A key question in comparative law is why different legal systems provide different legal solutions for the same problem. To answer this question, we use novel comparative evidence on how the conflict between the dispossessed original owner and the bona fide purchaser of a stolen good is resolved in different countries. This is the most primitive manifestation of a fundamental legal choice: the balance between the protection of the owner’s property rights and the enhancement of the buyer’s reliance on contracts. In this essay the authors provide arguments that teaching is an art and that teachers can learn much about their trade from a careful study of the performances of other artists. Artists and teachers have the same basic challenge: in order to be successful, both groups have to obtain and retain peoples’ attention. This also holds for popular music artists. Ten female student teachers specializing in the Pre-school and Foundation phases of schooling (four-to-six-year olds), and six lecturers from the Faculty (...) of Education at the University of the Free State, Bloemfontein, South Africa, participated in a workshop at a local game lodge. During the workshop, videos of ABBA songs and Mamma Mia! The Movie were analyzed and discussed. The theme of the workshop was “Being an Excellent Teacher: Appreciating ABBA.” The 4D-cycle of Appreciative Inquiry– Discover, Dream, Design and Destiny–was used as a methodological framework to identify numerous positive themes with possible classroom applications from the songs and the film. These themes were then connected to educational theory and embedded in the insights of Benny Andersson, Björn Ulvaeus, Judy Cramer and other people involved with ABBA. A reflective report by one student teacher about the impact the workshop had on her views of teaching and an excellent class that she presented is also included. (shrink)

Abstrak: Dalam tulisan ini penulis berusaha mencermati karya-karya dari almarhum Pater Robertus Hardawiryana, SJ (1926-2009), salah satu teolog Indonesia yang terkemuka segera seusai Konsili Vatikan II. Berdasarkan karya-karya beliau terakhir yang sudah diterbitkan, yakni Pentalogi, tetapi juga memanfaatkan beberapa manuskrip yang belum diterbitkan, penulis memusatkan diri pada pandangan Hardawiryana tentang metode berteologi sejauh tercermin dalam tulisan-tulisannya. Pada umumnya, pandangan Hardawiryana tentang metode bisa dilihat pada awal karangan-karangannya, di mana tampak bahwa dia sangat sadar akan pentingnya metode dalam berteologi. Dalam hal (...) ini Hardawiryana sejalan dengan arah-arah baru yang dibuka oleh Federasi Konferensi-konferensi Uskup Asia dalam pelbagai dokumennya. Meskipun demikian, sulit diharapkan suatu paparan teoretis yang menyeluruh dan sistematis tentang metode berteologi dari teolog ini, mengingat bahwa minat utamanya lebih tertuju pada pengupayaan suatu arah pastoral yang kuat pada tulisan-tulisan teologi, dan sebaliknya juga, pada pemberian dasar teologis yang kuat pada kebijakan-kebijakan pastoral. Selain itu, penulis juga memandang perlu untuk menilik sejenak pembentukan intelektual Hardawiryana agar lebih menolong untuk memahami kecenderungan-kecenderungannya kelak dalam berteologi. Robert Hardawiryana, S.J., (1926-2009), one of prominent Indonesian theologians in the wake of the Second Vatican Council. Based on this theologian’s latest published works, the Pentalogi, but also making use of some yet unpublished manuscripts, the author focuses on Hardawiryana’s view of theological method as reflected in his writings. In most cases, his view on method can be seen from the introduction he provides at the beginning of his articles, as he is highly aware of the importance of method in doing theology. In this way he concurs with the new trends opened up by the Federation of Asian Bishops’ Conference in its various documents. However, one can hardly expect a thorough and systematic theoretical exposition on theological method from this theologian, as his main interest lies elsewhere, namely, to bring a truly responsible pastoral thrust to theological writings, and vice versa, to provide sound theological foundation to pastoral policies. The author also considers that a glimpse at his intellectual formation would be of considerable help to understand Hardawiryana’s future leanings in theology. Abstrak: Kekerasan dalam Alkitab boleh dikatakan merupakan sebuah topik alkitabiah yang unik dan abadi, baik dari sudut pandang akademis maupun spiritual. Orang tidak hanya perlu memahaminya untuk orang lain, tetapi juga untuk diri sendiri. Sejak Marcion di abad pertama sampai saat ini, meskipun sudah amat banyak tulisan dihasilkan, tidak pernah ada suatu solusi yang memuaskan semua pihak. Tulisan ini menawarkan sudut pandang yang jarang disentuh, yaitu sudut pandang Gereja Katolik. Membaca Alkitab