J.L. Austin argues that ordinary language should be used to identify when it is appropriate or inappropriate to make, accept, or reject knowledge claims. I criticize Austin’s account: In our ordinary life, we often accept justifications rooted in racism, sexism, ableism, and classism as reasons to dismiss knowledge claims or challenges, despite the fact such reasons are not good reasons. Austin’s Ordinary Language Epistemology (OLE) classifies the discounting of knowledge claims in classic cases of epistemic injustice as legitimate ordinary maneuvers. (...) BackgroundThe ARRIVE (Animal Research: Reporting of In Vivo Experiments) guidelines are widely endorsed but compliance is limited. We sought to determine whether journal-requested completion of an ARRIVE checklist improves full compliance with the guidelines.MethodsIn a randomised controlled trial, manuscripts reporting in vivo animal research submitted to PLOS ONE (March–June 2015) were randomly allocated to either requested completion of an ARRIVE checklist or current standard practice. Authors, academic editors, and peer reviewers were blinded to group allocation. Trained reviewers performed outcome adjudication (...) in duplicate by assessing manuscripts against an operationalised version of the ARRIVE guidelines that consists 108 items. Our primary outcome was the between-group differences in the proportion of manuscripts meeting all ARRIVE guideline checklist subitems.ResultsWe randomised 1689 manuscripts (control: n = 844, intervention: n = 845), of which 1269 were sent for peer review and 762 (control: n = 340; intervention: n = 332) accepted for publication. No manuscript in either group achieved full compliance with the ARRIVE checklist. Details of animal husbandry (ARRIVE subitem 9b) was the only subitem to show improvements in reporting, with the proportion of compliant manuscripts rising from 52.1 to 74.1% (X2 = 34.0, df = 1, p = 2.1 × 10−7) in the control and intervention groups, respectively.ConclusionsThese results suggest that altering the editorial process to include requests for a completed ARRIVE checklist is not enough to improve compliance with the ARRIVE guidelines. Other approaches, such as more stringent editorial policies or a targeted approach on key quality items, may promote improvements in reporting. (shrink)

