Disability laws are crucial in ensuring a life of dignity for persons with disabilities. However, they remain limited and ineffective in the absence of adequate knowledge and awareness of the experiences with disability. The limitedness of disability laws has been spoken of in cases where the full realization of rights is subject to technological, philosophical, and market dynamics. In many cases, the law is also weakened by negative cultural beliefs and social perceptions of disability. And then there are cases where (...) disability laws perpetuate or tolerate oppression and violence. Despite their limitedness, disability laws offer normative content to facilitate engagement and critique for reform. In terms of what disability laws ‘ought’ to be, scholars write, that they should be about disabled people and the meanings provided by them. This objective has and can be fulfilled with the aid of disability studies that go beyond the inquiries of law with the right kind of research tools to theorize and re-theorize concepts and meanings about disability. Disability studies, in other words, represent the living conditions of disabled persons and the questions of how disability and/or impairment should be defined. This chapter examines the interaction between disability law and disability studies through the prism of the Convention on the Rights of Persons with Disabilities (CRPD). While discussing the models of disability (medical, social, human rights, and relational-community models) and agendas for reforming the CRPD, the chapter highlights the importance of new concepts and approaches. Further, the potential of disability laws, CRPD in particular, has been discussed keeping in mind the application of its core principles across different sectors (with a special focus on the Marrakesh treaty and copyright laws). Thriving is a psychological state in which individuals experience a sense of vitality and a sense of learning. Thriving come from relational connections with others, and is deeply rooted in social systems. Theoretical literature suggests that thriving occurs in the presence of decision-making discretion, broad information sharing, and a climate of trust. However, no study has investigated these environmental factors empirically. Using a multiple-studies approach, we established valid and reliable scale for each of these environmental factors using experimental vignettes, confirmed (...) the association of decision-making discretion, broad information sharing and climate of trust with thriving, and identified the role of self-determination theory in determining these relationships. Our analysis was based on data collected from 512 Indian management students across five studies. The results indicate significant difference in thriving for high vs. low level for decision-making discretion, broad information sharing and climate of trust. The relationship of these environmental factors with thriving is mainly due to the fulfillment of the need for competence. Competence partially mediates the relationship of decision-making discretion with thriving, and fully mediates the relationship of broad information sharing and climate of trust with thriving. Autonomy, although positively related with the environmental factors, does not lead to thriving. Practical implications, limitations and research avenues are discussed. (shrink)

Non-dualistic Vedanta insists on the importance of knowledge rather than action for attaining liberation. Knowledge is regarded as the direct and immediate means of liberation. The cause of the bondage is ignorance and the latter can be removed by knowledge. Non-dualistic Vedānta advocates that the individual is ignorant of the truth that his Self is none other than the Brahman and gets involved in the chain of transmigration. Knowledge of the Self leads to liberation. However, this position leads to a (...) debate between Non-dualistic Vedānta and Mīmāmsā School of thought with reference to understanding whether knowledge itself is a mental action. Purpose The Hon’ble Supreme Court of India, in a landmark judgment, scrapped a draconian law [Section 66 ] that gave the police absolute power to put behind bars anybody who was found posting offensive or annoying comments online. This paper aims to examine the take of people on the “Free Speech via Social Media” issue and their attitude towards the way sensitive messages/information are posted, shared and forwarded on social media, especially, Facebook. Design/methodology/approach The research was carried out on a (...) sample of 200 social media users, all picked up randomly, from five Indian states/Union Territories. Data were collected through a questionnaire, and users were contacted through e-mail. Data collected were analyzed through the Kolmogorov–Smirnov Z test. Findings The findings indicate that hate posts/messages are on the rise, and more and more users are joining in. Besides, prosecution happens only when the aggrieved party is influential or powerful. Practical implications The findings of this research give a strong insight into the social media behaviour of users in relation to hate contents/posts. The study establishes the fact that Indian people are in favour of free speech, but with a sense of restraint and responsibility. The work could form the basis for future research on various aspects of hate speech on social media. Researchers could study the trials and prosecutions that have happened over the past few years and whether punishment has acted as a deterrent. Originality/value The research is likely to be important for those involved in work on freedom of speech or hate speech through social media. Social networking sites such as Facebook would also get some insights into users’ perception towards free and hate speech mechanism on social media. (shrink)

