This dissertation develops a reading of Arthur Schopenhauer’s theory of agency and autonomy that centers on the notion of the acquired character. I argue for a non-homuncular functionalist reading of Schopenhauerian self-government. On my reading, to be self-governing in Schopenhauer’s sense is just for a certain organizational structure to obtain between one’s individual character and one’s motivation. This structure is put in place through the hard-fought achievement of acquiring genuine self-knowledge of one’s characteristic patterns of acting, evaluative commitments, and, most (...) importantly, one’s volitional necessities. This is the achievement of what he calls the 'acquired character'. My reading also stresses the importance of the phenomena of self-expression and sublimation for Schopenhauer's view of autonomy. I also explore the overlap between Schopenhauer's views and contemporary non-homuncular models of agency, particularly Harry Frankfurt’s hierarchical model of agency, on the one hand, and Michael E. Bratman’s planning theory of autonomous self-governance, on the other. Whereas others have been skeptical of the very idea of Schopenhauerian autonomy, I argue that these reservations rest on a failure to recognize the non-homuncular option. An exploration of contemporary philosophical work on agency helps make this point stick. In the final chapter, I propose that we can see Nietzsche's famous prescription that we ‘give style' to our character as carrying forward certain elements of Schopenhauer's view of autonomy, particularly its aesthetic dimensions. This accomplishes two things. First, it shows that Schopenhauer's influence on Nietzsche goes deeper into the latter's ethical thought than many tend to think. Second, it points towards an elaboration of the view of Schopenhauerian autonomy that I establish earlier on. With the aesthetic dimensions of agency in view, acquired character can be seen as a process through which an agent develops an individual style of acting; it is a process through which one comes to fully act within themselves by embodying their character, just as the best stage and screen actors do. The study of the circulation of literary texts in ancient Rome has taken on new significance lately. Recent work on Roman books and their readers has emphasized the difference between the dissemination of texts in the ancient world and publication as we moderns know it, and we have come to see that our understanding of Roman culture and their politics can benefit from a closer examination of how the Romans composed, recited, and released their books. Take, for example, Cicero and (...) the readers of his philosophical works. In the Tusculans, the Academica, De Officiis, De Divinatione, and De Finibns Cicero promoted Latin, in terms very like those of modern linguistic nationalism, as a medium for intellectual discourse at the expense of Greek, and exhorted his readers to follow him in transferring philosophy from Greece to Rome. To choose to write philosophy at this time in Latin instead of Greek was, as Cicero put it, a practical means of increasing Rome's intellectual prestige, a campaign in which he invited his readers to enlist. But to whom was this appeal directed? Who, to Cicero's mind at least, would have been useful in achieving this political goal? From evidence in Cicero's letters to Atticus, we can largely retrace how he disseminated these philosophical books, reconstruct to some degree their original readers, and, most importantly, deduce the grounds on which Cicero selected them. Cicero's choice of audience, and the manner in which he assembled it, throws an interesting light both on his agenda in promoting Latin as a philosophical language as well as on the Roman culture of publication. Much of the legal and social interest in new neuroimaging techniques stems from the belief that they can deliver on the materialist understanding of the relationship between the brain and the mind. This article looks at predictions about the future both of scientific advances and of social reactions to those predictions. It looks at the likely technical limits on neuroscience-based mindreading, then at the likely limits in how the law might use such technologies. It describes three kinds of technical barriers (...) to detailed and useful mindreading: the likely impossibility of making a complete and accurate model of a human brain in light of its incredible complexity, the problems of interpersonal and intrapersonal plasticity, and the problem of trying to read, now, someone's past mental state. The potential changes to the operation of the law, through the use of mindreading as evidence of pain, deception, or bias, among other things, could be extremely important. (shrink)

This paper examines the roles that self-knowledge and reflection play in Schopenhauer’s view of agency. Focusing in particular on the discussion of the acquired character, his cognitive theory of motivation, and the idea of intellectual freedom, I argue that we find two conceptions of rational agency in Schopenhauer. The ‘minimal’ conception sees rational agency primarily as a kind of reflective motivation, whereas the ‘maximal’ or ‘robust’ conception sees rational agency as involving a kind of reflective self-organization. Furthermore, I argue that (...) rational self-organization and acquired character go hand-in-hand: it is only in virtue of achieving the latter that one achieves the former. Although some worry that the discussion of acquired character does not sit well with Schopenhauer’s broader determinist theory of action, the reading offered here aims to demonstrate that the two are reconcilable. This chapter corrects for Susan Sontag's undeserved neglect by contemporary moral philosophers by bringing awareness to some of the unique metaethical insights born of her reflections on photographic representations of evil. I argue that Sontag's thought provides fertile ground for thinking about: (1) moral perception and its relation to moral knowledge; and (2) the epistemic and moral value of our emotional responses to the misery and suffering of others. I show that, contrary to standard moral perception theory (e.g. Blum 1994), (...) Sontag holds that we can have general moral perceptual knowledge. I then explore Sontag's idea that certain emotional responses, like sympathy and compassion, can sometimes be impertinent, in virtue of their having false or illusory content. I explain why this is so, and show the epistemic and motivational problems it poses for moral sentimentalism. (shrink)

