The sex/gender distinction is a staple of feminist philosophy. In slogan form: sex is “natural,” while gender is the “social meaning” of sex. Considering the importance of the sex/gender distinction—which, here, I neither endorse nor reject—it’s interesting to ask if philosophers working on the metaphysics of sexuality might make use of an analogous distinction. In this paper, I argue that we ought to endorse the sexual orientation/identity distinction. In particular, I argue that the orientation/identity distinction is indispensable (...) to normative explanations regarding LGBTQIA+ oppression and resistance. As a case study, I consider the oppression involved in the gentrification of historic queer neighborhoods. (shrink)

Here, I examine the epistemic relation between beliefs about the nature of sexual orientation (e.g., beliefs concerning whether orientation is dispositional) and beliefs about the taxonomy of orientation categories (e.g., beliefs concerning whether polyamorous is an orientation category). Current philosophical research gives epistemic priority to the former class of beliefs, such that beliefs about the taxonomy of orientation categories tend to be jettisoned or revised in cases of conflict with beliefs about the nature of (...) sexual orientation. Yet, considering the influence of ideology on beliefs about socially significant phenomena, I argue for an epistemic reversal. (shrink)

Is there a choice in sexual orientation? [Wilkerson, William S. : “Is It a Choice? Sexual Orientation as Interpretation”. In: Journal of Social Philosophy 40. No. 1, p. 97–116] argues that sexual desires require interpretation in order to be fully constituted, and therefore sexual orientation is at least partially constituted by choice. [Díaz-León, Esa : “Sexual Orientation as Interpretation? Sexual Desires, Concepts, and Choice”; In: Journal of Social Ontology] critically assesses (...) Wilkerson’s argument, concluding that we still lack a good argument for the claim that choice plays a role in sexual orientation. Here I examine Díaz-León’s response to Wilkerson. I introduce what I call the conceptual act theory of sexual orientation, and argue that even if interpretation were not necessary to constitute sexual desires, it is a necessary element to constitute what we call sexual orientation. However, I conclude that even if we agree that interpretation is involved in sexual orientation, it does not follow that there is a choice involved. (shrink)

A common belief is that, among our sexual dispositions, sexual orientations are important and deep features of who someone is. This distinguishes them from other sexual dispositions—“mere” preferences—that are thought to be trivial in comparison. Is there a way to adequately account for this distinction? What is a plausible explanation for the belief that sexual orientation is a deep and important feature of who one is? This paper defends one necessary condition for a sexual (...) disposition to be an orientation, the well-being condition: if a sexual disposition is an orientation, then the inability to act on it lowers one’s well-being by rendering one’s life sexually deprived. The paper argues that the well-being condition better explains than other criteria the belief that orientations are important features of who one is. Are sexual orientations freely chosen? The idea that someone’s sexual orientation is not a choice is very influential in the mainstream LGBT political movement. But do we have good reasons to believe it is not a choice? Going against the orthodoxy, William Wilkerson has recently argued that sexual orientation is partly constituted by our interpretations of our own sexual desires, and we choose these interpretations, so sexual orientation is partly constituted by choice. (...) In this paper I aim to examine the question of whether our interpretations of our own sexual desires are constitutive of our sexual orientations. I will argue that whereas Wilkerson’s argument for the claim that sexual orientations are in part constituted by our chosen interpretations of our sexual desires is not sound, there are good reasons for endorsing a weaker claim, namely, that there are different but equally apt descriptions of the same sexual desires, depending on which concepts we have. I defend an account of sexual orientation, understood as a reflexive disposition to be sexually attracted to people of a particular biological Sex or Sexes. An orientation is identified in terms of two aspects: the Sex of the subject who has the disposition, and whether that Sex is the same as, or different to, the Sex to which the subject is disposed to be attracted. I explore this account in some detail and defend it from several challenges. (...) Norm entrepreneurs have made significant strides in advancing sexual orientation and gender identity resolutions at the UN Human Rights Council. However, these advancements are being fiercely contested. This paper examines the development of SOGI at the Council including how states advocate for and contest SOGI and the extent to which their positions are mutable. Resolution 32/2 of 2016, which created an independent expert, is the central focus of the paper. Participant interviews and content analysis of documents and statements (...) are used to provide an in-depth analysis of how states advocate their positions on SOGI. The paper finds that framing is the primary tool used by states. Both proponents and opponents of SOGI believe their own positions are universal and adhere to prior international law, while their opponents’ positions are relativist and revisionist. The paper further finds that deadlock on SOGI resolutions is imminent until Member States’ domestic legislation changes. (shrink)

