This article explores the discourses of multiculturalism and gender equality in relation to nation-building in Finland. The two discourses relate differently to the nation so that gender equality is seen as inherent to the nation while multiculturalism is seen as a challenge posed from outside. Nevertheless, the two discourses are dependent upon each other and cite each other. The material for the analysis is a document produced by an NGO-based multicultural women’s project in Finland. The article can also be read (...) as a contribution to the debate over the compatibility between gender equality and multiculturalism through an analysis of how gender equality - as an ideology and as a set of practices - is deeply embedded in the production of otherness in the Finnish context. Patient participation is a fundamental principle in modern Western health care, but not necessarily simple to achieve. During hospital ward rounds, patient participation is further hindered by the multi-party nature of the encounter: at times, members of the medical team talk with each other rather than with the patient. This article examines patients’ opportunities to participate in ward round conversations when the patient is not the addressed recipient. The data consist of 3 hours of video-recorded ward rounds in a Finnish (...) hospital. Using conversation analysis, we study patients’ practices for getting a turn in different sequential environments. The patients monitor the ongoing conversation and exploit its sequential organisation by producing responsive turns and repair initiations, thus becoming active participants. They also produce their own initiatives, although sequential and multimodal constraints affect their possibilities for modifying the participation framework. The results of this study can be exploited to promote patient participation. (shrink)

This qualitative social scientific study explores professional texts of healthcare ethics to understand the ways in which ethical professionalism in medicine and nursing are culturally constructed in Finland. Two books in ethics, published by Finnish national professional organizations—one for nurses and one for physicians—were analyzed with the method of critical discourse analysis. Codes of ethics for each profession were also scrutinized. Analysis of the texts sought to reveal what is taken for granted in the texts as well as to speculate (...) what appeared to be relegated to the margins of the texts or left entirely invisible. Physicians’ ethics was discovered to emphasize objectivity and strong group membership as a basis for ethical professionalism. The discourses identified in the physicians’ ethics guidebook were universal ethics, reductionism, non-subjectivity, and threat. Nursing ethics was discovered to highlight reflectivity as its central focus. This idea of reflectivity was echoed in the identified discourses: local ethics, enlightenment, and moral agency. The analysis exposes a cultural gap between the ethics discourses of medicine and nursing. More work is needed to bridge ethics discourses in Finland in a way that can support healthcare professionals to find common ground and to foster inclusivity in ethical dialogue. Further development of bioethical practices is suggested as a potential way forward. (shrink)

Relations between non-governmental organizations (NGOs) and companies have been the subject of a sharply increasing amount of publications in recent years within academic business journals. In this article, we critically assess this fast-developing body of literature, which we treat as forming a ‘business and society discourse’ on NGO–business relations. Drawing on discourse theory, we examine 199 academic articles in 11 business and society, international business, and management journals. Focusing on the dominant articulations on the NGO–business relationship and key signifiers they (...) rely on, we analyze the problem-settings of articles in order to reveal the statements that are acceptable and appropriate within this field. Our threefold aim is to (1) identify dominant articulations of NGO–business relations in business and society discourse, (2) expose those articulations that are silenced or suppressed by these dominant articulations, and (3) critically assess possible power effects of these discursive dynamics in the field of discursivity. While business and society discourse on NGO–business relations overall remains open to many different articulations, we also find that those articulations that focus on NGO–business partnerships and governance initiatives tend to privilege collaborative and deliberative ways of engaging and marginalize more adversarial subject positions. We call for more recognition of the potentially constructive role that can be played by conflict. (shrink)

