We all have agent-relative permissions to give extra weight to our own well-being. If you and two strangers are drowning, and you can save either yourself or two strangers, you have an agent-relative permission to save yourself. But is it possible for you to ‘vest’ your agent-relative permissions in a third party – a ‘proxy’ – who can enact your agent-centered permissions on your behalf, thereby permitting her to do what would otherwise be impermissible? Some might think that the answer (...) is ‘no’; it is definitive of agent-centered permissions that they apply only to the individuals ineliminably referenced in the content of that reason, which means that they lack reason-giving force for any ostensible proxy. The purpose of this paper is to show that vesting agent-relative permissions is indeed possible, provide an account of how agent-relative permissions are vested by considering the structure of rights more generally, and show that we have a right to vest such permission in this way. I argue that the lives of domestic and enemy civilians should not receive equal weight in our proportionality calculations. Rather, the lives of enemy civilians ought to be “partially discounted” relative to the lives of domestic civilians. We ought to partially discount the lives of enemy civilians for the following reason (or so I argue). When our military wages a just war, we as civilians vest our right to self-defense in our military. This permits our military to weigh our lives (...) more heavily. Before arguing for this view I first explain why recent accounts attempting to show the opposite – that enemy civilians ought to be weighed more heavily – are mistaken. (shrink)

Even in just wars we infringe the rights of countless civilians whose ruination enables us to protect our own rights. These civilians are owed compensation, even in cases where the collateral harms they suffer satisfy the proportionality constraint. I argue that those who authorize or commit the infringements and who also benefit from those harms will bear that compensatory duty, even if the unjust aggressor cannot or will not discharge that duty. I argue further that if we suspect antecedently that (...) we will culpably refrain from compensating those victims post bellum, then this makes satisfying the war’s proportionality constraint substantially more difficult at the outset of the war. The lesson here is that failing to take duties of compensation in war seriously constrains our moral permission to protect ourselves. (shrink)

Associative duties are agent-centered duties to give defeasible moral priority to our special ties. Our strongest associative duties are to close friends and family. According to reductionists, our associative duties are just special duties—i.e., duties arising from what I have done to others, or what others have done to me. These include duties to abide by promises and contracts, compensate our benefactors in ways expressing gratitude, and aid those whom we have made especially vulnerable to our conduct. I argue, though, (...) that reductionism faces a problem: special duties are not strong enough to account for the strength of our associative duties. At the bar of associative duties, we are required to do what no special duty can warrant. I then present an alternative reductionist analysis of associative duties—the ‘Identity-Enactment Account’—which not only accounts for the peculiar strength of our associative duties, but also characterizes them in an intuitively compelling way. On this account, our strongest associative duties are special duties to protect or promote the welfare of the duty’s beneficiary by adopting and enacting a practical identity in which the duty’s beneficiary features prominently. There are persons who can legitimately demand a prominent place in our mental lives, for the protection and intimacy it affords. They can, in effect, legitimately demand to be among our nearest and dearest. The correlative of such a demand is, on our part, an associative duty we have toward them. (shrink)

In Chapter 7, “Dignity, Self-Respect, and Bloodless Invasions”, Saba Bazargan-Forward asks How much violence can we impose on those attempting to politically subjugate us? According to Bazargan-Forward, “reductive individualism” answers this question by determining how much violence one can impose on an individual wrongly attempting to prevent one from political participation. Some have argued that the amount of violence one can permissibly impose in such situations is decidedly sub-lethal. Accordingly, this counterintuitive response has cast doubt on the reductive (...) individualist project. Bazargan-Forward argues, however, that political subjugation involves an institutionally embodied form of disrespect that has been altogether missed. A proper appreciation of this sort of disrespect, he contends, morally permits much greater defensive violence against those attempting to politically subjugate us or others. (shrink)

