This book represents emerging alternative perspectives to the "constructivist" orthodoxy that currently dominates the field of science and technology studies. As this threefold foundation makes clear, Levering draws together both "historical and theological reasons for believing that Jesus' Resurrection happened" (4).In chapter 1, Levering contends that, while "faith does not stand or fall upon the results of historical research, those who insist that the truth of Jesus' Resurrection has nothing to do with the domain of historical investigation are mistaken" (30). To this end, he offers a survey of three figures: (1) the Belgian Dominican theologian Edward Schillebeeckx; (2) the American Protestant biblical scholar Dale C. Allison Jr.; and (3) the Anglican bishop and biblical theologian N. T. Wright. Levering exposes the serious flaws of contemporary attempts to reduce the resurrection claims of early Christians to hallucinations or visions of someone who has recently died. In particular, Levering finds compelling Wright's argument that the bodily resurrection of Jesus provides "the best historical explanation" of the early Christian claim that what first-century Jews expected to happen to everyone at the end of time had in fact happened to only one person—Jesus of Nazareth—in the middle of time. From a strictly historical point of view, claims that the disciples were merely moved by grace to a new experience Jesus being "alive" or that they simply experienced hallucinatory visions of Jesus after his death fail to explain the "radical change of eschatology" that took place in the early Church (56).In chapter 2, Levering explores the question of whether "the Church's mediation is truly effective in enabling us to share in the apostolic communion with the risen Jesus" (63). He first offers a sympathetic overview of the Protestant biblical scholar Richard Bauckham's book Jesus and the Eyewitnesses (2003; 2nd ed., 2017), in which he claims that the Gospels rest largely on "eyewitness testimony" (87–88). According to Levering, Bauckham's historical arguments show that "the ongoing presence of eyewitnesses provides a reason for not being skeptical about the major events of Jesus' life as reported by the Gospels, including his Resurrection" (89). For a Better Worldliness is not only a statement of Abraham Kuyper's and Dietrich Bonhoeffer's theological concept and historical practice of discipleship. It is also--and perhaps more importantly--a call to engage in the fullness of the Christian life here and now. While this book goes to great efforts to establish sound historical and theological insights specifically in regards to Kuyper and Bonhoeffer, there is a strong underlying current that these particular insights deeply matter to the life of discipleship in the (...) world today. History shows us that discipleship is not a singular journey; because of Jesus Christ it is not a description of one set path with one set of guidelines. A disciple can be a prime minister who unabashedly and successfully campaigned on his Calvinistic principles, just as he can be a participant in a coup d'état launched against a tyrant, leading to the disciple's own imprisonment and death. Purpose The developing academic field of machine ethics seeks to make artificial agents safer as they become more pervasive throughout society. In contrast to computer ethics, machine ethics is concerned with the behavior of machines toward human users and other machines. This study aims to use an action-based ethical theory founded on the combinational aspects of deontological and teleological theories of ethics in the construction of an artificial moral agent. Design/methodology/approach The decision results derived by the AMA are acquired via (...) fuzzy logic interpretation of the relative values of the steady-state simulations of the corresponding rule-based fuzzy cognitive map. Findings Through the use of RBFCMs, the following paper illustrates the possibility of incorporating ethical components into machines, where latent semantic analysis and RBFCMs can be used to model dynamic and complex situations, and to provide abilities in acquiring causal knowledge. Research limitations/implications This approach is especially appropriate for data-poor and uncertain situations common in ethics. Nonetheless, to ensure that a machine with an ethical component can function autonomously in the world, research in artificial intelligence will need to further investigate the representation and determination of ethical principles, the incorporation of these ethical principles into a system’s decision procedure, ethical decision-making with incomplete and uncertain knowledge, the explanation for decisions made using ethical principles and the evaluation of systems that act based upon ethical principles. Practical implications To date, the conducted research has contributed to a theoretical foundation for machine ethics through exploration of the rationale and the feasibility of adding an ethical dimension to machines. Further, the constructed AMA illustrates the possibility of utilizing an action-based ethical theory that provides guidance in ethical decision-making according to the precepts of its respective duties. The use of LSA illustrates their powerful capabilities in understanding text and their potential application as information retrieval systems in AMAs. The use of cognitive maps provides an approach and a decision procedure for resolving conflicts between different duties. Originality/value This paper suggests that cognitive maps could be used in AMAs as tools for meta-analysis, where comparisons regarding multiple ethical principles and duties can be examined and considered. With cognitive mapping, complex and abstract variables that cannot easily be measured but are important to decision-making can be modeled. This approach is especially appropriate for data-poor and uncertain situations common in ethics. (shrink)