L.T.Hobhouse's concept of liberty--the concept at the heart of new liberalism--is based on T.H. Green's positive freedom. However, this paper demonstrates that the former has its own distinct nature and can be usefully defined as 'liberty as welfare'. In a context of renewed interest in the link between liberty and ability/personal development, scholars have looked back to Green's positive liberty. But the complex nature of latter has led to scholarly disagreement about its definitive features. The paper argues that Hobhouse's liberty (...) has achieved what neither of Green's two liberties, juristic and true (or positive), have: accommodate concerns with personal development and social justice in a 'primary' concept of freedom. It is demonstrated that only Green's positive freedom, as opposed to his juristic freedom, internalises commitment to development and social justice, but for a number of reasons reviewed in the paper, it is not a primary concept. The first section of the paper examines and criticises Green's dismissal of juristic freedom and outlines the ways in which this concept could have been more viable. The second section demonstrates how Hobhouse's liberty achieves what Green's juristic freedom could have but did not--accommodate personal development and social justice in a concept of liberty that remains an opportunity concept. Green's Moral and Political Philosophy: A Phenomenological Perspective. New York: Palgrave, 2001. Pp. xiii + 175. Cloth, $60.00 Like most today who study Green's idealism, Dimova-Cookson finds only his ethics to be still relevant. She rejects his metaphysical epistemology and consequently his teleology, but offers an alternative. Dimova-Cookson proposes (...) a Husserlian analysis of Green's positions on goodness and a critical defense that attempts to rectify his apparently inconsistent formulations of that concept. Provided we recall that Husserl's method is not unproblematic and resist the tendency to adjust the doctrine analyzed for the sake of methodological fidelity, there is reason to be open to the author's proposal. Several of Husserl's ideas seem relevant to Green's thought: intentionality; "noematic content of the determinable X" and "horizon" developed in Ideas; intersubjectivity; and Husserl's teleological descriptions of phenomenological consciousness. But Dimova-Cookson pursues none of these. She employs Husserl's problematic "epoche" and a "necessary feature of human practice" she calls "the phenomenological circle" (69, hereafter, PC).Dimova-Cookson uses PC to resolve certain confusions imputed to Green. Green himself anticipates the charge of vicious circularity concerning the moral ideal when he reasons that "the unconditional good for man" is the good will and that the good will is to will the unconditional good. He subsequently explains that the circularity is not logically vicious for the two terms describe different states of one teleological process of a will actualizing its potential for perfection, and are distinguished "as the complete from the incomplete." According to Dimova-Cookson, Green hasn't escaped the charge and needn't try. Rather, he has unwittingly stumbled upon PC, but confused matters by carelessly conflating perspectives on the senses of "good" which she believes are two different definitions of two different things, elements in PC. "Circularity in explaining morality can be legitimized," she says, provided one rigorously clarifies the shift in perspective between the two elements in PC (70ff.). This move, she holds, can resolve certain contemporary criticisms. But note that if Green hasn't escaped the charge, and it is a genuine logical circle, then, as Husserl recognized, it cannot be avoided simply by making a rigorously clear shift in perspective. That would be a psychologistic response to a logical problem. Moreover, even if clarity of perspectival shift is useful here, it fails to capture the continuity in the moral progress of the self-actualization of moral agent to moral citizen. Finally, had Green represented his distinction in such dichotomous fashion, this would have compromised the teleological component of his explanations and made it more difficult to keep his theory from being conflated with utilitarianism. Green is far-sighted here, given recent tendencies to confuse utilitarianism and teleology on the basis that both can be represented as versions of consequentialism, a confusion based on the fallacy of undistributed middle.Most of Dimova-Cookson's connections are highly suggestive and many of her distinctions useful. She teases out several possible meanings of Green's conception of good, and is to be commended for having tried to answer some of his critics and calling attention to the valuable content of Green's doctrine. Her attempt at a phenomenological approach is novel.It is troubling, though, that Dimova-Cookson thinks it is also transcendental, for her words reveal a grave confusion about what this means. When discussing what she thinks is either transcendental or phenomenological, she uses the language of contingent psychological experience; e.g., "storing experience" (44), and projecting and relating to one's self-image (65). The process of learning she describes is more reminiscent of Piaget's "assimilation-accommodation" model than anything Husserlian or transcendental. Yet the author considers this an "advanced transcendentalism" wherein "our experience is preconditioned—that is, made possible—by the conceptual baggage that has accumulated and is always present at the back of our minds" (27). The legitimacy of the refusal of South Australian nurses to care for second trimester abortion patients on grounds of conscience is examined as a test case for a theory of permissible limits on the autonomy of health care professionals. In cases of health care professional (HCP) conscientious refusal, it is argued that a balance be struck between the HCPs' claims to autonomous action and the consequences to them of having their autonomous action restricted, and the entitlement of patients to care (...) and the consequences for them of being refused such care. Conscientious action that results in the disruption or termination of health care services, however, is always impermissible on two grounds. Firstly, because it is at this point that the action '... invades a patient's autonomy, puts a patient at serious risk ... [and] treats a patient unjustly' (1) Secondly, because the consequences of such refusals turn them into political acts--acts of civil disobedience. It is arguable that in order for acts of civil disobedience to be legitimate, certain obligations are required of the dissenter by the community. It is concluded that the actions of the South Australian nurses, which have over the last few years both terminated and disrupted second trimester services, are morally impermissible. (shrink)

Benatar argues that it is better never to have been born because of the harms always associated with human existence. Non-existence entails no harm, along with no experience of the absence of any benefits that existence might offer. Therefore, he maintains that procreation is morally irresponsible, along with the use of reproductive technology to have children. Women should seek termination if they become pregnant and it would be better for potential future generations if humans become extinct as soon as humanely (...) possible. These views are challenged by the argument that while decisions not to procreate may be rational on the grounds of the harm that might occur, it may equally rational to gamble under certain circumstances that future children would be better-off experiencing the harms and benefits of life rather than never having the opportunity of experiencing anything. To the degree that Benatar’s arguments preclude the potential rationality of any such gamble, their moral relevance to concrete issues concerning human reproduction is weakened. However, he is right to emphasise the importance of foreseen harm when decisions are made to attempt to have children. (shrink)

