Hohfeld’s analysis on the different types of rights and duties is highly influential in analytical legal theory, and it is considered as a fundamental theory in AI&Law and normative multi-agent systems. Yet a century later, the formalization of this theory remains, in various ways, unresolved. In this paper I provide a formal analysis of how the working of a system containing Hohfeldian rights and duties can be delineated. This formalization starts from using the same tools as the classical ones by (...) Kanger and Lindahl used, but instead of focusing on the algebraic features of rights and duties, it aims at providing a comprehensive analysis of what these rights and duties actually are and how they behave and at saying something substantial on Power too—maintaining all along the Hohfeldian intentions that these rights and duties are sui generis and inherently relational. Every day, people make decisions about who owns what. What cognitive processes produce this? The target article emphasises the role of biologically evolved intuitions about competition and cooperation. We elaborate the role of cultural evolutionary processes for solving coordination problems. A model based fully on biological evolution misses important insights for explaining the arbitrariness and historical contingency in ownership beliefs.

There is ample research on how metaphors of life vary both cross-culturally and within culture, with age emerging as possibly the most significant variable with regard to the latter dimension. However, no representative research has yet been carried on whether variation can also occur across time. Our paper attempts to fill this gap in the literature by exploring whether a major crisis, such as the COVID-19 pandemic, can induce variation in how life is metaphorically conceptualized throughout society. By drawing on (...) the results of a nationwide, representative survey on the metaphorical preferences for life among Hungarian adults carried out during the second wave of the COVID-19 pandemic, we hypothesized that the pandemic would induce a revolutionary change (in the sense of the change being swift, as opposed to gradual) in how Hungarian adults metaphorically conceptualize life, as compared to the metaphorical preferences of the pre-COVID-19 era. We expected this variation to manifest itself in the emergence of novel metaphorical source domains and a realignment in metaphorical preferences. Our results, however, indicate that novel conceptualizations emerged only as one-off metaphors; Hungarians mostly rely on a stock collection of life metaphors even in times of crises, with changes happening mostly in the form of shifts in metaphorical preferences. Our study also found that the choice of preference of the source domains showed less alterations among older adults – implying that the older we get, the more resistant to change our metaphorical conceptualizations become, even under extreme conditions such as COVID-19. This paper arose out of the 2017 international conference on AI and law doctoral consortium. There were five students who presented their Ph.D. work, and each of them has contributed a section to this paper. The paper offers a view of what topics are currently engaging students, and shows the diversity of their interests and influences.

The present paper—taking the example of the English translation of the Hungarian Civil Code of 2013—aims to give an overview on the legal and terminology-related challenges and pitfalls that might occur during the process of translating a civil code with civil law traditions into the language of the common law world. An attempt is made to categorise terminology-related conceptual problems and elaborate how the different types of translation methods could be applied; moreover, how a kind of legal-linguistic checks-and-balances can be (...) achieved through the well-dosed combination, having also the ratio of similarities to differences of legal concepts behind the respective terms in mind. Legal translators must act beyond the role of a simple translator: they must be comparatists, being aware of the legal origin of the relevant concepts and using the methods of comparative private law and translation studies at the same time, since both law and language are system-bound and are heavily influenced by the cultural and social environment. The authors strive to identify the significance of those problems from the perspective of how language-related aspects can perform some fine-tuning on the comparative methodology and findings, whether they are barriers only or provide also an opportunity to verify or refute prima facie comparative results. Comparative law—no doubt—supports legal translation, but their relationship is reciprocal: legal-linguistic subjects and problems emerging in the course of legal translation supply valuable feedback and further sources of inspiration. Recorded accounts of biomagnetism, bioelectricity and magnetic therapy show an often-controversial history. Contemporary understanding of biomagnetism, based on the interaction of living organism with electromagnetic fields led to the new discipline of bioelectromagnetism: the study of electromagnetic phenomena within and between biological systems. Due to recent, groundbreaking research new paradigms are emerging linked to consciousness-related phenomena. While bioscientific interest in magnetism is concerned (...) directly with the anatomy and functions of the human body, related art projects tend focus on the invisible energies surrounding and impacting human life. The aim of this paper is to contribute to the development of a theory of economic freedom. In this endeavor, we build our framework on the Hayekian notion of freedom because it explicitly embodies the obvious link between freedom and the state: freedom is an absence of state coercion except for that which enforces abstract, general rules known beforehand. We derive two propositions from this Hayekian thesis and elaborate on them, leading to a categorization of government actions from the viewpoint (...) of economic freedom in which the criterion against which coercive governmental actions must be evaluated is the rule of law, meaning a government’s reliance on general, abstract rules. As an implication, our framework allows us to argue for the imperative differentiation between “efficiency” and “economic freedom” as two separate criteria against which government actions can and must be evaluated. We also show that our framework may help explain the process through which economic freedom enhances growth. (shrink)

