This article presents an analytic critique of the predominant revisionist theoretical paradigm of just war (henceforth: revisionism). This is accomplished by means of a precise description and explanation of the practicability problem that confronts it, namely that soldiers that revisionism would deem “unjust” are bound to fail to fulfil the duties that revisionism imposes on them, because these duties are overdemanding. The article locates the origin of the practicability problem in revisionism’s overidealized conception of a soldier as an individual rational (...) agent analogous to the aggressor or defender in a case of lethal self-defense, who is capable of reflecting on the morality of his status in war and of the killing he performs and thus of recognizing his revisionist duties. Revisionism, however, ignores the following fact: Killing in war is not a natural human behavior. This is why training soldiers to kill is—and arguably always has been—a necessity for the existence of war and the killing that occurs in it. Moreover, this training involves a certain level of moral desensitization to violence whose goal is to prevent soldiers from thoroughly reflecting on the morality of the killing they engage in. Hence, war and killing can only exist if soldiers are trained in such a way that they do not reflect on whether they could be addressees of revisionist duties in the first place. This means that military training is a “constitutive condition” of soldiers and war, which is why it cannot excuse their noncompliance with revisionist duties, thus making these duties categorically overdemanding. The argument here draws on the paradigmatic example of modern US military killing conditioning (MC), but embeds it into a broader military-historical perspective that describes how soldiers have always needed to be mentally and morally influenced in order to enable war and killing. The article’s explanation of revisionism’s practicability problem has a constructive consequence for future theory-building in the ethics of war: It implies that a potentially revised ethical theory of war must necessarily analyze the institutions that allocate belligerent resources, if it aims to morally assess battlefield behavior in a practicable manner. This article argues that military conditioning (MC) systematically violates the human dignity of soldiers. The argument relies on an absolute deontologist account of human dignity understood as a claim-right to live in self-respect, which is a right to decide on one’s own behalf about, and to be in control of, essential aspects of one’s own life. The article claims that MC violates soldiers’ dignity so understood because the largely automatic physical killing reflex that MC instills aims to remove their freedom (...) of choice to kill or not to kill, while the MC practices that rationalize the killing of opponents aim to subvert soldiers’ moral deliberation in relation to this behavior. MC thus aims to take away soldiers’ control over a very essential aspect of human life: the decision whether to take life in war. Thereby, MC systematically violates their human dignity. The article concludes with a proposal for an amendment to international law that would allow legal institutions to do more justice to soldiers’ dignity. (shrink)

It argues that those ‘virologically legitimized’ measures may infringe the human right to privacy and mark the transition into a world of global surveillance. At this possible turning point in human history, panic and latent fear seem to fog much needed farsightedness. Leaving the current state of emotional paralysis and restarting to critically assess the digital pandemic management can serve as an emergency break (...) against drifting into a new era of digital monitoring. This article argues that the reduction of the morality of killing in war to the morality of killing in self-defense by ‘reductive-individualist’ revisionist just war theories is inconsistent, because when those theories apply the moral notion of self-defense to the morality of killing in war, they do not preserve the two conceptions of the “individual” inherent in this notion. The article demonstrates this inconsistency in two steps: First, it disentangles the two conceptions of the individual inherent to the notion of (...) self-defense, namely (1) that the individual is an “entity” potentially bearing a right to self-defense (unlike, e.g., groups) and (2) that the individual is a “particular,” where “particular” signifies that every human is different from every other human. The conception of the individual as a “particular” is tied to the idea that a justification grounded in a rule of self-defense is necessarily “concrete,” in the sense of referring to individually given and specific perceptions or cases, as opposed to “abstract,” in the sense of being detached from specific perceptions or cases. The article then demonstrates that reductive individualism reflects the first notion of the individual, but not the second. Due to the “loss” of the individual as a “particular”, the reductive-individualist reduction of the morality of killing in war to the morality of killing in self-defense is inconsistent, and hence its justification of killing in war grounded in self-defense is not concrete. Since such a justification must be concrete, reductive individualism cannot offer a justification for belligerent killing. (shrink)

The concepts expressed by social role terms such as artist and scientist are unique in that they seem to allow two independent criteria for categorization, one of which is inherently normative. This study presents and tests an account of the content and structure of the normative dimension of these “dual character concepts.” Experiment 1 suggests that the normative dimension of a social role concept represents the commitment to fulfill the idealized basic function associated with the role. Background information can affect (...) which basic function is associated with each social role. However, Experiment 2 indicates that the normative dimension always represents the relevant commitment as an end in itself. We argue that social role concepts represent the commitments to basic functions because that information is crucial to predict the future social roles and role-dependent behavior of others. (shrink)

The Council on Ethical and Judicial Affairs of the American Medical Association examines physicians’ professional ethical responsibility in the event that the security of patients’ electronic records is breached.

