We care not only about what experiences we have, but when we have them too. However, on the B-theory of time, something’s timing isn’t an intrinsic way for that thing to be or become. Given B-theory, should we be rationally indifferent about the timing per se of an experience? In this paper, I argue that B-theorists can justify time-biased preferences for pains to be past rather than present and for pleasures to be present rather than past. In support of this (...) argument, I appeal to the doctrine of temporal parts or “four-dimensionalism” for short. When held in conjunction with a certain evaluative principle about whose experiences matter, four-dimensionalism reconciles B-theory with some time-biased preferences. (shrink)

The rationality of future bias figures crucially in various metaphysical and ethical arguments (Prior 1959; Parfit 1984; Fischer 2019). Recently, however, philosophers have raised several arguments to the effect that future bias is irrational (Dougherty 2011; Suhler and Callender 2012; Greene and Sullivan 2015). Particularly, Greene and Sullivan (2015) claim that future bias is irrational because future bias leads to two kinds of irrational planning behaviors in agents who also seek to avoid regret. In this paper, I join others who (...) have objected to Greene and Sullivan’s argument (Dorsey 2016; Tarsney 2017), but for significantly different reasons that put into question an unchallenged premise in the debate. These reasons are based on the relationship between the alleged irrational planning behaviors and certain features of regret that regret shares with future bias. First, regret is dynamic, involving preferences that change over time and in inconsistent ways. Second, regret comes in degrees, meaning that we can rank our potential regrets. Because regret has these features, I show that the future-biased agents in Greene and Sullivan’s cases do not need to act in irrational ways to rationally avoid regret. (shrink)

Future-biased agents care not only about what experiences they have, but also when they have them. Many believe that A-theories of time justify future bias. Although presentism is an A-theory of time, some argue that it nevertheless negates the justification for future bias. Here, I claim that the alleged discrepancy between presentism and future bias is a special case of the cross-time relations problem. To resolve the discrepancy, I propose an account of future bias as a preference for certain tensed (...) truths properly relativized to the present. (shrink)

Recently in Analysis, Ned Markosian (2019) has argued that a popular theory in the metaphysics of time—the Spacetime Thesis—falsely predicts that a normal musical performance is just as aesthetically valuable if it is rotated “sideways,” that is, if it is made to occur all at once. However, this argument falsely assumes that changing how something is oriented in space, and changing its duration in time, are analogous. That said, assuming they were analogous, Markosian’s argument is still unsuccessful. For the analogy (...) on which Markosian’s argument depends entails that if one can experience sideways music as it was originally, then one can prove that sideways music is just as aesthetically valuable. Not only is the common‐law standard of proof of mere likelihood in ordinary civil cases justifiable, but its justifiability supports the conclusion that there is no general norm that one must assert that p only if p is known. An argument by Voltaire is formalized to show that the mere likelihood standard is rational. It is also shown that no applicable norm preempts the common‐law rule. An objection that takes the pertinent knowledge‐norm to be honoured in the breach is rejected (...) by appeal to the absence of blameworthiness in alleged breaches of interest. An objection that takes civil verdicts to be manifestations of acceptance, rather than assertoric, is considered and rejected. (shrink)