sebagai orang Katolik berarti membaca dengan memperhatikan juga ajaran-ajaran (...) Gereja tentang (pokok-pokok tertentu dari) Alkitab sebagaimana terungkap dalam dokumen-dokumen resmi Gereja. Ajaran Gereja khususnya Dei Verbum artikel 11 dan 12 memuat paling tidak pemahaman akan tiga hal yang dapat membuka kemungkinan untuk memahami persoalan ini secara lebih utuh. Pokok-pokok yang dimaksud adalah soal inspirasi, paham tentang Alkitab, dan kesatuan seluruh Alkitab sebagai kunci penafsiran Alkitab dalam Gereja. Pembacaan Alkitab secara menyeluruh menunjukkan bahwa klim kekerasan dalam Alkitab adalah sebuah klim sepihak yang tidak memperhatikan keseluruhan Alkitab sebagaimana dipahami dan di terima Gereja sebagai buku iman. Abstract: Violence in the Bible could be considered a unique eternal theme in the Bible, be it from academic or spiritual perspective. One needs to understand it not only for helping others, but also for himself. Since Marcion in the first century up to our time, there has been no solution which is acceptable and could satisfy everybody, notwithstanding the abundance literature on this topic. To read the Bible as Catholic means to read it employing the Church’s teachings on the Bible which are found in the official Church documents as the hermeneutical key. The teaching of the Church especially Dei Verbum 11 and 12 offers an understanding on three important points that could be useful for comprehending the topic in a more comprehensive way. Those three points are the notion of biblical inspiration, the Catholic understanding of the Bible and the unity of the Bible. They could be the key to a correct interpretation of the Bible within the Church. The holistic reading of the Bible shows that the claim of biblical violence is actually a one-sided claim that does not pay fair attention to the unity of the Bible as a whole as it is understood and accepted by the Church as the book of faith. This paper is a philosophical reflection on how the development of science and technology can be studied better through the tradition of Islamic philosophy. This is attempted because the approach that has been used to study science and technology in the Islamic world is still centered on the process of assimilation or Islamization of Knowledge. In a critical reading of the two approaches, the problems that arise from the study of contemporary science and technology become something that is difficult to (...) anticipate. In fact, the development of science and technology is also moving very fast. This raises the question of the need for alternative approaches in the study of contemporary science and technology in the arena of Islamic Philosophy. To solve this problem, the author conducted an initial experiment that could elaborate Irfani's approach on the one hand with studies of contemporary science and technology on the other. This becomes possible with the reinterpretation of the concept of emanation that exists in the discourse of Yazdiyah's Hudhuri Science. Based on this interpretation as well as the perspective that Mishbah Yazdi has made about the help of Irfan in philosophy, the application of the Irfani approach in the study of science and technology becomes possible as part of the practice of Hudhuri Science. On a more practical level, the author also uses this Irfani approach in a scenario format to read the vision of contemporary science and technology in the NBIC discourse. (shrink)

The great numbers of service industrial is moving in insurance field have made insurance salespeople’s job more difficult and full challenge. This condition makes that insurance salespeople ought to have self efficacy. Self efficacy is a confidance about self capability to run his job with success, also to control the conditions around for attaining the success. Self efficacy can be influenced by perception of transformational leadership style from direct superior. The subject of this research is 102 insurance salespeople in a (...) private life insurance company. Data gathering by questionnaires and analized by product moment correlation, and regression analysis to analized the dimensions. The result have proven that the hypothesis in this research is accepted, that there is a very significant positive relationship between perception of transformational leadership style from direct superior to insurance salespeople’s self efficacy (r = 0,473; p (two tailed) = 0,000 and p (one tailed) = 0,000). The relationship between each dimension in perception of transformational leadership style from direct superior to self efficacy is discussed in this research.  . (shrink)

