The fasting and Eid al-Fitr celebration has a strong public dimension for their traditional characteristics in Islamic communal celebrations. This study used field research from interviews with the two largest mass organisations in Indonesia, Nahdlatul Ulama and Muhammadiyah, and the statements of mass media. This research shows that contestation of religious symbols is not something that needs to be debated but it should broaden the understanding of the differences that must be respected in order to build brotherhood not, (...) division. Contestation of religious symbols between the hisab [astronomical calculations] and the ru'yat [sighting a new crescent moon] is a competition between religious organisations, to strengthen their position, social legitimacy and religious authority in the public sphere. The government has to take the initiative to compromise the policy between the two Islamic organisations to reach a methodological agreement in order to minimise social tensions.CONTRIBUTION: This article proposed that understanding the ru'yat and hisab as a symbol of contestation becomes an attribute of religious organisations and part of organisational behaviour and culture. In this essay, I survey the different uses of the concept of the symbol at play in the philosophy of religion. Considering that historically theories of the symbol have frequently had significant religious presuppositions and implications, I suggest that one might expect that the symbol would play a significant role in current research. This is not the case, however, since the very specific metaphysical, linguistic and theological premises that have traditionally informed much theorisation of the symbol tend to be (...) unpopular today. The main exception is Peircean symbolics which has recently been re-appropriated by a variety of philosophical fields, including philosophy of religion. To open up further contexts for contemporary deployments of the symbol, I look to contemporary public and legal debates concerning the right to wear religious symbols as an area of research unjustly neglected by philosophers of religion: much of the inchoate conceptual work being done in the legal cases themselves would naturally feed into academic philosophical discussion of the symbol. : The European Court of Human Rights, established in 1959 as the unit of the Council of Europe, is the judicial authority that resolves individual, legal personality and international problems within the scope of fundamental rights defined in the 'European Convention on Human Rights' and other protocols. Historically, the European Court of Human Rights has taken various decisions that are considered within the scope of freedom of thought, conscience and religion. The Court defines in its decision, and in particular, what (...) it can be judged within the context of the religious symbol, from a secular point of view. The court recognized the right to freedom of belief and religion, on the other hand, described this right as a declaration of belief in public. The study was designed with a 'conceptual screening model' approaching religious symbols on the basis of freedom of religion and belief. Although this study seems to be in essence a literature review, conceptual screening differs from the literature review method in that it examines the different aspects of a concept within the scope of different science and disciplines. The purpose of this study is to determine the attitude of the European Court of Human Rights to the religious symbols of schools. As a consequence of this work, the nature and scope of local and forbidden legal initiatives against the growing religious symbolism in European schools over the last years have been determined. However, the place of religion in European educational systems and the "church-state relationship" within the social system is another consequence of this study. This study also specifies that the decisions of the courts should be shaped to express religious beliefs and traditions freely in the public sphere. (shrink)

In this article, we scrutinize several arguments that are frequently used to legitimize a ban on religious symbols for civil servants. Most arguments, however, do not stand up to the test of Rawlsian political liberalism. One argument stands out as underpinning such a general ban: state neutrality. While this argument has the most potential, we argue why it is still not decisive for a ban on all religious symbols for all civil servants. We conclude that from (...) a political liberal point of view the discussion is inconclusive, and therefore advocate a context-sensitive and balanced approach to the matter of civil servants’ dress code with respect to religious symbols. By arguing that political liberalism is indecisive, our position is different from both ‘exclusive neutrality’ and ‘inclusive neutrality’. (shrink)

How should judges deal with the manifestation of religious symbols in public educational institutions? In light of the important role of human rights in our legal and political system, courts should grant maximum protection under the freedom of religion or belief. The central thesis of this article is that the European Court of Human Rights fails to live up to this standard. In order to reach this conclusion, the article analyzes relevant case law of the European Court and (...) compares its case law with that of the high courts of Canada and South Africa. In addition, the article assesses the case law of all three courts from the angle of interpretation theory and particularly Cass R. Sunstein’s theory of judicial minimalism. Adoption of a more consistently minimalist methodology by the European Court might lead to a greater protection granted to individuals and groups. However, a wide and deep ruling is first required to overturn the current line of reasoning. The European Court can draw inspiration from Canada and South Africa for such a judgment. (shrink)

In 2009, a law was passed in the Danish parliament, according to which judges cannot wear religious symbols in courts of law. First, I trace the development of this legislation from resistance to Muslim religious practices on the nationalist right to ideas in mainstream Danish politics about secularism and state neutrality – a process I refer to as ‘liberalization’. Second, I consider the plausibility of such liberal justifications for restrictions on religious symbols in the public (...) sphere and, in particular, for the ban on the wearing of religious symbols by judges. I argue that such justifications are flawed and so are not plausible corollaries of anti-Islamic justifications originating on the nationalist right. (shrink)

Religious symbols refers less and less visible cosmic powers in the sky and increasingly sacred powers represented imaginatively and conceptually. In Religious but Not Religious, Jungian analyst Jason E. Smith explores the idea, expressed by C. G. Jung, that the religious sense is a natural and vital function of the human psyche. We suffer from its lack.

The dynamic of religious expression employs symbolic language, actions, and art. These symbols are symbols of transcendence because it is transcendence which is the unique referent that sets apart symbols which give rise to religious understanding from symbols which do not. The main objective of this book is to demonstrate that in Louis Dupre's work all religious expression, insofar as it has a transcendent reference, is intrinsically symbolic. Religious language is never purely (...) objective nor purely subjective, but a dialectical relation with a transcendent dimension. True to the teachings of Dupre, this book uncovers that without a transcendent referent, religious symbols lose their religious significance. This is the plight of the (late-post)modern condition which resulted from the fracturing of nature into its cosmic, human and transcendent components. To regain a sense of transcendence the believer is forced to make an inward turn akin to the mystical practice of past ages. This does not recover a sense of transcendence for culture but can do so for the believer's personal spiritual life. (shrink)

Included is the relevance of analytical philosophy of language, but the text also covers important historical debates about religious language that have had increasing impact upon biblical studies and theology.

In recent years philosophers have come to interest themselves quite a lot in religion seen as a human phenomenon. It is coming to be realized that philosophy cannot understand man without taking account of what has been historically his most important activity—apart from the satisfaction of his primary instincts. This taking account is a very complicated and vast business, and we must therefore allow for this in estimating works such as those of Professor Kimpel of Drew University.
