I want to examine the Habermasian account of modernity from a particular vantage-point: namely the collection of new technologies that are called variously “artificial intelligence,” “knowledge engineering,” “intelligent systems,” “expert systems,” and the like. The significance of these technologies far exceeds whatever role they may come to play in business, government, or the other institutions they penetrate. I suggest that they cast doubt over the entire project of modernity as understood by Habermas — not because they signify the penetration of (...) the lifeworld by instrumental rationality, but because they demonstrate the extent to which the formation of the lifeworld itself has simply moved beyond the problematic of autonomy and communicative rationality elaborated by Habermas. Delaware case law has rendered the tender offer obsolete as a method for purchasing a company whose directors oppose the acquisition. A potential acquirer facing target opposition today must run an insurgent director slate, in the expectation that its directors are more likely to sell. The Delaware courts have not justified their preference for elections over markets as the preferred vehicle for implementing changes in control. Informal scholarly analyses ask transaction cost questions, such as whether proxy contests are more costly (...) than takeovers. This article attempts to break new ground by asking whether there are systematic differences in the performance of elections and markets in the corporate context. Recent models of voting processes, we argue, strongly suggest that elections are inferior to markets. Proxy contest elections sometimes can be won by incumbent managements when a transfer of control would be efficient, a conclusion consistent with the sparse data; and the proxy election process aggregates information regarding the sale decision less well than markets do, thereby implying that proxy voters are less well-informed. Theory and data thus suggest, at the least, that the intellectual burden of proof should change: the task now is to justify using elections to transfer control despite their apparent deficiencies. The article briefly considers the policy implications of this change in perspective. (shrink)

This paper examines the relationship between organizational ethical culture in two large international CPA firms, auditors'' personal values and the ethical orientation that those values dictate, and judgments in ethical dilemmas typical of those that accountants face. Using an experimental task consisting of multiple judgments designed to vary in "moral intensity" (Jones, 1991), and unique as well as tried-and-true approaches to variable measurements, this study examined the judgments of more than three hundred participants in our study. ANCOVA and path analysis (...) results indicate that: (1) Ethical judgments in situations of high moral intensity are affected by personal values and by environmental variables, such as the professional code of conduct (direct and indirect effects) and previous ethics instruction (direct effect only). (2) Corporate ethical culture, and a relatively strong firm rules-orientation, affect auditors'' idealism but not relativism, and therefore indirectly affect ethical judgments. Jones'' (1991) moral intensity argument is supported: differences in the characteristics of specific judgment tasks apparently result in different decision processes. (shrink)

Language sample analysis is an important practice for providing a culturally sensitive and accurate assessment of a child's language abilities. A child's usage of literate language devices in narrative samples has been shown to be a critical target for evaluation. While automated scoring systems have begun to appear in the field, no such system exists for conducting progress-monitoring on literate language usage within narratives. The current study aimed to develop a hard-coded scoring system called the Literate Language Use in Narrative (...) Assessment, to automatically evaluate six aspects of literate language in non-coded narrative transcripts. LLUNA was designed to individually score six literate language elements. The interrater reliability of LLUNA with an expert scorer, as well as its' reliability compared to certified undergraduate scorers was calculated using a quadratic weighted kappa. Results indicated that LLUNA met strong levels of interrater reliability with an expert scorer on all six elements. LLUNA also surpassed the reliability levels of certified, but non-expert scorers on four of the six elements and came close to matching reliability levels on the remaining two. LLUNA shows promise as means for automating the scoring of literate language in LSA and narrative samples for the purpose of assessment and progress-monitoring. (shrink)

The six questions involve: 1) the nature of a mental disorder; 2) the definition of mental disorder; 3) the issue of whether, in the current state of psychiatric science, DSM-5 should assume a cautious, conservative posture or an assertive, transformative posture; 4) the role (...) of pragmatic considerations in the construction of DSM-5; 5) the issue of utility of the DSM - whether DSM-III and IV have been designed more for clinicians or researchers, and how this conflict should be dealt with in the new manual; and 6) the possibility and advisability, given all the problems with DSM-III and IV, of designing a different diagnostic system. Part I of this article took up the first two questions. Part II will take up the second two questions. Question 3 deals with the question as to whether DSM-V should assume a conservative or assertive posture in making changes from DSM-IV. That question in turn breaks down into discussion of diagnoses that depend on, and aim toward, empirical, scientific validation, and diagnoses that are more value-laden and less amenable to scientific validation. Question 4 takes up the role of pragmatic consideration in a psychiatric nosology, whether the purely empirical considerations need to be tempered by considerations of practical consequence. This essay has three aims. We wish to emphasize that (1) one of the main theses of Jaspers’ General Psychopathology is that our knowledge is limited to particular points of view within which alone evidence can be interpreted and assessed; (2) this early position of Jaspers (already present in the 1913 edition) has found indirect support recently in a carefully reasoned book by the prestigious philosopher of natural science, Ronald N. Giere, entitled Scientific Perspectivism (2006); and (3) Jaspers’ conviction (...) regarding the perspectivalism of knowledge remained powerfully influential throughout all his thought, even in his later philosophy. In the conclusion to this multi-part article I first review the discussions carried out around the six essential questions in psychiatric diagnosis – the position taken by Allen Frances on each question, the commentaries on the respective question along with Frances’ responses to the commentaries, and my own view of the multiple discussions. In this review I emphasize that the core question is the first – what is the nature of psychiatric illness – and that in some manner all further (...) questions follow from the first. Following this review I attempt to move the discussion forward, addressing the first question from the perspectives of natural kind analysis and complexity analysis. This reflection leads toward a view of psychiatric disorders – and future nosologies – as far more complex and uncertain than we have imagined. (shrink)