Emotional hardcore and other music genres featuring screamed vocals are puzzling for the appreciator. The typical fan attaches appreciative value to musical screams of emotional pain, all the while acknowledging it would be inappropriate to hold similar attitudes towards their sonically similar everyday counterpart: actual human screaming. Call this the screamed vocals problem. To solve the problem, I argue we must attend to the anti-sublimating aims that get expressed in the emotional hardcore vocalist’s choice to scream the lyrics. Screamed vocals (...) help us see the value in rejecting (a) restrictive social norms of emotional expressiveness and (b) restrictive artistic norms about how one ought to express or represent pain in art—namely that if one is going to do so, one must ensure the pain has been ‘beautified’. In developing this second point, I argue that emotional hardcore is well-suited (although not individually so) for putting pressure on longstanding views in the history of aesthetics about the formal relationship between art and human pain. This work serves as an introduction to both the theoretical and practical aspects of using computers to improve the delivery of social services. Though many practitioners believe that computerization dehumanizes clients and should be avoided, John Murphy and John Pardeck demonstrate how, through a holistic approach to computer use, this problem, and others like it, can be averted. By providing practitioners the opportunity to sharpen their conceptual skills in computer technology, this book promotes a rational understanding of the possible (...) uses and limitations of computers in social service agencies. Unlike other, technically-oriented works in this field, Murphy and Pardeck's work focuses on the philosophical justification of computer use, along with the conceptual or symbolic nature of computerization. They fully illustrate how to create the organizational conditions necessary for computers to improve social-service delivery, and they do so in a manner that is easily accessible for both general classroom and professional use. Among the topics addressed are the technological world-view, Western philosophy, and knowledge; computer mediated therapy; ethical issues related to computerized service delivery; and construction of a socially responsible technology. This work will be a unique and important resource for courses in computer applications, policy analysis, and social service administration, as well as a useful reference source for human service agencies and practitioners. Psychologist Richard Nisbett argues that fundamental aspects of critical thinking and logic are culturally conditioned. Nisbett’s claims, if correct, have substantial implications for the teaching of logic and critical thinking. In this paper I examine Nisbett’s arguments and conclude that he overstates the degree to which his empirical work justifies his theories about cultural difference. I will argue that we have good reason to be cautious about revising our pedagogy on the basis of assumptions about cultural difference, and that Nisbett’s (...) work does not provide convincing enough evidence to justify setting that caution aside. The central claim of Schopenhauer’s account of human motivation is that ‘cognition is the medium of motives’. In light of motivation’s cognitively mediated structure, he contends that human beings are caused to act by ‘mere thoughts’, what he refers to metaphorically as ‘fine, invisible threads’. Despite this avowedly intellectualist handling of the subject, some commentators remain convinced that Schopenhauer is best read as accepting the ‘Humean truism’ that reason alone never motivates; rather, motivation always has its source in desire together (...) with instrumental belief (Young 1987). Here, I raise some doubts for the Humean reading by arguing that it does not take sufficient account of the transformative effects of cognitive mediation, effects which support cases of non-desiderative motivation. I argue in particular that Schopenhauer permits cases of motivation by the essentially cognitive states of imagination and recognition. Tracing this intellectualist strand in Schopenhauer’s view of motivation has two important results. First, it unmasks an important structural role for Besonnenheit (reflectiveness) in his account of practical agency, thereby revealing a unified thread running throughout his system; second, we alight on a possible ‘expressivist’ picture of his account of motivation, something it shares with his broader theory of action. A major shift has taken place since the 1960s concerning disclosure to patients that they have a diagnosis of cancer and that their disease is considered terminal. Full disclosure is now considered the patient's right in the United States. However, there remain many countries in which nondisclosure is still the norm. When patients from those countries are diagnosed with cancer in America, differences in attitudes and expectations can cause conflict and misunderstanding.