Expression and transposition of the Suppressor‐mutator (Spm) transposon of maize are controlled by interacting epigenetic and autoregulatory mechanisms. Methylation of critical element sequences prevents both transcription and transposition, heritably inactivating the element. The promoter, comprising the terminal 0.2 kb of the element, and a 0.35‐kb, highly GC‐rich, downstream sequence are the methylation target sequences. The element encodes two proteins necessary for transposition, TnpA and TnpD. There are multiple TnpA binding sites, both in the 5′ terminal promoter region and at the (...) element's 3′ end. In addition to its role in transposition, TnpA is both a positive and a negative regulator of transcription. TnpA represses the element's promoter when it is not methylated. When the element is inactive and its promoter methylated, TnpA activates the methylated promoter and facilitates both its transient and heritable demethylation. (shrink)

However, it does not promise a detailed review of this enormous archive. On the contrary, it aspires to identify the principle concerns, the important interlocutors, the prevalent frameworks and contextualizes them socio-politically, in both their local and global embodiments. In historical time, as has been suggested elsewhere, the scientism-romanticism dialectic acquires diversified formulations. This review suggests that in post-colonial India (...) there has been an attempt to situate science within culture across this essential dichotomy. (shrink)

This is a study of Master Ramchandra, a nineteenth-century Indian mathematician, social commentator and Urdu journalist. The contradictions manifest in his projects, it is contended, were actually the products of the contradictions manifest in the political and ideological thinking of the period. One encounters in his writings a dominant critique of the prevalent religious, social and educational systems and also a call for social transformation, wherein scientific rationality and realism came to play an important role. Ramchandra's understanding is quite close (...) to that of the Comtean positivists. An attempt is made here to locate this emerging scientism within the context of nineteenth-century colonial politics. (shrink)

The development of democracy and the development of science are not in a simple causal relationship. Rather, history shows that science can also develop in non-democratic and autocratic societies. Given the production conditions of scientific knowledge, the natural and technical sciences, for example, need well-equipped laboratories and technical equipment. Scientists in many disciplines can only do their work in institutions that provide them with access to the facilities necessary for their research. The freedom of scientific research and its protection from (...) political interference can only be guaranteed by democratic conditions. Universities continue tobe among the most important sites of knowledge production. In the humanities and social sciences in particular, the freedom of research is often threatened. The importance of freedom in the sciences can only be understood if it is related to the fundamental value of scientific freedom. It is the responsibility of universities to safeguard this value and to protect the freedom of research. They can only fulfill their task of generating and developing knowledge if the freedom of critical research is guaranteed. (shrink)

