The main claim of this paper is the following: In a typical rational legal system, legal adjudication is necessarily discretional. Discretion is the result of what I call ‘systemic indeterminacy’. Systemic indeterminacy is the thesis that claims that typical rational legal systems that have an interpretative code with more than one interpretative directive and the non-redundancy clause are necessarily indeterminate. Since typical rational legal systems do not have redundant rules a plurality of interpretative directives will necessarily yield a plurality of (...) interpretative results. Due to the non-liquet rule judges are obligated to choose among the different interpretative results provided by the interpretative code. In other words, by building a thesis on legal indeterminacy as the consequence of having a plurality of interpretative directives that necessarily yield different results, I proceed to provide an account of discretion as a necessary feature of legal adjudication. Citizen science is growing quickly, given its potential to enhance knowledge coproduction by diverse participants, generating large and global data sets. However, uneven participation in CS is still an important concern. This work aims to understand participation dynamics in CS and how they are shaped by participation barriers and drivers. We do so by examining participation in CONECT-e, a CS project that uses a wiki-like platform to document traditional ecological knowledge. More precisely, we analyze quantitative data on participants’ profile and (...) activity patterns and qualitative data on barriers and drivers of participation. Our findings suggest that overcoming the education, age, and residence participation barriers is challenging even in cocreated CS projects. This is potentially due to issues of perceived self-illegitimacy and low access to information and communication technologies. Our results also point out that participants’ alliance with the project’s objectives and trust relationships with the project team are important drivers of participation in CS projects. Finally, we also highlight the need to think beyond participation as single actions and rather consider participation diversity in CS as functional diversity in ecosystems, with participants performing a diverse set of interconnected tasks or functions. We present the resistive switching characteristics of Metal-Insulator-Metal devices based on amorphous Al2O3which is deposited by Atomic Layer Deposition. A maximum processing temperature for this memory device is 300°C, making it ideal for Back-End-of-Line processing. Although some variations in the forming, set, and reset voltages are obtained for many of the measured MIM devices, thememristoreffect has been obtained after cyclicI-Vmeasurements. These resistive transitions in the metal oxide occur for bothbipolarandunipolarconditions, while theIOFF/IONratio is around 4–6 orders of magnitude and is formed (...) at gate voltages ofVg<4 V. In unipolar mode, a gradual reduction inVSETis observed and is related to combined incomplete dissolution of conductive filaments which leaves some residuals and thickening of chemically reduced Al2O3during localized Joule heating. This is important because, by analyzing the macroscopic resistive switching behavior of this MIM structure, we could indirectly relate it to microscopic and/or nanoscopic phenomena responsible for the physical mechanism upon which most of these devices operate. In discussions of standards of proof, a familiar perspective often emerges. According to what we call specificationism, standards of proof are legal rules that specify the quantum of evidence required to determine that a litigant’s claim has been proven. In so doing, they allocate the risk of error among litigants (and potential litigants), minimizing the risk of certain types of error. Specificationism is meant as a description of the way the rules actually function. We argue, however, that its claims are (...) either mistaken or at a minimum deeply misleading, especially when it comes to standard of proof rules (SPRs) that contain indeterminate formulas, as is typical. As against specificationism, we argue that SPRs are best understood as rules that confer competence to decide whether a given standard has been met—according to whatever vague or inchoate interpretation (if any) of the rule in question triers of fact implicitly or explicitly employ. ABSTRACT:The profound influence of Thomas Donaldson and Thomas Dunfee’s integrative social contracts theory on the field of business ethics has been challenged by Andreas Scherer and Guido Palazzo’s Habermasian approach, which has achieved prominence of late with articles that expressly question the defensibility of ISCT’s hypernorms. This article builds on recent efforts by Donaldson and Scherer to bridge their accounts by providing discursive foundations to the hypernorms at the heart of the ISCT framework. Extending prior literature, we propose an ISCT* (...) framework designed to retain ISCT’s practical virtue of managerial guidance while answering the demands of Scherer and Palazzo’s discursive account. By subscribing to a suitable portfolio of discursively justified hypernorms, we argue, companies unlock the valuable moral guidance of ISCT*, which says to treat these hypernorms as unequivocal outer bounds to the pursuit of business and as a starting point to tailor local norms through discursive stakeholder engagement. 