Discussions in social psychology overlook an important way in which biases can be encoded in conceptual representations. Most accounts of implicit bias focus on ‘mere associations’ between features and representations of social groups. While some have argued that some implicit biases must have a richer conceptual structure, they have said little about what this richer structure might be. To address this lacuna, we build on research in philosophy and cognitive science demonstrating that concepts represent dependency relations between features. These relations, (...) in turn, determine the centrality of a feature f for a concept C: roughly, the more features of C depend on f, the more central f is for C. In this paper, we argue that the dependency networks that link features can encode significant biases. To support this claim, we present a series of studies that show how a particular brilliance-gender bias is encoded in the dependency networks which are part of the concepts of female and male academics. We also argue that biases which are encoded in dependency networks have unique implications for social cognition. (shrink)

Food retailers are powerful actors of the agro-industrial food system. They exert strong lock-in effects that hinder transitions towards more sustainable agri-food systems. Indeed, their marketing practices generally result in excluding the most sustainable food products, such as local, low-input, small-scale farmers’ products. Recently in Belgium, several initiatives have been created to enable the introduction of local products on supermarket shelves. In this article, we study three of those initiatives to analyse if the development of local sourcing in supermarkets opens (...) up an opportunity for a transition towards more sustainable agri-food systems. We conceptualise transitions as a shift in governance and ethical values and adopt a pragmatist approach of ethics combined with the systemic perspective of transition studies, to evaluate the impact of these initiatives. Our analysis shows that they mainly contribute to the reproduction of the incumbent agri-food system. It also highlights that first, to be a driver for sustainability transitions, food ethics need to be systemic i.e. relate to a systemic understanding of problems and perspective of sustainability, including social justice. And second, it highlights that governance arrangements involving not only representative organisations of the various agri-food and non-agricultural actors, but also actors upholding ethical values that are currently missing in conventional supply chains and representing excluded and marginalised interests, favour the uptake of such systemic ethics by incumbent actors. Hence, systemic ethics and inclusive governance are key features for initiatives to contribute to a sustainability transition. (shrink)

Arbitrariness is a distinctive feature of human language, and a growing body of comparative work is investigating its presence in animal communication. But what is arbitrariness, exactly? We propose to distinguish four notions of semiotic arbitrariness: a notion of opaque association between sign forms and semiotic functions, one of sign-function mapping optionality, one of acquisition-dependent sign-function coupling, and one of lack of motivatedness. We characterize these notions, illustrate the benefits of keeping them apart, and describe two reactions to our proposal: (...) abandoning arbitrariness-talk in favor of the newly introduced conceptual vocabulary, or feeding the distinctions back into the parent concept. The most common approach to understanding the semantics of the concept of pain is third-person thought experiments. By contrast, the most frequent and most relevant uses of the folk concept of pain are from a first-person perspective in conversational settings. In this paper, we use a set of linguistic tools to systematically explore the semantics of what people communicate when reporting pain from a first-person perspective. Our results suggest that only a pluralistic view can do justice to the way we (...) talk about pain from a first-person perspective: The semantic content of the folk concept of pain consists of information about both an unpleasant feeling and a disruptive bodily state. Pain linguistics thus provides new insights into ordinary pain language and poses an interesting challenge to the dominant unitary views of pain. (shrink)

Theories of skill acquisition have made radically different predictions about the role of general problem‐solving methods in acquiring rules that promote effective transfer to new problems. Under one view, methods that focus on reaching specific goals, such as means‐ends analysis, are assumed to provide the basis for efficient knowledge compilation (Anderson, 1987), whereas under an alternative view such methods are believed to disrupt rule induction (Sweller, 1988). We suggest that the role of general methods in learning varies with both the (...) specificity of the problem solver's goal and the systematicity of the strategies used for testing hypotheses about rules. In the absence of a specific goal people are more likely to use a rule‐induction learning strategy, whereas provision of a specific goal fosters use of difference reduction, which tends to be a non‐rule‐induction strategy. We performed two experiments to investigate the impact of goal specificity and systematicity of rule‐induction strategies in learning and transfer within a complex dynamic system. The results of Experiment 1 indicated that during free exploration of a problem space, greater learning occurred if participants adopted more systematic strategies for rule induction, and that participants come to favor such strategies. Experiment 2 revealed that participants who were provided with a specific goal performed well on the initial problem but were impaired on a transfer test using a similar problem with a different goal. Instruction on a systematic rule‐induction strategy facilitated solution for both the initial and transfer problems, but participants' use of this strategy declined if they had a specific goal. Our results support Sweller's (1988) proposal that general problemsolving methods applied to a specific goal foster acquisition of knowledge about an isolated solution path but do not provide an effective way of learning the overall structure of a problem space. We interpret these results in terms of dualspace theories of search through problem space. (shrink)