The purpose of this research is figure out: (a) The student’s satisfaction to the services from the Academic Administration Bureau of University “X”, (b) The student’s perception on the services from the Academic Administration Bureau staffs of University “X” overally, (c) The student’s perception on the services from the Academic Administration Bureau staffs of University “X” based on the satisfaction of the students as customers. The participant of this research consists of 270 students of University “X” during the first half (...) of 2008. The sampling technique applied in this research is the non-probability sampling technique with convenience method. This is a non-experimental research consisting of two measuring variables, which are customer satisfaction and perception, by using SPSS version 15.0. The results acquired from this research reveal that customer tend to be unsatisfied to the services from the Academic Administration Bureau of University “X”, and they perceive that the staffs need to be trained, have no supervision while working, appear badly, behave unpatiently, and irresponsively serve the students. Observed from the effect of satisfaction that mostly influence the points of perception, the Academic Administration Bureau staffs are perceived to be poorly serve, unwillingly serve, uncheerfully serve, unpleasantly serve, and arrogantly serve the students. This study explored the effect of attitude towards entrepreneurship, need for achievement, risk-taking propensity, proactive personality, self-efficacy, opportunity recognition competency, entrepreneurship education, uncertainty avoidance, and entrepreneurial knowledge on entrepreneurial intention among university students in Malaysia. This quantitative study had adopted the cross-sectional design approach and involved 391 university students in Malaysia via the online survey. The study outcomes revealed that the NFA, PRP, and SLE significantly affect students’ attitudes towards entrepreneurship. Moreover, entrepreneurship education and UNA significantly affect ORC. Finally, ATE (...) has a positive and significant effect on ENIN among university students in Malaysia. As entrepreneurship offers an alternative career path for people seeking economic prosperity and addressing social issues, including unemployment, the government should formulate effective policies and regulations that support entrepreneurship activities. Universities and other institutions should play a pivotal role in providing the proper exposure via entrepreneurship education while honing the essential traits for a career in entrepreneurship. A crucial step in economic development is the depersonalization of business, which enables an enterprise to operate as a separate entity from its owners and managers. Until the emergence of a de iure depersonalization of business in the 19th century, business activities were eminently personal, with managing partners bearing unlimited liability. Roman law even restricted agency. Yet, the Roman legal system developed a form of de facto depersonalized business entity, where depersonalization was achieved by making the fulcrum of the business (...) a non-person: the slave. Although radically different from a legal perspective, this format exhibited all the distinctive features of modern corporations, thereby providing for a functional equivalent of the modern corporate form. The development of the de iure format was hindered by strong cultural, technological and institutional constraints. In contrast, slave-run businesses exhibited features that were largely compatible with these constraints and emerged along the path of least resistance to legal change. The end of slavery and the fall of the Roman Empire closed off this alternative path of legal evolution; consequently, the modern corporate form could only appear once these constraints had been overcome. Alasdair MacIntyre is considered one of the most prominent moral philosophers in the contemporary period. Nevertheless, some authors criticize his views on practical rationality as being relativistic. Though there have been authors who have defended MacIntyre through various arguments, none of these authors has referred to one of his later works, namely, Dependent Rational Animals: Why Human Beings Need the Virtues (DRA) for addressing the relativist challenge. The paper aims to fill this lacuna. Thus, the principal question to which the (...) paper responds is: Can the views discussed in DRA contribute toward addressing the relativist challenge raised against MacIntyre? Accordingly, through various arguments, the paper demonstrates that MacIntyre’s views on animal rationality, vulnerability, and dependence as well as those concerning the virtues of care and misericordia as discussed in DRA contribute their mite toward addressing the relativist challenge raised against him. Abstrak Alasdair MacIntyre merupakan salah satu pakar filsafat moral terkemuka di era kontemporer. Namun, beberapa pemikir menuduh konsepnya tentang rasionalitas praktis bersifat