Though the duties of care owed toward innocents in war and in civil life are at the bottom univocally determined by the same ethical principles, Bazargan-Forward argues that those very principles will yield in these two contexts different “in-practice” duties. Furthermore, the duty of care we owe toward our own innocents is less stringent than the duty of care we owe toward foreign innocents in war. This is because risks associated with civil life but not war (a) often increase (...) the expected welfare of the individuals upon whom the risk is imposed, (b) are often imposed with consent, and (c) are often imposed reciprocally. The conclusion—that we have a pro tanto reason for adopting a more stringent standard of risk imposition toward foreign innocents in war—has implications for not only what standards of risk we should adopt in war, but also how we should weigh domestic versus foreign civilian lives. Suppose someone (P1) does something that is wrongful only in virtue of the risk that it will enable another person (P2) to commit a wrongdoing. Suppose further that P1’s conduct does indeed turn out to enable P2’s wrongdoing. The resulting wrong is agentially mediated: P1 is an enabling agent and P2 is an intervening agent. Whereas the literature on intervening agency focuses on whether P2’s status as an intervening agent makes P1’s conduct less bad, I turn this issue on its (...) head by investigating whether P1’s status as an enabling agent makes P2’s conduct more bad. I argue that it does: P2 wrongs not just the victims of ϕ but P1 as well, by acting in a way that wrongfully makes P1 accountable for ϕ. This has serious implications for compensatory and defensive liability in cases of agentially mediated wrongs. (shrink)

Complicity marks out a way that one person can be liable to sanctions for the wrongful conduct of another. After describing the concept and role of complicity in the law, I argue that much of the motivation for presenting complicity as a separate basis of criminal liability is misplaced; paradigmatic cases of complicity can be assimilated into standard causation-based accounts of criminal liability. But unlike others who make this sort of claim I argue that there is still room for genuine (...) complicity in the law and in morality. In defending this claim, I sketch an approach to complicity which grounds our liability for what others do not in our causal relation to their actions but in our “agency-relations” with others. In such cases, one agent can be liable for the wrongs of second agent to the extent that first authorizes the second to act at her behest. This approach fills the gap where standard causation-based accounts of complicity fail – especially in where several agents cooperatively contribute to an overdetermined harm. (shrink)

The destruction wrought by even just wars lends undeniable appeal to radical pacifism, according to which all wars are unjust. Yet radical pacifism is fundamentally flawed. In the past decade, a moderate and more defensible form of pacifism has emerged. According to what has been called ‘contingent pacifism’, it is very unlikely that it is morally permissible to wage any given war. This chapter develops the doctrine of contingent pacifism by distinguishing and developing various versions of it, and by assessing (...) the merits and drawbacks of each. According to ‘proportionality-based’ contingent pacifism, almost all wars with just causes are unjust ‘tout court’ because the in bello harms such wars impose on the innocent are too great relative to the relevant evils averted by achieving the war’s aims. After arguing against this view, the chapter introduces a novel, more defensible form of contingent pacifism, called ‘epistemic-based’ contingent pacifism, according to which the prevalence of mistaken judgements regarding the justness of wars, combined with the devastating harmfulness of unjust wars, requires imposing prohibitions against waging war, where the strength of the prohibition varies according to whether the government has a history of mistakes or deception regarding the justness of wars. A minimally responsible threatener is someone who bears some responsibility for imposing an objectively wrongful threat, but whose responsibility does not rise to the level of culpability. Minimally responsible threateners include those who knowingly commit a wrongful harm under duress, those who are epistemically justified but mistaken in their belief that a morally risky activity will not cause a wrongful harm, and those who commit a harm while suffering from a cognitive impairment which makes it prohibitively difficult to recognize and (...) act on what is morally required of them. The chapter argues that minimally responsible threateners can indeed be morally liable for the harms they impose. Put differently, culpability is not a necessary basis for liability. (shrink)

