En el artículo se presentan las novedades jurisprudenciales del Tribunal Supremo en la aplicación de la perspectiva de género. Con especial atención en el ámbito penal, el texto recorre la valoración de la declaración de la víctima en el juicio oral y la viabilidad de la prueba pericial en relación a la veracidad sobre la declaración de la víctima en materia de violencia de género.

Academic ethical values, having the well-deserved place by nursing and other scientific fields, and developing of the nursing science are proportionate to obeying the academic ethical values and internalizing those values. This study was carried out to determine the nurse academicians’ attitudes related to ethical values and related factors. The descriptive research was carried out between the dates of May and June 2017. The scope of the research consisted of nurse academicians working for two universities in Turkey and the sample (...) of the study consisted of 103 nurse academicians who had accepted to participate in the research. Data were collected by using “Descriptive Characteristics Information Form” and “Academic Ethics Values Scale”. Ethical considerations: Ethic approval from the institution, the Training and Research Hospital Noninvasive Clinical Studies Ethics Committee at the University of İzmir Katip Çelebi, and written approval from the owner of the scale were taken in order to carry out the study. The average age of the participants was 35.7 ± 9.6, 95% of them were female, and 51.5% of them were working as research assistants. The nurse academicians’ total item point average was 177,99 ± 11,01 and the attitudes of nurse academicians towards academic ethical values were positively. When the sub-dimension item point averages of the scale were examined, the lowest item point average was determined for the sub-dimension of “Scientific Research” as the highest item point average were being determined for the sub-dimension of “Teaching Process”. In this study that the participants’ attitudes towards academic ethical values were found meaningful at a high level, it was seen that academic assignment and age were important factors for the nurse academicians’ attitudes towards the colleagues and the teaching process. The article is devoted to Miguel Servet (Michael Servetus, Spain – Miguel Serveto, also known as Miguel Servet, Miguel Serveto, Revés, or Michel de Villeneuve) – the XVI century Spanish thinker who was recognized as a heretic and burnt at the stake in Geneva in 1553.The author discusses the specifics of Servet’s philosophical system, the scientific background of his system, and his key ideas that have become a matter for auto-da-fė. The author argues that Servet’s concept (...) was aimed to reconstruct the “pure” Christian dogma, although he was not a professional theologist. The author claims that Servet used the deep knowledge in geography, astronomy, medicine, linguistics to create his complex system which was aimed to rescue the mankind from total destruction (Apocalypse). The author claims that Servet’s system could be considered as an example of interdisciplinary approach in the pre-disciplinary epoch. Moreover, Servet’s approach to the problem of personal salvation and the transformation of the humane nature is based on empirical scientific data. Hence, it is appropriate to consider his philosophical system as a mixture of theology, natural science and humanities. (shrink)

Con frecuencia el judaísmo es considerado como un sistema cerrado de minuciosas prácticas, alejado de cualquier tendencia universalista. Aunque las comunidades judías estén extendidas por todo el mundo son percibidas como una minoría dispersa a lo largo de la historia y a lo ancho del planeta (tiempo y espacio) siempre luchando por preservar su identidad. La carencia de una autoridad central unitaria y el poco interés por el proselitismo ofrecen la imagen de una comunidad de creyentes enclaustrada y ensimismada. Con (...) frecuencia esta actitud se pone en contraste con la del cristianismo o la del islam, radicalmente orientados al proselitismo y la conversión sobre la base de una formulación apodíctica: fuera del grupo no hay salvación. Firstly, this paper tackles the way in which – within the Christian context – the body qua body, as the sole locus of existence, only arises when the disparity between the mortal creature and the immortal God is highlighted, that is to say, when man is regarded as a sort of vestigium Dei instead