This qualitative social scientific interview study delves into the ways in which professional vision is constructed in clinical ethics consultation (CEC). The data consist of 11 semi-structured interviews that were conducted with clinical ethics consultants currently working in hospitals in one major urban area in the U.S. The interviews were analyzed with the qualitative research method of critical discourse analysis, with a focus on identifying the cultural structures of knowledge that shape CEC as a professional practice. The discourses were first (...) identified as belonging to two higher discourse categories, order and agency. Order was divided into three lower categories, emotional, managerial, and rational order, and discourses of agency into the lower categories of exploration, technique, deliberation, and distancing. An additional discourse of neutral interaction was identified as a bridging discourse, activated to level tensions emerging out of conflicting goals and agencies embedded in CEC practice. This analysis brings out as its main observation that clinical ethics consultants draw on and shift between potentially ideologically conflicting social positions that can create built-in tensions within the professional domain. The study calls attention to these tensions and suggests for the professional group to discuss the possibility of defining priorities between different kinds of order, identified in this study, that shape the CEC domain. Community engagement to protect and empower participating individuals and communities is an ethical requirement in research. There is however limited evidence on effectiveness or relevance of some of the approaches used to improve ethical practice. We conducted a study to understand the rationale, relevance and benefits of community engagement in health research. This paper draws from this wider study and focuses on factors that shaped Community Advisory Group members’ selection processes and functions in Malawi. A qualitative research design was used; (...) two participatory workshops were conducted with CAG members to understand their roles in research. Workshop findings were triangulated with insights from ethnographic field notes, key informant interviews with stakeholders, focus group discussions with community members and document reviews. Data were coded manually and thematic content analysis was used to identify main issues. Results have shown that democratic selection of CAG members presented challenges in both urban and rural settings. We also noted that CAG members perceived their role as a form of employment which potentially led to ineffective representation of community interests. We conclude that democratic voting is not enough to ensure effective representation of community's interests of ethical relevance. CAG members’ abilities to understand research ethics, identify potential harms to community and communicate feedback to researchers is critical to optimise engagement of lay community and avoid tokenistic engagement. The reconstructive theory of the procedural legitimacy of modern law developed on the basis of the theory of discourse ethics has limited itself solely to the deontological, moral‐normative aspects of the validity claims of legal norms and judgments. However, teleological and axiological aspects are also intertwined with legal validity claims and with the procedures in which legal norms and judgments are produced. The discursive‐procedural concept of legitimacy seems to require as its support, instead of the theory of discourse ethics, a (...) general theory of practical discourses or, more generally, of rational collective will‐formation. In this article, the authors present an ethnography of biomedical knowledge production and science collaboration when they take place in developing country contexts. The authors focus on the arrival of international clinical trials to Sri Lanka and provide analysis of what was described as one of the first multisited trials in the country, a pharmaceutical company sponsored, phase 2, randomized, double-blind, placebo controlled trial carried out between 2009 and 2010. Using interviews with those who conducted the trial and six months (...) of participant observation at the trial hospital, the authors describe the work that goes on to perform trials according to international standards. The