How should we decide a single employee's accountability in a corporation that commits egregious wrongs? What about a single solider fighting in an unjust war? Or a single participant in a lynching? We need a way to make sense of individual moral accountability in cases where multiple individuals are cooperating in a way that results in a wrongful harm. -/- Authority, Cooperation, and Accountability develops a novel strategy for addressing this issue. Saba Bazargan-Forward makes the case for thinking that (...) distinct aspects of human agency, normally wrapped up in a single person, can be 'distributed' practically across different people. He argues that we 'distribute' agency routinely, by forming promises, by making requests, by issuing demands, and by undertaking shared action. The resulting division of agential labour makes possible a distinctive way in which one person can be accountable for the actions of another. Bazargan-Forward highlights that what matters morally is not just our causal contributions to wrongful cooperative activity. In addition, the purposes we confer upon one another can inculpate us as well. The result is an account that can help us make sense of individual moral accountability in a bureaucratized world. -/- The first half of the book develops a theory of accountability in the context of cooperation. Sarah Grand was one of the most prominent New Women of the 1890s and a notable social purity feminist and suffragist. This collection offers important insights into the full range of her journalistic output and lesser-known fictional writings. It also makes available biographical and autobiographical material, and previously unpublished manuscript sources. The first volume reproduces Grand's articles and the contemporary critical reception of her work. The letters in volume two, written mostly in the 1920s and 1930s, shed light on Grand's (...) genesis as a writer and her interaction with 1890s artistic and feminist circles. The third and fourth volumes contain a selection of short stories from three collections published at and after the turn of the century. These comment on some of the explosive issues of that time: feminism, decadence, eugenics, class, race and war. They also reflect Grand's exploration of the interplay between gender and genre. Conventional rockets are not a suitable technology for interstellar missions. Chemical rockets require a very large weight of propellant, travel very slowly compared to light speed, and require significant energy to maintain operation over periods of years. For example, the 722 kg Voyager spacecraft required 13,600 kg of propellant to launch and would take about 80,000 years to reach the nearest star, Proxima Centauri, about 4.3 light years away. There have been various attempts at developing ideas on which one might (...) base a spacecraft that would permit interstellar travel, such as spacewarps. In this paper we consider another suggestion from science fiction and explore how the quantum vacuum might be utilized in the creation of a novel spacecraft. The spacecraft is based on the dynamic Casimir effect, in which electromagnetic radiation is emitted when an uncharged mirror is properly accelerated in vacuum. The radiative reaction produces a dissipative force on the mirror that tends to resist the acceleration of the mirror. This force can be used to accelerate a spacecraft attached to the mirror. We also show that, in principle, one could obtain the power to operate the accelerated mirror in such a spacecraft using energy extracted from the quantum vacuum using the standard Casimir effect with a parallel plate geometry. Unfortunately the method as currently conceived generates a miniscule thrust, and is no more practical than a spacewarp, yet it does provide an interesting demonstration of our current understanding of the physics of the quantized electromagnetic field in vacuum. Looking back on the many prophets who tried to predict the future as if it were predetermined, at first sight any forward-looking activity is reminiscent of making predictions with a crystal ball. In contrast to fortune tellers, today’s exercises do not predict, but try to show different paths that an open future could take. A key motivation to undertake forward-looking activities is broadening the information basis for decision-makers to help them actively shape the future in a desired way. (...) Experts, laypeople, or stakeholders may have different sets of values and priorities with regard to pending decisions on any issue related to the future. Therefore, considering and incorporating their views can, in the best case scenario, lead to more robust decisions and strategies. However, transferring this plurality into a form that decision-makers can consider is a challenge in terms of both design and facilitation of participatory processes. In this paper, we will introduce and critically assess a new qualitative method for forward-looking activities, namely CIVISTI (Citizen Visions on Science, Technology and Innovation; www.civisti.org), which was developed during an EU project of the same name. Focussing strongly on participation, with clear roles for citizens and experts, the method combines expert, stakeholder and lay knowledge to elaborate recommendations for decision-making in issues related to today’s and tomorrow’s science, technology and innovation. Consisting of three steps, the process starts with citizens’ visions of a future 30–40 years from now. Experts then translate these visions into practical recommendations which the same citizens then validate and prioritise to produce a final product. The following paper will highlight the added value as well as limits of the CIVISTI method and will illustrate potential for the improvement of future processes. (shrink)