The aim of this study is to investigate the necessity of revising the Ethics Code of the Psychology and Counseling Organization of the Islamic Republic of Iran with respect to people’s rights and dignity and to avoid unfair discriminations toward sexual orientation and gender identity. It is said that confused diagnoses; wrong decision making; unethical practice; and the subsequent harm caused to lesbian, gay, bisexual, and transgender clients result from the lack of a clear code and relevant guidelines. In addition, certain conditions in Iran lead professional psychologists and researchers to avoid researching sexual minorities and gender identity, which negatively impacts the Ethics Code of the PCOIRI. Iranian and Western researchers have identified four primary sources to which psychologists and counselors can refer when faced with ethical dilemmas: developmental psychology, professional ethics codes, philosophy of psychology literature, and available researches and compilations on professional ethics. Finally it is suggested that, when dealing with homosexual clients and the related ethical dilemmas, Iranian psychologists and counselors need clear and specific guidelines and a professional ethics code developed from more appropriate reference points than legal and religious sources. In the last few years, many countries have introduced (or are proposing to introduce) legislation on ‘conversion therapy’, prohibiting attempts to change or suppress sexual orientation and/or gender identity. This legislation covers ‘aversion therapy’, a form of torture that has already been criminalized in most progressive countries, and also ‘talk therapy’, involving things like counselling, psychoanalysis, and prayer. Focusing on this latter category of practices, I explain what is at stake in the fact that sexual orientation (...) and gender identity have been paired for the purposes of this legislation. I use a particular law reform institute’s approach to this legislation as a case study, and review their literature review in mind to discovering whether they provided sufficient empirical justification for including gender identity in their conversion therapy legislation. I conclude that they did not, and suggest that the pairing of sexual orientation and gender identity may be purely political. (shrink)

Heterosexually oriented people are perceived to be in the majority and homosexually oriented people as the minority. What is sexual orientation? The contemporary consensus among philosophers is that it is a disposition. Unsurprisingly, recent debates about the metaphysics of sexual orientation are almost entirely intramural. Behavioral dispositionalists argue that sexual orientation is a disposition to behave sexually. Desire dispositionalists argue that it is a disposition to desire sexually. We argue that sexual orientation is not best understood in terms of dispositions to behave or dispositions to desire before arguing that (...) dispositions tout court fail to illuminate sexual orientation. Throughout history, women and men have been seen as "opposites" in various respects. Examples from the writings of political theorists illustrate this point, while Virginia Woolf is shown to have departed radically from the general tendency to dichotomize sexual difference. Further, this "need" to dichotomize sexual differences contributes to anxiety about and stigmatization of homosexuality. As the social salience of gender becomes reduced, it is to be expected that hostility to homosexuality will decline.

