It is almost 30 years since the sociobiology controversy burst into full bloom. The modern theory of the evolution of animal behavior was born in the mid 1960’s with Bill Hamilton’s seminal papers on inclusive fitness and George William’s book Adaptation and Natural Selection. The following decade saw an avalanche of important ideas on the evolution of sex ratio, animal conflicts, parental investment, and reciprocity, setting off a revolution our understanding of animal societies, a revolution that is still going on (...) today. By the mid-1970’s, Richard Alexander, E. O. Wilson, Napoleon Chagnon, Bill Irons, and Don Symons among others began applying these ideas to understand human behavior. Humans are evolved creatures, and quite plausibly the same evolutionary forces that shaped the behavior of other animals also molded our behavior. Moreover, the new theory of animal behavior—especially, kin selection, parental investment, and optimal foraging theory—seemed fit the data on human societies fairly well. (shrink)

Virtually every aspect of the current philosophical discussion of self-deception is a matter of controversy including its definition and paradigmatic cases. We may say generally, however, that self-deception is the acquisition and maintenance of a belief (or, at least, the avowal of that belief) in the face of strong evidence to the contrary motivated by desires or emotions favoring the acquisition and retention of that belief. Beyond this, philosophers divide over whether this action is intentional or not, whether self-deceivers recognize (...) the belief being acquired is unwarranted on the available evidence, whether self-deceivers are morally responsible for their self-deception, and whether self-deception is morally problematic (and if it is in what ways and under what circumstances). The discussion of self-deception and its associated puzzles gives us insight into the ways in which motivation affects belief acquisition and retention. And yet insofar as self-deception represents an obstacle to self-knowledge, which has potentially serious moral implications, self-deception is more than an interesting philosophical puzzle. It is a problem of particular concern for moral development, since self-deception can make us strangers to ourselves and blind to our own moral failings. (shrink)

Medical ethics, principles, persons, and perspectives is discussed under three headings: History, Theory, and Practice. Under Theory, the author will say something about some different approaches to the study and discussion of ethical issues in medicine—especially those based on principles, persons, or perspectives. Under Practice, the author will discuss how one perspectives based approach, hermeneutics, might help in relation first to everyday ethical issues and then to public controversies. In that context some possible advantages of moving from controversy to conversation (...) will be explored; and that will then be illustrated with reference to a current controversy about the use of human embryos in stem cell therapy research. It is widely acknowledged that individual moral obligations and responsibility entail shared (or joint) moral obligations and responsibility. However, whether individual epistemic obligations and responsibility entail shared epistemic obligations and responsibility is rarely discussed. Instead, most discussions of doxastic responsibility focus on individuals considered in isolation. In contrast to this standard approach, I maintain that focusing exclusively on individuals in isolation leads to a profoundly incomplete picture of what we're epistemically obligated to do and when we deserve epistemic blame. First, (...) I argue that we have epistemic obligations to perform actions of the sort that can be performed in conjunction with other people, and that consequently, we are often jointly blameworthy when we violate shared epistemic obligations. Second, I argue that shared responsibility is especially important to doxastic responsibility thanks to the fact that we don't have the same kind of direct control over our beliefs that we have over our actions. In particular, I argue that there are many cases in which a particular individual who holds some problematic belief only deserves epistemic blame in virtue of belonging to a group all the members of which are jointly blameworthy for violating some shared epistemic obligation. Thanks to the advent of social media, large numbers of Americans believe outlandish falsehoods that have been widely debunked. Many of us have a tendency to fault the individuals who hold such beliefs. We naturally assume that the individuals who form and maintain such beliefs do so in virtue of having violated some epistemic obligation: perhaps they failed to scrutinize their sources, or failed to seek out the available competing evidence. I maintain that very many ordinary individuals who acquire outlandish (...) false beliefs thanks to their use of popular social media platforms (and other similar internet technologies) deserve little or no blame for believing these falsehoods. Such individuals would be fully blameworthy only if they had formed or maintained the relevant beliefs partly in virtue of violating some epistemic obligation and had no excuse for violating that obligation. However, the nature of these internet technologies provides excuses for violating the relevant epistemic obligations, and so individuals are excused for holding the resulting false beliefs. (shrink)

Very often when the vast majority of experts agree on some scientific issue, laypeople nonetheless regularly consume articles, videos, lectures, etc., the principal claims of which are inconsistent with the expert consensus. Moreover, it is standardly assumed that it is entirely appropriate, and perhaps even obligatory, for laypeople to consume such anti-consensus material. I maintain that this standard assumption gets things backwards. Each of us is particularly vulnerable to false claims when we are not experts on some topic – such (...) falsehoods have systematic negative impacts on our doxastic attitudes that we can neither prevent nor correct. So, when there is clear expert consensus on a given scientific issue, while it is permissible for experts to consume anti-consensus material, laypeople have an epistemic obligation to avoid such material. This argument has important consequences for philosophical discussions of our epistemic obligations to perform or omit belief-influencing actions. Such discussions typically abstract away from the important differences between experts and laypeople. Accordingly, we should reject this typical practice as problematic, and insist instead that laypeople and experts have fundamentally different epistemic obligations. (shrink)