relativistis. Meski banyak penulis lain telah berusaha membela posisi MacIntyre, tidak satu pun dari mereka mendasarkan diri pada karya MacIntyre yang lebih mutakhir, y.i. Dependent Rational Animals: Why Human Beings Need the Virtues (DRA). Makalah ini berusaha untuk mengisi kekosongan tersebut. Maka, pertanyaan utama tulisan ini ialah apakah gagasan-gagasan yang dikembangkan MacIntyre di dalam DRA dapat dipakai untuk menghadapi tuduhan relativisme terhadapnya. How can law embrace -- in other words --the 'posthuman' condition -- a condition in which non-human forces such as climate change and Covid-19 signal the impossibility of clinging to the existing imaginaries of Western legal systems and international law? Readers have struggled to interpret an image from the end of Juvenal's fifth satire, a poem which focusses upon the poor hospitality shown to a dinner guest, Trebius, at the hands of his host, Virro. After repeatedly juxtaposing the luxurious food served to Virro with the scant fare served to Trebius, Juvenal describes the final course of thecena. He again contrasts the host's hyper-abundance with his guest's mere scraps (5.149–55):Virro sibi et reliquis Virronibus illa iubebitpoma dari, quorum solo pascaris odore,qualia (...) perpetuus Phaeacum autumnus habebat,credere quae possis subrepta sororibus Afris:tu scabie frueris mali, quod in aggere roditqui tegitur parma et galea, metuensque flagellidiscit ab hirsuta iaculum torquere capella.Virro will demand that he and the rest of his entourage receive these apples—though you'll dine on their smell alone—like those the endless autumn of the Phaeacians used to yield, which you could believe stolen away from the African sisters: you will enjoy the scab of an apple, which, on the Embankment, is gnawed by someone who is protected by a buckler and helm and who, fearing a whipping, learns to hurl a javelin from atop a shaggy goat.While the core contrast between the quality of each type of fare is clear, the concludingqui-clause is less intelligible. Child-centered education has become pervasive due to its emphasis on freedom, which is highly valued in modern society. This progressive approach has brought an inquiry into the teacher’s authority which is viewed as traditional and irrelevant for students today. This essay aims to step back and to explore the concept of the teacher’s ‘authority’ more deeply through Hannah Arendt’s writing entitled “The Crisis in Education”. It begins by analyzing what Arendt means by the ‘crisis’ in education, particularly in the American (...) context. Then, by departing from the progressive interpretation, I re-examine the concept of ‘authority’ and its relation to ‘freedom’, based on ancient Greek and Roman understandings. Drawing on these analyses, Arendt asserts that teachers play a significant role because they prepare students to love and care for the world (amor mundi). Nevertheless, I argue that a teacher’s authority must also include attention to the private realm that continues impacting students’ learning at schools. Only in this way are students genuinely prepared for their responsibility as political agents in our society. Abstrak Pendidikan yang berpusat pada anak menjadi kian populer karena sangat menekankan kebebasan, sesuatu yang sedemikian dijunjung tinggi oleh masyarakat modern. Pendekatan progresif ini membuat otoritas guru lantas dipertanyakan, karena dianggap terlalu tradisional dan tidak relevan lagi. Artikel ini ingin menelusuri konsep ‘otoritas’ guru secara lebih mendalam melalui tulisan filsuf Hannah Arendt yang berjudul “The Crisis in Education”. Pertama, akan diselidiki makna ‘krisis’ dalam konteks Pendidikan di USA. Kedua, sedikit menyimpang dari tafsiran progresif dan dengan menimba inspirasi dari pemahaman Yunani dan Romawi kuno, artikel ini hendak menilai kembali makna ‘otoritas’ dan relasinya dengan ‘kebebasan’. Ketiga, berdasarkan analisis makna ‘otoritas’ tersebut, Arendt menegaskan bahwa guru memainkan peran krusial karena merekalah yang menyiapkan siswa untuk mencintai dan peduli kepada dunia sekitarnya (amor mundi). Penulis berpendapat lebih lanjut bahwa otoritas guru harus memperhatikan dimensi privat yang sangat memengaruhi proses pembelajaran siswa di sekolah. Hanya dengan demikian siswa dapat sungguh siap untuk kemudian memikul tanggung jawab sebagai aktor-aktor politis dalam masyarakat. Sugirtharajah, seorang pakar biblika kelahiran Sri Lanka, yang mengajar di Universitas Birmingham, U.K., dan dikenal sebagai godfather penelitian pascakolonial dalam bidang Alkitab, menambahkan suatu karya inovatif lagi pada daftar tulisan-tulisannya yang sudah sangat mengesankan. Perhatiannya untuk suara penafsiran pinggiran sudah diketahui dari karyanya yang paling terkenal, Voices from the Margin (1991). Meskipun Alkitab berasal dari Asia, namun kebanyakan peneliti-an