On what we can call the “folk” conception of sexual orientation, sexual orientation is understood as sex-based attraction, that is, as (partly) attraction on the basis of the perceived sex of the person to whom one is attracted. However, in recent discussions, philosophers have either added gender to sex as the basis of sexual orientation, or have altogether replaced sex with gender. Moreover, this addition or replacement has gone—mostly—unargued for. This paper argues that a (...) sex-based conception of sexual orientation remains plausible because (1) it is compatible with gender-based attraction, which I argue can be understood as a preference; (2) the reasons so far on offer for adding gender to sex (or for replacing sex with gender) are not convincing; (3) we have good evolutionary and non-evolutionary reasons for thinking that sex is the basis of sexual orientation; (4) we have good reasons to not add gender as a basis of sexual orientation; and (5) a sex-based conception of sexual orientation accommodates the various sexual orientations that have recently appeared, orientations in addition to the folk two (or three) of heterosexuality, homosexuality (and bisexuality), such as pansexuality, skoliosexuality, gynsexuality, and androsexuality. What emerges is a conception of sexual orientation based (partly) on the sex of the people to whom we are attracted, but that understands sexual-based attraction in broad enough terms to include surgically altered bodies. Many people believe that a person's sexual orientation is genetic. Given the widespread prejudice against, and hatred of, homosexuals in many societies, it seems likely that many parents will be interested in using genetic technologies to prevent the birth of children who will not be heterosexual. This paper considers the moral and legal implications of such procedures (whether or not they would work). It is argued that the availability of procedures to select the sexual orientation of (...) children would contribute to discrimination and prejudice against lesbians, gay men and bisexuals and, more generally, undermine the maintenance of a just society. ‘What is ‘sexual orientation’ for?’ is a question we need to answer when addressing a more seemingly basic one, ‘what is sexual orientation?’. The concept of sexual orientation is grounded in the concepts of sex and/or gender since it refers to the sex or gender of the individuals one is sexually attracted to. Typical categories of sexual orientation such as ’heterosexual’, ‘homosexual’, and ‘bi-sexual’ all rely on a sex or gender binary. (...) Yet, it is now common practice to recognize sex and gender categories that transcend the binary. Should our sexual orientation categories be revised to reflect sex and gender diversity? Drawing on the example of pansexuality, I argue that they should. The reason is that one aim of reconstructing the concept of sexual orientation—in addition to the epistemic goal of understanding— should also be political: it should make it easier to argue for the protection of those who have been marginalized or discriminated against because their sexual attraction is other than heterosexual. A recent controversy about neural networks allegedly capable of detecting a person’s sexual orientation raises the question of whether all research on homosexuality should be permitted. This paper considers two arguments for limits to such research, and concludes that there are good reasons to limit at least the dissemination of applied research on the etiology of homosexuality. The paper then briefly sketches how this could work, and looks at three objections against these limitations.

Most Africans are generally in sync in their communal rejection of certain perceived moral threats – in this case, allegedly ‘unnatural’ sexual orientations – as immoral and un-African. It is the truthfulness of these assumptions that I seek to question. Thus, in this essay, I question the assumption that nonheterosexuality is immoral and un-African. To do this, I attempt to isolate the traditional African outlook on alleged ‘unnatural’ sexual orientations, the communal drive towards this outlook and the implications (...) of both for individual freedom. Specifically, I introduce what I call communal dictatorships as the driving force behind the labels usually placed on nonconformal attitudes regarding sexual behaviours and orientations. I also examine what that means for the individual and whether such labelling is philosophically justified. I shall employ the conversational method of African philosophy as the methodology of this essay. (shrink)

This paper probes the implications of a genetic basis for sexual orientation for traditional branches of Judaism, which are struggling with how accepting to be of noncelibate gays and lesbians in their communities. The paper looks at the current attitudes toward homosexuality across the different branches of Judaism; social and cultural factors that work against acceptance; attitudes toward science in Jewish culture; and the likelihood that scientific evidence that sexual orientation is at least partly genetically determined (...) will influence Jewish scholars' and leaders' thinking on this issue. Was bisexuality a widespread feature of ancient Greek society? This question is an instance of cross-cultural projection -- of taking the means through which people are categorized in one culture and applying it to members of another. It’s widely held by those who think that sexual orientation is socially constructed that its projection poses a problem. In this paper, I offer a more careful analysis of this alleged problem. To analyze projection, I adapt Iris Einheuser’s substratum-carving model of (...) conventionalism to fit the specific needs of social construction. Using this model, I show that projection is conceptually coherent, and so does not for that reason pose any problem. Along the way, I identify some of the epistemic difficulties facing projection. While these difficulties are formidable, they are not substantially affected by the constructivist claim. I therefore conclude that there is no unique problem facing the projection of a socially constructed sexual orientation. (shrink)