article describes what happens when a randomized controlled trial encounters existing epistemic virtues and documents the impacts on ideas of authority, expertise and doctor–patient relationships found in Sri Lankan medicine. This article provides the first historiographical analysis of the origins of Jewish Orthodoxy in Helsinki and describes the development of the rabbinate from the establishment of the congregation in the late 1850s up to the early 1980s. The origins of the Finnish Jewish community lies in the nineteenth-century Russian army. The majority of Jewish soldiers in Helsinki originated from the realm of Lithuanian Jewish culture, that is, mainly non-Hasidic Jewish Orthodoxy that emerged in the late eighteenth century. Initially, the Finnish (...) Jewish religious establishment continued this Orthodox-Litvak tradition. After the independence of Finland, the Helsinki congregation hired academic, Modern Orthodox rabbis educated in Western Europe. Following the devastation of the Shoah and the Second World War, the recruitment of rabbis faced new challenges. Overall, the rabbi recruitments were in congruence with the social and cultural development of the Helsinki community, yet respected its Orthodox roots. (shrink)

Background While community engagement is increasingly promoted in global health research to improve ethical research practice, it can sometimes coerce participation and thereby compromise ethical research. This paper seeks to discuss some of the ethical issues arising from community engagement in a low resource setting. Methods A qualitative study design focusing on the engagement activities of three biomedical research projects as ethnographic case studies was used to gain in-depth understanding of community engagement as experienced by multiple stakeholders in Malawi. Data (...) was collected through participant observation, 43 In-depth interviews and 17 focus group discussions with community leaders, research staff, community members and research participants. Thematic analysis was used to analyse and interpret the findings. Results The results showed that structural coercion arose due to an interplay of factors pertaining to social-economic context, study design and power relations among research stakeholders. The involvement of community leaders, government stakeholders, and power inequalities among research stakeholders affected some participants’ ability to make autonomous decisions about research participation. These results have been presented under the themes of perception of research as development, research participants’ motivation to access individual benefits, the power of vernacular translations to influence research participation, and coercive power of leaders. Conclusion The study identified ethical issues in community engagement practices pertaining to structural coercion. We conclude that community engagement alone did not address underlying structural inequalities to ensure adequate protection of communities. These results raise important questions on how to balance between engaging communities to improve research participation and ensure that informed consent is voluntarily given. (shrink)

SUMMARYThe aim of this article is to analyse the complex roots of Carl Schmitt's theory on dictatorship in the classical world through the lens of classical receptions. It argues that Schmitt was deeply engaged with the classical tradition in formulating his theory on dictatorship. Knowingly or unknowingly, Schmitt legitimates his theory through a foundation in both the Roman idealisation of the virtuous dictators of the early Republic as well as the long tradition of the narrative of the enlightened sovereign as (...) a guarantor of law, present in both Greek and Roman antiquity and in the subsequent European tradition. Schmitt skilfully repurposed the Roman historical tradition on dictators but glossed over the traditional antipathy of Roman republicanism towards sovereign rule. The claim that this article is presenting is that even though it has been overlooked by earlier scholars, Schmitt was both directly and indirectly influenced by the classical tradition of dictatorship and utilised their mythical and symbolic dimensions in the later Roman and the subsequent European legal and political traditions. The reason for this omission was that Schmitt, like his contemporaries, belonged to one of the last generations to be groomed in the classical tradition of literature. (shrink)

