BackgroundThe rise of Big Data-driven health research challenges the assumed contribution of medical research to the public good, raising questions about whether the status of such research as a common good should be taken for granted, and how public trust can be preserved. Scandals arising out of sharing data during medical research have pointed out that going beyond the requirements of law may be necessary for sustaining trust in data-intensive health research. We propose building upon the use of a social (...) licence for achieving such ethical governance.Main textWe performed a narrative review of the social licence as presented in the biomedical literature. We used a systematic search and selection process, followed by a critical conceptual analysis. The systematic search resulted in nine publications. Our conceptual analysis aims to clarify how societal permission can be granted to health research projects which rely upon the reuse and/or linkage of health data. These activities may be morally demanding. For these types of activities, a moral legitimation, beyond the limits of law, may need to be sought in order to preserve trust. Our analysis indicates that a social licence encourages us to recognise a broad range of stakeholder interests and perspectives in data-intensive health research. This is especially true for patients contributing data. Incorporating such a practice paves the way towards an ethical governance, based upon trust. Public engagement that involves patients from the start is called for to strengthen this social licence.ConclusionsThere are several merits to using the concept of social licence as a guideline for ethical governance. Firstly, it fits the novel scale of data-related risks; secondly, it focuses attention on trustworthiness; and finally, it offers co-creation as a way forward. Greater trust can be achieved in the governance of data-intensive health research by highlighting strategic dialogue with both patients contributing the data, and the public in general. This should ultimately contribute to a more ethical practice of governance. (shrink)
Purpose: Commenting on the transcript of a lecture. Findings: The document reconstructs the development of the original 1973 lecture by Heinz von Foerster into his best-known paper, On Constructing a Reality. Many aspects of that paper can be identified as being shaped through interaction with the audience. Implications: The lecture documented here was a forerunner of a central paper in constructivism.
Context: Many recent research areas such as human cognition and quantum physics call the observer-independence of traditional science into question. Also, there is a growing need for self-reflexivity in science, i.e., a science that reflects on its own outcomes and products. Problem: We introduce the concept of second-order science that is based on the operation of re-entry. Our goal is to provide an overview of this largely unexplored science domain and of potential approaches in second-order fields. Method: We provide the (...) necessary conceptual groundwork for explorations in second-order science, in which we discuss the differences between first- and second-order science and where we present a roadmap for second-order science. The article operates mainly with conceptual differentiations such as the separation between three seemingly identical concepts such as Science II, Science 2.0 and second-order science. Results: Compared with first-order science, the potential of second-order science lies in 1. higher levels of novelty and innovations, 2. higher levels of robustness and 3. wider integration as well as higher generality. As first-order science advances, second-order science, with re-entry as its basic operation, provides three vital functions for first-order science, namely a rich source of novelty and innovation, the necessary quality control and greater integration and generality. Implications: Second-order science should be viewed as a major expansion of traditional scientific fields and as a scientific breakthrough towards a new wave of innovative research. Constructivist content: Second-order science has strong ties with radical constructivism, which can be qualified as the most important root/origin of second-order science. Moreover, it will be argued that a new form of cybernetics is needed to cope with the new problems and challenges of second-order science. (shrink)
Background: Due to recent legislations on euthanasia and its current practice in the Netherlands and Belgium, issues of end-of-life medicine have become very vital in many European countries. In 2002, the Ethics Working Group of the German Association for Palliative Medicine has conducted a survey among its physician members in order to evaluate their attitudes towards different end-of-life medical practices, such as euthanasia, physician-assisted suicide, and terminal sedation. Methods: An anonymous questionnaire was sent to the 411 DGP physicians, consisting of (...) 14 multiple choice questions on positions that might be adopted in different hypothetical scenarios on situations of “intolerable suffering” in end-of-life care. For the sake of clarification, several definitions and legal judgements of different terms used in the German debate on premature termination of life were included. For statistical analysis t-tests and Pearson-correlations were used. Results: The response rate was 61%. The proportions of the respondents who were opposed to legalizing different forms of premature termination of life were: 90% opposed to EUT, 75% to PAS, 94% to PAS for psychiatric patients. Terminal sedation was accepted by 94% of the members. The main decisional bases drawn on for the answers were personal ethical values, professional experience with palliative care, knowledge of alternative approaches, knowledge of ethical guidelines and of the national legal frame. Conclusions: In sharp contrast to similar surveys conducted in other countries, only a minority of 9.6% of the DGP physicians supported the legalization of EUT. The misuse of medical knowledge for inhumane killing in the Nazi period did not play a relevant role for the respondents’ negative attitude towards EUT. Palliative care needs to be stronger established and promoted within the German health care system in order to improve the quality of end-of-life situations which subsequently is expected to lead to decreasing requests for EUT by terminally ill patients. Context: The journal Constructivist Foundations celebrates ten years of publishing articles on constructivist approaches, in particular radical constructivism. Problem: In