The paper reacts against the strict separation between dialectical and rhetorical approaches to argumentation and argues that argumentative discourse can be analyzed and evaluated more adequately if the two are systematically combined. Such an integrated approach makes it possible to show how the opportunities available in each of the dialectical stages of a critical discussion have been used strategically to further the rhetorical aims of the speaker or writer. This paper focuses on discourse analysis, particularly persuasive discourse, using pragmatics and rhetoric in a new combined way, called by us Pragma-Rhetoric. It can be said that this is a cognitive approach to both pragmatics and rhetoric. Pragmatics is essentially Gricean, Rhetoric comes from a new reading of Aristotle’s Rhetoric, extending his notion of discourse to meso- and micro-discourses. Two kinds of intentions have to be considered: first, communicative intention, and, then, persuasive intention. The fulfilment of those intentions (...) is achieved by a successful persuasive-communicative action. Analytic philosophers have, since the pioneering work of B.K. Matilal, emphasized the contributions of Nyāya philosophers to what contemporary philosophy considers epistemology. More recently, scholarly work demonstrates the relevance of their ideas to argumentation theory, an interdisciplinary area of study drawing on epistemology as well as logic, rhetoric, and linguistics. This paper shows how early Nyāya theorizing about argumentation, from Vātsyāyana to Jayanta Bhaṭṭa, can fruitfully be juxtaposed with the pragma-dialectic approach to argumentation pioneered by Frans van Eemeren. This paper describes the development of pragma-dialectics as a theory of argumentative discourse. First the development of the pragma-dialectical model of a critical discussion is explained, with the rules that are to be complied with in order to avoid fallacies from occurring. Then the integration is discussed of rhetorical insight in the dialectical framework. In this endeavour, the concept of strategic manoeuvring is explained that allows for a more refined and more profoundly justified analysis of argumentative (...) discourse and a better identification of fallacies. The article focuses on the New Rhetoric’s concept of quasi-logical arguments imitating logical or mathematical demonstrations, and examines it from point of view of pragma-dialectics as a device contributing towards resolving the difference of opinion. It is shown that the category of quasi-logical arguments cannot be considered as an argument scheme or a united type of strategic maneuvering. It is suggested to consider the category of quasi-logical arguments as a cluster of specific strategic maneuvers increasing the efficiency of arguments (...) under certain circumstances. France and New Caledonia are currently involved in an ongoing debate surrounding the independence of the latter from the former that will lead to referenda in 2018–2022. The main stakeholders in the negotiation process are France, the Caldoche population of the island agglomeration and its Kanak inhabitants. Most critical discourse studies analyse texts as expressions of power entrenched in monologues. In this paper, however, the debate between the social actors is seen as a plurilogue. The study argues that the dominant (...) interactants propagate a rhetoric of unity and homogeneity, aiming to further marginalise the Kanak people and other minority groups in New Caledonian society by rendering them invisible. It further argues that the French political power aims to persuade the other groups to accept the reality of a common destiny as a given truth. The paper combines Systemic Functional Linguistics and Pragma-dialectics, and incorporates postcolonial and poststructuralist perspectives into a critical study of discourse samples, taken from a larger corpus of French data, across various genres and registers. The analysis reveals that the French rhetoric of unity is built upon Republican principles inherent to neo-colonialist ideology. It also shows that the French rhetoric is being reproduced by local settler interactants, based on values that pertain to Caldoche nationalist ideology. Both French and Caldoche ideologies are in discord with Kanak socialist ideology. By exposing the existing power inequalities the study does not only contribute to defending the Kanak minority discourse, but also emphasises the rights for recognition and self-determination of the Kanak indigenous people of New Caledonia. Although the controversy between Malthus and Ricardo has long been considered to be an important source for the history of economic thought, it has hardly been the object of a careful study qua controversy, i.e. as a polemical dialogical exchange. We have undertaken to fill this gap, within the framework of a more ambitious project that places controversies at the center of an account of the history of ideas, in science and elsewhere. It is our contention that the dialogical co-text (...) is essential for reconstructing the meaning and the evolution of science. In the present paper we try to substantiate this contention by means of a pragma-rhetorical study of this particular controversy. First, we reconstruct, through an analysis of a chunk of the correspondence, a micro-level of specific moves and countermoves which constitute a sequential structure within which also meta-scientific and meta-controversial considerations play a role. We then move to a macro-level of analysis, looking for recurrent patterns of argumentation. Finally, we draw epistemological conclusions on the nature of rationality and progress as manifested in actual scientific controversies. (shrink)