Social media is an endless source of texts and images about almost everything. Accordingly, the number of analyses based on this source increases daily. Among the numerous methods social media can be analysed by, our attention focusses on discourse analysis. DA is a complex approach which makes it possible to capture not only the linguistic characteristics of given texts, but also their socially constructive and socially constructed features. Therefore, we carried out a systematic examination of the articles at one of (...) the largest academic databases, EBSCO available in 2019 which used DA in social media research. Our investigation studies not only the geographical distribution of this corpus, but the different self-proclaimed DA approaches. Furthermore, we developed a three-level scale in order to capture the methodological complexity of the collected articles. At one end of the scale there are those research papers where discourse appears only as a label for the textual material gathered, without further indication of any DA theories or methodologies. The other end, however, refers to those research projects which applied DA both in their theoretical and methodological frameworks, providing complex discourse analytical investigations of social media texts. This way we were able to demonstrate the wide array of DA perspectives employed in social media research. (shrink)

This article provides an overview of some of the key changes brought about by the groundbreaking Framework Agreement (known as the Ohrid Agreement) in Macedonia since its signing in 2001. A power-sharing arrangement, it saved Macedonia from the brink of civil war. This article describes how the Ohrid Agreement restored peace by addressing the constitutional status of minorities, their equitable representation in the public sector and issues connected with higher education in the 2002–2006 period. It further assesses the merits of (...) decentralization as a remedy for safeguarding a unitary state in a multi-ethnic environment. It consequently argues that the Ohrid Agreement and the ensuing reforms have been important steps in the right direction revitalizing Macedonia by empowering not only the sizeable Albanian population but other less numerous communities as well. However, daunting challenges remain ahead. The perception and language gap between the two main ethnic communities hinder efforts for a truly functioning multi-ethnic state. Moreover, the new government formed after the July 2006 general elections has stirred controversy and caused tensions affecting its Euro-Atlantic perspective. To what extent this will affect Macedonia’s multi-ethnic democracy remains to be seen. (shrink)

An online survey of 654 Australians found that the NP seniors is associated with positive personal characteristics of health and well-being such as ‘like to travel’, ‘lead an involved and active life’, ‘are vibrant and full of purpose’. Older people is also associated with positive characteristics, but somewhat less so than seniors and more socially oriented. Older people are seen to ‘benefit the workforce through their experience’, ‘have wisdom and can always be turned to for advice’, ‘play an important role (...) in their extended family’s life’. By contrast, the characteristics of those typically referred to by the elderly are negative in that the referents are incompetent or impose a burden on society, cf. ‘are frail and fall more often’, ‘are often victims of mental and physical abuse’, ‘are unable to look after themselves and depend on others for help’. The referents of old people and oldies have no particular set of characteristics assigned to them; perhaps that is why they only figure in the one characteristic ‘are tight-fisted with money’ that itself is not strongly associated with any one of the five NPs. The formal analysis of normative systems has traditionally focused on their deontic dimension rather than on their potestative dimension; yet, a growing amount of works aims at shedding light on the notion of power, its norm changing potential and its general interactions with deontic concepts. The present article contributes to this line of inquiry by adopting the following perspective: a normative system can be metaphorically seen as an agent that allocates abilities (powers) in order to promote the fulfillment of certain (...) desires (deontic directives), and in doing so regulates its behavioural domain. Our analysis emphasizes the instrumental nature of power, while clarifying the distinction between ‘being allowed’ and ‘being enabled’ and unveiling new patterns of interaction between deontic and potestative concepts. Operationally, we formulate this framework in terms of conditional rules, and provide a corresponding logic programming (ASP) implementation. (shrink)