I will situate the fallacies approach to reasoning with the aim of making it more relevant to contemporary life and thus intellectually significant and valuable as a method for teaching reasoning. This entails a revision that will relegate some of the traditional fallacies to the realm of history and introduce more recently recognized problems in reasoning. Some newly recognized problems that demand attention are revealed by contemporary science studies, which reveal at least two tenacious problems in reasoning that I will (...) explore in this paper. One of these problems is androcentrism, a ubiquitous problem with reasoning that feminists exposed in the twentieth century but that continues to pervade people’s reasoning. The other is biological reductionism in at least two specific forms: genetic determinism and adaptationism. (shrink)

The project 'Facing Forward' started with a collaboration between five institutions: the Stedelijk Museum Amsterdam, the Amsterdam School for Cultural Analysis at the University of Amsterdam, De Appel arts centre, W139, the Stedelijk Museum Bureau Amsterdam and the art magazine Metroplis M. Having previously organized the lecture series and publications 'Right About Now: Art & Theory in the 1990s' (2005/2006) and 'Now is the Time: Art & Theory in the 21st Century' (2008/2009), the organizing committee decided to take the (...) final step in this timeline and turn its attention to the far horizon. Informed by a shared interest in the role that history, speculation, and utopianism play in the field of contemporary art and design (as well as the larger context of global, socio-economic and political developments), a selection of seven themes emerged from the conversations of the initial organizers. These would eventually shape the seven lecture and discussions events - collected in this volume of essays - publicized under the banner Art & Theory From a Future Perspective. A great number of internationally renowned speakers were invited to reflect on the proposed themes during often sold-out events, which were presented at the Oude Lutherse Kerk in Amsterdam in 2011/2012. Yet, however compelling our desire as organizers to go beyond the framework of contemporary events and the current interest, well-nigh obsession, with history, it is obviously an illusion to think that we can escape the past by means of a turn towards the future."--Page 8. The problem of consciousness has been an issue in philosophy of mind for decades, and in recent years panpsychism and panprotopsychism have gained attention among philosophers who are still dedicated to finding a complete explanation of consciousness. In this dissertation, I criticize panpsychism and panprotopsychism by examining their metaphysical plausibility and their epistemic prospects. Concerning the metaphysical plausibility of panpsychism and panprotopsychism, I explain the “combination problem” of panpsychism and criticize several major accounts of panpsychism and panprotopsychism that aim at (...) solving this problem, including Seager’s panpsychist infusionism, Goff’s phenomenal bonding proposal, and Coleman’s panqualityism. I also examine the proposal of motivating panpsychism and panprotopsychism by drawing support from the integrated information theory (IIT) of consciousness. I argue that this proposal to merge panpsychism or panprotopsychism with IIT does not work. Concerning the epistemic prospect of panpsychism and panprotopsychism, I raise concerns about whether panpsychism and panprotopsychism can guide a fruitful research program about the nature of consciousness. First, I argue that a theory based on Russellian Monism would not have a promising epistemic prospect. I compare Russellian Monism to Thomistic Hylomorphism and argue that Russellian Monism faces similar epistemic challenges that plagued Thomistic Hylomorphism. Since most theories of contemporary panpsychism and panprotopsychism rely on the metaphysical framework of Russellian Monism, the challenges to Russellian Monism also undermine the epistemic prospects of panpsychism and panprotopsychism. Second, I challenge the epistemic prospects of panpsychism and panprotopsychism by examining if there can be a viable method to study the consciousness of micro-level entities. After revisiting the reasoning process that guided the study of atoms, I argue that studying micro-level facts requires “analogies” that compare micro-level facts with macro-level models. Then I argue that an analogy that fits the need of panpsychism or panprotopsychism is hard to achieve, because we have no macro-level models to be compared to the hypothesized systems of micro-level consciousness. This article sets out a forward-looking account of moral responsibility on which the ground-level practice is directly sensitive to aims such as moral formation and reconciliation, and is not subject to a barrier between tiers. On the contrasting two-tier accounts defended by Daniel Dennett and Manuel Vargas, the ground-level practice features backward-looking, desert-invoking justifications that are in turn justified by forward-looking considerations at the higher tier. The concern raised for the two-tier view is that the ground-level practice will (...) be insufficiently responsive to the forward-looking aims that are held to justify it. On the single-tier alternative, forward-looking considerations can more readily motivate substantial revisions, which the practice, due to serious and pervasive deficiencies, requires. (shrink)