The article deals with the question whether a state might be held liable for the infringement of constitutional law if its national court of last instance violates the obligation to make a reference for a preliminary ruling to the Court of Justice of the European Union under the conditions laid down in Article 267 of the Treaty on the Functioning of the European Union and developed in the case-law of the Court. Relying on the well-established practice of the European Court (...) of Human Rights, which accepts that in theory an arbitrary decision not to refer a question for a preliminary ruling could infringe the right to a fair trial established in the ECHR, the author analyses whether constitutional courts of Germany, Czech Republic, Spain and Lithuania have elaborated the equivalent practice and if so, whether they have established any specific criteria that national courts are required to bring into play in order to substantiate the decision not to refer. The article discusses the possible consequences that can be faced by a Member State of the European Union if its national court does not comply with the obligation to make a reference for a preliminary ruling to the Court of Justice. The TFEU does not specify any sanctions applicable to a state when its national court disregards its obligation under Article 267 TFEU. Therefore, the analysis focuses on the practice of the Court of Justice and its interpretation by scholars. At (...) the outset, the author analyses whether refraining from making a reference for a preliminary ruling can lead to the duty to pay damages to an individual. Taking into account the criteria of a sufficiently serious breach formulated in the Köbler case, the author comes to the conclusion that the infringement of the obligation to make a reference for a preliminary ruling is one of the most important criteria in assessing whether a Member State has to pay damages for any loss suffered by an individual, but the infringement itself is not sufficient to make a state liable. With the ever-growing quality of observational data in astronomy, the complexity of astrophysical models has been increasing in turn. This trend raises the question: Are there still reasons to prefer simpler models if the final goal is an actual model-target comparison? I argue for two aspects in which astrophysical research may favor models having reduced complexity: first, to address the problem of determining the values of adjustable parameters and, second, to pave the way for a validation of the model based (...) on the modeler’s understanding of the scope of the model and the critical processes on the target’s side. In the eighteenth century, the sciences and their applications adopted a new attitude based on quantification and, increasingly, on a notion of precision. Within this process, instruments played a significant role. However, while new devices such as the micrometer, telescope, and pendulum clock embodied a formerly unknown potential of precision, this could only be realized by defining a set of practices regulating their application and control. The paper picks up the case of pendulum clocks used in eighteenth-century observatories in order (...) to show the process of learning in the course of which the pendulum clock first became a precision instrument. By examining the results of an especially developed statistical analysis, conducted to compare the performance of eighteenth-century clocks, it highlights the diversity of conditions, attitudes, and manners of handling that are characteristic for the epoch. In this way, it underlines the necessity of standardization of timekeeping practices rather than exclusively focusing on the technological development of clocks. Ultimately, the paper discusses the role of makers and users in order to show the evolution of a “precision instrument.”. (shrink)

Delusions have traditionally been considered the hallmark of mental illness, and their conception, diagnosis and treatment raise many of the fundamental conceptual and practical questions of psychopathology. One of these fundamental questions is whether delusions are understandable. In this paper, we propose to consider the question of understandability of delusions from a philosophy of language perspective. For this purpose, we frame the question of how delusions can be understood as a question about the meaning of delusional utterances. Accordingly, we ask: (...) “what meaning(s) can delusional utterances possibly have?”. We argue that in the current literature, there is a standard approach to the meaning of delusional utterances, namely the descriptive account which assumes that a delusional utterance “p” means that p is the case. Drawing on Speech Act Theory, we argue that solely relying on the descriptive account disregards essential ways of how linguistic meaning is constituted. Further, we show that Speech Act Theory can prove a helpful addition to the theoretical and clinical “toolbox” used for attempting to understand delusional utterances. This, we believe, may address some of the theoretical and clinical shortcomings of using only the currently predominant descriptive account. (shrink)

The Paris Climate Agreement is an important step for international climate policy, but the compensation for negative effects of climate change based on clear assignment of responsibilities remains highly debated. From both a policy and a science perspective, it is unclear how responsibilities should be defined and on what evidence base. We explore different normative principles of justice relevant to climate change impacts, and ask how different forms of causal evidence of impacts drawn from detection and attribution research could inform (...) policy approaches in accordance with justice considerations. We reveal a procedural injustice based on the imbalance of observations and knowledge of impacts between developed and developing countries. This type of injustice needs to be considered in policy negotiations and decisions, and efforts strengthened to reduce it. (shrink)