Recent studies in social endocrinology have explored the effects of social relationships on female reproductive steroid hormones—estradiol and progesterone—investigating whether they are suppressed in partnered and parous women. Results have been mixed for these hormones although evidence is more consistent that partnered women and women with young children have lower levels of testosterone. These studies were sequential to earlier research on men, based on Wingfield’s Challenge Hypothesis, which showed that men in committed relationships, or with young children, have lower levels (...) of testosterone than unpartnered men or men with older or no children. The study described here explored associations between estradiol and progesterone with partnership and parity among women from two different ethnicities: South Asian and white British. We hypothesized that both steroid hormones would be lower among partnered and/or parous women with children ≤3 years old, regardless of ethnicity. In this study we analyzed data from 320 Bangladeshi and British women of European origin aged 18 to 50 who participated in two previous studies of reproductive ecology and health. Levels of estradiol and progesterone were assayed using saliva and/or serum samples and the body mass index calculated from anthropometric data. Questionnaires provided other covariates. Multiple linear regressions were used to analyze the data. The hypotheses were not supported. We argue here that, unlike links between testosterone and male social relationships, theoretical foundations for such relationships with female reproductive steroid hormones are lacking, especially given the primary role of these steroids in regulating female reproductive function. Further longitudinal studies are needed to explore the bases of independent relationships between social factors and female reproductive steroid hormones. (shrink)

An implicit goal of many interventions intended to enhance integrity is to minimize peoples' exposure to unethical events. The intent of the present effort was to examine if exposure to unethical practices in the course of one's work is related to ethical decision making. Accordingly, 248 doctoral students in the biological, health, and social sciences were asked to complete a field appropriate measure of ethical decision making. In addition, they were asked to complete measures examining the perceived acceptability of unethical (...) events and a measure examining perceptions of ethical climate. When these criterion measures were correlated with a measure examining the frequency with which they had been exposed to unethical events in their day-to-day work, it was found that event exposure was strongly related to ethical decision making but less strongly related to climate perceptions and perceptions of event acceptability. However, these relationships were moderated by level of experience. The implications of these findings for practices intended to improve ethics are discussed. (shrink)

Nora is used to me reading philosophy at night; but she is not used to me laughing loudly while doing so. Clearly, she was curious. I smiled in recognition of what Nora’s behavior had enabled me to realize: I don’t often laugh when I read philosophy, not like I did that night while reading Willett’s work.Anecdote II: Cindy came out to New Mexico last spring to give the keynote address at our department’s annual graduate student conference. The afternoon she arrived, a few graduate students had arranged to take her on a hike in a nature preserve, a beautiful tract of land alongside the Rio Grande, which winds through Albuquerque. The next day, two of [End Page 50] the graduate students were in my office and I asked how the hike went. The students looked at each other, shuffled a bit, and stared at the floor until one announced, “Well, we kind of got locked in the preserve.” Me: “You got locked in the nature preserve?” “Yep, but it all worked out okay. She was cool with it,” one student reported. The other added: “Yeah, she’s pretty wild.”That conversation happened months before I was asked to speak on and to Willett’s work, but that conversation, that compliment, that word—“wild”—came to mind many times as I was preparing these comments in her honor. And I mean “wild” in the best sense: as rowdy and irreverent and joyful. There is a wildness to Willett’s texts in their performative aspect, one that marks them as singular. Bucking certain philosophical tendencies to overindulge a metaphorics of war and violence, Willett’s own work evinces an entirely different philosophical orientation, one that takes love, and more specifically eros, as its bedrock. The wildness of Willett’s ethical philosophy comes into play in the truly variable scenes in which Willett locates eros and its promise. It’s a wild kind of love that informs Willett’s ethics, one that refuses