This paper presents and defends a novel meta‐epistemological thesis, epistemic isomorphism, according to which our relations to others and to ourselves have the same pattern of relevance to our rationality. This means that correct epistemological theorizing will give formal parity to interpersonal and intrapersonal epistemic norms, such that what holds interpersonally also holds, mutatis mutandis, intrapersonally. In addition to arguing for epistemic isomorphism, the paper presents some epistemological case studies in which it is shown that the methodological and argumentative strategies (...) used by epistemologists in these case studies give expression to the idea of epistemic isomorphism as well as the argument presented here for its truth. Finally, the paper considers a possible counterexample to epistemic isomorphism based on an agent‐centered theory of justification, but it shows how to reconcile this theory with epistemic isomorphism. The access-to-justice movement broadly concerns the extent to which people have the ability to resolve legally actionable problems. To the extent that individuals seek resolution through civil litigation, they can be disadvantaged by their unmet need for legal services, particularly in high-stakes cases and complicated areas of law. In part, this is because legal services and litigation are cost-prohibitive, especially for indigent plaintiffs. As a result, these individuals are priced out of litigation and, by extension, unable to use law to (...) seek justice. I propose an innovative legal intervention to this problem called “compensatory preliminary damages,” which builds from the work of Gideon Parchomovsky and Alex Stein. I argue that preliminary damages should function as compensatory awards for harm to a plaintiff’s ability to access justice, rather than a contingency loan that might make indigent plaintiffs worse off than before if they lose. As compensatory awards, preliminary damages address a defendant’s liability for a plaintiff’s prospective litigation costs that inequitably affect the plaintiff’s ability to access justice. In short, given a suitable connection between the underlying harms of the case and the plaintiff’s resources to meet their legal needs, the litigation costs that plaintiffs must face to litigate should, in some cases, be compensable. To seek such compensation, I propose that plaintiffs would have to plead, among other things, that their alleged injuries have resulted in various barriers to accessing justice, but that the hardship to the plaintiff and the balance of equities favor shifting the cost to access justice onto the defendant. By awarding such damages, courts make plaintiffs whole for harm to their access to justice that is not conditional on a decision after the merits or their final recovery for the injuries alleged. Tom Dougherty (2013) argues that the following moral principles are inconsistent: (α) it is impermissible to benefit many people slightly rather than save someone’s life, and (β) it is permissible to risk someone’s life slightly to benefit them slightly. This inconsistency has highly counterintuitive consequences for non-consequentialist moral theories. However, Dougherty’s argument, the “Repetition Argument,” relies on a premise that ignores a morally important distinction between acting with statistical knowledge and acting with individualized knowledge. According to this premise, if it (...) is permissible to make it near certain that a distribution obtains, then it is permissible to bring about that distribution. I will argue that this premise proves too much for the Repetition Argument, and so we should reject it. Finally, to further motivate my own objection, I show that a recent objection to the Repetition Argument by James R. Kirkpatrick (2018) does not resolve the inconsistency. (shrink)

In the last half-century Ludwig Wittgenstein's relevance beyond analytic philosophy, to continental philosophy, to cultural studies, and to the arts has been widely acknowledged. Wittgenstein's Tractatus Logico-Philosophicus was published in 1922 - the annus mirabilis of modernism - alongside Joyce's Ulysses, Eliot's The Waste Land, Mansfield's The Garden Party and Woolf's Jacob's Room. Bertolt Brecht's first play to be produced, Drums in the Night, was first staged in 1922, as was Jean Cocteau's Antigone, with settings by Pablo Picasso and music (...) by Arthur Honegger. In different ways, all these modernist landmarks dealt with the crisis of representation and the demise of eternal metaphysical and ethical truths. Wittgenstein's Tractatus can be read as defining, expressing and reacting to this crisis. In his later philosophy, Wittgenstein adopted a novel philosophical attitude, sensitive to the ordinary uses of language as well as to the unnoticed dogmas they may betray. If the gist of modernism is self-reflection and attention to the way form expresses content, then Wittgenstein's later ideas - in their fragmented form as well as their “ear-opening” contents - deliver it most precisely. Understanding Wittgenstein, Understanding Modernism shows Wittgenstein's work, both early and late, to be closely linked to the modernist Geist that prevailed during his lifetime. Yet it would be wrong to argue that Wittgenstein was a modernist tout court. For Wittgenstein, as well as for modernist art, understanding is not gained by such straightforward statements. It needs time, hesitation, a variety of articulations, the refusal of tempting solutions, and perhaps even a sense of defeat. It is such a vision of the linkage between Wittgenstein and modernism that guides the present volume. (shrink)

The curriculum design, faculty characteristics, and experience of implementing masters' level international research ethics training programs supported by the Fogarty International Center was investigated. Multiple pedagogical approaches were employed to adapt to the learning needs of the trainees. While no generally agreed set of core competencies exists for advanced research ethics training, more than 75% of the curricula examined included international issues in research ethics, responsible conduct of research, human rights, philosophical foundations of research ethics, and research regulation and ethical (...) review process. Common skills taught included critical thinking, research methodology and statistics, writing, and presentation proficiency. Curricula also addressed the cultural, social, and religious context of the trainees related to research ethics. Programs surveyed noted trainee interest in Western concepts of research ethics and the value of the transnational exchange of ideas. Similar faculty expertise profiles existed in all programs. Approximately 40% of faculty were female. Collaboration between faculty from low- and middleincome countries (LMICs) and high-income countries (HICs) occurred in most programs and at least 50% of HIC faculty had previous LMIC experience. As genomic research becomes commonplace across the world, there is an increased need to coordinate practices among researchers, especially with regard to data sharing. One such way is an international code of conduct. In September 2020, an expert panel consisting of representatives from various fields convened to discuss a draft proposal formed via a synthesis of existing professional codes and other recommendations. This article presents an overview and analysis of the main issues related to international genomic research that were discussed (...) by the expert panel, and the results of the discussion and follow up responses by the experts. As a result, the article presents as an annex a proposal for an international code of conduct for data sharing in genomics that is meant to establish best practices. (shrink)