8 March, now known as International Women’s Day, is a day for feminist claims where demonstrations are organized in over 150 countries, with the participation of millions of women all around the world. These demonstrations can be viewed as collective rituals and thus focus attention on the processes that facilitate different psychosocial effects. This work aims to explore the mechanisms involved in participation in the demonstrations of 8 March 2020, collective and ritualized feminist actions, and their correlates associated with personal (...) well-being and collective well-being, collective efficacy and collective growth, and behavioral intention to support the fight for women’s rights. To this end, a cross-cultural study was conducted with the participation of 2,854 people from countries in Latin America and Europe, with a retrospective correlational cross-sectional design and a convenience sample. Participants were divided between demonstration participants and non-demonstrators or followers who monitored participants through the media and social networks. Compared with non-demonstrators and with males, female and non-binary gender respondents had greater scores in mechanisms and criterion variables. Further random-effects model meta-analyses revealed that the perceived emotional synchrony was consistently associated with more proximal mechanisms, as well as with criterion variables. Finally, sequential moderation analyses showed that proposed mechanisms successfully mediated the effects of participation on every criterion variable. These results indicate that participation in 8M marches and demonstrations can be analyzed through the literature on collective rituals. As such, collective participation implies positive outcomes both individually and collectively, which are further reinforced through key psychological mechanisms, in line with a Durkheimian approach to collective rituals. En la segunda, se expone la perspectiva de la cultura ciudadana desde los postulados que señala el (...) sociólogo Alain Touraine, en el cual menciona que pasar de la pasividad de los individuos hacia la conformación de ciudadanos es mediante el reconocimiento de su subjetividad y del sí mismo, para fomentar una intervención reflexiva y crítica de su medio. A pesar de que los filósofos modernos se caracterizan por ser versados en muchas disciplinas y ciencias, pocos son los intelectuales que, como Leibniz, logran formular una comprensión del mundo en la que cada una de estas disciplinas se articula con las demás. Esto hace que la propuesta filosófica y científica del hannoveriano, a diferencia de otras propuestas filosóficas de la modernidad, sea lo suficientemente compleja y robusta como para responder muchas problemáticas contemporáneas. Dada la amplia diversidad de temáticas que (...) aborda Leibniz a lo largo de su vida, sin embargo, el presente libro pretende reflexionar tan sólo sobre los alcances de algunas de estas problemáticas, las cuales se encuentran divididas en cinco grupos o ejes temáticos.El primer grupo de textos, así, aborda problemas relacionados con su metafísica y su caracterización dinámica del mundo. El segundo comprende aquellos textos relacionados con lógica, argumentación y filosofía del lenguaje, mientras que en el tercero se hace alusión a su caracterización de la belleza cara a su noción de orden y armonía. En el cuarto grupo nos encontramos una serie de textos que exploran la relación entre su propuesta filosófica y otras disciplinas, tales como las ciencias naturales, la literatura y la psicología. Abductive problems have been widely studied in propositional logic. First order abduction, however, has been viewed as intractable, for the undecidability of logical consequence. In this paper, we propose a notion of abductive problem, N-abductive problem, which is relative to the cardinality of the minimal model satisfying the given theory. We use a notion of restricted satisfaction, also relative to a domain cardinality. Background Consent policies for post-mortem organ procurement (OP) vary throughout Europe, and yet no studies have empirically evaluated the ethical implications of contrasting consent models. To fill this gap, we introduce a novel indicator of governance quality based on the ideal of informed support, and examine national differences on this measure through a quantitative survey of OP policy informedness and preferences in seven European countries. -/- Methods Between 2017–2019, we conducted a convenience sample survey of students (n = 2006) in (...) Austria (AT), Belgium (BE), Denmark (DK), Germany (DE), Greece (GR), Slovenia (SI) and Spain (ES), asking participants about their donation preferences, as well as their beliefs and views about the policy in place. From these measures, we computed indices of informedness, policy support, and fulfilment of unexpressed preferences, which we compared across countries and consent systems. -/- Results Our study introduces a tool for analyzing policy governance in the context of OP. Wide variation in policy awareness was observed: Most respondents in DK, DE, AT and BE correctly identified the policy in place, while those in SI, GR and ES did not. Respondents