Properties of Law is a legal-theoretical analysis about modern state law; about sociality, normativity and plurality as its properties, and what will come after modern state law. The main objective of this study is to offer a legal theoretical recapitulation of modern state law that avoids the fallacies of Legal Positivism. This calls for a relationist approach where law's sociality is related to normativity, and normativity to sociality. Avoiding Legal Positivism's fallacies also includes refraining from extrapolating from modern state law (...) to law in general; replacing Legal Positivism's conceptual universalism with sensitivity to the varieties of law, and acknowledging that law existed before modern state law, that it will exist after modern state law, and that other law exists alongside modern state law. This concluding article draws together some of the connecting strands between the preceding four articles, seeking to outline a number of fundamental issues common to them all and ultimately the legal concept of universality in general. I argue that there is a fundamental Eurocentrism present that has a number of implications, ranging from the hierarchical worldview and its ingrained evolutionary basis to the notion of communities beyond the nation state which would in the guise of benevolence impose and dictate both (...) law and values with an universal reach and finally, an idea that legal concepts were in an by themselves universal. What these had in common was that they were based on an understanding of humanity as universal, a certain concept of concept as universal and, finally, resorting to a very particular concept of universal rights. However, despite the manifold claims of universality, the practical application and interpretation of these rights was exceedingly limited to a certain group and a certain time and a place. (shrink)

This volume showcases contemporary, ground-up ethical essays in the tradition of Wittgenstein’s broader philosophy and Wittgenstein-inspired ethical reflection. It takes the ethical relevance of Wittgenstein as a substantial and solid starting point for a broad range of ongoing thinking about contemporary ethical issues. The texts are organised in two sections. The first consists of chapters exploring questions around what could be called the “grammar” of our moral forms of life, and thus represents a more traditional approach in ethics after Wittgenstein. The second part represents a recent turn in the tradition towards investigating moral conceptions, perspectives and concepts that are undergoing change, either because the world itself is changing (for instance with new technologies) or because human agency, such as social movements, has brought us to reconsider previously unquestioned ideas and structures. Within the book, the authors’ contributions are inspired, in their ways of working with ethical questions, by Wittgenstein’s conceptions of language, understanding and the nature of philosophical inquiry. The article examines the Finnish branch of Chabad Lubavitch as a fundamentalist and charismatic movement that differs from other branches of ultra-Orthodox Judaism in its approaches to outreach to non-observant Jews. Whilst introducing the history of Chabad Lubavitch in Finland and drawing on historical and archival sources, the authors locate the movement in a contemporary context and draw on 101 semi-structured qualitative interviews of members of the Finnish Jewish communities, who either directly or indirectly have been in contact with representatives (...) of Chabad Finland. The material is examined through the theoretical concept of ‘vicarious religion’. As the results of the article show, whilst Chabad very much adheres to certain fundamentalist approaches in Jewish religious practice, in Finland they follow a somewhat different approach. They strongly rely on people’s sense of Jewish identification and Jewish identity. Individuals in the community ‘consume’ Chabad’s activities vicariously, ‘belong without believing’ or ‘believe in belonging’ but do not feel the need to apply stricter religious observance. Whilst many of them are critical of Chabad and their activities, they do acknowledge that Chabad fills the ‘gaps’ in and outside the Jewish Community of Helsinki, predominantly by creating new activities for some of its members. Nurses need to adapt to various interactional situations and design their talk for different recipients. One essential communicative task for nurses is to transmit information on test and measurement results both to the patient and to the physician. This article examines how nurses design their talk on numerical values according to the recipient and the activity. The nurse can deliver the information either plainly through numbers or by formulating some type of qualitative description of the value. The data consist of (...) 