order to preserve the sustainability of radical constructivism and regain its appeal to new generations of researchers, we set up a new course of action for and with the radical constructivist community to study its innovative potential. This new avenue is “second-order science.” Method: We specify two motivations of second-order science, i.e., the inclusion of the observer, and self-reflexivity that allows (...) second-order science to operate on the products of normal or first-order science. Also, we present a short overview of the contributions that we have collected for this inaugural issue on second-order science. Results: These six initial contributions demonstrate the potential of the new set of approaches to second-order science across several disciplines. Implications: Second-order science is believed to be a cogent concept in the evolution of science, leading to a new wave of innovations, novel experiments and a much closer relationship with current research in the cognitive neurosciences in particular, and with evolutionary and complexity theories in general. Context: Although second-order cybernetics was proposed as a new way of cybernetic investigations around 1970, its general status and its modus operandi are still far from obvious. Problem: We want to provide a new perspective on the scope and the currently available potential of second-order cybernetics within today’s science landscapes. Method: We invited a group of scholars who have produced foundational work on second-order cybernetics in recent years, and organized an open call for new approaches to second-order cybernetics. The accepted (...) contributions are discussed and mapped. We also investigate the relations between second-order cybernetics and second-order science. Results: We present a coherent outlook on the scope of second-order cybernetics today, identify a general methodology of science and show that second-order cybernetics can be used in a large number of disciplines that go well beyond purely scientific domains. These results are based on a new epistemic mode “from within,” which can be traced back directly to von Foerster. We also arrived at the conclusion that from its early years onwards second-order cybernetics was developed in two different ways, so that second-order cybernetics and second-order science operate in different domains. Implications: Both the coherent perspective of the scope of second-order cybernetics with a new five-part agenda and the outline for a general methodology of science based on a new epistemic mode that was created within and for second-order cybernetics demonstrate the growing importance of reflexivity in science, which, so far, has not been widely recognized. A national sample of 362 respondents assessed the ethical predisposition of the American marketplace by calculating a consumer ethics index. The results indicate that the population is quite intolerant of perceived ethical abuses. The situations where consumers are ambivalent tend to be those where the seller suffers little or no economic harm from the consumer's action. Younger, more educated, and higher income consumers appear more accepting of these transgressions. The results provided the basis for developing a four-group taxonomy of consumers (...) which retailers should find insightful in assessing potential consumer actions in a variety of situations. We give the first systematic study of strong isomorphism reductions, a notion of reduction more appropriate than polynomial time reduction when, for example, comparing the computational complexity of the isomorphim problem for different classes of structures. We show that the partial ordering of its degrees is quite rich. We analyze its relationship to a further type of reduction between classes of structures based on purely comparing for every n the number of nonisomorphic structures of cardinality at most n in both (...) classes. Furthermore, in a more general setting we address the question of the existence of a maximal element in the partial ordering of the degrees. (shrink)
The curriculum design, faculty characteristics, and experience of implementing masters' level international research ethics training programs supported by the Fogarty International Center was investigated. Multiple pedagogical approaches were employed to adapt to the learning needs of the trainees. While no generally agreed set of core competencies exists for advanced research ethics training, more than 75% of the curricula examined included international issues in research ethics, responsible conduct of research, human rights, philosophical foundations of research ethics, and research regulation and ethical (...) review process. Common skills taught included critical thinking, research methodology and statistics, writing, and presentation proficiency. Curricula also addressed the cultural, social, and religious context of the trainees related to research ethics. Programs surveyed noted trainee interest in Western concepts of research ethics and the value of the transnational exchange of ideas. Similar faculty expertise profiles existed in all programs. Approximately 40% of faculty were female. Collaboration between faculty from low- and middleincome countries (LMICs) and high-income countries (HICs) occurred in most programs and at least 50% of HIC faculty had previous LMIC experience. This article presents a qualitative case study that explores how faculty and administrators at one community college conceptualized and experienced academic community within their institution and how that conceptualization helped shape the part-time faculty work environment. Using a combined framework of academic community and care ethics, this study utilizes data from 55 interviews with full-time and part-time faculty and administrative leaders from a large community college. Findings from this study indicate that defining membership, a sense of belonging, and shared mission (...) and goals are key components to their understanding of academic community. From these three components, the study found that when participants included adjunct faculty as members of their academic community, they also reported a sense of responsibility or obligation to supporting them. Objectives: To analyse legislation and medical professional positions concerning the doctor’s role in assisted dying in western Europe, and to discuss their implications for doctors.Method: This paper is based on country-specific reports by experts from European countries where assisted dying is legalised , or openly practiced , or where it is illegal .Results: Laws on assisted dying in The