The “centre-periphery” relationship historically structured scientific exchanges between metropolis and province, between the fount of empire and its outposts. But the exchange, if regarded merely as a one-way flow of scientific information, ignores both the politics of knowledge and the nature of its appropriation. Arguably, imperial structures do not entirely determine scientific practices and the exchange of knowledge. Several factors neutralise the over-determining influence of politics—and possibly also the normative values of science—on scientific practice.In examining these four examples of Indian (...) scientists in encounters with their peers at the centre, exceptional scientists are seen in a social context where the epistemology of science supposedly describes its practice. Imperialism imposes practices and patronage, which moderate the exchange of scientific knowledge. But, at Level Two, the politics of knowledge and the patterns of patronage within it mediate exchanges between the centre and the periphery.The first step in reconfiguring exchanges between centre and periphery —in this case, between Europe and India during the period 1850 to 1930— is to recognise the relation between the acquisition of resources and the maintenance of legitimacy and identity.67 Political life is not confined to the core of political institutions.68 Second, in examining science as practised in the colonies, it is necessary to see stages of scientific institutions, whose development structures the exchange.From the encounter of Ramchandra and De Morgan, it is evident that the centre-periphery framework should be separated from the models of transmission embedded within it. The notion of “translation” helps to suggest that scientists bring personal motives and meanings to each encounter. Ramchandra, for example, sought a novel method of teaching Indians calculus, while De Morgan's interest lay in finding a place for algebra in a liberal education.The hierarchy inherent in the centre-periphery framework compels the conclusion that, at Level Two, the autodidact outside the institutions of science must have his work presented to scientists at the centre by authoritative figures from the centre. This is not mainly a question of imperialism, but rather of patronage. The peripheral scientist could not be granted direct entry into the collegial circle until his efforts at the periphery could be translated into the language and concerns of the central community. Ramanujan's enigmatic formulas were translated into the language of analysis by Hardy, which enabled the creation of a field to which Hardy was committed. Scientists from the periphery who were already part of the circle by virtue of their training, were not necessarily subject to the same degree of attestation as other scientists from the periphery. P.C. Ray, with his DSc from Edinburgh, and his position at Calcutta University, had less difficulty in winning the trust of colleagues at the centre, even when he returned to India. On the contrary, remaining at the periphery, he moved from a context of patronage to a sphere of competition. In addition, Ray's collegiality, even at Level Two, was more comprehensive, and connected him with Level One.Eventually, the professional Indian science graduate found collegiality within the international community of scientists. Saha's self-imposed progressive nationalism constrained his identification with the centre and made him a potential competitor instead. Once having achieved eminence in the world of science, C.V. Raman and Saha shifted their work to journals of physics published in India in order to further the cause of physics research in their own country.69To go beyond the limitations of the centre-periphery model, it is necessary not merely to examine exchanges between scientists functioning in a “shared epistemological universe”,70 but also to recognise the part played by institutions, the experience of colonialism, and the forms of patronage characterising both colonialism and science. Put another way, although there is relative epistemological autonomy within the disciplinary research communities of science, the interplay between knowledge and power structures this exchange.The scientific links between colonial India and Britain at the turn of the century were mediated by structures which prefigured change. Does structure determine all? If it does, we are left with an Orientalist reconstruction of the docile native, and a passive cultural medium into which science percolates. But this neglects the role of scientists in creating new structures within which they worked. A middle position—one more sensitive to the exigencies of colonial scientific life—would be one where the participants are seen not as the dupes of “structure nor the potentates of action”, but as occupying a ground between the two.71. With the rising poverty in the Philippines, Filipino farm workers in Agusan del Sur faced distinctive challenges in their homes and working environment. This study aimed to discuss Filipino farm workers’ lived experiences, challenges, and coping mechanisms. Filipino farm workers shared their experiences that tapped into their psychological aspects. Mainly, the problem was stress, worry, and frustration centered on poverty and educational attainment. Some farm workers were likely unaware of the main problem that prolonged their hardships. Still, most have managed (...) to fortify their mental health. This report indicates that most Filipino farm workers in Agusan del Sur have a healthy psychological well-being. However, this statement does not change the intensity of their struggle to survive. (shrink)

Vaccination is a highly effective public health strategy that provides protection to both individuals and communities from a range of infectious diseases. Governments monitor vaccination rates carefully, as widespread use of a vaccine within a population is required to extend protection to the general population through “herd immunity,” which is important for protecting infants who are not yet fully vaccinated and others who are unable to undergo vaccination for medical or other reasons. Australia is unique in employing financial incentives to (...) increase vaccination uptake, mainly in the form of various childcare payments and tax benefits linked to timely, age-appropriate vaccination. Despite relatively high compliance with the childhood vaccination schedule, however, the Australian government has determined that rates should be higher and has recently introduced policy that includes removing certain tax and childcare benefits for non-vaccinators and formally disallowing conscientious objection to vaccination. In addition, it has raised the possibility of banning unvaccinated children from childcare centres. This article examines the impact of coercive approaches to childhood vaccination and raises the question of the ethical justification of health policy initiatives based on coercion. We consider the current evidence regarding childhood vaccination in Australia, the small but real risks associated with vaccination, the ethical requirement for consent for medical procedures, and the potential social harms of targeting non-vaccinators. We conclude that the evidence does not support a move to an increasingly mandatory approach that could only be delivered through paternalistic, coercive clinical practices. (shrink)