Persuasive definitions – those that convey an attitude in the act of naming – are frequently employed in discourse and are a form of strategic maneuvering. The dynamics of persuasive definition are explored through brief case studies and an extended analysis of the use of the “war” metaphor in responding to terrorism after September 11, 2001. Examining persuasive definitions enables us to notice similarities and differences between strategic maneuvering in dialectical and in rhetorical argument, as well as differences (...) between the role of strategic maneuvering in normatively ideal argument and in actually existing argument. This will avoid the double standard of comparing ideal dialectic with actual rhetoric, or vice versa. The results of the analysis suggest possibilities for a rapprochement between dialectical and rhetorical approaches to argumentation. (shrink)

A pervasive feature of populism is the use of rescue narratives to stimulate emotional adherence with audience predicated on evoking fear versus hope for salvation. This paper argues that restricting the rhetorical appeal of rescue narratives to the affective domain obscures the argumentative function that these narratives partake in constructing political arguments. It, thus, claims that rescue narratives can perform as arguments when used to provide reasons to justify political action. The paper examines the way(s) Donald Trump employs rescue (...) narratives as arguments to justify military interventions in Iraq and Syria. The analytical framework supplements the argumentative strategies of the Discourse-Historical Approach to Critical Discourse Studies with pragma-dialectics’ argumentation schemes. The analysis shows that the different elements of the narrative construct premises for argument schemes adduced to justify the rightness of claims. Conceptualizing Trump’s rescue narratives as arguments prompts a reflection on the possibility of narrative discourse to be associated with the domain of reason. (shrink)

Since published acknowledgements of scientific misconduct are a species of image restoration, common strategies for responding publicly to accusations can be expected: from sincere apologies to ritualistic apologies. This study is a rhetorical examination of these strategies as they are reflected in choices in language: it compares the published retractions and letters of apology with the letters that charge misconduct. The letters are examined for any shifts in language between the charge of misconduct and the response to the charge (...) in order to assess whether the apology was sincere or ritualistic. The results indicate that although most authors’ published acknowledgments of scientific misconduct seem to minimize culpability by means of the strategic use of language, their resulting ritualistic apologies often still satisfy in some way the accusers’ (and thus their community’s) concerns. In this article the author develops a framework for a pragma-dialectical reconstruction of teleological argumentation in a legal context. Ideas taken from legal theory are integrated in a pragma-dialectical model for analyzing and evaluating argumentation, thus providing a more systematic and elaborate framework for assessing the quality of teleological arguments in a legal context. Teleological argumentation in a legal context is approached as a specific form of pragmatic argumentation. The legal criteria that are relevant for the evaluation of (...) teleological argumentation are discussed and translated in terms of critical questions that are relevant for the evaluation of the various forms of teleological argumentation. Disagreement space consists of all the commitments and understandings required for an utterance to take on its discourse function. These are virtual standpoints that can be called out for explicit argumentation. This paper shows how the Inquisition systematically controlled disagreement space, preventing some apparently important standpoints from ever being argued about, and requiring attention to others that may not have initially seemed relevant. This control of disagreement space constituted violation of the rules for critical discussion. The essay suggests that the (...) idea of disagreement space be slightly enlarged, to show the distinctions among virtual, possible, and actual disagreement spaces. The Inquisition's extra-argumentative power is what permitted its specification of the possible disagreement space. The analysis suggests that pragma-dialectics may have application in the criticism and analysis of social institutions. (shrink)

Argumentation can play an important role in medical consultation. A doctor could, for instance, argue in support of a treatment advice to overcome a patient’s hesitance about it. In this argumentation, the doctor might explicitly present him- or herself as an authority, thereby presenting an argument by authority. Depending on the specific conditions under which the doctor advances such an argument, the doctor’s argument by authority can constitute a sound or a fallacious contribution to the discussion. On the approach to discussions of policy choices that treats such discussions as instances of issue-processing, the joint use of the logic of questions and the logic of rules gives precise formulation to two sorts of issues. To one sort of issue belong issue-circumscribing questions; to another sort, issues-simplicter, which consist of disjunctions of policy proposals – so many proposed social rules – that are answers, in the case of each disjunction, to a given issue-circumscribing question. Work in pragma-dialectics (...) can take over the issue-processing approach; and by doing so add to the pragma-dialectical repertory further dimensions in the analysis of issues and in protocol-narratives of discussion. The analysis and narratives would now include accounts of how issue-circumscribing questions generate initial standpoints and how discussions sometimes end with compromises between standpoints. Further research questions follow about transformations of issues and the comparison of successive rounds of discussion. A narrative of one period of discussion during `the War on Drugs' in the United States illustrates these points. (shrink)

