, three refused and 24 did not respond to two letters. Thirty-three completed consent forms, all positive for participation in the asthma study, giving a positive response rate of 73% .Conclusions: The use of postmortem tissue for research is acceptable to the next of kin when an approach is sensitive to their concerns and needs and is made by experienced counsellors from a familiar organisation. Despite the painful memories evoked by the approach of the research group, the acceptance rate among those who could be contacted was high. (shrink)

Modern ethics has been chiefly concerned with the analysis of the conditions and principles of morality; and, in particular, one of its most important achievements has been the further elucidation of the Kantian dictum that “I ought” implies that I can. On the face of it Kant's contention seems perfectly straightforward, but, on examination, it becomes apparent that the simple word “can” covers a somewhat complicated ambiguity. When it is said that I ought to do act A, it may rightly (...) be taken that I can do act A; but the question arises whether or not this in turn involves that I am aware that I can do act A. There is clearly some significance in the assertion that I can do many acts which, however, never occur to me, either because I am ignorant of certain facts or because I have a mistaken opinion about the facts. On the other hand, it may quite properly be said that I cannot perform any act of the possibility of which I am unaware. The problem then is to determine and examine the sense of the word “can” which is a pre-condition of moral obligation. (shrink)

In the third of his Essays on the Intellectual Powers of Man, Reid devotes the fourth chapter to the concept of‘identity’, and the sixth chapter to Locke’s theory of ‘personal identity’. This latter chapter is widely regarded as a definitive refutation of the thesis that personal identity is no more than memories of a certain sort. It is interesting that the terms ‘identity’ and ‘personal identity’ do not appear as chapter or section titles elsewhere in any of Reid’s works; and (...) Hume is neither mentioned nor his theory of personal identity discussed in the two chapters specifically addressed to the matter. Moreover, while Locke, Reid, and Hume are often anthologized in works on personal identity, Reid is always presented as replying only to Locke. (shrink)

Between the covers of this truly estimable work one meets not just the subtle and instructive thought of Seneca and Augustine, Iamblichlus and Epictetus, but insightful commentaries on the work of Damasio, Le Doux, Maclean and others. In all, Emotion and Peace of Mind is a benchmark- volume, an outstanding contribution to the philosophy and psychology of emotion; surely a required work for anyone prepared to approach the subject with the seriousness it demands. The second book of this review, Other Minds, is a work of philosophical rigor and originality, composed by an Oxford tutor who has skillfully shaped other minds with the sharp and sharpening instrument of conceptual analysis. Do computers have minds? Do animals have minds? Are there minds other than my own? And if I know of my own mind in that most basic first-person sense, then clearly there is no other mind that I can thus know. If there is something epistemologically amiss about first-person achievements, then there is surely something suspect about claims to the effect that I know of my mind. There have been great advances in our understanding of the functional anatomy of the nervous system, advances that stand in vivid contrast to our understanding of the moral, aesthetic and political dimensions of human life. In recent decades, issues that reside at the center of philosophical and psychological inquiry have been absorbed into a scientific framework variously identified as "brain science," "cognitive science," and "cognitive neuroscience." Scholars have heralded this development as revolutionary, but a revolution implies an existing method has been overturned in favor of something new. Previously it had been more or less generally assumed that moral philosophy was principally concerned with the idea of good, and followed its course by asking such questions as: What is the meaning of good? or, What are the characteristics which anything must have in order to be good? or even, What things are good? On the one hand, it is the very substance of the Christian faith that is at stake, and on the other hand, it is the fundamental nature of scientific method, in its critical and methodological renunciation of prior understanding, that is at stake. This article will argue that much of Kierkegaard’s authorship is reflective of the characteristics of the Eucharistic liturgy found in the 1830 Forordnet Alter-Bog for Danmark (confession, invitation, preparation/exhortation, consecration, and thanksgiving/praise/blessing), particularly as each of those elements of the liturgy are reflected in his seven Discourses at the Communion on Fridays in Part IV of Christian Discourses. Major components of his authorship function as an indirect invitation to the single individual reader to inwardly experience the prototype-redeemer dialectic as it (...) was enacted in a typical Eucharistic liturgy of Kierkegaard’s day. The readers of Kierkegaard’s work make interpretive decisions not only about Kierkegaard’s texts, but most importantly about themselves, God, and the paradox of Christ, such that by the time they finish the authorship they find themselves inwardly standing at the foot of the altar, either offended by the paradox of Christ and ready to turn and leave, or beating their breasts alongside the tax collector. This article examines the affordable housing market to develop a new way to understand the problem of co-optation in participatory urban governance. Through a case study of the Chicago metropolitan area, it uses data from 105 in-depth interviews—supplemented with ethnographic, archival, and secondary data—to shed light on the circumstances in which poverty-managing organizations compete for the resources necessary to house marginalized populations. Findings show how community-based groups, which have long housed the poorest neighborhoods and residents, are systematically excluded from access (...) to development capital in favor of other “grassroots for hire” organizations more amenable to the elite co-optation of grassroots empowerment—a process referred to as co-optation by cohort replacement.
