The growth of urban violence in Brazil, as in other countries, has led citizens to demand more severe and punitive measures to solve the problem of juvenile crime. One motion submitted to the Brazilian parliament, for instance, proposes to reduce the age of penal majority from 18 to 16 years. Our hypothesis is that popular opinions about this proposal are largely constrained by construal levels and psychological distance. Accordingly, we expect that the knowledge and proximity to the circumstances associated with (...) juvenile transgression will influence opinions about the proposal. To test this hypothesis, we evaluated how opinion against or for the proposal can be explained by psychological distance and moral development theory. We studied two samples, composed of people who do not have a deep experience with the subject and workers from a juvenile justice court. After collecting socio-demographic information from the subjects and their answer to moral dilemmas, the data was subjected to a multivariate analysis by multimodal logistic regression for socio-demographic characteristics, Kohlberg moral stages, and opinion on the reduction of APM as dependent variables. Our findings suggest that 1) opinion about the APM depends on psychological distance and 2) socioeconomic variables may influence the average construal level of adolescent transgressors in the public’s perspective. Hugo Grotius believed that last wills belonged to the Law of Nature, whereas Samuel Pufendorf argued that testamentary succession was a mere creation of human laws. I argue that Pufendorf’s rejection of the Natural Law origins for wills lacks internal consistency in both his Natural Law system and his proprietary rights theory. Pufendorf even contradicts his own previous claim stating wills are recognised by the Law of Nature as useful to the promotion of social peace. Grotius’s analysis of testaments, on (...) the other hand, brief though it may be, is entirely consistent with his previous arguments: that the Law of Nature can attach itself to human creation; and that a human creation such as testamentary succession belongs to Natural Law when derived from, or when it agrees with, human reason and sociability. Neurosurgery for psychiatric disorders, also sometimes referred to as psychosurgery, is rapidly evolving, with new techniques and indications being investigated actively. Many within the field have suggested that some form of guidelines or regulations are needed to help ensure that a promising field develops safely. Multiple countries have enacted specific laws regulating NPD. This article reviews NPD-specific laws drawn from North and South America, Asia and Europe, in order to identify the typical form and contents of these laws and to (...) set the groundwork for the design of an optimal regulation for the field. Key challenges for this design that are revealed by the review are how to define the scope of the law, what types of regulations are required, and how to approach international harmonization given the potential migration of researchers and patients. This claim appears to be threatened by reports of `selfless' episodes, or conscious episodes lacking self-consciousness, recently described in a number of pathological and nonpathological conditions. However, the credibility of these reports has in turn been challenged on the following grounds: remembering and reporting a past conscious episode as an episode that one went through is only possible if one was conscious of oneself while undergoing it. (...) Call this the Memory Challenge. This paper argues that the Memory Challenge fails to undermine the credibility to reports of selfless episodes, because it rests on problematic assumptions about episodic memory. The paper further argues that we should distinguish between several kinds of self-representation that may be involved in the process of episodic remembering, and that once we do so, it is no longer mysterious how one could accurately remember and report a selfless episode as an episode that one went through. Thus, we should take reports of this kind seriously, and view them as credible counter-examples to the claim that consciousness constitutively involves self-consciousness. (shrink)

Many authors argue that conscious experience involves a sense of self or self-consciousness. According to the strongest version of this claim, there can be no selfless states of consciousness, namely states of consciousness that lack self-consciousness altogether. Disagreements about this claim are likely to remain merely verbal as long as the target notion of self-consciousness is not adequately specified. After distinguishing six notions of self-consciousness commonly discussed in the literature, I argue that none of the corresponding features is necessary for (...) consciousness, because there are states of consciousness in which each of them is plausibly missing. Such states can be said to be at least partially selfless, since they lack at least one of the ways in which one could be self-conscious. Furthermore, I argue that there is also preliminary empirical evidence that some states of consciousness lack all of these six putative forms of self-consciousness. Such states might be totally selfless, insofar as they lack all the ways in which one could be self-conscious. I conclude by addressing four objections to the possibility and reportability of totally selfless states of consciousness. (shrink)