The question as to whether or not an argument isadditional may be decisive in the evaluation ofjudicial decisions. It is, however, often difficult todistinguish between arguments that are additional(obiter dicta) and arguments that are not (ratio decidendi). This paper will focus on twoproblems concerning this distinction: thecharacterization of obiter dicta and theiridentification. A pragma-dialectical approach toargumentation will be the framework in which theseproblems will be addressed. Its insights intodialogical aspects of argumentation will be used tocharacterize obiter dicta. And its (...) assessment oflinguistic clues for the recognition of argumentationstructures will be used for the identification ofobiter dicta. Problems related to the identificationof obiter dicta will be illustrated through ananalysis of decisions in which the expressions anyway, for that matter and if onlybecause are considered as indicative of obiter dicta. A systematic rhetorical analysis may reveal elements of multimodal argumentative discourse that would otherwise remain hidden. In this article, we present simultaneously the basics of the method we have developed to integrate theories about different modalities in one parallel processing framework for rhetorical analysis and the results of its application to an intriguing ad.

The 25th of January, 2011 witnessed a wave of political unrest all over Egypt, with repercussions that have re-shaped the future of contemporary Egypt. For the first time in the modern history of Egypt since the 1952 Nasserite revolution, grass-root protestors went to streets chanting slogans against the military regime headed by the (since then ex-) President of Egypt, Hosni Mubarak. This placed the then regime, as well as its mainstay, the National Democratic Party (NDP), in a political crisis on (...) both local and international scales. It is this critical moment that led Mubarak to give his unprecedented speech on February 1st, 2011. The speech has brought about epoch-making political changes in the history of contemporary Egypt. Under public pressure, two seminal declarations were made in this speech: (1) Mubarak’s intention not to nominate himself for a new presidential term; (2) a call on the Houses of Parliament to amend articles 76 and 77 of the constitution concerning the conditions on running for presidency and the period for the presidential term in Egypt. The present paper seeks to answer the following overarching question: what are the discursive strategies used for saving the political face of Mubarak in his speech on February 1st, 2011? I follow a text-analytic framework based on the socio-semantic theory of social actors and the pragmatic models of speech acts and face-threatening acts. The analysis reveals Mubarak’s attempt to save his positive political face as a legitimate President who regarded himself as the official ruler invested with absolute power over Egypt. (shrink)

In this contribution I characterize the role of the judge in the context of the argumentative activity of legal proceeding. I describe the role of the judge from a pragma-dialectical perspective and explain in which way this role promotes a rational resolution of the dispute. I specify how a critical discussion in accordance with the ideal model is implemented in legal procedure to accomplish the institutional point, a resolution of the dispute in accordance with the Rule of Law.

This article provides a rhetorical analysis of a public apology that was issued by conservative talk radio host Rush Limbaugh in response to criticism of on-air comments that he made in February 2012. I argue that Limbaugh deployed his apology as a plea for moral exoneration, not as a formal admission of misconduct. Hence his apology was meant to absolve Limbaugh from blame by offsetting acknowledgements of wrongdoing with an appeal to truth as a force for exculpation.

Within the Pragma-Dialectical School of argumentation theory both a normative and a descriptive component are essential in order to account for a reconstruction of argumentative language use. This paper concentrates on the descriptive component and discusses the choice of the adjacency pair as a tool for the systematic description of the confrontation stage of argumentative conversations. First a structural description of confrontation in conversation is developed from the discourse analytical approach to argumentation of Jackson and Jacobs, within the normative (...) frame of the theory of argumentation of Van Eemeren and Grootendorst. Then the pro's and con's of the adjacency pair model for the analysis of conversation in general and for that of argumentative conversation in particular are discussed. Where the adjacency pair fails, alternative models like Edmondson's model for the analysis of spoken discourse (1981) are examined. Finally the description of confrontation in conversations in terms of the adjacency pair is shown to be in line with the rational model for describing the pragmatic aspects of conversational coherence proposed by Jackson and Jacobs in 1983 and with their current thinking on the status of adjacency pairs (1987). For the elaboration of Jackson and Jacobs' sketch of a rational model of conversational coherence the use of notions from Edmondson's model of interactional analysis is recommended. (shrink)