Multisubunit protein complexes are essential for cellular function. Genetic analysis of essential processes requires special tools, among which temperature‐sensitive (Ts) mutants have historically been crucial. Many researchers assume that the effect of temperature on such mutants is to drive their proteolytic destruction. In fact, degradation‐mediated elimination of mutant proteins likely explains only a fraction of the phenotypes associated with Ts mutants. Here I discuss insights gained from analysis of Ts mutants in oligomeric proteins, with particular focus on the study of (...) septins, GTP‐binding subunits of cytoskeletal filaments whose structures and functions are the subject of current investigation in my and many other labs. I argue that the kinds of unbiased forward genetic approaches that generate Ts mutants provide information that is largely inaccessible to modern reverse genetic methodologies, and will continue to drive our understanding of higher‐order assembly by septins and other oligomeric proteins.Also watch the Video Abstract. Our target article proposed that language production and comprehension are interwoven, with speakers making predictions of their own utterances and comprehenders making predictions of other people's utterances at different linguistic levels. Here, we respond to comments about such issues as cognitive architecture and its neural basis, learning and development, monitoring, the nature of forward models, communicative intentions, and dialogue.

The view that the fundamental kind properties are intrinsic properties enjoys reflexive endorsement by most metaphysicians of science. But ontic structural realists deny that there are any fundamental intrinsic properties at all. Given that structuralists distrust intuition as a guide to truth, and given that we currently lack a fundamental physical theory that we could consult instead to order settle the issue, it might seem as if there is simply nowhere for this debate to go at present. However, I will (...) argue that there exists an as-yet untapped resource for arguing for ontic structuralism – namely, the way that fundamentality is conceptualized in our most fundamental physical frameworks. By arguing that physical objects must be subject to the ‘Goldilock's principle’ if they are to count as fundamental at all, I argue that we can no longer view the majority of properties defining them as intrinsic. As such, ontic structural realism can be regarded as the most promising metaphysics for fundamental physics, and that this is so even though we do not yet claim to know precisely what that fundamental physics is. The paper deals with Forward exchange contracts and Swap exchange contracts, These two types of contracts are among the most prominent types of financial derivative contracts that arose after the collapse of the Bretton Woods system in 1971 or the so-called Nixon shock, where the convertibility of the dollar into gold was stoped, which led to turmoil in the exchange rates of the currencies of many countries and the emergence of the need to stabilize the exchange rate Currencies in (...) transactions where the delivery of the two exchanges is delayed. This research has studied forward exchange contracts and swap exchange contracts in four sections. The first section defines the Forward exchange contract, which is a contract in which the two parties commit to exchange a specified amount of foreign currencies on a forward date, at a price agreed upon in advance. The elements and elements that must be mentioned in this contract, such as the seller and buyer, the size of the contract, the date of delivery and the forward exchange rate, were mentioned in this section, with an illustrative example of the mechanism of conducting this contract. In addition to addressing the differences between forward exchange contracts and future exchange contracts, the characteristics of forward exchange contracts and the purposes of those dealing with them from hedging and speculation are mentioned in this section. The second section has been devoted to the definition of swap exchange contracts, it is for the two parties to the contract to agree that one of them buys from the other a specific amount of a currency in exchange for a specific amount of another currency and at the current exchange rate, provided that the two exchanges are delivered immediately, and in the same contract, the two parties agree to make a forward reverse exchange contract, at a price determined within Contract, and to clarify the picture of swap exchange contracts, an example has been given to illustrate the mechanism for conducting this type of contract. In the third section, the views of contemporaries scholars regarding the İslamic law of the forward exchange contract were discussed, where the opinion of the objectors was mentioned at all and the evidence they inferred from it. And then the opinion of those who advocate the permissibility of forward exchange contracts that are in the form of a dating that is not binding on both parties together, provided that there is nothing in the dating that indicates that it is a contract of sale and provided that a new contract is delivered independent of the dating. Then I discussed the opinion and evidence of the impediments in four points, and I concluded that the most correct opinion at the first is the impermissibility of the forward exchange contract in the form such as the traditional banks do it because of the deception it contains. But I recanted and permitted this type of contract in two cases, the first: the case of need with the absence of an alternative, and the second: the case that transaction is not binding dating for both parties and on some terms. Some contemporary scholars suggested conducting buying and selling operations in the same currency as an alternative to forward exchange contracts, and some of them suggested that Islamic banks should have a common unit of account to settle accounts between the parties to commercial transactions. But in my opinion two solutions are often not feasible. As for the fourth section, I dealt with the opinions of contemporary scholars in the swap exchange contract. it seems likely to me that swap currency exchange contracts are nothing but a usurious loan that is prohibited by Sharia. Because when examining the mechanism of conducting this type of contract, it turns out that one of the parties lent the other an amount in one currency in exchange for the other lending him an amount in another currency under the name of the spot exchange contract. Since one of the two parties requires the other to increase what he lent - if the exchange rate of the Forward exchange contract is different from the Spot exchange rate, which is predominant - under the name of the Forward exchange contract, then this process is nothing but a usurious loan. I supported the proposal to exchange loans in different currencies as a İslamic alternative to transaction contracts, provided that there is no preference for one party over another, and there is no usurious increase. And in order to solve the problem of the high rate of currency inflation of one of the two loans more than the other, the researcher suggested adding the inflation rate to the two loans when they are performed. BackgroundPatient advocacy organizations (PAOs) have an increasing influence on health policy and biomedical research, therefore, questions about the specific character of their responsibility arise: Can PAOs bear moral responsibility and, if so, to whom are they responsible, for what and on which normative basis? Although the concept of responsibility in healthcare is strongly discussed, PAOs particularly have rarely been systematically analyzed as morally responsible agents. The aim of the current paper is to analyze the character of PAOs’ responsibility to provide (...) guidance to themselves and to other stakeholders in healthcare.MethodsResponsibility is presented as a concept with four reference points: (1) The subject, (2) the object, (3) the addressee and (4) the underlying normative standard. This four-point relationship is applied to PAOs and the dimensions of collectivity and prospectivity are analyzed in each reference point.ResultsUnderstood as collectives, PAOs are, in principle, capable of intentionality and able to act and, thus, fulfill one prerequisite for the attribution of moral responsibility. Given their common mission to represent those affected, PAOs can be seen as responsible for patients’ representation and advocacy, primarily towards a certain group but secondarily in a broader social context. Various legal and political statements and the bioethical principles of justice, beneficence and empowerment can be used as a normative basis for attributing responsibility to PAOs.ConclusionsThe understanding of responsibility as a four-point relation incorporating collective and forward-looking dimensions helps one to understand the PAOs’ roles and responsibilities better. The analysis, thus, provides a basis for the debate about PAOs’ contribution and cooperation in the healthcare sector. (shrink)

