The purpose of this article is to call for the formulation and adoption of a declaration on the universal rights and duties of business. We do not attempt to define the specific contents of such a declaration, but rather attempt to explain why such a declaration is needed and what would be some of its general characteristics. The catalyst for this call was the recognition that even under optimal conditions, good companies sometimes are susceptible to moral lapses, and when companies (...) undertake ventures in authoritarian countries with poor human rights records, even those with the best intentions may find themselves drawn into complicity in human rights abuses. There, market exigencies may persuade them to leave their codes of ethics and commitments to human rights at home. Pragmatism, it would seem, requires thatthey accept the ethical inconsistencies that follow from a “When in Rome, do as they Romans do” outlook. When facing the moral dilemma about whether or not to invest in human rights abusing countries, companies are offered two alternatives: they can operate in those countries and accept potential complicity or they can stay away. We suggest, however, that a preferable option is to address the underlying problem, and to this end we advocate the promulgation of a declaration for business that is comparable to the Universal Declaration of Human Rights. Our proposed name for this is the “Declaration on the Universal Rights and Duties of Business.” To be effective, such a declaration would require enforcement mechanisms. To illustrate this issue, we focus on China, not because China is unique in its human rights abuses, but because China occupies such a central place in the globalization efforts of the major companies from around the world. A robust international declaration is needed to provide a common framework for the practice of consistent and fair business competition everywhere. (shrink)

Milton Friedman famously stated that the only social responsibility of business is to increase its profits, a position now known as the shareholder model of business. Subsequently, the stakeholder model, associated with Edward Freeman, has been widely seen as a heuristically stronger theory of the responsibilities of the firm to the society in which it is situated. Friedman’s position, nevertheless, has retained currency among many business thinkers. In this article, we argue that Friedman’s economic writings assume an economy in which (...) businesses operate under the protections of limited liability, which allows corporations to privatize their gains while externalizing their losses. By accepting limited liability, Friedman must also accept a view of business as embedded in social interdependency, which serves as the logical and moral foundation for corporate social responsibility (CSR). To achieve consistency with his economic principles, Friedman must either abandon limited liability or modify his doctrine on CSR and his related shareholder model of business. (shrink)

Governance theories impact how corporations are run, which in turn impacts societal well-being. This dynamic is commonly accepted, as evidenced by the flood of articles exploring the links between corporate governance and corporate social responsibility (e.g., Hong et al. in J Bus Ethics 136:199–213, 2016). This article supplements current corporate governance theories with Catholic social thought (CST) to address burgeoning societal issues such as the increasing trust gap, income inequality (the compensation gap), and an overemphasis on financial compensation as the (...) primary way to motivate senior managers. The authors propose a shift away from agency theory and stakeholder theory, both of which, with their limited depictions of the motivations of managers, have contributed to excessive executive compensation. Instead, the authors develop an alternative—justice stewardship theory—which integrates organizational justice theory, the principles of stewardship theory, and the insights of 150 years of CST. The gastrointestinal tract is an asymmetrically patterned organ system. The signals which initiate left‐right asymmetry in the developing embryo have been extensively studied, but the downstream steps required to confer asymmetric morphogenesis on the gut organ primordia are less well understood. In this paper we outline key findings on the tissue mechanics underlying gut asymmetry, across a range of species, and use these to synthesise a conserved model for asymmetric gut morphogenesis. Presentism states that everything is present. Crucial to our understanding of this thesis is how we interpret the ‘is’. Recently, several philosophers have claimed that on any interpretation presentism comes out as either trivially true or manifestly false. Yet, presentism is meant to be a substantive and interesting thesis. I outline in detail the nature of the problem and the standard interpretative options. After unfavourably assessing several popular responses in the literature, I offer an alternative interpretation that provides the desired (...) result. This interpretation is then used to clarify the distinction between ‘real change’ from mere variation and temporal relativisation. Reflecting on my solution, I try to diagnose the source of confusion over these issues. Then, building upon Fine’s distinction between ontic and factive presentism, I elucidate what the presentist thesis specifically concerns and how best to formalise it. In the process I distinguish a weak and strong version of the presentist thesis. Finally, I end by drawing out some limitations of the paper. (shrink)

Misunderstandings of Hegel have several roots: one is the intrinsic difficulty of his highly technical and interrelated conceptual sets, another is ideological opponents who consequently take statements out of context, and a third is following those of high stature who pass on the misunderstandings. Typical misunderstandings concern freedom and necessity, slavery, that status of the individual, God and the State, facts measuring up to concepts, the relation of rationality and actuality, the status of passion, and, above all, the nature of (...) absolute knowing. Este artigo compara e contrapõe a abordagem naturalista pragmatista para a peculiaridade da linguagem, exemplificada, principalmente, mas, não exclusivamente, por John Dewey, com a extensa abordagem de Charles Taylor em seu O animal linguístico. Taylor, inspirado pelas obras de Hamann, Herder, e Humboldt, conta com recursos filosóficos e conceituais diferentes para o delineamento do que ele denomina de ‘a forma’ da capacidade linguística humana. Porém, Dewey e Taylor chegam a posições que se sobrepõem sem se identificar: a linguagem é a (...) característica definidora constitutiva dos seres humanos. Seres humanos são definidos pelo surgimento da ‘como’ consciência, uma ‘ruptura’ em nossa imersão imediata no mundo, e, como Peirce e Dewey mostraram de maneira tão lúcida, um reflexivo estar consciente do uso de signos e sistemas de signos de todos os tipos. Esses sistemas potencializam e transformam nosso acesso ao mundo e a nós mesmos. Eles não apenas rotulam um mudo já existente. Eles criam âmbitos de significados e valores que não surgiram sem eles. A distinção crucial de Taylor entre os modelos designativo e constitutivo da linguagem é apoiada plenamente pela consideração pragmatista da linguagem, a qual Taylor não declara. Essa distinção mostrará ser de importância especial para Dewey e Taylor na criação de paisagens existencialmente vitais de significado incorporados nas autodescrições e nas práticas delicadas das artes de auto-reflexão. Tanto Dewey quanto Taylor mostram que assim como as texturas abertas da experiência crescem por suas extremidades, assim a própria linguagem possui sua própria “extremidade” e nos aponta para os domínios “liminares” que sustentam o limiar do sentido para além do totalmente dizível. Esses domínios, que eles mostram de maneiras diferentes mas complementares, são acessados como realidades por formas não discursivas que abrangem as obras de arte, o que Taylor denomina de ‘representações,’ e rituais performativos e restaurativos, tanto pessoais, cívicos e religiosos que incorporam os significados. Dewey e Taylor, divergem, entretanto, sobre se e de que maneira estes domínios precisam transcender a natureza. (shrink)