Kyle Stanford has recently given substance to the problem of unconceived alternatives, which challenges the reliability of inference to the best explanation (IBE) in remote domains of nature. Conjoined with the view that IBE is the central inferential tool at our disposal in investigating these domains, the problem of unconceived alternatives leads to scientific anti-realism. We argue that, at least within the biological community, scientists are now and have long been aware of the dangers of IBE. We re-analyse the nineteenth-century (...) study of inheritance and development (Stanford’s case study) and extend it into the twentieth century, focusing in particular on both classical Mendelian genetics and the studies by Avery et al. on the chemical nature of the hereditary substance. Our extended case studies show the preference of the biological community for a different methodological standard: the vera causa ideal, which requires that purported causes be shown on non-explanatory grounds to exist and be competent to produce their effects. This book throws new light on the way in which the Internet impacts on democracy. Based on Jürgen Habermas' discourse-theoretical reconstruction of democracy, it examines one of the world's largest, most diverse but also most unequal democracies, Brazil, in terms of the broad social and legal effects the internet has had. Focusing on the Brazilian constitutional evolution, the book examines how the Internet might impact on the legitimacy of a democratic order and if, and how, it might yield opportunities for (...) democratic empowerment. The book also assesses the ways in which law, as an institution and a system, reacts to the changes and challenges brought about by the Internet: the ways in which law may retain its strength as an integrative force, avoiding a 'virtual' legitimacy crisis. Philosophical and empirical research on bodily awareness has mostly focused so far on bodily disorders – such as anorexia nervosa, somatoparaphrenia, or xenomelia (body integrity dysphoria) – and bodily illusions induced in an experimental setting – such as the rubber hand illusion, or the thermal grid illusion. Studying these conditions can be illuminating to investigate a broad range of issues about the nature, function, and etiology of bodily experience. However, a number of psychoactive compounds can also induce a remarkably wide (...) variety of bodily effects that have received little attention despite their relevance to these issues. Some of these effects are similar to those associated with bodily disorders or experimental bodily illusions, while others appear to be unique. The purpose of this chapter is to provide an overview of these lesser known bodily effects of psychoactive compounds, and outline some ways in which they can bear on recent debates regarding bodily awareness and bodily ownership. In recent years, the scientific study of meditation and psychedelic drugs has seen remarkable developments. The increased focus on meditation in cognitive neuroscience has led to a cross-cultural classification of standard meditation styles validated by functional and structural neuroanatomical data. Meanwhile, the renaissance of psychedelic research has shed light on the neurophysiology of altered states of consciousness induced by classical psychedelics, such as psilocybin and LSD, whose effects are mainly mediated by agonism of serotonin receptors. Few attempts have been made (...) at bridging these two domains of inquiry, despite intriguing evidence of overlap between the phenomenology and neurophysiology of meditation practice and psychedelic states. In particular, many contemplative traditions explicitly aim at dissolving the sense of self by eliciting altered states of consciousness through meditation, while classical psychedelics are known to produce significant disruptions of self-consciousness, a phenomenon known as drug-induced ego dissolution. In this article, we discuss available evidence regarding convergences and differences between phenomenological and neurophysiological data on meditation practice and psychedelic drug-induced states, with a particular emphasis on alterations of self-experience. While both meditation and psychedelics may disrupt self-consciousness and underlying neural processes, we emphasize that neither meditation nor psychedelic states can be conceived as simple, uniform categories. Moreover, we suggest that there are important phenomenological differences even between conscious states described as experiences of self-loss. As a result, we propose that self-consciousness may be best construed as a multidimensional construct, and that “self-loss,” far from being an unequivocal phenomenon, can