This paper explores the epistemic status of models and simulations between theory, on the one hand, and observations, on the other. In particular, I will argue that the interpretation of an essentially invariant astrophysical model structure can change substantially over time. I will illustrate this claim using as an example the first 20 years (1985–2004) of development of the Paris-Durham shock code—a numerical model of slow interstellar shock waves (i.e. a disturbance of the medium that travel faster than the local (...) speed of sound). I will show that the model’s interpretation and, in particular, its underlying representational ideal—the modeler’s (often implicit) goal governing the development and the use of the model—changed notably during this period. Whereas the code was originally used in a purely exploratory fashion, it was later taken to represent and encompass the target phenomenon as completely as possible. It is noteworthy that during this transition the model’s change of epistemic status was never explicitly acknowledged or in any way articulated. However, the impetus for the change can, I claim, be found in the role that observational data came to play in the later publications. (shrink)

The aim of this paper is to link empirical findings concerning environmental inequalities with different normative yard-sticks for assessing whether these inequalities should be deemed unjust, or not. We argue that such an inquiry must necessarily take into account some caveats regarding both empirical research and normative theory. We suggest that empirical results must be contextualised by establishing geographies of risk. As a normative yard-stick we propose a moderately demanding social-egalitarian account of justice and democratic citizenship, which we take to (...) be best suited to identify unjust as well as legitimate instances of socio-environmental inequality. Attitudes toward repository projects cannot be explained merely on the basis of perceived risks, trust, or technical information. Issues of justice and fairness frequently arise when burdens and benefits are to be allocated. A fair distribution across the various parts of a given territory of the waste to be stored is unlikely to be accomplished as it is contingent on appropriate geological formations and other factors. The process by which the specific distribution is determined and accomplished needs to be taken (...) into account as well. Thus, justice evaluations of both the distributive outcome and the process itself, by which the outcome is accomplished, are likely to affect people’s attitudes toward and acceptance of siting decisions. Data from a number of methodically different studies conducted over the last eight years on site selection in Switzerland suggest that a fair procedure is more essential than a fair distribution to a consensus about the decisions made. As a consequence, even normative assessments of the fairness of a distribution of nuclear waste must consider procedural justice as a valuable indicator, independently of the particular shape of the distribution. However, contextual factors, such as the wider nuclear energy strategy of a country, may compete with procedural fairness in terms of importance. Even though fairness is a requirement it does not guarantee acceptance. It may, however, enhance acceptability from a moral standpoint. (shrink)

As our experience with this special issue shows, climate change is such a multi-faceted problem that interdisciplinary research is a necessity. This is much more easily said than done. In the course of the publication of this special issue there were many lessons to be learned. First of all we saw how the exchange between our authors allowed them to expand the focus of their respective disciplines. Philosophers considered literature from various fields they would not have touched upon in their (...) usual course of inquiry. Scientists and legal scholars became more sensitive to the normative dimensions and justice-related intricacies involved in their research. This enabled all contributors to open up to different vocabularies and standards of research. At the same time, however, several obstacles to the success of this issue emerged as well. For such an endeavor it is necessary to find researchers who are ready to engage with other disciplines and to take up ideas and comments which at first sight might not seem relevant and out of place from their disciplinary perspective. Due to the special format another challenge was to communicate the interdisciplinary character of this special issue to the reviewers and to put the reviews in context accordingly without risking to diminish the disciplinary quality of contributions. For the guest editors this came with a further challenge. We not only had to become familiar with different disciplinary vocabularies and standards of research but also had to judge the quality and relevance of contributions in the light of our overall aim as well as disciplinary standards of quality. Investigators agree that hope is an important coping skill for patients. Hope is stronger than optimism and influences one's physical well being. Suggestions and strategies that can be used in the clinical setting to increase hope begin with an admission of its important role.