Many large corporations now have written codes of ethics to guide the business/marketing activities of employees. The purpose of this study was to determine the frequency and types of topics which are covered in the ethics policy statements of large U.S. corporations. The results indicated that the topics covered most often (respectively) were: misuse of funds/improper accounting, conflicts of interest, political contributions, and confidential information. Ela explora o valor heurístico da noção de Dewey de um contexto não apenas para a filosofia, mas para o pensamento e a vida como um todo. Contextos possuem poder existencial profundo tanto que os temos encarnados em nós mesmos. Contextos funcionam como panos de fundo, conforme determinam embasamentos, influenciando de maneira ampla como ante-estruturas de nossas formas de (...) sentimentos, nossos padrões de ação, e os idiomas nos quais nos descrevemos, bem como nossos mundos. Dewey também pensa em contextos como espécies de atmosferas ou brumas, conectando-os com as qualidades determinantes das situações problemáticas nas quais nós nos encontramos. Sustento o argumento de Dewey com ferramentas analíticas fornecidas pela análise da encarnação e da natureza tácita de premissas de Michael Polanyi, e pela exploração da noção de atmosferas e espaços harmonizados de Gernot Böhme. O reconhecimento dos diversos tipos de contextos, nos quais as pessoas vivem e a partir das quais elas falam, é essencial para chegarmos aos tipos de confiança que reduzem o apelo à força e possibilitam acordos em significados comuns enquanto reconhecem as raízes existenciais da diferença. Umberto Eco’s philosophical project, which culminates in the development of a systematic and philosophically relevant semiotics, has a perplexing and problematic debt to and link with pragmatism in its many forms. Indeed, his apparent relation to pragmatism as such is in fact quite tangential if we ignore the pivotal role of Peirce in defining and supporting Eco’s explicit semiotic turn. But Eco claimed that John Dewey’s Art as Experience, the foundation of a distinctively pragmatist aesthetics, was a major factor in (...) his early philosophical movement away from certain premises of the aesthetic tradition that held sway during his student days. Eco engages Dewey in surprising and enlightening ways in his early books, but the trail of Dewey is gradually ‘lost.’ It is this trail, wandering through different contexts, that I follow in this paper. I also indicate how Dewey’s work could have played a larger role in Eco’s mature aesthetic thought and that we should see the absence of Dewey to represent a lost opportunity for emphasizing and enriching the pragmatist side of a semiotic approach to aesthetics. The VIA Classification of Character Strengths and Virtue has received substantial attention since its inception as a model of 24 dimensions of positive human functioning, but less so as a potential contributor to a psychological science on the nature of virtue. The current paper presents an overview of how this classification could serve to advance the science of virtue. Specifically, we summarize previous research on the dimensional versus categorical characterization of virtue, and on the identification of cardinal virtues. We give (...) particular attention to the three-dimensional model of cardinal virtues that includes moral, self-regulatory, and intellectual domains. We also discuss the possibility that these three clusters be treated as fundamental elements of a virtue model, meaning that they clearly and directly contribute to both individual and communal flourishing across various cultures. This discussion includes a summary of previous speculations about the evolution of adaptations underlying the human capacity for using behavioral repertoires associated with the three virtues, as well as discussing ways in which they simultaneously enhance community and individual, in the last case focusing particularly on evidence concerning mating potential. We then discuss the relationship between the evolutionary perspective on virtues and Aristotle’s concept of the reciprocity of the virtues. Finally, we provide speculations about the nature of practical wisdom. While accepting the potential value of future revisions to the VIA model, that model even under its current conditions has the potential to generate a number of intriguing and testable hypotheses about the nature of virtue. PLATO'S WAS a peculiar genius unmatched by any in the entire history of Western thought. He understood well the central play in human experience between appearance, which, ambiguously poised, is a vehicle of both revelation and concealment, and the reality which appearance both conceals and reveals--or better, which appearance conceals as it reveals. The grounds of this play lie both in the character of human structure and in the character of the whole within which that structure functions. Grounded in the (...) unconscious of physiology, the field of human awareness rises by stages from an immediately given, biologically-based circle of sensory awareness, through a culturally mediated sphere of different modes of situating the sensory surface within the greater whole, to a basic orientation toward that all-encompassing whole, which affords us the distance needed to grasp both the orientation itself as orientation and the stages preceding it. Ordinary life is locked into a struggle between the biologically grounded desires and the peculiarities of cultural mediation that seek to channel those desires. Ordinary life exists in relation to a kind of functional surface of things which it co-constitutes with those things in a sort of "dashboard knowledge," knowing what to push and pull and turn to get the desired responses. Sophists continually arise as masters of appearance, often taking themselves, especially if they think they have the sanction of the gods, as genuine lovers of wisdom. (shrink)