Some commentators worry that a plurinational constitutional order can only ever be an inherently unstable modus vivendi. They fear that the accommodation of sub-state nationalism will tend to undermine the viability of constitutional democracies. This article enlists Ronald Dworkin's theory of ‘law as integrity’ to show how these concerns might be assuaged. My central claim is that the expressive value of integrity can drive a divided society in the direction of an eventual community of principle, even in the absence (...) of a common political identity. I argue that this model of political community is a more plausible prescription for divided societies than the theory that competing nationalisms might be superseded by constitutional patriotism. I go on to explain, however, that integrity has a better chance of realizing this potential if the generally judge-centric focus of Dworkin's theory is expanded to make greater room for non-judicial interpretative responsibility. Occasional references are made to the example of Northern Ireland to illustrate my points. (shrink)

Using the Schwarzschild calculation of the Relativistic bending of starlight near the sun as an illustration, it is shown that the relationship between theory and data requires a hierarchy of structures of different logical type. An essential feature of this hierarchy is the use of idealizations and approximate truths. On the basis of a counterfactual analysis of these concepts, it is shown that confirmation is possible even though statistical measures of goodness of fit are not satisfied. The consequences of this (...) view of confirmation and hierarchical structure for scientific realism are then considered. (shrink)

From the perspective of cognitive science, it is illuminating to think of much contemporary scientific research as taking place in distributed cognitive systems. This is particularly true of large-scale experimental and observational systems such as the Hubble Telescope. Clark, Hutchins, Knorr-Cetina, and Latour insist or imply such a move requires expanding our notions of knowledge, mind, and even consciousness. Whether this is correct seems to me not a straightforward factual question. Rather, the issue seems to be how best to develop (...) a theoretical understanding of such systems appropriate to the study of science and technology. I argue that there is no need to attribute to such systems as a whole any form of cognitive agency. We can well understand the importance of such systems while restricting agency to the human components. The implication is that we think of these large-scale distributed cognitive systems not so much as unified wholes, but as hybrid systems including both physical artifacts and ordinary humans. In this paper, I will develop a nontrivial interpretation of Feyerabend's concept of a hidden anomalous fact. Feyerabend's claim is that some anomalous facts will remain hidden in the absence of alternatives to the theories to be tested. The case of Brownian motion is given by Feyerabend to support this claim. The essential scientific difficulty in this case was the justification of correct and relevant descriptions of Brownian motion. These descriptions could not be simply determined from the available observational data. (...) An examination, however, of this case shows that no alternative theory is or historically was thought to be necessary in order to justify descriptions of Brownian motion that "directly" refute thermodynamics. While Feyerabend's appraisal of this case therefore is incorrect, a sense is developed in which successful alternatives lend inductive support to the correctness of refuting experimental descriptions. Crucial though to the explanation of this support is the notion of arguments that show the possibilities for improving experimental fit. (shrink)

Cultural group selection seems the only compelling explanation for the evolution of the uniquely human form of cooperation by large teams of unrelated individuals. Inspired by descriptions of sanctioning in mutualistic interactions between members of different species, I propose partner choice by powerful individuals or institutions as an alternative explanation for the evolution of behavior typical for “team players.” (Published Online April 27 2007).

These comments seek to take issue with the contention that society has a responsibility to provide its members with any needed health care. In order to deal with this claim, we must first make clear exactly what it meant by the proposition. I take it that those who embrace this view mean considerably more than that each of us has a moral obligation to contribute to those in need of medical attention who are unable, for one reason or another, to (...) afford the necessary care. This is a moral proposition and is traditionally dealt with under the heading of charity. But the contention, as here used, means considerably more since its main implications are not moral but primarily political. (shrink)

The similarity of documents in a large database of published Fractals articles was examined for redundancy. Three different text matching techniques were used on published Abstracts to identify redundancy candidates, and predictions were verified by reading full text versions of the redundancy candidate articles. A small fraction of the total articles in the database was judged to be redundant. This was viewed as a lower limit, because it excluded cases where the concepts remained the same, but the text was altered (...) substantially. Far more pervasive than redundant publications were publications that did not violate the letter of redundancy but rather violated the spirit of redundancy. There appeared to be widespread publication maximization strategies. Studies that resulted in one comprehensive paper decades ago now result in multiple papers that focus on one major problem, but are differentiated by parameter ranges, or other stratifying variables. This ‘paper inflation’ is due in large part to the increasing use of metrics (publications, patents, citations, etc) to evaluate research performance, and the researchers’ motivation to maximize the metrics. Using the emerging technology of large-scale textual analysis, this study examines the use of the term ‘customer satisfaction’ and its variants in the annual reports issued by publicly traded U.S. corporations and filed with the Securities and Exchange Commission as Form 10-K. We document the frequency of the term’s occurrence in 10-Ks over the 1995–2013 period and the differences in usage across industries. We then relate the term’s usage in 10-Ks to subsequent scores from the American Customer Satisfaction Index to (...) determine whether management’s discussion of customer satisfaction in financial disclosures is credible. The commitment of management to shareholders versus, more broadly, stakeholders is a central question in business ethics, and the integrity of management communication is a fundamental construct in the American Marketing Association’s Statement of Ethics. We document a complex relation between management’s discussion of customer satisfaction and subsequently reported satisfaction. We find that the general use of customer satisfaction in 10-K documents is negatively correlated with subsequent ACSI scores. However, for retail firms, when the phrase is located near words indicating measurement or monitoring of the phenomenon, the empirical relation is reversed and becomes positive. (shrink)