Multiculturalist theories of recognition consist of explanatory-descriptive social theoretical accounts of the position of the minorities whose predicaments the theories seek to address, together with normative principles generating political implications. Although theories of recognition are often based on illiberal principles or couched in illiberal-sounding language, it is possible to combine proper liberal principles with the kind of social theoretical accounts of minority groups highlighted in multiculturalism. The importance of ‘the social bases of self-respect’ in Rawls’s political liberalism is used to (...) illustrate how a liberal theory of recognition might be constructed, and it is argued that such a theory can capture some, though not all, of the concerns of multiculturalism, even though the resulting ‘politics of recognition’ is neither a ‘politics of difference’ nor a kind of ‘identity politics’. Background and objective: Code status discussions may fail to address patients’ treatment-related goals and their knowledge of cardiopulmonary resuscitation (CPR). This study aimed to investigate patients’ resuscitation preferences, knowledge of CPR and goals of care. Design, setting, patients and measurements: 135 adults were interviewed within 48 h of admission to a general medical service in an academic medical centre, querying code status preferences, knowledge about CPR and its outcome probabilities and goals of care. Medical records were reviewed for clinical information (...) and code status documentation. Results: 41 (30.4%) patients had discussed CPR with their doctor, 116 (85.9%) patients preferred full code status and 11 (8.1%) patients expressed code status preferences different from the code status documented in their medical record. When queried about seven possible goals of care, patients affirmed an average of 4.9 goals; their single most important goals were broadly distributed, ranging from being cured (n = 36; 26.7%) to being comfortable (n = 8; 5.9%). Patients’ mean estimate of survival to discharge after CPR was 60.4%. Most patients believed it was helpful to discuss goals of care (n = 95; 70.4%) and the chances of surviving inhospital CPR (n = 112; 83.0%). Some patients expressed a desire to change their code status after receiving information about survival following inhospital CPR (n = 11; 8.1%) or after discussing goals of care (n = 2; 1.5%). Conclusions: Doctors need to address patients’ knowledge about CPR and take steps to avoid discrepancies between treatment orders and patients’ preferences. Addressing CPR outcome probabilities and goals of care during code status discussions may improve patients’ knowledge and influence their preferences. (shrink)

The soul has played many different roles in philosophy and religion. Two of the primary functions of the soul are the bearer of personal identity and the foundation of immortality. In this paper I shall consider different interpretations of what the soul has been taken to be and argue that however we interpret the soul we cannot consistently maintain the soul is both what we are and what continues after our bodily death.

This article discusses the nature and significance of the holistic health movement in four ways. First, a general characterization of the movement is proposed, based on shared commitment to five assumptions: (1) a positive view of health as well-being, (2) individual responsibility for health, (3) the importance of health education, (4) control of social and environmental determinants of health, and (5) low technology or “natural” therapeutic techniques. Second, a basic difference among advocates of holistic health/medicine is proposed in terms of (...) the presence or absence of commitment to scientific method. Third, holistic health/medicine is briefly compared with concepts of holism in biology and in the social sciences. Finally, criticisms of each of the basic tenets of the holistic health movement are offered. (shrink)

The Ukrainian legislator’s differentiation of criminal liability for certain manifestations of collaboration has led to unjustified competition and considerable difficulties in qualifying the relevant unlawful acts. The purpose of this study was to analyse the specific features of criminal liability for aiding and abetting the aggressor state in the national and international dimensions. To complete the tasks of this study, a set of scientific methods was employed: dogmatic – in the analysis of legal constructions of elements of collaboration and abetting (...) the aggressor state; comparative legal – in the context of comparing the rules on liability for collaboration and the rules of international humanitarian law. The study showed that Ukrainian criminal law theory and court practice have not developed consistent approaches to the application of the rules on liability for collaboration. The study focused on the fact that the criminal legislation of Ukraine applies an approach whereby certain types of economic collaboration are factually identified with military collaboration, which does not follow international humanitarian law. It was concluded that when qualifying the transfer of material resources to representatives of the aggressor state, there is a competition between the provisions of Part 4 of Article 111- 1 and Article 111-2 of the Criminal Code of Ukraine. In such a situation, it is reasonable to apply the rule on liability for collaboration. It was found that the payment of taxes, fees, and other mandatory payments to the Russian budget of any level, made in the occupied territory of Ukraine by a citizen of Ukraine, a foreigner, a stateless person for themselves and/or in the interests of legal entities registered in the territory of the Russian Federation cannot be covered by the objective side of abetting the aggressor state, as it does not follow international humanitarian law and does not contain such a feature as voluntariness, which is a mandatory feature of the crime under Article 111-2 of the Criminal Code of Ukraine. The practical significance of this study lies in defining certain rules for qualifying aiding and abetting the aggressor state which may be used by pre-trial investigation authorities in the legal assessment of such behaviour. For Catholicism had asserted that the world was rationally organized in accordance with higher divine intent and that religious belief was in harmony with human reason, although superior thereto inasmuch as the source of faith was (...) revelation or emanation from divine reason. Protestantism, on the other hand, counterposed to this a religion that appealed to common sense, the irrationalist teaching that revived Tertulian's famous proposition Credo quia absurdum. (shrink)