Prehensity -- Intensity -- Potentiality -- Sensibility.

This article has four aims. First, it will consider explicitly, and polemically, the hierarchical relationship between conversation analysis and membership categorization analysis. Whilst the CA ‘juggernaut’ flourishes, the MCA ‘milk float’ is in danger of being run off the road. For MCA to survive either as a separate discipline, or within CA as a focus equivalent to other ‘generic orders of conversation’, I suggest it must generate new types of systematic studies and reveal fundamental categorial practices. With such a goal (...) in mind, the second aim of the article is to provide a set of clear analytic steps and procedures for conducting MCA, which are grounded in basic categorial and sequential concerns. Third, the article aims to demonstrate how order can be found in the intuitively ‘messy’ discourse phenomenon of membership categories, and how to approach their analysis systematically as a robust feature of particular action-oriented environments. Through the exemplar analyses, the final aim of the article is to promote MCA as a method for interrogating culture, reality and society, without recourse to its reputed ‘wild and promiscuous’ analytic approach. The field of bioethics has deployed different models of justification for particular moral judgments. The best known models are those of deductivism, casuistry, and principlism (under one, rather limited interpretation). Each of these models, however, has significant difficulties that are explored in this essay. An alternative model, suggested by the work of Henry Richardson, is presented. It is argued that specified principlism is the most promising model of justification in bioethics.