tentang Alkitab dan juga tentang pengaruhnya sepanjang sejarah, terfokus pada Eropa dan Amerika, dengan meminggirkan Asia. Itu mendorong S untuk mengadakan penelitian (...) tentang Alkitab di Asia, khusus-nya sejarah penerimaannya. Ia menyadari bahwa dampak Alkitab terhadap kebudayaan Asia minim bila dibandingkan dengan pengaruhnya atas kehidupan dan kebudayaan di Eropa. Itu menjadi sangat tampak dalam uraiannya tentang peran Alkitab dalam sastra Asia (bab 7) di mana kutipan, tokoh, dan cerita Alkitab jarang muncul, dan bila ada, lebih banyak dipakai sebagai kritik terhadap kolonialisme Barat atau institusi kekristenan.... S mengakhiri tulisannya dengan menegaskan bahwa prinsip sola scriptura, Alkitab saja, tak punya pasar di Asia yang cenderung membaca Alkitab bersama dengan yang lain, Bhagavad Gita, Dhammapada, Analecta (mengapa di sini Alquran tak disebut S?). Hermeneutika Asia yang diselidiki oleh S, menolak kecenderungan kolonial yang ada baik dalam Alkitab sendiri dan lebih lagi dalam interpretasi kekristenan Barat: Kebudayaan dan masyarakat Asia tidak bergantung pada nilai-nilai kristiani untuk pemerintahan dan pengembangan yang baik.... Di Asia Alkitab adalah salah satu di antara banyak teks yang berwenang (hlm. 259). Tugas kita, menurut S, adalah membebaskan Asia dari klaim monopolistis kitab suci tertentu. Tugas ini mendesak di saat para fundamentalis dari semua agama memakai kitab sucinya untuk membenarkan kekerasannya terhadap yang lain. S bahkan mempertanyakan monoteisme yang dapat menekan perbedaan dan mengabaikan kemungkinan pusat-pusat yang banyak (p. 260). Ia tidak menganjurkan untuk kembali kepada penyembahan banyak dewa-dewi tetapi men-dorong kajian terhadap spirit politeistis yang mendorong toleransi, kemurahan hati, dan koeksistensi. Pembaca tentu bertanya: di mana sesungguhnya posisi S di medan diskusi pluralisme dan inklusivisme, berkaitan dengan cara dialog antaraagama, dan ditantang untuk memikirkan posisinya sendiri. S mengakui bahwa banyak hal mengenai Alkitab di Asia masih perlu diselidiki. Lima belas abad pra-kolonial dibicarakan dalam dua halaman saja. Alkitab yang oleh gereja Nestorian tanpa kekuatan apa pun disebarkan ke India, Sumatra, dan China cuma dihormati tetapi tinggal tidak diterjemahkan selama belasan abad; kabarnya hanya diketahui melalui liturgi. Ada pula kesan bahwa Asia dalam karya S terutama Asia Selatan dan Asia Timur. Asia Tengah (bekas bagian-bagian USSR) memang dari awal tidak dimasukkan dalam penelitiannya, tetapi juga Asia Barat Daya dan Asia Tenggara yang multi-agama hampir tidak disentuh. S mungkin tidak mengetahui beberapa penelitian tentang penerimaan Alkitab di Indonesia yang sudah dipublikasikan oleh Lembaga Alkitab Indonesia. Namun demikian, apa yang disajikan sungguh menarik dan penting, serta membuka mata dan jalan bagi penelitian yang lebih luas. The theory is used to illuminate three major problems in the drafting and the interpretation of criminal codes: 1) what the voluntary act requirement both does and should require; 2) (...) what complex descriptions of actions prohibited by criminal codes both do and should require ; and 3) when two actions are 'the same' for purposes of assessing whether multiple prosecutions and multiple punishments are warranted. The book both contributes to the development of a coherent theory of action in philosophy, and it provides both legislators and judges a grounding in three of the most basic elements of criminal liability. In this short, dense essay, Jean Cavaillès evaluates philosophical efforts to determine the origin - logical or ontological - of scientific thought, arguing that, rather than seeking to found science in original intentional acts, a priori meanings, or foundational logical relations, any adequate theory must involve a history of the concept. Cavaillès insists on a historical epistemology that is conceptual rather than phenomenological, and a logic that is dialectical rather than transcendental. His famous call (cited by Foucault) to abandon "a (...) philosophy of consciousness" for "a philosophy of the concept" was crucial in displacing the focus of philosophical enquiry from aprioristic foundations toward structural historical shifts in the conceptual fabric. This new translation of Cavaillès's final work, written in 1942 during his imprisonment for Resistance activities, presents an opportunity to reencounter an original and lucid thinker. Cavaillès's subtle adjudication between positivistic claims that science has no need of philosophy, and philosophers' obstinate disregard for actual scientific events, speaks to a dilemma that remains pertinent for us today. His affirmation of the authority of scientific thinking combined with his commitment to conceptual creation yields a radical defense of the freedom of thought and the possibility of the new.