domestication, refuses to be hemmed in by the borders between species, refuses to be fixed. The scope that Willett assigns eros is broad, countering the tendency to reduce it to the sexualized and sentimental contexts in which it is often placed.1At the heart of Willett’s deliberations across her four monographs and many articles is an abiding concern with, and celebration of, eros as a site of social, political, and ethical promise. A preoccupation with eros is evident in her work from the very beginning. In her first monograph, Maternal Ethics and Other Slave Moralities (1995), Willett frames her project in reference to Audre Lorde’s claim (in Lorde’s essay “Uses of the Erotic: The Erotic as Power”) that European American culture has perpetuated an understanding of power that parses the erotic from the spiritual and political and as a consequence has “suppressed the deepest source of power and knowledge in our lives” (Lorde 1984, 55, cited in Willett 1995, 7). This first book suggests new conceptions of freedom and ethical subjectivity based on social eroticism, a project furthered in her second monograph The Soul of Justice: Social Bonds and Racial Hubris (2001), where hubris is understood with and against the Greeks as an assault on this primary sociality. “In response to the Greeks we might say that the person is born, not of honor, but of love. Moral error theorists often respond to the epistemic companions in guilt strategy by adopting the Disparity Response: reject the putative parity between moral and epistemic reasons and claim that though the former are irreducibly normative, the latter aren’t. I argue such a response fails. Expanding on Das’ Australas J Philos 95:58–69, work I present a master argument against Disparity Responses: the arguments moral error theorists use to advance their conceptual claim apply in the epistemic domain also. This prohibits the error (...) theorist from adopting epistemic reductionism. I use Jonas Olson’s work as exemplary of moral error theory. I demonstrate that Olson’s argument that the rhetorical authority of moral claims is best explained by the error theorist’s conceptual claim applies equally in the epistemic case. Olson attempts to avoid this by claiming that epistemic claims are reducible to claims about whether our doxastic attitudes live up to their functions. There are two problems with Olson’s argument. Firstly, functional reasons are a species of a common genus – standards reasons – and since Olson’s authority argument against moral reductionism applies to standards reasons, it applies to functional reasons. Secondly, Olson’s claim that we cannot also cast moral reasons as functional is under-supported. I suggest that there is plausible evidence that we can and undermine his arguments against this claim. I do not argue that the epistemic companions in guilt strategy demonstrates the falsity of moral error theory. Rather, I argue that the Disparity Response to the epistemic companions in guilt strategy fails. (shrink)

In many ways, we live in propitious times for gay and lesbian people. In 1996, the Supreme Court struck down Colorado law prohibiting any kind of protected status based on sexual orientation. In 2003, the Supreme Court held that states may not criminalize sexual conduct between consenting adults of the same sex in private, so long as no money changes hands. In 2010, the Congress repealed the “Don't Ask, Don't Tell” policy that excluded openly gay men and lesbians from military (...) service. In 2013, the Supreme Court struck down key elements of the Defense of Marriage Act that prohibited any federal recognition of same‐sex marriage. Most states do not allow same‐sex marriage, but more and more states are joining the fold. Likewise, most U.S. states do not forbid discrimination based on sexual orientation, but the number that does is increasing. Arguably, no other social minority has made as much legal progress in so short a time. Despite these advances, the story of gay and lesbian people and the law is not yet finished, and the meaning of homosexuality for bioethics is still being written too. Concerns about gay and lesbian people remain important to bioethics in key domains, especially in seeing to the conferral of optimal health care benefits and in sorting through the priorities and social effects of research. Progress in these domains still involves lifting certain burdens of medical and social misjudgments about same‐sex attraction. (shrink)

