This contribution explores disability rights protection in Inter-American States within the framework of the OAS and in the context of the obligations established under the CIADDIS and the CRPD. Following the classical division between ‘primary’ and ‘secondary’ rules, the contribution first sketches key regulatory initiatives in the area of disability rights and second considers compliance and enforcement mechanisms. Along these lines, the first section illustrates similarities and differences between the CIADDIS and the CRPD and, within this framework, essential regional regulatory (...) initiatives. The second section assesses disability rights in select countries, based on periodic reports under the CIADDIS and CRPD. The section examines the four largest countries by population in the region, notably, the United States of America (US), Mexico, Brazil and Colombia. The third section explores the enforcement of disability rights via key cases before the Inter-American Commission on Human Rights (IAComHR) and the Inter-American Court of Human Rights (IACtHR). The purpose is providing a comprehensive understanding of disability rights in the region and identifying key regulatory problems and ways forward. (shrink)
Open peer commentary on the article “Lived Experience and Cognitive Science Reappraising Enactivism’s Jonasian Turn” by Mario Villalobos & Dave Ward. Upshot: Jonas was not defending an unrestrained anthropomorphism but, rather, a “zoomorphism,” which offered a rigorous, considered view of the deep phylogenetic origins of purpose and mind. Jonas did not reject science per se, but an alienated, rigid conception of the latter. His work helped pave the way to a richer science of mind.
A version of nonstandard analysis, Internal Set Theory, has been used to provide a resolution of Zeno's paradoxes of motion. This resolution is inadequate because the application of Internal Set Theory to the paradoxes requires a model of the world that is not in accordance with either experience or intuition. A model of standard mathematics in which the ordinary real numbers are defined in terms of rational intervals does provide a formalism for understanding the paradoxes. This model suggests that in (...) discussing motion, only intervals, rather than instants, of time are meaningful. The approach presented here reconciles resolutions of the paradoxes based on considering a finite number of acts with those based on analysis of the full infinite set Zeno seems to require. The paper concludes with a brief discussion of the classical and quantum mechanics of performing an infinite number of acts in a finite time. (shrink)

In 1931 the mathematical logician Kurt Godel published a revolutionary paper that challenged certain basic assumptions underpinning mathematics and logic. A colleague of Albert Einstein, his theorem proved that mathematics was partly based on propositions not provable within the mathematical system and had radical implications that have echoed throughout many fields. The first major work in the history of philosophy to bear the title "Metaphysics" was the treatise by Aristotle that we have come to know by that name. But Aristotle himself did not use that title or even describe his field of study as 'metaphysics'; the name was evidently coined by the first century C.E. editor who assembled the treatise we know as Aristotle's Metaphysics out of various smaller selections of Aristotle's works. The title 'metaphysics' -- literally, 'after the Physics' (...) -- very likely indicated the place the topics discussed therein were intended to occupy in the philosophical curriculum. They were to be studied after the treatises dealing with nature (ta phusika). In this entry, we discuss the ideas that are developed in Aristotle's treatise. (shrink)
In this highly original account of Bishop George Berkeley's epistemological and metaphysical theories, George S. Pappas seeks to determine precisely what doctrines the philosopher held and what arguments he put forward to support them. Specifically, Pappas overturns accepted opinions about Berkeley's famous attack on the Lockean doctrine of abstract ideas. Berkeley's criticism of these ideas had been thought relevant only to his views on language and to his nominalism; Pappas persuasively argues that Berkeley's ideas about abstraction are crucial to nearly (...) all of the fundamental principles that he defends. Pappas demonstrates how an adequate appreciation of Berkeley's views on abstraction can lead to an improved understanding of his important principle of esse is percipi, and of the arguments Berkeley proposes in support of this principle. Pappas also takes up Berkeley's widely rejected claim to be a philosopher of common sense. He assesses the validity of this self-description and considers why Berkeley might have chosen to align himself with a commonsense position. "One basic and underlying assumption