take several forms. Indeed, various aspects of self-consciousness, including narrative aspects linked to autobiographical memory, self-related thoughts and mental time travel, and embodied aspects rooted in multisensory processes, may be differently affected by psychedelics and meditation practices. Finally, we consider long-term outcomes of experiences of self-loss induced by meditation and psychedelics on individual traits and prosocial behavior. We call for caution regarding the problematic conflation of temporary states of self-loss with “selflessness” as a behavioral or social trait, although there is preliminary evidence that correlations between short-term experiences of self-loss and long-term trait alterations may exist. There is converging evidence that high doses of hallucinogenic drugs can produce significant alterations of self-experience, described as the dissolution of the sense of self and the loss of boundaries between self and world. This article discusses the relevance of this phenomenon, known as “drug-induced ego dissolution (DIED)”, for cognitive neuroscience, psychology and philosophy of mind. Data from self-report questionnaires suggest that three neuropharmacological classes of drugs can induce ego dissolution: classical psychedelics, dissociative anesthetics and agonists of the kappa opioid (...) receptor (KOR). While these substances act on different neurotransmitter receptors, they all produce strong subjective effects that can be compared to the symptoms of acute psychosis, including ego dissolution. It has been suggested that neuroimaging of DIED can indirectly shed light on the neural correlates of the self. While this line of inquiry is promising, its results must be interpreted with caution. First, neural correlates of ego dissolution might reveal the necessary neurophysiological conditions for the maintenance of the sense of self, but it is more doubtful that this method can reveal its minimally sufficient conditions. Second, it is necessary to define the relevant notion of self at play in the phenomenon of DIED. This article suggests that DIED consists in the disruption of subpersonal processes underlying the “minimal” or “embodied” self, i.e., the basic experience of being a self rooted in multimodal integration of self-related stimuli. This hypothesis is consistent with Bayesian models of phenomenal selfhood, according to which the subjective structure of conscious experience ultimately results from the optimization of predictions in perception and action. Finally, it is argued that DIED is also of particular interest for philosophy of mind. On the one hand, it challenges theories according to which consciousness always involves self-awareness. On the other hand, it suggests that ordinary conscious experience might involve a minimal kind of self-awareness rooted in multisensory processing, which is what appears to fade away during DIED. Der Sinn dieses Unternehmens liegt darin, ein Emanzipationspotential für eine Kritische Gesellschaftstheorie auszuweisen. Dazu muss freilich gezeigt werden können, dass das Subjekt mehr ist als reine Theorie. Es muss über einen Gesellschaftsbezug verfügen können. "Die Politik des Subjekts“ versucht diesen Bezug auszuweisen und gleichzeitig auszuloten, welche normativen Grundlagen eine Theorie des Politischen für eine Kritische Theorie anbieten kann.

Cet article constitue la présentation des recherches effectuées par une équipe franco-grecque sur le tell de Kirrha en Phocide entre 2008 et 2015, et représente la publication préliminaire des structures archéologiques mises au jour. Deux secteurs distants l’un de l’autre ont été fouillés, révélant une dense occupation de l’Helladique Moyen, ainsi que des niveaux s’étageant jusqu’à l’Helladique Récent III. Notamment, une nécropole de la période transitionnelle (Helladique Moyen III – Helladique Récent I/II) a été fouillée dans la partie occidentale du (...) site, tandis que des niveaux mycéniens ont été reconnus à proximité du sommet. Archaeology and Intentionality explores perhaps one of the most overlooked topics in archaeology, that of intentionality. In archaeology, most explanations of human behaviour rely on intentionality and this book fills a surprising gap in the literature. By identifying the historical trajectory of the notion of intentionality, this book reframes our understanding of what it means to act intentionally and how archaeologists provide explanations concerning past (and present) societies. In general, this book presents a strong framework for archaeological research, one that (...) fits to current archaeological practices and research around the world. This framework considers that past actors were not unconditional free agents, who could act however they wished, nor were they absolute prisoners of the economic, biological, and environmental circumstances in which they lived. From the standpoint of intentionality, it becomes clear that human agency is not about what you can or cannot do, but about what you should, that is to say, actions are above all ethical. In a world