“This book isn’t a blueprint for a new conversation. It’s an explanation of why we need one, and an invitation to participate in moving that forward”, says Katie Watson in the introduction to her book Scarlet A: The Ethics, Law and Politics of Ordinary Abortion. She does herself a disservice with this; in many respects her text provides us with just that—a model for what a more productive discussion of how society responds to and organizes around the issue of unwanted (...) pregnancy might look like; a question that has remained contentious across the centuries and for which we may never have an ‘answer.’ It is precisely because perceptions of abortion are so hard to prise apart from our attitudes towards women... The book has two parts. The first looks at the destructive use to which Descartes puts the method of doubt. But this is just half the story since, according to Broughton, Descartes also uses the method of doubt constructively. The second part of the book takes up the constructive use. Both uses fit into an overarching claim that is set out in the introduction. According to this claim, Descartes employs the method of doubt in order to establish fundamental metaphysical claims (...) – or, as he says, claims of first philosophy (recall Descartes’s title: Meditations on First Philosophy). These include: God exists, we ought to assent only to what we clearly and distinctly perceive, the essential attribute of matter is extension, the essential attribute of the human mind is thought, and sense experience allows us to know the primary qualities of material objects. This metaphysical interpretation of the method’s aim is contrasted with others: that the aim is to secure some form of high-grade knowledge, to clear the way for Descartes’s mechanistic physics, to refute the skepticism of the day, and to free the mind from the senses so we can think better about supersensible entities. Broughton cites passages in support of each interpretation. As her survey shows, there is (at least) decent textual support for each interpretation. Perhaps then the method of doubt is multi-purposed. After all, there is no obvious incompatibility between any two or more of the aims – so why take the various interpretations as competing with one another? Unfortunately, Broughton doesn’t say. Modern philosophical analyses of mysticism impoverish mysticism with a common understanding that the life and the language of the mystic is a separate category from that of the mystical experience. It is my contention, however, that such an understanding runs counter to what the mystics themselves attest to. ;William James's understanding of mysticism is that it serves as the means towards the circumvention of an individual's religious tradition. This view is contrary to the understanding of mysticism put forth by the (...) sixth century Christian mystic, Dionysius the Areopagite, who stressed the communal nature of the mystical life. Related to this is the analysis of the mystic's language suggested by W. T. Stace. For Stace, the mystic enters into a peculiar mystical state of consciousness, one that is characterized as inherently paradoxical. Because of this, the mystic is "embarrassed" by the language he or she employs. But in contrast, the 13th century Dominican, Meister Eckhart, employs a deliberate apophatic strategy in his use of the paradox. And finally, Steven T. Katz argues that the mystic's life and language "shapes" the mystical experience. But such a view, again, only separates the life and language of the mystic from that of the experience. St. John of the Cross taught that only through a life of love can one come to know God. This is not a contingent relationship for St. John. ;In contrast to these modern philosophical analyses of mysticism, Ludwig Wittgenstein's philosophical work can be seen to be in concert with much of what the mystics themselves attest to. Wittgenstein urges one to attend to the "grammar" of a language in order to understand its meaning. Therefore, with an examination and application of Wittgenstein's thought, the philosophical impositions cited above can be avoided. Such an approach is thus more promising to the study of mysticism for it pays attention to the life of the mystic in which the mystic's words ultimately have their meaning. (shrink)

Spreading its light and dissipating the clouds of error, the Enlightenment's eye of reason levitates like an aerostat. Its liberating power illuminates the law symbolized by a winged figure pointing to the tablets below containing the articles proclaiming that "men" are born free and equal. Despite the prominence given to the eye of reason, it is in the atmosphere in which it elevates that we must look for the elemental spring of liberty.References to the aerial nature of liberty most intriguingly surfaced in contemporary debates concerning the universality of the Declaration of the Rights of Man. The revolutionary and abolitionist Jacques Pierre [End Page 201] Brissot characterized the 1791 slave rebellion that ravaged the colony of Saint-Domingue (now Haiti) as a fight for a purer, healthier air. Woods et al. (2015) claim that secular Simple Reaction Time (SRT) slowing (Woodley et al. 2013), disappears once modern studies are corrected for software and hardware lag, and once Galton’s data