of an imago Dei. Throughout early modernity, only theologians and philosophers who, like Servet or Da Costa, posit the mortality of the soul are capable of (...) presenting the body in all its radicality. Contrarily, the body cannot truly appear in an anthropology which, as in Suarez’s case, sticks to the model of likeness or the imago Dei up to its last consequences. In his juridical-political theory, which operates to a certain extent within the regio dissimilitudinis, an authentic body does appear – namely, the social or political one. However, he returns to the realm of likeness, and so the autonomous view of the body is obscured, when he insists on the need of indirectly submitting the political body’s mortal soul to the immortal soul of the Church’s corpus mysticum. Kur’ân ve hadislerde geçen müteşâbih ifadelerin nasıl anlaşılacağına dair kelâm geleneğinde ciddi tartışmalar yaşanmış ve farklı ekollere mensup âlimler tarafından birçok eser yazılmıştır. Mâtürîdî bir âlim olan Nâsırüddîn es-Semerkandî de bu çalışmada tenkitli neşri sunulan Fethu’l-ğalak fi’t-tevhîd adlı eseri kaleme almıştır. Günümüze ulaşan Arapça elyazması Süleymaniye Kütüphanesi Fatih koleksiyonunda 3142 demirbaş numarasıyla bulunmaktadır. Bildiğimiz kadarıyla bu alanda müstakil olarak kaleme alınmış olup günümüze ulaşan tek Mâtürîdî eser olma özelliğine sahiptir. Akıl ve şeriatten hareketle yapılması gerektiğini savunduğu te’vîlin belirli ilkeler çerçevesinde (...) özellikle de luğavî anlamın dışına çıkmadan müteşâbih ifadelerin muhkemlere hamlederek yapılması gerektiğini belirtmektedir. Bu noktada çizdiği çerçevede olmayan ve uç noktalar olarak gördüğü Bâtinîlerin ve Hanbelîlerin te’vîl anlayışlarını da eleştirmektedir. Müteşâbih ifadeleri te'vîl etmeyi uygun gören Mâtürîdî-Hanefî geleneğin yaklaşımını ortaya koymasının yanında geç bir dönemde yazılan eser bu konuda ele alınan ifadelerin yorumuna dair zengin ve bilgilendirici bir içerik sunmakta ve müteşâbihlerin bütünsel anlaşılması yönünde imkân sağlamaktadır. Bu çalışma kapsamında müteşâbihe dair bir giriş, es-Semerkândî’nin hayatı ve eserin tenkitli neşri dikkatlere sunulacaktır. (shrink)

El socinianismo, o más ampliamente el antitrinitarismo, fue comparado muchas veces con el islam: tanto la herejía cristiana como la religión musulmana rechazan la doctrina de la Trinidad y consideran que Jesús fue tan solo un profeta y no un dios. De hecho, hay numerosos vínculos históricos entre las dos corrientes. Desde Miguel Servet, el Corán y las escrituras islámicas tuvieron un gran impacto en la crítica emergente sociniana. Los antitrinitarios intentaron establecer una genealogía histórica que iba desde el (...) primer cristianismo de los ebionitas hasta el presente, pasando por el islam (que preservó la verdadera idea monoteísta). A menudo los antitrinitarios adquirieron sus conocimientos de las obras mucho más ortodoxas de los arabistas cristianos, que incluían, por ejemplo, traducciones de pasajes sacados de la crítica a San Pablo de al-Qarafi. Además, algunos escritores atrevidos, como Aubert de Versé, propusieron incluso un enfoque histórico-crítico para el texto del Corán basándose en el modelo de la crítica histórica del Antiguo Testamento de Richard Simon. Châteillon a peut-être laissé un plus grand souvenir par son opposition à Calvin dans l'affaire Servet que par sa traduction française de la Bible. Après le rappel à grands traits de la vie de ce “ savoyard ” , J. Roubaud place son œuvre de traducteur sous le signe de cette affaire, de son adhésion à la Réforme et de son souci de s'adresser non seulement aux lettrés, à ceux qui connaissent la latin et le grec, mais surtout aux (...) “ idiots ”, c'est-à-dire à ceux qui ignorent les langues anciennes. Loin de considérer ces derniers comme gens stupides, il les rejoint dans leur créativité verbale, n'hésitant pas à utiliser le langage populaire, voire à créer des mots, de façon à rendre le texte biblique aussi direct que possible dans son expression, ce qui lui fit produire un chef d'œuvre du français du XVIe siècle.Châteillon has perhaps left a greater impression by his opposition to Calvin in the Servet affair than by his French translation of the Bible. After recalling the main lines of the life of this "Savoyard" , J. Roubaud puts his translation under the sign of the above affair, of his adhesion to the Reformation, and of his concern to write not only for the educated, for those who know Latin and Greek, but especially