Netherlands and Belgium are restricted to doctors. In principle, assisted suicide is not illegal in either Germany or Switzerland, but a doctor’s (...) participation in Germany would violate the code of professional medical conduct and might contravene of a doctor’s legal duty to save life. The Assisted Dying for the Terminally Ill Bill proposed in the UK in 2005 focused on doctors, whereas the Proposal on Assisted Dying of the Norwegian Penal Code Commission minority in 2002 did not.Professional medical organisations in all these countries except The Netherlands maintain the position that medical assistance in dying conflicts with the basic role of doctors. However, in Belgium and Switzerland, and for a time in the UK, these organisations dropped their opposition to new legislation. Today, they regard the issue as primarily a matter for society and politics. This “neutral” stance differs from the official position of the Royal Dutch Medical Association which has played a key role in developing the Dutch practice of euthanasia as a “medical end-of-life decision” since the 1970s.Conclusion: A society moving towards an open approach to assisted dying should carefully identify tasks to assign exclusively to medical doctors, and distinguish those possibly better performed by other professions. This paper is a study about Philadelphia’s comprehensive user engagement sites (CUESs) as the authors address and examine issues related to the upcoming implementation of a CUES while seeking solutions for its disputed questions and plans. Beginning with the federal drug schedules, the authors visit some of the medical and public health issues vis-à-vis safe injection facilities (SIFs). Insite, a successful Canadian SIF, has been thoroughly researched as it represents a paradigm for which a Philadelphia CUES can expand upon. Also, (...) the existing criticisms against SIFs are revisited while critically unpackaged and responded to in favor of the establishment. In the main section, the authors propose the layout and services of the upcoming CUES, much of which would be in congruent to Vancouver’s Insite. On the other hand, the CUES would be distinct from Insite, as the authors emphasize, in that it will offer an information center run by individuals in recovery and place additional emphasis on early education for young healthcare professionals by providing them a platform to work at the site. The paper will also briefly investigate the implementation of a CUES site under an ethical scope of the Harm Reduction Theory. Lastly, the authors recommend some strategic plans that the Philadelphia City government may consider employing at this crucial stage. (shrink)

What role does non-genetic inheritance play in evolution? In recent work we have independently and collectively argued that the existence and scope of non-genetic inheritance systems, including epigenetic inheritance, niche construction/ecological inheritance, and cultural inheritance—alongside certain other theory revisions—necessitates an extension to the neo-Darwinian Modern Synthesis (MS) in the form of an Extended Evolutionary Synthesis (EES). However, this argument has been challenged on the grounds that non-genetic inheritance systems are exclusively proximate mechanisms that serve the ultimate function of calibrating organisms (...) to stochastic environments. In this paper we defend our claims, pointing out that critics of the EES (1) conflate non-genetic inheritance with early 20th-century notions of soft inheritance; (2) misunderstand the nature of the EES in relation to the MS; (3) confuse individual phenotypic plasticity with trans-generational non-genetic inheritance; (4) fail to address the extensive theoretical and empirical literature which shows that non-genetic inheritance can generate novel targets for selection, create new genetic equilibria that would not exist in the absence of non-genetic inheritance, and generate phenotypic variation that is independent of genetic variation; (5) artificially limit ultimate explanations for traits to gene-based selection, which is unsatisfactory for phenotypic traits that originate and spread via non-genetic inheritance systems; and (6) fail to provide an explanation for biological organization. We conclude by noting ways in which we feel that an overly gene-centric theory of evolution is hindering progress in biology and other sciences. (shrink)
Classical scholarship played a vital role in the intellectual concerns of early nineteenth-century Germany. Situated at the crossroads of religion, history, and explorations of the development of the human mind, Greek mythology in particular was expected to shed light on the origins of civilization. In the search for the true nature of myth, the hermeneutic problems involved in historical understanding were intensified. As myth was held to be of a different nature than rationality, to read the sources was to look (...) for a completely different referent of the texts than was the case in historical reconstruction. In the quests for a scientific mythology, K. O. Müller was often regarded as an opponent of F. Creuzer . Yet an analysis of their published work and of their private documents shows that they had much in common, a fact they both appreciated. In particular they held similar, deeply Romantic views on the religious origin of culture, in Müller's case inspired by Pietism, in Creuzer's by neo-Platonism. Creuzer's influence is revealed in Müller's Prolegomena zu einer wissenschaftlichen Mythologie and more specifically in his interpretation of the Amazons as worshippers of sexuality in Die Dorier . Nevertheless, Müller differed from Creuzer in his views on the relationship of myth to history. Myth was not the reflection of a universal religion, sustained by a priestly class , but the outcome of the encounter between the mental endowment of a people and local, historical circumstances. In the case of the Amazons, however, Müller assessed the connection of myth to history in defiance of his own theory, guided by his views on gender difference and on sexual morality. (shrink)
Open peer commentary on the article “Luhmann and the Constructivist Heritage: A Critical Reflection” by Armin Scholl. Upshot: The comment starts with Buchinger’s assessment that Luhmann’s contribution to constructivism is original and inspiring, but raises more questions than answers. In three variations, the comment tries to show that Luhmann can indeed be viewed as a big question-generator and that his heritage for radical constructivism may lie in the original and inspiring effects these new and additional questions can produce.
