Muddles can be instructive. The clarifying confusion to be examined in this paper is Isaiah Berlin's intelligent vacillation on the issue of whether or not the extent of a person's freedom depends on his desires. Is the amount of freedom an agent possesses determined solely by his objective circumstances or is it also partly a function of his subjective tastes and preferences? In clarifying this question I shall suggest that Berlin has trouble answering it because he almost perceives (...) that interpersonal cardinal measurement of freedom, if possible at all, is possible only on a subjective basis. Yet as Berlin eloquently reminds us measuring freedom according to a subjective metric generates paradox. Whether commonsense ideas of freedom are consistent and reasonable is not purely an academic issue, for we do often make political judgments to the effect that one or another policy, or a movement to one or another form of society, can be expected to reduce or enlarge human freedom. If freedom is not measurable these judgments are merely hortatory. (shrink)

Following hints in the writings of Isaiah Berlin, some political theorists hold that the thesis of value pluralism is true and that this truth provides support for political liberalism of a sort that prescribes wide guarantees of individual liberty.1 There are many different goods, and they are incommensurable. Hence, people should be left free to live their own lives as they choose so long as they don’t harm others in certain ways. In a free society there is a strong (...) presumption in favor of letting individuals act as they choose without interference by others. William A. Galston has developed this argument with exemplary clarity.2 He is wrong. The idea that value incommensurability is a reason for toleration of diverse ways of life and protection of the individual’s freedom to choose among diverse ways of life is a mistake. In his paper for this volume, What Value Pluralism Means for Legal Constitutional Orders, Galston undertakes to resolve a further problem, namely, whether the presumption in favor of individual liberty that value pluralism establishes can be kept within bounds. In his words, “Within the pluralist framework, how is the basis for a viable political community to be secured?”3 On one construal of these words, Galston is seeking the solution to a non-problem. Value pluralism does not establish any normative presumption in favor of liberty, so the worry “does this presumption hold without limit” or, “are there good reasons that constrain it at some point”, is otiose. On another construal, Galston is addressing a different question: if most of the members of society came to believe that given value pluralism, they ought to be left free to live according to their own conception of values, then would a “decently ordered public life” be impossible to sustain?4 On the second construal, the issue being posed is a genuine empirical question, which philosophical arguments cannot answer. Carl Gustav Hempel was one of the preeminent figures in the philosophical movement of logical empiricism. He was a member of both the Berlin and Vienna circles, fled Germany in 1934 and finally settled in the US where he taught for many years in New York, Princeton, and Pittsburgh. The essays in this collection come from the early and late periods of Hempel's career and chart his intellectual odyssey from a rigorous commitment to logical positivism in the 1930s to (...) a more sociological approach close in spirit to the work of Neurath and Kuhn. The collection brings together essays which have up till now been difficult to find, four of which are appearing in English for the first time. He died June 7, 1999, in his apartment in New York shortly after his 95th birthday. Kristeller studied in Heidelberg under Martin Heidegger and received his doctorate in 1927 for his work on Neo-Platonism. He was a lecturer and an assistant at (...) Heidelberg until 1933 when he had to leave Germany because of his Jewish ancestry. He went to Italy where he continued his studies and taught at Pisa. He was awarded another doctorate for his work on the Florentine Platonist, Marsilio Ficino.A few years later when Italy adopted anti-semitic racial laws, Kristeller