are corrected for fastest-response selection. Here, this is challenged with a reanalysis of the secular slowing of SRT in the UK amongst large (N>500), population-representative age-matched (≊18-30 years) studies. Starting with Galton’s sample, this is assigned the simulated value estimated by Dodonova and Dodonov (2013, who like Woods et al. (...) were critical of secular SRT slowing, owing to measurement issues) on the basis that he collected the fastest of three trials (207.5ms). The two sexes in Galton’s study are combined (as in Woods et al.), raising the weighted sample mean to 208.5ms. Next is the Wilkinson and Alison (1989) study, which attempted to replicate Galton’s study one century later, collecting SRTs as part of an exhibit in the London Science Museum. An electronic chronoscope recorded SRTs on magnetic tape, and sampled over eight trials with micro-processor-determined variable foreperiods. The mean SRT value for the 1,189 participants aged between 20 and 29 is 245ms. The presence of long and variable foreperiods necessitates a penalty of 10ms (Dodonova & Dodonov, 2013). Another 10ms should be deducted based on key-pressing time (Dodonova & Dodonov, 2013), reducing the mean to 225ms. The studies of Deary and Der (2005) and Der and Deary (2006) are also included. The first utilized the highly representative Scottish Twenty-07 cohort. Dodonova and Dodonov (2013) identified a 53ms lag stemming from liquid crystal stimulus onset delay. This is subtracted from the weighted average of the two sexes (300.8ms), along with another 10ms for key-pressing time. The resultant mean is 237.8ms.Dodonova and Dodonov (2013) cleaned the male data in the Der and Deary (2006) study, collected from the representative UK Health and Lifestyle Survey, by removing cases for which SRT standard deviations exceeded those for choice RT. This reduced the N from 834 to 661, and also reduced the mean from 300ms to 284ms. The estimate was also penalized for LCD onset delay and key-pressing time, reducing the mean to 221ms. When the SRT value for the female sample is penalized equivalently the resulting value is 239ms. In order to simulate the female N for the purposes of taking a weighted average of both sexes, the actual female N is reduced in proportion to the male N (79.3%=881), yielding a weighted mean of 230.9ms for a combined sample-size of 1,472. Bubble-size is proportional to sample size. Combined N=6,622. The secular slowing between UK studies is statistically significant (β=0.97; 95% CI=0.969 to 0.971, N=6,622), at –22.8ms a century. Additional evidence for generational SRT slowing comes from Verhaeghen (2014), who suggested that the ratio of longitudinal to cross-sectional age-related slowing might tentatively infer generational changes in processing speed. Verhaeghen reports ratios for two SRT studies (0.91 and 1.15), implying both secular losses and gains. For the study of Deary and Der (2005), the SRT ratios are “censored because they were excessively large” (p. 256). In this study, the ratio of the cross-sectional slowing trend (taking the weighted average of all paired between-cohort differences rescaled in terms of change per decade for males and females), to the weighted average decadal longitudinal slowing trend for both the males and females is 0.73, for an N of 1,926 (cf. Woodley et al., 2014b, for a detailed reanalysis of this dataset). The weighted average of the three SRT ‘Verhaeghen ratios’ is 0.9 (N=4,078) – tentatively consistent with generational declines (i.e. a ratio of <1). In conclusion Woods et al. (2015) have undoubtedly made an important contribution to the debate concerning the role of software and hardware lag in the inflation of contemporary estimates of SRT, however the evidence for generational SRT slowing remains quite compelling. The history of psychiatry does not inspire confidence, even among psychiatrists, and there has always been a cottage industry in medicine and psychology that wrestles with various conceptual problems around mental illness. It’s arguable that philosophers of science have not paid enough attention to this literature. Even if you aren’t interested in psychiatry, you might profit from the debates in psychometrics on the measurement of mental constructs, or look at the arguments over causation, reduction, and explanation that psychiatrists fight out (...) among themselves, increasingly with some philosophical input. Kenneth Kendler is a major contributor to this literature as theorist, experimentalist, and (via his role in the DSM) institution-builder and gatekeeper. He stands out too for his willingness to engage and learn from philosophy; and also to teach, for many of us can vouch to learning a lot about psychiatry from Kendler’s willingness to collaborate with philosophers and integrate the two communities. So it is a great pleasure to have a selection of Kendler’s papers