In this article, Bettcher argues that sexual attraction must be reconceptualized in light of transgender experience. In particular, Bettcher defends the theory of “erotic structuralism,” which replaces an exclusively other-directed account of gendered attraction with one that includes a gendered eroticization of self as an essential component. This erotic experience of self is necessary for other-directed gendered desire, where the two are bound together and mutually informing. One consequence of the theory is that the controversial notion of “autogynephilia” is (...) rejected. Kant on sex gives most philosophers the following associations: a lifelong celibate philosopher; a natural teleological view of sexuality; a strange incorporation of this natural teleological account within his freedom-based moral theory; and a stark ethical condemnation of most sexual activity. Although this paper provides an interpretation of Kant’s view on sexuality, it neither defends nor offers an apology for everything Kant says about sexuality. Rather, it aims to show that a reconsidered Kant-based account can utilize his many worthwhile (...) insights and that making Kant’s account of sexuality more consistent with his own basic philosophical commitments results in a compelling approach to the complex and complicated phenomena of sexual love, sexual identity, and sexual orientation. Past research finds that after menopause some women experience negative changes such as vaginal dryness, decreased libido, and decreased orgasm quality; very little research inquires about positive changes. In contrast, this study shifts the research focus from whether women experience menopausal changes to how women view any changes in sex life. Based on 30 in-depth interviews with heterosexual and lesbian women, the author finds that most women emphasize cultural and social issues, such as relationship status and quality, health, and (...) class='Hi'>sexual history, rather than menopausal changes when they describe sex after menopause. However, she finds a difference by sexual orientation in how women handle problems in sex. The author concludes by discussing the implication of this research for future menopause and sex research; most important, she emphasizes studying sex in the context of women's lives rather than as a result of the biological changes of menopause. In the last decade, fierce controversy has arisen over the nature of sexual orientation. Scientific research, religious views, increasingly ambiguous gender roles, and the growing visibility of sexual minorities have sparked impassioned arguments about whether our sexual desires are hard-wired in our genes or shaped by the changing forces of society. In recent years scientific research and popular opinion have favored the idea that sexual orientations are determined at birth, but philosopher and educator Edward Stein (...) argues that much of what we think we know about the origins of sexual desire is probably wrong. Stein provides a comprehensive overview of such research on sexual orientation and shows that it is deeply flawed. Stein argues that this research assumes a picture of sexual desire that reflects unquestioned cultural stereotypes rather than cross-cultural scientific facts, and that it suffers from serious methodological problems. He considers whether sexual orientation is even amenable to empirical study and asks if it is useful for our understanding of human nature to categorize people based on their sexual desires. Perhaps most importantly, Stein examines some of the ethical issues surrounding such research, including gay and lesbian civil rights and the implications of parents trying to select or change the sexual orientation of their children. The Mismeasure of Desire offers a reasoned, accessible, and incisive examination of contemporary thinking about one of the most hotly debated issues of our time and adds a compelling voice of dissent to prevailing--and largely unexamined--assumptions about human sexuality. Equality policies in Spain have increasingly developed since the creation of the National Women’s Agency (1983). Over a ten‐year period Spain has achieved European standards in equality policies in terms of institutions, budget and legitimization. In a short time Spain moved from a dictatorship to European Union membership, which has brought about enormous changes regarding women’s roles and rights. Other relevant changes concern the political organization of the state: the 1978 Constitution sets a model of regional administrative autonomy, neither centralized (...) nor federal, in which each region has developed gender institutions. Gender‐equality policies constituted the framework for the development of gay and lesbian policies. Both gender equality and gay and lesbian policies have evolved differently at the national and regional levels, with a trend of inclusiveness, more creative policies and institutions at the regional and local levels. In the meantime, the national debate has concentrated on same‐sex marriage, while sexuality is not a topic within gender equality policies. This paper argues that the progressive inclusiveness of lesbians within the equality agenda and the new intersectional perspectives, alongside gay marriage shows an evolution of Spanish citizenship models, largely influenced by the European Union context.