7.5 hours of video-recorded interaction in a Finnish hospital. Using conversation analysis, we demonstrate how the institutional roles and the ongoing activity sequence affect how nurses formulate their talk. When nurses discuss results with their patients, they typically use qualitative descriptions, whereas when they talk with doctors, the typical turn involves numeric information. It will be demonstrated that nurses construct their professional identity involving both care and medical expertise through their linguistic-interactional choices. (shrink)

Concepts that refer to trends like globalization and medicalization have, of late, become a hallmark of public debates. The logic of such concepts is that the same word can refer both to good and bad developments, partly depending on the chosen viewpoint. Hardly anyone opposes the global enforcement of human rights, but the global liberation of trade is sometimes viewed with suspicion. Este artículo tiene como objetivo presentar un manuscrito conservado en la biblioteca de la Universidad de Bengasi (Libia) que contiene el Kitāb al-Ǧawhara fī nasab al-nabī ṣallā Allāh ʽalayhi wa-sallam wa-aṣḥābihi al-ʽašara por Abū ʽAbd Allāh Muḥammad b. Abī Bakr b. ʽAbd Allāh b. Mūsà al-Anṣārī al-Barrī al-Tilimsānī (596/1200-681/1282). Aunque ha sido mencionado en algunas publicaciones, no llamó la atención de los especialistas de la historia cultural de al-Andalus. Debido a la situación actual de la institución de conservación, no ha (...) sido posible ver ni ofrecer reproducciones. Aun así, como se cedió una fotografía para un catálogo, el último folio resultó muy útil. Se hace constar claramente el origen de la obra, que fue copiada en Menorca por su propio autor en el año 645/1248. Además, se puede observar que fue ofrecido como regalo a Saʽīd b. Ḥakam al-Qurašī, el gobernador de la isla, que fundó una biblioteca cuya riqueza fue celebrada por los autores medievales. En el estado actual del conocimiento, se trata precisamente del quinto manuscrito identificado, encontrándose hoy los otros cuatro en la Real Biblioteca del Monasterio de San Lorenzo de El Escorial. La historia del manuscrito permanece oscura, aunque se puede dar por establecido que reapareció en Libia a mediados del siglo XIX, siendo entonces propiedad de Muḥammad b. ʽAlī al-Sanūsī, fundador de la poderosa ṭarīqa al-Sanūsiyya. Makalenin konusu Ebû Hanîfe örneğinden hareketle İslam düşüncesinde yargı-siyaset ilişkisi-dir. Ebû Hanîfe’nin yaşadığı döneme kadar karizmanın dini ve siyasi kültürde gelişimine paralel olarak yargı-siyaset ilişkileri bağlamında İslam düşüncesinde bazı formlar çoktan ortaya çık-mıştı. Burada amaç İslam’ın henüz ikinci asrında yargı-siyaset ilişkilerini Ebû Hanîfe üzerinden anlamaya çalışmak ve dolaylı olarak da meselenin bugüne yansıyan yönlerine ışık tutmaktır. Bu yüzden farklı sosyolojik düzlemlerde inşa edilmiş Şiî, Haricî, Sünnî öteki formlar çalışma dışında tutulmuştur. Araştırma Ebû Hanîfe’nin; doktrini oluşturan Kur’an, sünnet ve sahabe uygulamaları (...) ile kendi dönemindeki dini, siyasi, sosyal ve kültürel şartlar arasında nasıl bir okuma yaptığını sorunsallaştırmıştır. Çalışmada Ebû Hanîfe’nin yargı-siyaset ilişkisi bağlamın-da ortaya çıkardığı genel anlama biçiminin, işaret edilen dini ve tarihi şartlarla kendi dini top-lumsallaşma çevresindeki diyalektik bir ilişkide şekillendiği varsayılmıştır. Dolaylı gözlem yöntemi ile elde edilen veriler bir tekil olay incelemesi bağlamında fenomenolojik bir çözüm-lemeye tabi tutulmuştur. Konu bugüne kadar ilahiyat bağlamında olduğu gibi din bilimi alanın-da da dikkat çekici görülmemiştir. Makale İslam düşüncesinde yargı-siyaset ilişkisinin farklı desenleri arasında Ebû Hanîfe modelini tartışması bağlamında bir değere sahip görülebilir. Çalışmada; temel hak ve özgürlüklerin korunması noktasında sivil ve barışçıl bir muhalefetin yeterli olmadığı, iktidarın kişisel hakları tanımaktan daha çok kişisel ödevler ve mutlak itaat talebi ile siyaset yaptığı bir ortamda Ebû Hanîfe’nin soruna ahlaki bir saikle yaklaştığı ve bu bağlamda bir çözüm önerisi getirdiği görülmüştür. Ebû Hanîfe gerek otorite ve karizması ge-rekse ekonomik statüsü ve kültürel birikiminden aldığı güç ile yaşadığı dönemde üst düzey siyasal ve hukuki bir katılım gerçekleştirmiştir. Yasama erkinin özgür bir üyesi olarak Ebû Hanîfe temel haklar bağlamında hayatı boyunca hep iktidarlarla karşı karşıya gelmiş ve bu mücadele içinde iken