in opt-out countries (AT, BE, ES and GR) tended to support the policy in place (with one exception, i.e., SI), whereas those in opt-in countries (DE and DK) overwhelmingly opposed it. These results reveal stark differences in governance quality across countries and consent policies: We found a preponderance of informed opposition in opt-in countries and a general tendency towards support–either informed or uninformed–in opt-out countries. We also found informed divergence in opt-in countries and a tendency for convergence–either informed or uninformed–among opt-out countries. -/- Conclusion Our study offers a novel tool for analyzing governance quality and illustrates, in the context of OP, how the strengths and weaknesses of different policy implementations can be estimated and compared using quantitative survey data. Providing an inclusive and quality education for all contributes toward the Sustainable Development Goals of the United Nations. High-quality learning environments based on what works in education benefit all students and can be particularly beneficial for children with disabilities. This article contributes to advance knowledge to enhance the quality of education of students with disabilities that are educated in special schools. This research analyses in which ways, if any, interactive learning environments can be developed in special schools and create better (...) learning opportunities for children with disabilities. A case study was conducted with students with disabilities (N = 36) and teaching staff in a special school, involving interviews and focus groups. We argue that rethinking the learning context by introducing instruction models based on interaction benefit children with disabilities and provide high-quality learning and safe and supportive relationships for these students, thereby promoting their educational and social inclusion. Es por ello que, basándonos en algunas Encíclicas o Cartas Apostólicas, corroboramos el “buen olor (...) agustiniano” tanto en la vida como en la obra de este papa santo cuyo único propósito, al igual que san Agustín, fue el de servir a Dios y a la Iglesia, defendiendo en todo momento la fe católica. In 1972, in Chile, the German designer Gui Bonsiepe was in charge of the Industrial Design Department of Technological Institute of the National Corporation for the Promotion of Production INTEC Corfo, during the government of socialist President Salvador Allende in Chile. In this article from the INTEC magazine n.2, published this time for the first time in English, Bonsiepe develops a theoretical formulation, applied to the field of design, through which he proposes a concept that will be fundamental in the (...) field of interactive development, both analog and digital: the Interface. Thus, it also includes concepts of cybernetics such as variability and predictive study of behavior in the field of projecting disciplines. Bonsiepe is an exceptional representative during the formation of the iconic Hochschule für Gestaltung in Ulm. And among other elements, one very outstanding was his time as a student of Professor Max Bense and Horst Rittel, who would have introduced the concepts of first-order Cybernetics in the teaching of communication, and the design of information, in a pioneering way. The challenge posed in 1972, in Chile, focused on the possibility of calculating elements of criticism of political economy, in the field of knowledge generated by sensitive experiences, "calculating the use value" of the field of esthetics. As a renowned disciple of Max Bense and Tomas Maldonado, Bonsiepe represents the meeting of two Cybernetic traditions, collaborating with the emblematic Cybersyn Corfo project, in which the formulation of interaction mechanisms was strategic in combination with Stafford Beer's approaches to a second-order Cybernetics, according to the Viable System Model, for a project of decentralized state production, and transmission of information in real time. A investigação operou por meio dos Ateliês de Escrileituras: Conatus e Rabiscos de sensações na produção de um corpo crianceiro. O trabalho teve por objetivo fazer “escrever a n-1”, segundo um agenciamento rizomático de saberes. Produziram-se escrituras a partir de elementos extraídos da arte, da filosofia e da ciência. Destacam-se os Ateliês na proposta de uma escrita que extraí a unidade da multiplicidade, de uma vida potente e saudável.
RésuméCet article propose de concevoir le dissensus moins comme le constat d’un désaccord irréductible que comme le point de départ d’un processus visant à élaborer un territoire épistémique commun. Dans le travail argumentatif de confrontation des désaccords, il ne s’agit pas d’identifier le dispositif qui conduit à un accord via la délibération rationnelle. Il s’agit plutôt de comprendre comment le dissensus permet de construire des communautés plurielles. Il discute certains textes de philosophie politique, où semble centrale la question de l’accord (...) comme horizon d’attente des confrontations argumentatives. L’article utilise cette hypothèse pour analyser la diffusion de la dynamique de Leibniz dans sa correspondance avec De Volder. Cette analyse permet de montrer que le dissensus n’est pas un obstacle mais le socle à partir duquel de multiples diffusions sont possibles. (shrink)
