Joint attention occurs when two (or more) individuals attend together to some object. It has been identified by psychologists as an early form of our joint engagement, and is thought to provide us with an understanding of other minds that is basic in that sophisticated conceptual resources are not involved. Accordingly, it has also attracted the interest of philosophers. Moreover, a very recent trend in the psychological and philosophical literature on joint attention consists of developing the suggestion that it holds (...) partially in virtue of communication: it is because we share our thoughts or feelings about an object that our individual attention becomes joint. Legal reasoning requires identification through search of authoritative legal texts that apply to a given legal question. In this paper, using a network representation of US Supreme Court opinions that integrates citation connectivity and topical similarity, we model the activity of law search as an organizing principle in the evolution of the corpus of legal texts. The network model and probabilistic search behavior generates a Pagerank-style ranking of the texts that in turn gives rise to a natural geometry of the (...) opinion corpus. This enables us to then measure the ways in which new judicial opinions affect the topography of the network and its future evolution. While we deploy it here on the US Supreme Court opinion corpus, there are obvious extensions to large evolving bodies of legal text. The model is a proxy for the way in which new opinions influence the search behavior of litigants and judges and thus affect the law. This type of “legal search effect” is a new legal consequence of research practice that has not been previously identified in jurisprudential thought and has never before been subject to empirical analysis. We quantitatively estimate the extent of this effect and find significant relationships between search-related network structures and propensity of future citation. This finding indicates that “search influence” is a pathway through which judicial opinions can affect future legal development. (shrink)

This paper explains how an assertion may be understood despite there being nothing said or meant by the assertion. That such understanding is possible is revealed by cases of the so-called ``felicitous underspecification'' of demonstratives: cases where there is understanding of an assertion containing a demonstrative despite the interlocutors not settling on one or another object as the one the speaker is talking about (King 2014a, 2017, 2021). I begin by showing how Stalnaker's ([1978] 1999) well-known pragmatic principles adequately permit (...) and constrain the felicitous underspecification of demonstratives. I then establish a connection between the satisfaction of Stalnaker's principles and understanding, and show how that connection sheds further light on the relevant cases. After developing and motivating my proposal, I address some objections to it, then briefly discuss the felicitous underspecification of expressions other than demonstratives alongside contrasting my proposal with a similar one from Bowker (2015, 2019) that concerns definite descriptions. Beginnend in der sinnlichen Erfahrung und im Begreifen der Vielheit der Phänomene soll sich das Denken - durch Rückwendung ins Innere - seiner selbst und seines eigenen Grundes bewußt werden. Ziel (...) dieses denkenden, das eigene Sein in immer klarere Formen der Einheit verwandelnden Bewegung ist es, aus dem Vollzug eines mit sich selbst identisch gewordenen Denkens sich selbst zu überschreiten und sich mit dem Ursprung, dem Einen selbst, zu einen: Plotin erweist sich darin auch als Paradigma einer philosophischen Mystik.