It is well-known that naïve realism has difficulty accommodating perceptual error. Recent discussion of the issue has focused on whether the naïve realist can accommodate hallucination by adopting disjunctivism. However, illusions are more difficult for the naïve realist to explain precisely because the disjunctivist solution is not available. I discuss what I take to be the two most plausible accounts of illusion available to the naïve realist. The first claims that illusions are cases in which you are prevented from perceiving (...) properties you would ordinarily perceive and subsequently form a mistaken judgment about the perceived object. The second appeals to an unusual look or appearance that the perceived object instantiates. I argue that neither account is satisfactory and that, consequently, naïve realism ought to be rejected. The Data Protection Act 1998 presents a number of significant challenges to data controllers in the health sector. To assist data controllers in understanding their obligations under the act, the Information Commissioner has published guidance, The Use and Disclosure of Health Data, which is reproduced here. The guidance deals, among other things, with the steps that must be taken to obtain patient data fairly, the implied requirements of the act to use anonymised or psuedonymised data where possible, an exemption applicable (...) principally to records based research, the right of patients to object to the processing of their data, and the interface of the act and the common law duty of confidence. When you have a perceptual experience of a given physical object that object seems to be immediately present to you in a way it never does when you consciously think about or imagine it. Many philosophers have claimed that naïve realism (the view that to perceive is to stand in a primitive relation of acquaintance to the world) can provide a satisfying account of this phenomenological directness of perceptual experience while the content view (the view that to perceive is to (...) represent the world to be a certain way) cannot. I argue that this claim is false. Specifically, I maintain that the only acceptable naïve realist account of the relevant phenomenology is circular and that the content view can provide a similar account. In addition, I maintain that a certain specific variety of the content view provides a non-circular and thus more satisfactory account of this phenomenology. If so, then contrary to what is commonly assumed there are powerful phenomenological grounds for preferring the content view to naïve realism. (shrink)