of this investigation will be that there is a distinct continuity and development in Berkeley's thought which can be traced through all of his reflective analyses of the problem of perception." The essay argues for Berkeley's theory of perception as a "prototype of the phenomenalists." It argues also for Berkeley's incorporation of elements from the representative theory of perception. Of special interest is the treatment of Berkeley's doctrine of "suggestion" and its connection with the role (...) of imagination in the perception of physical objects. The linguistic aspect of Berkeley's work is minimized. Berkeley's theory of notions receives only a passing reference. The last third of the book is a clear and useful discussion of Berkeley and contemporary phenomenalism. In Carnap’s autobiography, he tells the story how one night in January 1931, “the whole theory of language structure” in all its ramifications “came to [him] like a vision”. The shorthand manuscript he produced immediately thereafter, he says, “was the first version” of Logical Syntax of Language. This document, which has never been examined since Carnap’s death, turns out not to resemble Logical Syntax at all, at least on the surface. Wherein, then, did the momentous insight of 21 January 1931 (...) consist? We seek to answer this question by placing Carnap’s shorthand manuscript in the context of his previous efforts to accommodate scientific theories and metalinguistic claims within Wittgenstein’s Tractatus theory of meaning. The breakthrough of January 1931 consists, from this viewpoint, in the rejection of the Tractatus theory in favor of the meta-mathematical perspective of Hilbert, Gödel, and Tarski. This was not yet the standpoint of the published Logical Syntax, as we show, but led naturally to the “principle of tolerance” and thus to Carnap’s mature philosophy, in which the inconsistencies between this first view and the principle of tolerance, which survived into the published Syntax, were overcome. Our study presents an overview of the issues that were brought forward by participants of a moral case deliberation (MCD) project in two elderly care organizations. The overview was inductively derived from all case descriptions (N = 202) provided by participants of seven mixed MCD groups, consisting of care providers from various professional backgrounds, from nursing assistant to physician. The MCD groups were part of a larger MCD project within two care institutions (residential homes and nursing homes). Care providers are (...) confronted with a wide variety of largely everyday ethical issues. We distinguished three main categories: ‘resident’s behavior’, ‘divergent perspectives on good care’ and ‘organizational context’. The overview can be used for agendasetting when institutions wish to stimulate reflection and deliberation. It is important that an agenda is constructed from the bottom-up and open to a variety of issues. In addition, organizing reflection and deliberation requires effort to identify moral questions in practice whilst at the same time maintaining the connection with the organizational context and existing communication structures. Once care providers are used to dealing with divergent perspectives, inviting different perspectives (e.g. family members) to take part in the deliberation, might help to identify and address ethical ‘blind spots’. In his book Shadows of the Mind: A search for the missing science of con- sciousness [SM below], Roger Penrose has turned in another bravura perfor- mance, the kind we have come to expect ever since The Emperor’s New Mind [ENM ] appeared. In the service of advancing his deep convictions and daring conjectures about the nature of human thought and consciousness, Penrose has once more drawn a wide swath through such topics as logic, computa- tion, artificial intelligence, quantum physics (...) and the neuro-physiology of the brain, and has produced along the way many gems of exposition of difficult mathematical and scientific ideas, without condescension, yet which should be broadly appealing.1 While the aims and a number of the topics in SM are the same as in ENM , the focus now is much more on the two axes that Pen- rose grinds in earnest. Namely, in the first part of SM he argues anew and at great length against computational models of the mind and more specifi- cally against any account of mathematical thought in computational terms. Then in the second part, he argues that there must be a scientific account of consciousness but that will require a (still to be found) non-computational extension or modification of present-day quantum physics. Stages on Life's Way, the sequel to Either/Or, is an intensely poetic example of Kierkegaard's vision of the three stages, or spheres, of existence: the esthetic, the ethical, and the religious. With characteristic love for mystification, he presents the work as a bundle