de öldürülmüştür. Müslüman bir ailede doğmasına rağmen dönemin politik tavrı nedeniyle daha doğumuyla birlikte iktidar tarafından öteki olarak görülmüş ve ömrü boyunca bu statü ile yaşamak zorunda kalmıştır. Başlangıçta kendi ailesi içinde toplum-sallaşırken deneyimlediği mevalilik duygusu, Ebû Hanîfe’de özellikle hocasının ölümünden sonra iktidarlara karşı toplumsal bir hak arayışına dönüşmüştür. Esasen kendi özelinde bir hak arayışı olmaksızın iktidarların yasa ile sorunlu politik tavırları karşısında dini, hukuki ve top-lumsal bir tavır içinde yürüttüğü bu mücadelesi Ehl-i Beyt’i ve diğer bütün toplumsal grup ve kategorileri içine alan bir genişlikte ilerlemiştir. Ebû Hanife’nin yargı- siyaset ilişkisine dair bu yaklaşımı teorik ve pratik olarak tamamen sistematik bir çerçevede şekillenmiştir. İslam hu-kukunun dayandığı bilgi gövdeleri kapsamında o, çok kapsayıcı ve dinamik bir tarzda din ve şeriat kavramsallaştırması yapmıştır. Buna göre Ebû Hanîfe dine temel hakların dayandığı temel yasa anlamı yüklerken şeriata ise kendisinin bu dini alana veya başka bir ifadeyle yasaya göre düzenlendiği neshe açık, değişken bir alan anlamı vermiştir. Bu tevhit eksenli hiyerarşi içinde siyaset, yasaya karşı kesin sorumluluğu olan dünyevi bir alan görülmüştür. Ebû Hanîfe’nin İslam’ın ilk dönemini bir hukuk devleti nosyonu içinde değerlendirdiğinde kuşku yoktur. Buna mukabil, genel yargı-siyaset ilişkisine yaklaşımından anlaşıldığına göre yaşadığı dönemi, iktidarlar tarafından hukukun araçsallaştırıldığı bir dönem olarak görmüştür. Kurmuş olduğu akademi onun yargı-siyaset ilişkisine bakışının önemli bir pratiğidir. Bu akademiden yetişen ve daha sonra resmi ve gayri resmi olarak yasamanın bir üyesi olan öğrencilerine tav-siyeleri ve mektupları, onun bir yargı elemanı olarak siyaset kurumuna yaklaşımının sübjektif değil; bir düzen ihtiyacının ortaya çıkardığı objektif bir tavır olduğunu göstermiştir. During the early Islamic period Cyprus was a frontier territory unlike most—control, influence, and tax revenue over the island were shared mutually by both the Byzantine and Islamic states—and the historiographical record demonstrates that its legal and administrative status was fraught with challenges. The present study is based on the surviving Arabic material in Abū ʿUbayd al-Qāsim b. Sallām’s Kitāb al-Amwāl, subsequently transmitted in Kitāb Futūḥ al-buldān of al-Balādhurī. It argues that the problematic nature of Cyprus in this period, coupled (...) with Abū ʿUbayd’s unprecedented access to genuine correspondence of jurists from the end of the eighth century, led the author to enshrine important documentary evidence that did not survive elsewhere. Furthermore, it suggests that the continued source-critical and comparative analysis of early Arabic narrative source material can still yield fruitful information for an understanding of the earliest centuries of Islamic history despite the sources’ many limitations. Many Japanese American Buddhist families in the San Jose, California area observe a series of late life celebrations in honor of their elders. The sixty-first, the seven-tieth, the seventy-seventh, and eighty-eighth birthdays are celebrated with special flourish. These celebrations mark milestones in life and underscore the respect and gratitude elders are accorded by the family and community. At these gatherings the talk among family and guests invariably turns to the life of the elder and they wonder how the elder was (...) able to survive and even flourish amid the hard- ships and setbacks during his or her long life. Indeed, long-lived elders do seem to have a presence of being that can only come from many years of living. The idea of kyogai, “one's station in life,” is especially revered in the elder. Ordinarily, kyogai refers to one's place in society. Kyogai also suggests the spiritual maturity of being able to live with equanimity and ease in a transient and interdependent world. For Shiryu Morita, a leading Japanese sho-artist or calligrapher and student of Buddhist thought and practice, kyogai is both a spiritual and an aesthetic quality. I reflect on Morita's notion of kyogai within the context of the Buddha's attitude toward aging and elders. I offer my reflections as a Buddholo- gist interested in elder ethics and as a Buddhist priest concerned with caring for and empowering elders. I begin with a description of the Buddha's attitude toward aging and elders outlined in the Sutta-Nipata, an early Buddhist document. The “Salla Sutta” in the Sutta-Nipata outlines the Buddha's attitude toward old age, elders and elder tasks.