Background Preconception Expanded Carrier Screening is a genetic test offered to a general population or to couples who have no known risk of recessive and X-linked genetic diseases and are interested in becoming parents. A test may screen for carrier status of several autosomal recessive diseases at one go. Such a program has been piloted in the Netherlands and may become a reality in more European countries in the future. The ethical rationale for such tests is that they enhance reproductive (...) autonomy. The dominant conception of autonomy is individual-based. However, at the clinic, people deciding on preconception ECS will be counselled together and are expected to make a joint decision, as a couple. The aim of the present study was to develop an understanding of autonomous decisions made by couples in the context of reproductive technologies in general and of preconception ECS in particular. Further, to shed light on what occurs in reproductive clinics and suggest concrete implications for healthcare professionals. Main text Based on the shift in emphasis from individual autonomy to relational autonomy, a notion of couple autonomy was suggested and some features of this concept were outlined. First, that both partners are individually autonomous and that the decision is reached through a communicative process. In this process each partner should feel free to express his or her concerns and preferences, so no one partner dominates the discussion. Further, there should be adequate time for the couple to negotiate possible differences and conclude that the decision is right for them. The final decision should be reached through consensus of both partners without coercion, manipulation or miscommunication. Through concrete examples, the suggested notion of couple autonomy was applied to diverse clinical situations. Conclusions A notion of couple autonomy can be fruitful for healthcare professionals by structuring their attention to and support of a couple who is required to make an autonomous joint decision concerning preconception ECS. A normative implication for healthcare staff is to allow the necessary time for decision-making and to promote a dialogue that can increase the power of the weaker part in a relationship. (shrink)

From a scientific approach, this work explores the moral implications of genetic engineering and argues for corrective genetic interference.