A new global pandemic of an infectious agent, transmitted through sexual contact and blood, affecting alienated and/or deprived people and communities, infectious throughout, that causes a slowly progressive breakdown of defence against other infectious diseases, as well as causing dementia in some, and leads to a premature death, occurring in an era of extensive travel and rapid communication, is a veritable tocsin. These crude ingredients of AIDS as a (...) medical and social phenomenon, blended with the poignant personal histories revealed to clinical professionals, spiced — as if this were necessary — by the fear, the prejudice, the wild theorising and the voyeurism, have presented a substantial challenge to practical medical ethics.Familiar ethical debates have been reopened with new perspective and insight, others have been examined thoroughly for the first time. Building on the major developments in medical ethics over recent decades, AIDS has provided an opportunity, indeed a necessity, for its maturation. It continues to present new issues for debate, while those that were present from the outset continue to perplex us, as this issue of the journal should show. In teaching, AIDS offers a plethora of examples to illustrate most of the central tenets and tensions of medical ethics. As an exemplar, it has provided preparation and precedent for addressing some of the issues emerging from new challenges, such as screening for susceptibility to genetic disease.AJPBereavementThe word comes from the same germanic root as “to be robbed excessively”. The symposium in this issue, on equality and disability, helps to clarify some areas of continuing disagreement in disability studies, but also uncovers substantial consensus. All of the contributors appear to endorse John Harris's statement that “No disability, however slight, nor however severe, implies lesser moral, political or ethical status, worth, or value”.1 It seems safe to assume, moreover, that few if any readers of the Journal of Medical Ethics are likely to disagree with this, or indeed to challenge Kate (...) Diesfeld's initial assumption that “Generally speaking, it is both immoral and unlawful to discriminate between people on the ground of disability”.2Some, of course, might challenge Diesfeld's choice of the word “between” rather than “against”. What is generally agreed to be both immoral and unlawful is discrimination in the modern sense of treating people unjustly on the basis of distinctions that are not morally relevant to the matter in hand. It is neither immoral nor illegal, for example, for a transport employee to discriminate between members of the travelling public in order to offer some but not others the use of a wheelchair or a wheelchair ramp. Nor is it immoral or illegal for society to discriminate between its members through legislation which offers, to some but not others, special forms of aid or protection, based on the recognition of their respective disabilities.Legislation designed to protect people …. Was society’s response adequate in the cases of Mrs Pretty and Ms B?On the 11th of May, less than two weeks after losing her final legal appeal, Mrs Diane Pretty died, under sedation and in the care of a hospice. It was not the end she had pursued through the English High Court, the Court of Appeal, the House of Lords, and the European Court of Human Rights. Paralysed by motor neurone disease and unable to take her own life, Mrs (...) Pretty wanted her husband to be allowed to help her to die when they decided the time had come. But in England, assisting suicide is a crime, although suicide itself no longer is, and the English courts refused Mrs Pretty’s request to grant her husband legal immunity. In turning to the European Court of Human Rights, Mrs Pretty argued that the English courts’ refusal had violated the European Convention on Human Rights.The European court, however, judged that there had been no violation. The right to life could not be construed as conferring a “right to die”, and consequently the state could not be required to “sanction actions intended to terminate life” in order to protect Mrs Pretty from the “inhuman or degrading treatment” to which she claimed the law on assisted suicide subjected her. The right to respect for private life , moreover, had to be exercised “in accordance with the law” of the state concerned. “States were entitled to regulate through the operation of the general criminal law activities which were detrimental to the life and safety of other individuals”; and such activities were what the English law against assisting suicide was designed to prevent. The fact that each of us has significantly greater confidence in the claims of co-partisans – those belonging to groups with which we identify – explains, in large part, why so many people believe a significant amount of the misinformation they encounter. It's natural to assume that such misinformed partisan beliefs typically involve a rational failure of some kind, and philosophers and psychologists have defended various accounts of the nature of the rational failure purportedly involved. I argue that none of (...) the standard diagnoses of the irrationality of misinformed partisan beliefs is convincing, but I also argue that we ought to reject attempts to characterize these beliefs as rational or consistent with epistemic virtue. Accordingly, I defend an alternative diagnosis of the relevant epistemic error. Specifically, I maintain that such beliefs typically result when an individual evaluating testimony assigns more weight to co-partisanship than he ought to under the circumstances, and consequently believes the testimony of co-partisans when better alternatives are available. A perceptual experience of a given object seems to make the object itself present to the perceiver’s mind. Many philosophers have claimed that naïve realism (the view that to perceive is to stand in a primitive relation of acquaintance to the world) provides a better account of this phenomenological directness of perceptual experience than does the content view (the view that to perceive is to represent the world to be a certain way). But the naïve realist account of this phenomenology (...) has a conspicuous shortcoming: it explains the phenomenological directness of veridical perceptual experiences but not of hallucinations. Conversely, I maintain that a particular variety of the content view provides a unified account of the phenomenological directness of both veridical and hallucinatory experiences. If so, then contrary to what is often assumed, the phenomenological facts concerning perceptual experience are explained better by the content view than by naïve realism, and consequently, we have a compelling reason to prefer the content view to naïve realism. The fact that you see some particular object seems to be due to the causal relation between your visual experience and that object, rather than to your experiences’ phenomenal character. On the one hand, whenever some phenomenal element of your experience stands in the right sort of causal relation to some object, your experience presents that object (your experience’s phenomenology doesn’t need to match that object). On the other hand, you can’t have a perceptual experience that presents some object unless (...) you stand in the right sort of causal relation to that object (no matter how closely your experience’s phenomenology matches some object). According to the continuity thesis, property perception is similar to object perception in these two respects. A standard reason to reject the continuity thesis is the assumption that the environmental properties that a perceptual experience presents are determined by its phenomenal properties (which are not determined by the environmental properties that cause the experience). I maintain that the continuity thesis is false but for a different reason: perceptual experiences present both objects and properties via manners of presentation; but, whereas perceptual manners of presentation for objects are purely relational, perceptual manners of presentation for properties are satisfactional. This collection of essays uses Alexis de Tocqueville's writings as a jumping-off point to explore the dilemmas of democratization in the twenty-first century.

The reports of individuals who have had their vision restored after a long period of blindness suggest that, immediately after regaining their vision, such individuals are not able to recognize shapes by vision alone. It is often assumed that the empirical literature on sight restoration tells us something important about the relationship between visual and tactile representations of shape. However, I maintain that, immediately after having their sight restored, at least some newly sighted individuals undergo visual experiences that instantiate basic (...) shape phenomenology but which do not present (that is, neither represent nor involve acquaintance with) the corresponding shape properties. Consequently, the empirical literature on sight restoration tells us something important about the role that perceptual phenomenology plays in our perceptual awareness of an object’s properties—it tells us that the properties presented by perceptual experiences are not determined by or “built into” perceptual phenomenology. In addition, I maintain that the evidence concerning sight restoration suggests an alternative theory concerning the role that sensory phenomenology plays in our perceptual awareness of an object’s properties. Specifically, it suggests that, while not inherently representational, sensory phenomenal properties can serve as vehicles for the representation of an object’s properties. (shrink)

If we acknowledge that a perceptual experience’s sensory phenomenology is not inherently representational, we face a puzzle. On the one hand, sensory phenomenology must play an intimate role in the perception of ordinary physical objects; but on the other hand, our experiences’ purely sensory element rarely captures our attention. I maintain that neither indirect realism nor the dual component theory provides a satisfactory solution to this puzzle: indirect realism is inconsistent with the fact that sensory phenomenology typically goes unnoticed by (...) perceivers; while, the dual component theory cannot do justice to the important role that sensory phenomenology plays in our perceptual awareness of physical objects. I argue that in order to avoid the difficulties with each of the standard alternatives, we must characterize sensory phenomenology as functioning in the way that linguistic symbols function in thought.