of documents fallen by chance into the hands of "Hilarius Bookbinder," who prepared them for printing. The book begins with a banquet scene patterned on Plato's Symposium. (George Brandes maintained that "one must recognize with amazement that it (...) holds its own in this comparison.") Next is a discourse by "Judge William" in praise of marriage "in answer to objections." The remainder of the volume, almost two-thirds of the whole, is the diary of a young man, discovered by "Frater Taciturnus," who was deeply in love but felt compelled to break his engagement. The work closes with a letter to the reader from Taciturnus on the three "existence-spheres" represented by the three parts of the book. Stages on Life's Way not only repeats themes, characters, and pseudonymous authors of the earlier works but also goes beyond them and points to further development of central ideas in Concluding Unscientific Postscript. The later Wittgenstein’s perspective on mathematical sentences as norms is motivated for sentences belonging to Hilbertian axiomatic systems where the axioms are treated as implicit definitions. It is shown that in this approach the axioms are employed as norms in that they function as standards of what counts as using the concepts involved. This normative dimension of their mode of use, it is argued, is inherited by the theorems derived from them. Having been motivated along these lines, Wittgenstein’s perspective on (...) mathematical language may appeal also to those who are not friends of or experts on Wittgenstein’s later philosophy of mathematics. Nearly as famous as his denial of the existence of matter is Berkeley's insistence that his philosophy is somehow a defense of commonsense. This is most often taken to mean that Berkeley thinks of his philosophy as supporting commonsense beliefs. However, the inadequacies of such views have persuaded some to disregard entirely Berkeley's claims about commonsense. Both readings are undesirable. Extant interpretations misunderstand the relationship between Berkeley's philosophy and commonsense. In this paper, I present a new account of how to (...) understand Berkeley's so-called defense of commonsense; it is not a defense-cum-apology for commonsense beliefs, but a defensive attack against a skeptical threat. I then examine two rival accounts of the defense of commonsense and show how each fails to satisfy the criteria for a successful account. Finally, I briefly address the implications this view has for future scholarship. (shrink)
Hempel's paradox of the ravens has to do with the question of what constitutes confirmation from a logical point of view; Wason 's selection task has been used extensively to investigate how people go about attempting to confirm or disconfirm conditional claims. This paper presents an argument that the paradox is resolved, and that people's typical performance in the selection task can be explained, by consideration of what constitutes an effective strategy for seeking evidence of the tenability of universal or (...) conditional claims in everyday life. A layman's guide to the mechanics of Gödel's proof together with a lucid discussion of the issues which it raises. Includes an essay discussing the significance of Gödel's work in the light of Wittgenstein's criticisms.
Various claims have been made, recently, that Darwin's argumentation in the Origin instantiates and so supports some general philosophical proposal about scientific theorizing, for example, the "semantic view". But these claims are grounded in various incorrect analyses of that argumentation. A summary is given here of an analysis defended at greater length in several papers by the present author. The historical and philosophical advantages of this analysis are explained briefly. Darwin's argument comprises three distinct evidential cases on behalf of natural (...) selection, cases, that is, for its existence, its adequacy and its responsibility. Theorizing, today, about evolution by natural selection involves a similar structure of evidential and explanatory concerns. (shrink)
Hintikka has criticized psychologists for "hasty epistemologizing," which he takes to be an unwarranted transfer of ideas from psychology (a discipline dealing with questions of fact) into epistemology (a discipline dealing with questions of method and theory). Hamlyn argues, following Hintikka, that Gibson's theory of perception is an example of such an inappropriate transfer, especially insofar as Hamlyn feels Gibson does not answer several important questions. However, Gibson's theory does answer the relevant questions, albeit in a new and radical way, (...) which suggests that the alleged distinction between psychology and epistemology is suspect. In fact, contrary to Hintikka and Hamlyn's claims, Gibson's theory of perception appears to be a valuable source of epistemological as well as psychological ideas. (shrink)