had to leave a country a second time and went to the United States in 1939. Soon he became a lecturer and instructor at Columbia University and continued on the faculty there, retiring in 1973 as the Frederick Woodbridge Professor of Philosophy.Kristeller brought both the rigor and wealth of German scholarship in Renaissance studies to America. He helped to make materials available for American students. He was a founding member and later president of the Renaissance Society of America and gave lectures all over the United States as well as in Europe, encouraging interest and concern for serious scholarship and Renaissance Studies.He wrote voluminously, over eight hundred articles and many books on his chosen subject. From his earliest writings as a student in the Evangelical Stift in Tübingen to the last years of his life as a professor in Berlin, art played a major role in Hegel’s various philosophical formulations. It is important to note, however, that although Hegel remained convinced of the general importance of art for his own philosophical endeavors, the particular details of his interpretation of its significance changed quite markedly over the years as he developed his own unique philosophical position (...) and as his firsthand experience of works of art increased. In this paper I will concentrate on some of Hegel’s earliest efforts toward developing his own philosophical system, and will show how this development is reflected in a fundamental transformation of his interpretation of the significance of art. More specifically, I will establish in what follows that one major consequence of Hegel’s evolving systematic philosophy is an “impoverishment” of the artistic in the sense that art comes to lose a certain fertility which it had had in his earlier views. This impoverishment is in effect the price exacted if art is to assume a place within Hegel’s system, precisely because the role and significance of art now come to be defined by and expressed in terms of its place in that system. Although this paper will be concerned with only the first stages in a process of development which continues all the way up to his Berlin lectures on beautiful art, it will nonetheless become apparent that Hegel’s early understanding of art has to have been radically altered for such a development even to begin. Zusammenfassung Dieser Aufsatz vergleicht die beiden klassischen apologetischen Schriften, Moses Mendelssohns “Jerusalem” und Friedrich Schleiermachers Reden “Über die Religion”, als Beispiele dafür, wie im Berlin des ausgehenden 18. Jahrhunderts die Religion und ihre prägenden jüdischen und protestantisch-christlichen Traditionen verstanden werden konnte. Keine dieser beiden Schriften läßt sich einfach nach den üblichen Mustern der deutschen Aufklärung oder der deutschen Frühromantik erklären. Werden diese beiden Texte gemeinsam in den Blick genommen, so geben sie Gelegenheit zur Einsicht, wie sich ihre Argumente sowohl (...) aufeinander als auch auf aufklärerische und romantische Interpretationen der Religion beziehen lassen. Auf den Einsatz von Brechmitteln, der als körperlich wirkender Eingriff zur beweismäßigen Sicherung von verschluckten Drogenpäckchen an den Anforderungen von § 81a StPO zu messen ist, wird insbesondere in Großstädten und Ballungsgebieten der Bundesrepublik als Mittel im Kampf gegen den Straßenhandel mit Betäubungsmitteln zurückgegriffen. Der Autor befasst sich mit der Zulässigkeit der Vergabe von Brechmitteln im strafprozessualen Ermittlungsverfahren. Ausgangspunkt der Diskussion ist eine Entscheidung des OLG Frankfurt a. M. aus dem Jahre 1996. Das OLG sah in der in Rede stehenden (...) Maßnahme u. a. einen Verstoß gegen den verfassungsrechtlich verbürgten Grundsatz der Selbstbelastungsfreiheit. In zwei gegenläufigen Entscheidungen aus den Jahren 2000 und 2001 befand das Berliner Kammergericht die Brechmitteleinsätze dagegen für rechtlich unbedenklich. Die Analyse der Urteile beider Gerichte führt den Verfasser unter Berücksichtigung tatsächlicher Problemstellungen bei der Brechmittelvergabe zu einer vertieften Auseinandersetzung mit dem Grundsatz der Selbstbelastungsfreiheit im Strafverfahren und der von der herrschenden Meinung hierzu vertretenen Auffassung. Danach