ZusammenfassungDie traditionsreiche Deutsche Gesellschaft für Innere Medizin war durch ihr Agieren in der NS-Zeit belastet. Vor ihrem ersten Nachkriegskongress 1948 in Karlsruhe fiel dem Bonner Klinikdirektor Paul Martini die Rolle eines Reorganisators zu. Martini, der während der NS-Zeit in Opposition zum Regime gestanden hatte, wählte einen Kurs umfassender Integration. Verfolgte des NS-Staats versuchte er ebenso in die DGIM einzubinden wie einstige gemäßigte Nationalsozialisten. Zugleich bemühte er sich um die Bewahrung des gesamtdeutschen Charakters der Kongresse sowie um einen zügigen Anschluss an (...) die internationale Forschung. Dennoch führte der eingeschlagene Weg die DGIM in nur scheinbar unpolitische Wissenschaftlichkeit und Jahrzehnte weitgehender Kritiklosigkeit gegenüber ihrer NS-Geschichte. (shrink)

Objectives Medical futility at the end of life is a growing challenge to medicine. The goals of the authors were to elucidate how clinicians define futility, when they perceive life-sustaining treatment (LST) to be futile, how they communicate this situation and why LST is sometimes continued despite being recognised as futile. Methods The authors reviewed ethics case consultation protocols and conducted semi-structured interviews with 18 physicians and 11 nurses from adult intensive and palliative care units at a tertiary hospital in (...) Germany. The transcripts were subjected to qualitative content analysis. Results Futility was identified in the majority of case consultations. Interviewees associated futility with the failure to achieve goals of care that offer a benefit to the patient's quality of life and are proportionate to the risks, harms and costs. Prototypic examples mentioned are situations of irreversible dependence on LST, advanced metastatic malignancies and extensive brain injury. Participants agreed that futility should be assessed by physicians after consultation with the care team. Intensivists favoured an indirect and stepwise disclosure of the prognosis. Palliative care clinicians focused on a candid and empathetic information strategy. The reasons for continuing futile LST are primarily emotional, such as guilt, grief, fear of legal consequences and concerns about the family's reaction. Other obstacles are organisational routines, insufficient legal and palliative knowledge and treatment requests by patients or families. Conclusion Managing futility could be improved by communication training, knowledge transfer, organisational improvements and emotional and ethical support systems. Das deutsche Gesundheitswesen steht durch die schnell steigende Anzahl an CO- VID-19-Erkrankten vor erheblichen Herausforderungen. In dieser Krisensituation sind alle Beteiligten mit ethischen Fragen konfrontiert, beispielsweise nach gerech- ten Verteilungskriterien bei begrenzten Ressourcen und dem gesundheitlichen Schutz des Personals angesichts einer bisher nicht therapierbaren Erkrankung. Daher werden schon jetzt klinische und ambulante Ethikberatungsangebote verstärkt mit Anfragen nach Unterstützung konfrontiert. Wie können Ethikberater*innen Entscheidungen in der Krankenversorgung im Rahmen der COVID-19-Pandemie unterstützen? Welche Grenzen von Ethikberatung sind zu beachten? Bislang liegen hierzu (...) noch wenige praktische Erfahrungen vor. Angesichts der dynamischen Entwicklung erscheint es der Akademie für Ethik in der Medizin (AEM) wichtig, einen Diskurs über die angemessene Rolle der Ethikberatung bei der Bewältigung der vielfachen Heraus- forderungen durch die COVID-19-Pandemie zu führen und professionelle Hinweise zu geben. Mit dem vorliegenden Diskussionspapier möchte die AEM einen Beitrag zur Beantwortung wesentlicher Fragen leisten, die sich für die Ethikberatung in den verschiedenen Bereichen des Gesundheitswesens stellen. Sie regt an, diesen Dis- kurs weiter zu führen und hat ein Online-Forum (s. unten) eingerichtet, in dem Ethikberater*innen ihre Erfahrungen teilen und die professionelle Selbstreflexion der Ethikberatung in Pandemiezeiten mit Anregungen fördern können. This book addresses the question of how to properly handle Dōgen’s texts, a core issue that became critical during the Meiji period in which the philosophical appropriation of Dōgen became apparent inside and outside of the monastery. In present day Dōgen studies, most scholarship is informed by a number of factions representing Dōgen. The chapters herein address: the Zennist (j. zenjōka) emphasising practice, the Genzōnians (j. genzōka) shifting the attention to the close reading of Dōgen’s texts, the laity movement opening (...) up both the texts and the practice to people in modern society, and the Genzō researchers (j. genzō kenkyūka) searching for the authenticity and truth of Dōgen’s writings. The book aims to clarify the rightful place of Dōgen: in the monastery, in denominational studies, or in modern academic philosophy? It brings forth various viewpoints on Dōgen, and analyzes the relations of these viewpoints from the premodern to modern times. The collected volume appeals to students and researchers in the field while establishing hermeneutic standards of reading and proposing new, original, and critical interpretations of Dōgen’s texts. Business Ethics: A European Review, EarlyView.