Our goal in this paper is to establish a set of criteria for understanding the meaning and sources of attributing (un)fairness to AI algorithms. To do so, we first establish that (un)fairness, like other normative notions, can be understood in a proper primary sense and in secondary senses derived by analogy. We argue that AI algorithms cannot be said to be (un)fair in the proper sense due to a set of criteria related to normativity and agency. However, we demonstrate how (...) and why AI algorithms can be qualified as (un)fair by analogy and explore the sources of this (un)fairness and the associated problems of responsibility assignment. We conclude that more user-driven AI approaches could alleviate some of these difficulties. (shrink)

As synthetic biology develops into a promising science and engineering field, we need to have clear ideas and priorities regarding its safety, security, ethical and public dialogue implications. Based on an extensive literature search, interviews with scientists, social scientists, a 4 week long public e-forum, and consultation with several stakeholders from science, industry and civil society organisations, we compiled a list of priority topics regarding societal issues of synthetic biology for the years ahead. The points presented here are intended to (...) encourage all stakeholders to engage in the prioritisation of these issues and to participate in a continuous dialogue, with the ultimate goal of providing a basis for a multi-stakeholder governance in synthetic biology. Here we show possible ways to solve the challenges to synthetic biology in the field of safety, security, ethics and the science-public interface. (shrink)

As part of the SYNBIOSAFE project, we carried out an open electronic conference (e-conference), with the aim to stimulate an open debate on the societal issues of synthetic biology in a proactive way. The e-conference attracted 124 registered participants from 23 different countries and different professional backgrounds, who wrote 182 contributions in six different categories: (I) Ethics; (II) Safety; (III) Security; (IV) IPR; (V) Governance and regulation; (VI) and Public perception. In this paper we discuss the main arguments brought up (...) during the e-conference and provide our conclusions about how the community thinks, and thinks differently on the societal impact of synthetic biology. Finally we conclude that there is a chance for an open discourse on the societal issues of synthetic biology happening, and that the rules to govern such a discourse might be set up much easier and be respected more readily than many would suggest. The daughter of French psychoanalyst Jacques Lacan tries to make sense of her relationship with her father. “When I was born, my father was already no longer there.” Sibylle Lacan's memoir of her father, the influential French psychoanalyst Jacques Lacan, is told through fragmentary, elliptical episodes, and describes a figure who had defined himself to her as much by his absence as by his presence. Sibylle was the second daughter and unhappy last child of Lacan's first marriage: the (...) fruit of despair (“some will say of desire, but I do not believe them”). Lacan abandoned his old family for a new one: a new partner, Sylvia Bataille (the wife of Georges Bataille), and another daughter, born a few months after Sibylle. For years, this daughter, Judith, was the only publicly recognized child of Lacan—even if, due to French law, she lacked his name. In one sense, then, A Father presents the voice of one who, while bearing his name, had been erased. If Jacques Lacan had described the word as a “presence made of absence,” Sibylle Lacan here turns to the language of the memoir as a means of piecing together the presence of a man who had entered her life in absence, and in his passing, finished in it. In its interplay of absence, naming, and the despair engendered by both, A Father ultimately poses an essential question: what is a father? This first-person account offers both a riposte and a complement to the concept (and the name) of the father as Lacan had defined him in his work, and raises difficult issues about the influence biography can have on theory—and vice versa—and the sometimes yawning divide that can open up between theory and the lives we lead. This volume includes essays presented at the conference on Emotions and Rationality in Moral Philosophy held at the Universities of Neuchâtel and Bern in October 2005. The authors of this volume share the Humean insight that the ‘sentiments’ have a crucial role to play in elucidating the practice of morality. In a Humean fashion, they warn us against taking an intellectualist view of emotions and reject the rationalist account of morality.

Contemporary and emerging chatbots can be fine-tuned to imitate the style, tenor, and knowledge of a corpus, including the corpus of a particular individual. This makes it possible to build chatbots that imitate people who are no longer alive — deathbots. Such deathbots can be used in many ways, but one prominent way is to facilitate the process of grieving. In this paper, we present a framework that helps make sense of this process. In particular, we argue that deathbots can (...) serve as affective scaffolds, modulating and shaping the emotions of the bereaved. We contextualize this affective scaffolding by comparing it to earlier technologies that have also been used to scaffold the process of grieving, arguing that deathbots offer some interesting novelties that may transform the continuing bonds of intimacy that the bereaved can have with the dead. We conclude with some ethical reflections on the promises and perils of this new technology. (shrink)

Deepfake technology uses machine learning to fabricate video and audio recordings that represent people doing and saying things they've never done. In coming years, malicious actors will likely use this technology in attempts to manipulate public discourse. This paper prepares for that danger by explicating the unappreciated way in which recordings have so far provided an epistemic backstop to our testimonial practices. Our reasonable trust in the testimony of others depends, to a surprising extent, on the regulative effects of the (...) ever-present possibility of recordings of the events they testify about. As deepfakes erode the epistemic value of recordings, we may then face an even more consequential challenge to the reliability of our testimonial practices themselves. (shrink)