assembled in one place. The essays in this volume cover a variety of conceptual issues in psychiatry, together with some historical material looking at the recent development of biomedical psychiatry. The most notable historical piece is the chapter on the origins of the Fechner criteria for validation of diagnoses, which had an enormous impact on the development of biological psychiatry in the 1970s. This collection covers many issues, and we won’t try to discuss everything, instead opting for one or two main issues that we think philosophers of science will be especially interested in. But there is something here for almost everyone in philosophy of science, and we urge them to look at this volume even if psychiatry is not on their normal reading list. (shrink)

The recent debates concerning divine action in the context of quantum mechanics are examined with particular reference to the work of William Pollard, Robert J. Russell, Thomas Tracy, Nancey Murphy, and Keith Ward. The concept of a quantum mechanical “event” is elucidated and shown to be at the center of this debate. An attempt is made to clarify the claims made by the protagonists of quantum mechanical divine action by considering the measurement process of quantum mechanics in detail. Four (...) possibilities for divine influence on quantum mechanics are identified and the theological and scientific implications of each discussed. The conclusion reached is that quantum mechanics is not easily reconciled with the doctrine of divine action. (shrink)

In Punishment and the Moral Emotions, Jeffrie Murphy rejects his earlier, strong endorsements of retributivism. Questioning both our motivations for embracing retributivism and our views about the basis of desert, he now describes himself as a “reluctant retributivist.” In this essay, I argue that Murphy should reject retributivism altogether. Even if we grant that criminals have negative desert, why should we suppose that it is desert of suffering? I argue that it is possible to defend desert-based theories of (...) punishment that reject this view of the object of desert. I consider, but reject, expressivist versions of such a theory. As the sustained and devastating extent of the coronavirus disease 2019 pandemic becomes apparent, a key focus of public scrutiny in the UK has centred on the novel legal and regulatory measures introduced in response to the virus. When those measures were first implemented in March 2020 by the UK Government, it was thought that human rights obligations would limit excesses of governmental action and that the public had more to fear from unwarranted intrusion into civil liberties. However, within the (...) first year of the pandemic’s devastation in the UK, a different picture has emerged: rather than through action, it is governmentalinactionthat has given rise to greater human rights concerns. The UK Government has been roundly criticized for its inadequate response, including missteps in decision-making, delayed implementation and poor enforcement of lockdown measures, abandonment of testing, shortages of critical resources and inadequate test and trace methods. In this article, we analyse the UK Government’s missteps and compare them with published international guidance; we also contrast the UK’s decisions with those taken by several other countries to understand how its actions and inactions have contributed to unfavourable outcomes. Using an analytical perspective that demonstrates how human rights are both a protection from the power of the state and a requirement that governmental powers are used to protect the lives, health and wellbeing of citizens, we argue that the UK Government’s failure to exercise their powers competently allowed the virus to spread without ensuring the country had the means to manage a high case load. This abject failure has led to one of the highest rates of deaths per capita worldwide. We offer several lessons that can be learnt from this unfortunate, but preventable, situation. (shrink)

Zeno's famous paradox of the flying arrow, and the statements made in efforts to solve it by Hegel and Engels to the effect that a moving body is, at a given instant, both in and not in a given place, reveal, on the one hand, the objective contradictoriness of motion and, on the other, the difficulty of explaining it within the framework and method of formal logic. The elevation of the laws of formal logic to an absolute, and the exaggeration (...) of its role have led certain writers to deny the truth of Hegel's and Engels' statement. It was shown that no body can simultaneously be and not be in a given place, and that, in describing motion, one should, instead of employing this mode of expression, merely say that the body is shifting, and successively passes one point after another. This passage is motion as an objectively non-contradictory process. (shrink)