I believe that as a teacher I must provide high quality content for my students. And all these should be available for free online so that bright students globally can choose which editions of a seminal text they can study. In every UG, PG examination, one is asked about the importance of the title of Shaw's play. In this paper I have illustrated by my own reading how one should and can approach the play. For scholars, my annotations referring to (...) John of Patmos may be interesting. Read together, the articles engage and sometimes trouble the temporal and spatial distinctions drawn between decolonial and postcolonial approaches. Kiran Asher explores overlaps between decolonial and postcolonial thought by comparing the ideas of Gayatri Chakravorty Spivak and Silvia (...) Rivera Cusicanqui on representation. Aimee Carrillo Rowe also stages a dialogue between these approaches when interrogating her family ’s Chican@ settler history. Tiara R. Na’puti and Judy Rohrer offer an account of how recent scholarship from Hawai‘i and Guåhan (Guam) has elaborated Indigenous epistemologies in settler contexts. Two articles excavate colonialism’s relationship to science: Jennifer Hamilton, Banu Subramaniam, and Angela Willey explore how two instances of population genetic research illustrate the racialized knowledge systems that undergirded colonialism, while Sandra Harding points out how the colonization of Latin America contributed to the edifice of Western science. In a related vein, Breny Mendoza centers the material role of Abya Yala (the preferred term for Latin America) in not just Spanish colonialism but British colonial expansionism and eventually the eclipsing of China. Patricia A. Schechter reflects on her trajectory as a scholar and teacher of US women’s history and the insights she has gained through 504Preface engaging decolonial scholarship. Amy Piedalue and Susmita Rishi argue for a more expansive understanding of postcolonial feminism’s reach as they review recently published titles in the field. Although Anna Tsing and Paulla Ebron’s review of feminist scholarship about the Anthropocene does not directly mention postcolonial or decolonial approaches, it nonetheless engages relevant scholarship on the environmental impact of settler modernization and capitalism. An art essay by Hyunji Kwon introduces the largely unrecognized paintings of former comfort woman Duk-kyung Kang (1929–1997) and focuses on the potential of Kang’s work to challenge Japanese colonial hierarchies. Our featured poets in this issue are Emily Zhang, Megan Kaminski, and Raina J. León. Both postcolonial and decolonial scholars have been committed to critiquing the material and epistemic legacies of colonialism. The distinctions that are frequently drawn between the two approaches, however, have been a source of disquiet to the editors of Feminist Studies, and they prompted our journal’s call for papers in 2016. A common temporal marking that concerned us was the eclipsing of postcolonialism, which was increasingly becoming viewed as passé, and a setting up of decolonial feminism as always already better in time. Decolonial approaches sometimes depicted postcolonial feminism as being only about the past, despite postcolonial feminism’s stated commitment to studying the continuing impact of colonial processes and its complex use of the prefix “post.” Our concern was, as well, with misrepresentations of postcolonial feminist priorities. The depiction of postcolonial feminism as deconstructive, abstract, elite theory confined to the ambit of modern colonial knowledge systems overlooked the important quandaries that postcolonial feminism raised about how to represent marginalized people ethically and, indeed, how to understand the very desire to represent the marginalized—whether or not we claim belonging to them. Postcolonial feminists warned against an easy embrace of alterity, noting that the desire for positioning oneself outside colonialism could naively ignore the power of colonial discourses to frame colonialism’s Other. Another set of hopes for this special issue was to dwell on the spatial markings of decolonial and postcolonial feminisms: decolonial feminism is often associated with Indigenous scholars and those from the Americas, and postcolonial feminism with scholars from South Asia, Africa, and the Middle East. These regional emphases, although not always as tidy as sometimes depicted, have produced distinct intellectual Preface 505 priorities. We must heed decolonial feminism’s insistence on engaging with the genocidal history of settler colonialism, the current manifestations of the violent dispossession of land, and its constitution of gendered racial capitalism the world over. Yet, if postcolonial feminism is circumscribed geographically to only South Asia, Africa, and the Middle East, we risk ignoring its powerful transcontinental mapping of imperial gender formations and its scrupulous attention to the ethics of representing...