for the "idiots", that is to say for those who ignore ancient languages. Far from conside7ing the latter as stupid, he joins them in their verbal creativity, not hesitating to use popular language, indeed to create words in order to make the biblical text as direct as possible in its expression. Necip Fazıl Kısakürek, 20. Yüzyılın en önemli Türk şair ve düşünürlerinden biridir. İslami hareketin sembollerinden biri olmasına rağmen, popülaritesi sadece dindar kesimlerle sınırlı kalmamıştır. Ülke genelinde büyük bir üne kavuşmuş, farklı kültürel çevrelerden, değişik fikir akımlarına mensup hayranlara sahip olmuştur. Bu durum şairin ifadelerinin akıcılığı, edebi yeteneğinin gücü ve Türkçeyi hem şiir hem nesirde ustalıkla kullanmasından kaynaklanmaktadır. Onun velûd bir yazar niteliğiyle çok sayıda ürün vermiş olması yazdıklarının edebi değerini düşürmemiştir. Ayrıca gençliğinden beri farklı gazete ve dergilerde makaleler yazmıştır. Otuz (...) yılı aşkın bir süre "Büyük Doğu" mecmuasını yayımlamıştır. Aynı isimle bir yayınevi kurmuş ve yaklaşık yüz kitap neşretmiştir. Şair olarak divanlar yayımlamasının yanı sıra hikayeler, romanlar, piyesler telif etmiş, fikri, ahlaki ve siyasi yazılar yazmıştır. Otuz yaşına kadar “bohem” diye tavsif ettiği bir hayat sürmüş, ruhi boşluktan kurtulamamıştır. Sonrasında bir vesileyle tanıştığı döneminin tanınan medrese alimi ve mutasavvıf Abdülhakim Arvasi’den etkilenmiştir. Böylece köklü bir fikri dönüşüm yaşamış, İslami dünya görüşünü benimsemiştir. Bu merhaleden sonra çok çeşitliliğe sahip edebi ürünlerinin tümünde inanç ve fikirlerini cesaretle savunmayı gaye edinmiştir. Muhalif bir kimlikle döneminin devlet ricaline alenen tenkitler yönetmekten çekinmemiştir. Bu uğurda ortaya koyduğu mücadele sebebiyle resmi kovuşturmalara maruz kalmış, defalarca hapis yatmıştır. Edebi faaliyetlerini, fikir kavgası niteliğinde icra etmiş, vefatına kadar da bu çizgisini sürdürmüştür. Tüm bu özellikleri birçok çevrede saygın bir mevkiye sahip olmasını sağlamıştır. Türk edebiyatındaki bu etkili konumuna rağmen Necip Fazıl, hala Arap okuyucusu tarafından nispeten bilinmemektedir. Arap araştırmacıların şaire dair teşekküre şayan değerli araştırmalar ve makaleler telif etmiş olmalarına rağmen eserleri henüz hak ettiği seviyede Arap okuyucusuna tanıtılabilmiş değildir. Burada Türkçeden Arapçaya tercüme faaliyetlerinin çok güçlü olmamasının etkisi akla gelebilir. Ancak başka Türk edebiyatçıların kitaplarının Arapçaya tercüme edildiği dikkate alındığında Necip Fazıl’ın eserleri özelinde bir eksiklikten bahsetmek yanlış olmaz. Her halükârda edebi eserleri Arapçaya çevirenler için yazarın ürünleri zengin bir servet mahiyetindedir. Biz de bu bağlamda Necip Fazıl’ın “Çile” adlı kitabından bazı şiirleri Arapça tahlil ederek manzum halde bu dile çevirdik. Manzumelerde klasik Arap şiiri kaidelerini dikkate aldık. Aynı şiirleri nesir olarak da çevirdik ve anlaşılmalarını kolaylaştırmak için kısa açıklamalar ekledik. Orijinal olduğunu düşündüğümüz bu çalışmamızla, Türk edebiyatı metinlerini Arapçaya çevirerek alana katkıda bulunanlar arasında yer almayı umuyoruz. (shrink)

Toplumların sosyal yapısının harcı yahut temeli mesabesinde olan ahlaki erdem ve faziletler, kuşaklar arasında daha çok edebi eserlerle nakledilmektedir. Zira toplumların milli sermayeleri olan edebiyatçılar, yaşadıkları dönemde kendilerine tevarüs eden ahlaki birikimi söz sanatları ile yeniden cazibeli edebi bir kalıba döküp sunmaktadır. Cahiliye dönemi de dâhil olmak üzere Araplar, sosyal ilişkilerinde güzel buldukları davranışları şiir kaydıyla muhafaza etmeye çalışmışlardır. Aile içi iletişimden güçlü bir kabile reisinin huzurunda takınılacak tavra kadar pek çok görgü kuralı şiirde nazmedilmiş ve bu türden şiirler Arapların (...) sosyal yaşam rehberi haline dönüşmüştür. Sadece şiir değil mensur eserlerde de sosyal faziletlere dair ilgi çekici ibretlik hikâyeler ve yaşanmış olaylara dair anlatılar bulunmaktadır. Müslüman Arapların henüz hicri ilk yüzyıldan itibaren tanıştığı servet ve beraberinde gelen şehirleşme, sosyalliğin güçlenmesi ve bundan mütevellit olarak da sosyal erdemlerin daha fazla bir önem kazanması sonucunu doğurmuştur. Bu makalede özellikle Abbasi dönemi edebiyatçılarının söz konusu sosyal erdemler bağlamında dikkat çekmek istedikleri hususlar bir araya getirilmiştir. Çalışma, klasik dönemden günümüze ulaşan edebi malzemenin –makale düzeyinde- önemli konu başlıkları halinde tasnif edilmesini amaçlamıştır. (shrink)