This article analyzes the phrase "corporate rule" and related expressions as they occur in the discourse of globalization. It argues that the cognitive dimension of conceptual figures depends substantially on the figures' rhetoricity. The analysis has three parts: conceptual metaphor analysis that considers metonymy, primary metaphors, and rhetoricity; rhetorical analysis that considers intensity, responsiveness, and the role of the utterer; and analysis of "licensing stories" that are formed through conceptual blending of The Developed World and (...) The Developing World. This article claims that rhetorical analysis is an important method for metaphor studies because it allows us to see connections between metaphoric expressions and relevant discourse and to recognize the patterns of variation that attend figurative expressions. ABSTRACTIn this paper, we utilize a rhetorically grounded textual analysis to study the Open Letter, the first publicized text sent out from the Central government to all the Party and Communist Youth League members on 25 September 1980. By reading through the text, we identify three individual figures – the ‘people’ as ‘the origin of problems,’ the people as ‘reasonable and considerate,’ and those charged with advocating compliance as ‘active propagandists and responsible educators’ – that have been crafted in (...) the text. We argue that by constructing three subject positions that served to identify the people via both language and social practices, the Central government in China after Mao Zedong’s death constructed the discourses of urgency and necessity of adhering to the one-child policy to both convince and compel people to exercise responsibility in having only one child. Following a review of a call for a new rhetoric in the 1970s with new conceptualizations of language as symbolic and its occurrence within symbolic forms, this article details the role of ethnography in rhetorical analysis. Through a review of those studies that have examined the indigenous understandings of the choice of when or when not to speak and through what cultural frames, we advance a study of rhetoric within a study of localized cultural discourses. The article concludes (...) by bridging the prevailing understandings of rhetoric within an ethnography of communication suggesting that cultural analysis is not just an optional analytical method for consideration, but a crucial part of future rhetorical analyses. This paper answers the question how pragmatic argumentation which occurs in a legal context, can be analyzed and evaluated adequately. First, the author surveys various ideas taken from argumentation theory and legal theory on the analysis and evaluation of pragmatic argumentation. Then, on the basis of these ideas, she develops a pragma-dialectical instrument for analyzing and evaluating pragmatic argumentation in a legal context. Finally she demonstrates how this instrument can be used by giving an exemplary analysis and (...) evaluation of pragmatic argumentation in a decision of the Dutch Supreme Court. (shrink)

Critical discourse analysis (CDA) has been evident in disciplines such as sociology and cultural studies for many years, and is of increasing interest to nurse scholars internationally. This paper outlines what CDA is and how it might be used as an approach to analysing any health text, using an example from the UK — the teenage pregnancy strategy. Discourses and linguistic techniques used within this document are discussed, together with the potential impact they may have, both on health professionals (...) as readers, and on pregnant teenagers as targets of the strategy. Teenage pregnancy itself is an international concern, prompting different responses from the various governing bodies. When approaches to a health matter are so diverse across the developing world, it is useful to consider how policy analysis using CDA can advance our understanding of the positions taken up by the authors of the policies that might not otherwise be made explicit. Comparing frameworks for AI development allows us to see trends and reflect on how we are conceptualizing, interacting with, and imagining futures for AI. Recent scholarship comparing a range of AI frameworks has often focused methodologically on consensus, which has led to problems in evaluating potentially ambiguous values. We contribute to this scholarship using a rhetorical perspective attuned to how frameworks shape people’s actions. This perspective allows us to develop the concept of an “AI mainstream” through an analysis (...) of five of the highest-profile frameworks, including Asimov’s Three Laws. We identify four features of this emerging AI mainstream shared by most/all of the frameworks: human-centered design focus, abstraction-oriented ethical reasoning, privileged authorship, and ahistorical regulatory justifications. Notably, each of these features permeates each framework, rather than being limited to a single principle. We then evaluate these shared features and offer scholarly alternatives to complement and improve them. (shrink)

This article investigates the uneasy process of integrating midwifery’s alternative, women-centered model of childbirth care within the medically-dominated healthcare system in Canada. It analyses the impure processes of rhetorical identification and differentiation that characterized the debate about how to regulate midwifery in Ontario by examining a selection of submissions from diverse health care groups with vested interest in the debate’s outcome. In divergent ways, these groups strategically appeal to the value of the “public interest” in order to advance professional (...) concerns. The study considers the implications of this rhetorical process for re-defining midwifery’s distinctive professional identity in relation to other health professions, to the state, and to the women for whom midwives care. Likewise, it suggests the relevance of rhetorical analysis for understanding the discursive formation and re-formation of health models, values, and professions in Western culture. (shrink)