Emergence of the novel pathogenic coronavirus SARS‐CoV‐2 and its rapid pandemic spread presents challenges that demand immediate attention. Here, we describe the development of a semi‐quantitative high‐content microscopy‐based assay for detection of three major classes (IgG, IgA, and IgM) of SARS‐CoV‐2 specific antibodies in human samples. The possibility to detect antibodies against the entire viral proteome together with a robust semi‐automated image analysis workflow resulted in specific, sensitive and unbiased assay that complements the portfolio of SARS‐CoV‐2 serological assays. Sensitive, specific (...) and quantitative serological assays are urgently needed for a better understanding of humoral immune response against the virus as a basis for developing public health strategies to control viral spread. The procedure described here has been used for clinical studies and provides a general framework for the application of quantitative high‐throughput microscopy to rapidly develop serological assays for emerging virus infections. Peter Abelard (1079–1142 ce) was the most wide‐ranging philosopher of the twelfth century. He quickly established himself as a leading teacher of logic in and near Paris shortly after 1100. After his affair with Heloise, and his subsequent castration, Abelard became a monk, but he returned to teaching in the Paris schools until 1140, when his work was condemned by a Church Council at Sens. His logical writings were based around discussion of the “Old Logic”: Porphyry's Isagoge, aristotle'S Categories and (...) On Interpretation and boethius'S textbook on topical inference. They comprise a freestanding Dialectica (“Logic”; probably c.1116), a set of commentaries (known as the Logica [Ingredientibus], c. 1119) and a later (c. 1125) commentary on the Isagoge (Logica Nostrorum Petititoni Sociorum or Glossulae). In a work Abelard called his Theologia, issued in three main versions (between 1120 and c.1134), he attempted a logical analysis of trinitarian relations and explored the philosophical problems surrounding God's claims to omnipotence and omniscience. The Collationes (“Debates,” also known as “Dialogue between a Christian, a Philosopher and a Jew”; probably c.1130) present a rational investigation into the nature of the highest good, in which the Christian and the Philosopher (who seems to be modeled on a philosopher of pagan antiquity) are remarkably in agreement. The unfinished Scito teipsum (“Know thyself,” also known as the “Ethics”; c.1138) analyses moral action. (shrink)

ZusammenfassungEin Großteil der medizinisch und ethisch schwierigen Therapieentscheidungen betrifft kritisch kranke, einwilligungsunfähige Patienten und wird auf Basis des mutmaßlichen Patientenwillens getroffen. Das Gesetz kann hierzu nur allgemeine Vorgaben geben. Es ist für die behandelnden Ärzte essentiell, sich ein konkretes Vorgehen zu erarbeiten. Wie in der Praxis vorgegangen wird, ist bisher kaum untersucht. Ziel dieser Studie ist es, die Vielfalt der Herangehensweisen und Erfahrungen von Klinikern zum mutmaßlichen Patientenwillen zu erforschen. Wir führten semistrukturierte Interviews mit 18 Ärzten und elf Pflegekräften von (...) intensiv- und palliativmedizinischen Abteilungen eines Universitätsklinikums durch. Die Abschriften der Tonaufnahmen wurden mithilfe der Qualitativen Datenanalyse ausgewertet. Auf einer numerischen Ratingskala wurde erhoben, wie hilfreich die Kliniker das Konzept des mutmaßlichen Willens fanden. Die meisten Studienteilnehmer hielten das Konzept des mutmaßlichen Willens für sehr hilfreich. Zu ihrem Vorgehen berichteten sie, dass sie zumeist die nächsten Angehörigen befragen, zuweilen auch Professionelle und falls möglich die Patienten selbst. Gefragt werde nach früheren Äußerungen der Patienten, nach ihrer Lebenspraxis und -einstellung sowie ihrem aktuellen Verhalten. Benannt wurden auch zahlreiche Unsicherheiten und Schwierigkeiten psychologischer, sozialer, praktischer und konzeptioneller Natur. Der mutmaßliche Patientenwille wird, so unser Ergebnis, in der von uns untersuchten klinischen Praxis entsprechend den gesetzlichen Vorgaben ermittelt. Da jedoch zahlreiche Probleme berichtet werden, stellen wir konkrete Empfehlungen zur Ermittlung des mutmaßlichen Willens vor. (shrink)

Sensationalistic Phenomenalism and Economy of Thought. On Ernst Mach's Concept of Science. Ernst Mach, natural scientist and major precursor of the Vienna Circle, never wants to be a philosopher. Nevertheless his writings are full of valuable hints for a modern theory of human knowledge – with respect to economical, historical and evolutionary aspects. His kind of phenomenalism is sensationalistic, monistic and instrumentalistic. This article deals with some contributions of his approach to actual debates in the general philosophy of science.