wealth inequality runs rampant, where humans have damaged the environment beyond recognition, and where technology advances at an alarming rate - it is important that we recognize our intentions and the ethical responsibility that accompanies those intentions. The book highlights how archaeology is the perfect discipline to understand how and from where those intentions come from. This book is a large-scale historical reconstruction of liberal legalism, from its inception in the mid-nineteenth century, the moment in which the jurists forged the alliance between political liberalism and legal expertise embodied in classical private law doctrine, to the contemporary anxiety about the possibility of both a liberal solution to the problem of political justification and of law as a respectable form of expert knowledge. Each stage in the history is a moment of synthesis between a substantive and a (...) methodological idea. The former is the liberal political theory of the period, purporting to provide a solution to the problem of political justification. The latter is a conception of legal method or science, supposedly vindicating the access of the expert to the political choices embodied in the law. Thus, each moment in the history of liberal legalism integrates a political theory with a jurisprudential conception. Although it reaches the unsettling conclusion that liberal legalism has largely failed by its own standards, the book urges us to avoid quietism, skepticism or cynicism, in the hope that a deeper understanding of the fragility of our values and institutions inspires a more thoughtful, broadminded and nurtured citizenship. Ribeiro discorre, principalmente, sobre dois desdobramentos fundamentais do pensamento hobbesiano. O primeiro é o pacto entre os homens para a formação do Estado, por meio do qual transferem todos os direitos ao soberano. Segundo, uma consequência direta dessa concentração de poder: o controle do conhecimento pela autoridade política.

In recent years, a debate has emerged on whether bodily sensations are typically accompanied by a sense of body ownership, namely a distinctive experience of one's body or body part as one's own. Realists about the sense of body ownership heavily rely on evidence from experimentally-induced bodily illusions (e.g., the rubber hand illusion) and pathological disownership syndromes (e.g. somatoparaphrenia). In this chapter, I will introduce novel evidence regarding body disownership syndromes induced by psychoactive drugs rather than pathological conditions, and discuss (...) its relevance to the debate on the sense of body ownership. Quais são as causas do descontentamento das pessoas com a política, pergunta-se o filósofo Renato Janine Ribeiro na abertura de O Valor Volta à Política, coletânea de artigos escritos entre 2011 e 2015, num momento de forte otimismo com um país que, após consolidar a democracia, parecia destinado a fortalecê-la e se desenvolver. O retrocesso que o atingiu - assim como a outros países - substituiu a política pelo ódio. Mais que o antipetismo, o maior triunfo desse furor foi (...) a antipolítica. Mas o que aconteceu? Será que a vida política se tronou um efeito da vida econômica? Se a cidadania, em nossos dias, realmente foi substituída pelo consumo, então é a subida ou a queda no nível de vida o principal critério para as pessoas decidirem seus votos? É recorrendo ao tempo longo que Janine vai examinar se o apelo democrático simplesmente se esgotou ou se o que estamos vivendo é uma "reação reacionária" dos ressentidos com um mundo em transformação. Observador atento e afiado, o próprio autor revisita esses anos de efervescência tecendo, em 2021 - portanto após a ascensão da extrema-direita -, comentários aos seus artigos. This book offers a unique perspective on Zionism. The author, a geneticist by training, focuses on science, rather than history. He looks at the claims that Jews constitute a people with common biological roots. An argument that helps provide justification for the aspirations of this political movement dedicated to the return of the Jewish people to their homeland. His study explores two issues. The first considers the assertion that there is a biology of the Jews. The second deals with attempts (...) to integrate this idea into a consistent history. Both issues unfolded against the background of a romantic national culture of Western Europe in the 19th century: Jews, primarily from Eastern Europe, began to believe these notions and soon they took the lead in the re-formulation of Jewish and Zionist existence. The author does not intend to present a comprehensive picture of the biological literature of the origins of a people and the blood relations between them. He also recognizes that the subject is emotionally-loaded. The book does, however, present a profound mediation on three overlapping questions: What is special or unique to the Jews? Who were the genuine Jews? And how can one identify Jews? This volume is a revised and edited English version of Tzionut Vehabiologia shel Hayehudim, published in 2006. (shrink)