habe die Abgrenzung zulässiger von unzulässigen Zwangsmaßnahmen anhand der Frage zu erfolgen, ob dem Betroffenen ein passives Erdulden oder aber eine aktive Mitwirkung an der eigenen Überführung abverlangt wird. Obgleich berechtigte Zweifel an der Leistungsfähigkeit dieses Abgrenzungskriteriums bestehen, sind die Kritiker bislang einen überzeugenden alternativen Lösungsansatz schuldig geblieben. Hackethal kommt daher zu dem Ergebnis, dass die Frage der Zulässigkeit der Brechmitteleinsätze auf dem Boden der von der herrschenden Meinung vertretenen Auffassung zu beantworten und zu verneinen ist. Dabei erweist sich als maßgebend die Erwägung, dass bei der in letzter Konsequenz notwendig werdenden gewaltsamen Durchsetzung des Zwangsmittels gesundheitliche Nachteile für den Betroffenen nicht auszuschließen sind. Cioran (1911-1995) hatte als junger rumänischer Stipendiat der Humboldt-Stiftung die Gelegenheit, Ende 1933 eine Gastvorlesung Ludwig Klages’ (1872-1956) an der Berliner Friedrich-Wilhelms-Universität zu hören. Klages’ Lebensphilosophie, namentlich seine biozentrische Metaphysik, wie sie vor allem in seinem gerade erschienenen Hauptwerk Der Geist als Widersacher der Seele (1929/1932) zur Sprache kommt, sollte tiefe Spuren bei Cioran hinterlassen. Zentrale Klages’sche Philosopheme ziehen sich fortan wie ein roter Faden durch Ciorans Œuvre: von dem in archaischen Zeiten stattgefundenen dämonischen Einbruch des Geistes ins (...) Leben und der damit verbundenen Entstehung des schmerzlichen, weil isolierenden Bewusstseins über die Herausbildung des rational-logisch-kausalen Denkens und des Aufkommens des Willens bis hin zum Machbarkeits- und Fortschrittswahn des Menschen, der mithilfe von Wissenschaft und Technik unausweichlich zu apokalyptischer Zerstörung führt. Die Exegeten des Cioran’schen Schaffens haben zwar den generellen Einfluss der Klages’schen Philosophie registriert, doch Ausmaß und Tragweite dieser speziellen Rezeptionsgeschichte blieben bislang unentdeckt. Cet article porte sur le cours de philosophie de la religion donné par Tillich à Berlin en 1920. Il retrace le parcours qui conduit Tillich à l’affirmation que Dieu vient à l’existence dans tout acte religieux. Le point de départ est la critique des preuves de Dieu; elle se poursuit dans une critique de l’objectivation religieuse qui fait de Dieu un être existant au-dessus des autres. Contre cette conception de l’existence de Dieu, Tillich soutient la thèse d’une réalisation du (...) divin, d’une venue de Dieu à l’existence, dans l’acte religieux lui-même. C’est dans l’autotranscendance de l’acte religieux que le mystère de l’être fait irruption à travers les formes de la conscience. (shrink)

Despite his fame as a philosopher, Leibniz was a diplomat by profession, and seldom managed to engage in sustained philosophical activity for any length of time. One exception to this, though, is the period towards the end of his stay in Paris and a little afterwards, when he launched a concerted attack on most of the profoundest problems in metaphysics, tackling them with a penetration and persistence that is remarkable by any standards. The resulting series of “meditations”, to use his (...) own descriptive term, penned between December of 1675 and his arrival at the court in Hanover in December of 1676, has been available for the greater part of this century only to a handful of Leibniz scholars. An edition was published in Kazan in 1913 by Ivan Jagodinsky, and it is from this source that Loemker drew to give a tantalizingly brief selection of the ‘Paris Notes’ in his well known volume of English translations. But Jagodinsky’s edition is as unreliable as it is rare, and it was not until recently that Leibniz scholars were presented with an authoritative and wholly reliable Latin edition by the German Academy of Science at Berlin, volume 3 of Series VI of Gottfried Wilhelm Leibniz: Sämtliche Schriften und Briefe. In this volume most of the notes on metaphysics are collected together in Section F under the title De Summa Rerum, where they consitute articles 57 through 87. This fine edition, however, is of limited use for those having no Latin or German, and even for those who do, it is scarcely either convenient or affordable. (shrink)