So einleuchtend der Gedanke ist, dass alle Menschen qua ihres Menschseins und unabhängig von ihren individuellen Eigenschaften gleich an Würde und Rechten sind, so unbefriedigend scheint er jedoch auf den ersten Blick zu sein, wenn man sich dem Thema der Kinderwürde und Kinderrechte zuwendet. Denn erstens scheint es auch innerhalb des grundsätzlichen Rechts auf moralische Berücksichtigung spezielle Formen der Achtung oder Missachtung der kindlichen Würde zu geben. Und zweitens stellt sich das Problem eines richtigen Verständnisses der Kinderwürde noch einmal grundsätzlicher, (...) wenn man nach der begründenden Rolle der Menschenwürde für die Menschenrechte fragt. Denn hier liegt es nahe, auf bestimmte Würde verleihende Charakteristika aller Menschen zurückzugreifen, von denen es aber sehr fraglich ist, ob auch Kinder sie teilen. Es ist ein Verdienst Georg Lohmanns, in seinen Arbeiten auf beide Schwierigkeiten der zu einfachen Charakterisierung des Verhältnisses zwischen Kindern und Würde hingewiesen zu haben. Ich werde deshalb zunächst, in den ersten beiden Teilen meines Beitrags, orientiert an seinen Überlegungen, herausarbeiten, inwiefern dieses Verhältnis hier zu einem Problem wird. Einen Lösungsvorschlag, also eine positive Charakterisierung der Würde des Kindes, hat Lohmann, soviel ich weiß, bislang nicht vorgelegt. Im letzten Teil des Beitrags möchte ich skizzieren, wie eine Lösung meines Erachtens aussehen könnte. (shrink)

This article is concerned with the role empirical research can play in normative practical ethics. There is no doubt that ethical research requires some kind of collaboration between normative disciplines and empirical sciences. But many researchers hold that empirical science is only assigned a subordinate role, due to the doctrine that normative conclusions cannot be justified by descriptive premises. Scientists working in the field of ethics commonly hold, however, that the empirical sciences should play a much bigger role in ethical (...) research. The aim of this paper is to show that empirical sciences can play a substantive role in normative ethics, with no illicit inferences from is to ought. To achieve this aim, I explain Hume’s thesis. In the following sections, I am concerned with different uses of empirical data that do not imply an illicit inference from descriptive premises to a normative conclusion. The article demonstrates that there are many modes of ethical reasoning that allow for a substantive use of empirical data, and it also shows the importance of Hume’s thesis for clarifying ethical reasoning. Modern medicine provides unprecedented opportunities in diagnostics and treatment. However, in some situations at the end of a patient’s life, many physicians refrain from using all possible measures to prolong life. We studied the incidence of different types of treatment withheld or withdrawn in 6 European countries and analyzed the main background characteristics.

In her essay , 82–111), Shell wants to demonstrate that 1. Kant's theory of the right of nations ‘can furnish us with some much needed practical help and guidance’, and 2. ‘Kant is less averse to the use of force, including resort to pre-emptive war… than he is often taken to be’ . The first claim is unconvincing. The second one is in need of clarification. Shell turns Kant into a kind of realist and just-war theorist, into a liberal who (...) is prejudiced against illiberal regimes. In the end, her Kant is closer to Locke, Vattel and other early liberal international lawyers than to himself. Almost all that is unique in Kant's theory of the right of nations gets lost. In this, Shell follows a general trend among some Kant interpreters: the interpretation is only loosely based on Kant; it claims to follow his ‘spirit’ and offers creative ‘Kantian perspectives’. Amidst interpretational creativity, Kant's texts more or less disappear in the mist. (shrink)

In this paper my primary aim is to present a logical system of practical reasoning that can be used to assess the validity of practical arguments, that is, arguments with a practical judgment as conclusion. I begin with a critical evaluation of other approaches to this issue and argue that they are inadequate. On the basis of these considerations, I explain in Sect. 2 the informal conception of practical validity and introduce in Sect. 3 the logical system P , which (...) is an extension of propositional logic and can be used to assess the validity of a wide range of practical arguments. In the last section, I apply this system to some examples of practical reasoning in order to demonstrate how it can be used in practice. (shrink)