In the following text I provide my response to the three reviewers of my book titled “Reviewing the Past. The Presence of Ruins”. First I list a few elements that all the reviewers highlighted. Then, I answer the insightful comments and detailed observations brought forward by them, organised in thematic structures. In this part I start with the three main criteria and the agency of Nature in ruination. Then I investigate the issues regarding the so-called “contemporary ruins”. Ruins’ environmental character, (...) context and sitedness are put into focus in the next section, to finally arrive to the equally inspiring questions of picturesque, sublime and to the issues of representation. Do tej pory badacze dysponowali jedynie źródłami drukowanymi lub odpisami wykonanymi przez osoby trzecie. Rękopisy ujawnione w kolekcji Simona Gratza w zbiorach Historical Society of Pennsylvania składają się z dwóch części (czystopisu i brudnopisu), obejmując łącznie 5 stron wierszy podpisanych nazwiskiem Jakubowskiego. Omawiane rękopisy stanowią reprezentatywny przykład wszechstronnych umiejętności pisarskich i poetyckiej dykcji Jakubowskiego oraz pokazują jego osobowość twórczą w nowym (...) oświetleniu. Nie tylko przynoszą nową wiedzę o dorobku poety, jego zainteresowaniach lekturowych, wrażliwości i podjętym wysiłku adaptacji w USA, ale także umożliwiają usytuowanie znanych utworów w nowej perspektywie badawczej oraz odzyskanie utraconego sensu wierszy zagubionych lub przepisywanych obcą ręką. Robocze zapiski Jakubowskiego pozwalają „podejrzeć” poezję _in statu nascendi_, wniknąć w proces twórczy poety oraz dostarczyć nowych informacji o jego warsztacie pisarskim. (shrink)

Powodem umieszczenia przez Dewhursta tekstu Anatomii w książce poświęconej Sydenhamowi był brak pewności co do jej autorstwa; choć pierwotnie badacz ten przypisał go Locke’owi, po (...) pewnym czasie zmienił zdanie, uznając, że autorem był jednak Sydenham. Powodem był m.in. fakt, że pierwszy akapit napisany został ręką Sydenhama, co skłoniło Dewhursta do przypuszczenia, że rola Locke’a sprowadzała się jedynie do pełnienia obowiązków sekretarza znanego angielskiego lekarza. O autorstwie Sydenhama miała świadczyć także zbieżność poglądów zawartych w tekście z treścią jego Observationes Medicae. In the context of mainstream feminism, Eastern-European women, coming from a post-Communist context are overwhelmed. As they have been unable to access the newest developments of feminist thought, feminist theology, they cannot find their own place and voice. In order to overcome this state of mind, this article puts forward an approach and a strategy. Drawing from the main ideas of contemporary Romanian and Transylvanian feminists – Mihaela Mudure, Mihaela Miroiu, Réka Geambasu, Enikő Magyari-Vincze and others – the article aims (...) to start the quest for a fitting Eastern European-type of feminism. Post-Communist countries are the so-called ‘second world’. They need to find their own way, their own voice, similar to the ‘third world’, which has already started to do so. The knowledge and reception of the international feminist movement and its main oeuvre can help Central and Eastern European women theologians find those aspects that have supported others. Stating the specific situation of ‘second world’ women and seeking the theological aspects that describe their position and problems adequately, they can contribute to finding their one and only special voice. This dialogue between Paul Ricoeur and Sorin Antohi took place in Budapest on March 10, 2003 at Pasts, Inc., Center for Historical Studies, which is affiliated with Central European University (CEU). Ricoeur was the honorary president of Pasts, Inc., and its spiritus rector. On March 8, he had given a lecture on "History, Memory, and Forgetting" in the context of an international conference entitled "Haunting Memories? History in Europe after Authoritarianism," and organized by Pasts Inc. and the Körber Foundation. On (...) March 9, Ricoeur had received the first Honoris Causa doctorate ever granted by CEU. Ricoeur had already visited Hungary in 1933. At the time, he was participating in a Boy Scouts European jamboree at Gödöllö (where he also saw Horthy on his white horse). After WWII, he went back to Hungary to meet with Lukács. Mona Antohi has transcribed and edited the recording of the dialogue. The two interlocutors have then made some minor revisions. The original text, in French, is available on the website of Pasts, Inc. (www.ceu.hu/pasts). This English version, translated and annotated by Gil Anidjar, will be included in Sorin Antohi's book, Talking History. Making Sense of Pasts, forthcoming in 2006 from CEU Press.