Seventeen years before Kant published The Critique of Pure Reason, there appeared another work designed to undercut Hume’s skepticism and the principles upon which that skepticism was based—Thomas Reid’s Inquiry into the Human Mind on the Principles of Common Sense. In this ambitious work, Reid hoped to show, against Hume, that there need be no quarrel between common sense and philosophical inquiry. “Philosophy,” proclaimed Reid, “has no other roots but the principles of Common Sense; it grows out of them, and (...) draws its nourishment from them.” Reid’s self-imposed task was thus two-fold—to expose the errors in philosophical method which had inexorably culminated in Hume’s phenomenalistic atomism, and correlatively to provide a more adequate metaphysical scheme which could avoid the pitfalls of skepticism while doing justice to our ordinary beliefs about the world. On receiver-based teleosemantic theories of representation, the chemical states of the circadian clocks in animal, plant and cyanobacterial cells constitute signals of future states of affairs, often the rising and setting of the sun. This signalling is much more rigid than sophisticated representational systems like human language, but it is not simple on all dimensions. In most organisms the clock regulates many different circadian rhythms. The process of entrainment ensures that the mapping between chemical states of the clock and the (...) daily light-dark cycle is adjusted to deal with seasonal changes. In regulating anticipatory behaviour, the states of the clock look forward both to the time the behaviour is supposed to happen and the later time when the anticipated circumstances are supposed to arise. The case of the circadian clock shows that purely indicative signals can arise in very basic biological systems and brings into sharp relief the trade-offs involved in characterizing representational systems. On receiver-based teleosemantic theories, future-directed signals are not restricted to complex multicellular organisms but are ubiquitous in the biological world. (shrink)

After the completion of the topological manuscript edition in section IX of the Kritische Gesamtausgabe der Werke (KGW IX), the additional chronological indexing of the late Nachlass remained a desideratum. The current manuscript closes this editorial gap. As an appendix to KGW IX, the chronology of the manuscripts 1885–89 provides the date for each distinguishable layer of inscription for every manuscript and note edited in KGW IX. In the first part of (...) the following chronology, the dated inscription layers for all late manuscripts from notebook N VII 1 to the scattered notes are recorded topologically. Since the election of Philippine President Rodrigo Duterte in 2016, extra-judicial killings have become commonplace as a result of his administration’s declaration of war on drugs. Empirical cross-national work on examining determinants behind state repression remains scant especially in understanding the phenomenon at the sub-national level. This study investigates what accounts for variations on EJKs at the level of Philippine provinces. Using monthly panel-data for 62 provinces and employing various count-model regressions, the findings indicate that Philippine provinces which have large (...) populations, stronger state capacity, and are more affluent in terms of the human development index are more likely to exhibit higher rates of EJKs. Furthermore, the vote share of the President in the 2016 elections and presidential visits to specific provinces are correlated with higher incidences of EJKs—corroborating theories on delegative democracies and penal populism. Lastly, it is found that drug-prone provinces are more likely to experience a higher share of human rights violations in terms of EJKs, compared to provinces that have lower affectation rates. The implications suggest that the Philippine war on drugs seem to promote vertical accountability as international criticism and domestic opposition mounts. (shrink)

This article is the first attempt to justify the "next" milestone in the development of legal realism: hyperrealism. The implications of digitalization have become the new fuel for the legal realist's jurisprudence prediction theory, that is, empirical research to predict the judge's or the court's decision. Indeed, that was impossible for American realists in the early twentieth century, and all the attempts failed. Therefore, tools such as Judicial Analytics allow us to prove that personal motives and prejudices affect a dispute's (...) resolution. Based on a systemic, comparative, and interdisciplinary analysis that intermingles legal theory, data analytics and digital technologies, the article substantiates the concept of hyperrealism itself. It evaluates the advantages and disadvantages of its primary tool—judicial analytics. The authors state the necessity of creating regulatory mechanisms of "curbing" to use them to improve justice and minimize the risk of rights violations. They propose using tools of expert evaluation, standardization, and ethical regulation of forensic analysis. (shrink)