In this article I suggest a way of overcoming the traditional dichotomy between analytic and continental philosophy by pointing at some similarities between apparently disparate philosophical approaches, viz. those of Michael Dummett and Jürgen Habermas. The comparison revolves around the so-called 'paradox of analysis', which poses a dilemma concerning philosophical propositions: these are allegedly shown to be either trivial or unsecured. Both Dummett and Habermas offer ways out of the dilemma, through recognition of the intersection of analysis with life. A (...) transcendentally characterized conception of language is conceived by both as the only way to overcome the haunting objective -subjective distinction. Thus they offer fresh insights into the nature of meaning and truth, and the place these occupy within philosophical systems. Both philosophers take the notions of justification and procedural rationality to be primary in the order of philosophical explanation. Meaning is not conceived in terms of representation and truth conditions, but in terms of validity claims. Truth is not viewed as independent and static, but as historically conditioned and constantly unfolding. As a result, even the statements of logic, and certainly those of philosophy, find a place between the alleged emptiness of analyticity and the robust empirical character of science. This common ground represents, I believe, one of the new faces of post-analytic -and hence also post-continental -philosophy. Parts of it are shared by other contemporary philosophers, such as Derrida and Brandom. What marks this new Weltanschauung is the way it surpasses the current eliminativist trends in philosophy. Modernism and the Language of Philosophy addresses the challenge this belief presented to philosophy, and argues that the modernist assumption rests upon a host of unacknowledged, repressed or denied dogmas or tacit images. Drawing in particular upon the work of Michale Dummett and Jacques Derrida, this book explores a new solution to this crisis in philosophical language, and it is these two philosophers who drive the narrative of the book and offer perspectives through which both past and present day philosophers are examined.  . The article links Blanchot’s philosophical and political ideas. Embarking from his recurrent dialogue with Wittgenstein’s Tractatus, it traces the development of Blanchot’s “dissident” version of modernism and his notion of “writing”, alongside his post-war political involvement and writing. I argue that Blanchot never relinquished the purist modernist idea of the privilege of writing and with it the privilege of his own self-identification primarily as a writer. It is my contention that this emphasis sometimes obfuscated his vision, both conceptually and politically. (...) Endeavors have been made to found and incorporate ethical values in most aspects of healthcare, including health technology assessment. Health technologies and their assessment are value-laden and could trigger problems with dissemination if they contradict societal norms. Per WHO definition, preconception expanded carrier screening is a new health technology that warrants assessment. It is a genetic test offered to couples who have no known risk of recessive genetic diseases and are interested pregnancy. A test may screen for carrier status of (...) several autosomal recessive diseases and X-linked at one go. The technique has been piloted in the Netherlands and is discussed in other countries. The aim of the study was to examine values and value conflicts that healthcare experts recounted in relation to the discussion of implementation and use of preconception ECS in Sweden. We interviewed ten experts, who were associated with influencing health policymaking in Sweden. We employed systematizing expert interviews, which endeavor to access experts’ specialist knowledge. There were four female and six male informants, of which four were physicians, three bioethicists, one a legal expert, one a theologian and one a political party representative in the parliament. The participants functioned as members of two non-governmental bodies and three governmental organizations. We employed thematic analysis to identify themes, categories and subcategories. Two main themes surfaced: values and value conflicts. The main categories of Respect for persons, Solidarity, Human dignity, Do no harm, Health and Love formed the first theme, while values conflicting with autonomy and integrity respectively, constituted the second theme. Concepts relating to respect for persons were the most commonly mentioned among the participants, followed by notions alluding to solidarity. Furthermore, respondents discussed values conflicting with Swedish healthcare ones such as equality and solidarity. The experts highlighted values and concepts that are distinctive of welfare states such as Sweden and delineated how preconception ECS could challenge such values. Moreover, the analysis revealed that certain values were deemed more substantive than others, judging by the extent and detail of inference; for example, respect for persons and solidarity were on top of the list. In an era where conditions for education are rapidly changing globally, online assessment presents several opportunities as well as challenges in the higher education landscape. The forceful transition from face-to-face to online assessments, as part of the emergency implementation of online learning due to the COVID-19 pandemic, has affected teaching, learning, and assessment experiences worldwide. This study explores how faculty members in Saudi universities secured their online assessment during phase one of the COVID-19 pandemic. The research aims were: 1) identifying (...) faculty assessment practices before the onset of COVID-19 and comparing these with practices during the pandemic, and 2) identifying the major challenges faced by the faculty members of the study in securing their online assessment to ensure that academic integrity and assessment standards remained intact. Data were collected from seven university professors through a self-reporting survey, followed by semi-structured interviews. The faculty members found the pandemic period to be the best time to change their assessment methods, and incorporate innovative ideas that conformed to both their own beliefs and students’ needs. The factors that influenced the faculty’s assessment alterations were their personal beliefs and learnings from others’ experiences, in addition to the guidelines issued by Saudi Arabia’s Ministry of Education. The results of this study have implications for the development of post-COVID-19 assessment practices and professional development priorities. (shrink)

Breaking bad news (BBN) to parents whose newborn has a major disease is an ethical dilemma. In Saudi Arabia, BBN about newborns is performed according to the parental preferences that have been reported from non-Arabic/non-Islamic countries. Saudi mothers' preferences about BBN have not yet been studied. Therefore, we aimed to elicit the preferences of Saudi mothers about BBN concerning newborns. We selected a convenience sample of 402 Saudi mothers, aged 18-50 years, who had no previous experience with BBN. We selected (...) them via a simple number-randomization scheme from the premises of a level III Saudi hospital between October of 2009 and January of 2011. We used a hypothetical situation (BBN about trisomy 21) to elicit their preferences about BBN concerning newborns via a structured verbal questionnaire composed of 12 multiple-choice questions. We expressed their preferences as percentages (95% confidence interval), and we used the Kendall's W test (W) to assess the degree of agreement in preferences. The Saudi mothers preferred that BBN be conducted with both parents together (64% [60-69]), albeit with weak levels of agreement (W = 0.29). They showed moderate agreement in their preferences that BBN should be conducted early (79% [75-83], W = 0.48), in detail (81% [77-85], W = 0.52), in person (88% [85-91], W = 0.58), and in a quiet setting (86% [83-90], W = 0.53). With extremely weak agreement, they preferred to have a known person present for support during BBN (56% [51-61], W = 0.01), to have close bodily contact with their babies (66% [61-70], W = 0.10), and to have no another patients present (64% [59-68], W = 0.08). They showed moderate levels of agreement in their desires to detail, in advance, their preferences about process of BBN by giving a reversible, written informed consent that could be utilized for guidance, if needed (80% [76-84], W = 0.36). In our experience, Saudi mothers' preferences about BBN concerning newborns are varied, suggesting that a "one-size-fits-all" approach is inappropriate. A reversible, written informed consent detailing their preferences about BBN that would be kept in their medical records and utilized for guidance, if needed, may be the best solution, given this level of diversity.