Requiring covariance of Maxwell's equations without a priori imposing charge invariance allows for both spin-1 and spin-1/2 transformations of the complete Maxwell field and current. The spin-1/2 case yields new transformation rules, with new invariants, for all traditional Maxwell field and source quantities. The accompanying spin-1/2 representations of the Lorentz group employ the Minkowski metric, and consequently the primary spin-1/2 Maxwell invariants are also spin-1 invariants; for example, Φ2−A2, E2−B2+2iE⋅B−2. The associated Maxwell Lagrangian density is also the same for both (...) spin-1 and spin-1/2 fields. However, in the spin-1/2 case, standard field and source quantities are complex and both charge and gauge invariance are lost. Requiring the potentials to satisfy the Klein–Gordon equation equates the Maxwell and field-potential equations with two Dirac equations of the Klein–Gordon mass, and thus one complex Klein–Gordon Maxwell field describes either two real vector fields or two Dirac fields, all of the same mass. The increasing use of digital technologies in judicial and arbitration proceedings increases the usage of digital evidence by the parties, which brings the necessity of creating patterns for adjudicators to admit and assess this new type of evidence. This paper generally addresses digital evidence focusing on the second moment in international arbitration proceedings. It also narrows the topic to hacked and leaked evidence and its admissibility in international arbitration. The literature review showed a significant amount of research devoted to the (...) evidence in arbitration. Some considered electronic evidence within one jurisdiction; others focused on certain forms of digital evidence such as electronic signatures. Papers on digital evidence in international arbitration approach arbitration rules for digital evidence but skip admissibility issues. No systemic and complex works research digital evidence in arbitration, explicitly focusing on the admissibility of hacked and leaked digital evidence from a comparative perspective. Also, no research deals with enforcing international arbitration awards relying on illegally obtained digital evidence. In these cases, there could be a possible violation of domestic public policy under the New York Convention terms (art. V, 2, b). That is why the paper aims to offer the concept of digital evidence in international arbitration, including hacked and leaked evidence, criteria of its admissibility and relevance, and design the arbitration guidelines for assessing hacked and leaked evidence. Comparative legal analysis of the international arbitration rules and national procedure law allowed us to compare the regulatory approaches to the definition of digital evidence and its admissibility worldwide. The method of legal modeling allowed designing model guidelines for arbitral tribunals to evaluate the admissibility and relevance of digital evidence, including hacked and leaked evidence. Moreover, the case study method allowed us to analyze jurisprudence and define criteria for admission of hacked and leaked evidence. We conclude that the admissibility of hacked and leaked evidence depends solely on the arbitrator’s broad discretion to assess the evidence. Nevertheless, thorough evidence analysis and a well-reasoned award are always mandatory. (shrink)

Legal decision-support systems have the potential to improve access to justice, administrative efficiency, and judicial consistency, but broad adoption of such systems is contingent on development of technologies with low knowledge-engineering, validation, and maintenance costs. This paper describes two approaches to an important form of legal decision support—explainable outcome prediction—that obviate both annotation of an entire decision corpus and manual processing of new cases. The first approach, which uses an attention network for prediction and attention weights to highlight salient case (...) text, was shown to be capable of predicting decisions, but attention-weight-based text highlighting did not demonstrably improve human decision speed or accuracy in an evaluation with 61 human subjects. The second approach, termed semi-supervised case annotation for legal explanations, exploits structural and semantic regularities in case corpora to identify textual patterns that have both predictable relationships to case decisions and explanatory value. One of the major values of animal ethical theory can be found in the light it sheds on practical ethical problems involving animals. McCulloch and Reiss’ paper does precisely this regarding the culling of badgers in England to limit the spread of tuberculosis. Perspicaciously realizing that societal ethics represents a combination of utilitarian and rights-based theorizing, the authors apply both of these perspectives to the issue, noting that both theoretical approaches generate a rejection of culling in the presence of other (...) viable alternatives. In addition, the authors suggest and defend the use of an Animal Welfare Impact Assessment tool to assess the impact of various management approaches on the animals, and demonstrate its congruence with both the ethical theories considered, and with societal moral attitudes. In this way, they show that their conclusion is directly compatible with the societal ethic, in my view a major prerequisite for effecting social change. (shrink)

Logic-based approaches to legal problem solving model the rule-governed nature of legal argumentation, justification, and other legal discourse but suffer from two key obstacles: the absence of efficient, scalable techniques for creating authoritative representations of legal texts as logical expressions; and the difficulty of evaluating legal terms and concepts in terms of the language of ordinary discourse. Data-centric techniques can be used to finesse the challenges of formalizing legal rules and matching legal predicates with the language of ordinary parlance by (...) exploiting knowledge latent in legal corpora. However, these techniques typically are opaque and unable to support the rule-governed discourse needed for persuasive argumentation and justification. This paper distinguishes representative legal tasks to which each approach appears to be particularly well suited and proposes a hybrid model that exploits the complementarity of each. (shrink)

This paper proposes a model ofratio decidendi as a justification structure consisting of a series of reasoning steps, some of which relate abstract predicates to other abstract predicates and some of which relate abstract predicates to specific facts. This model satisfies an important set of characteristics ofratio decidendi identified from the jurisprudential literature. In particular, the model shows how the theory under which a case is decided controls its precedential effect.
