In this book the practical dimension of social justice is explained using the analysis and discussion of a variety of well-known topics. These include: the relation between theory and practice in normative political philosophy; the issue of justice under uncertainty; the question of whether we can and should unmask social injustices by means of conspiracy theories; the issues of privacy and the right to privacy; the issue of how certain psychological states may affect our moral obligations, in particular the (...) obligation to treat others fairly; and finally the concepts of morality, fairness, and self-deception. The primary goal of the book is to provide readers with an updated discussion of some important and practical social justice issues. These issues are presented from a new perspective, based on the author ́s research. It is hoped that bringing these topics together in a single book will promote the emergence of new insights and challenges for future research. Questions are known to play a crucial role in helping to structure linguistic communication. I argue that paying attention to questions is also necessary for understanding disagreement, and in particular for distinguishing between genuine and merely verbal disagreements. I argue, moreover, that some of the questions that play this role are essentially practical questions, questions about what to do. Such questions can remain open even after questions about what is the case have (...) been settled. Essentially practical questions help structure discourse no less than ordinary questions. I argue that once we acknowledge them and their role in communication, we have new resources for making sense of cases of so-called “faultless disagreement” involving taste and aesthetic predicates within a standard, non-relativist semantics. Although the concept of Responsible Innovation (RI) has been applied to different types of innovations, three common assumptions have remained the same. First, emerging technologies require assessment because of their radical novelty and unpredictability. Second, early assessment is necessary to impact the innovation trajectory. Third, anticipation of unknowns is needed to prepare for the unpredictable. I argue that these assumptions do not hold for liminal innovation practices in clinical settings, which are defined by continuous transition on both sides of the (...) threshold between experiment and implementation, and between research and care. First of all, technologies at the center of liminal innovation practices have different characteristics than those typically attributed to emerging technologies. Additionally, the innovation trajectory is significantly different allowing continuous assessment and shaping long after implementation. Finally, these differences demand a reorientation in RI approaches for these cases, away from anticipation of the unknown and uncertain, and returning to observation of the known and predictable. Developments in professional practice can be related to ongoing changes in relations of power among professionals, which often lead to changes in the boundaries of practices. The differing contexts of practices also influence these changing relations among health professionals. Legislation governing professional practice also differs from country to country. In Brazil, over the past 12 years, in a climate of deep disagreement, a new law to regulate medical practice has been discussed. It was sanctioned, or made into law, but with (...) some notable changes, in July 2013. Of interest to us in this paper are the ways the proposed legislation, by setting out the boundaries and scope of medical practice, ‘interfered’ in the practices of other health professions, undermining many ‘independent’ practices that have developed over time. However, even taking into account the multiple routes through which practices are established and developed, the role of legislation that seems able to contradict and deny the historical realities of multiple, intersecting practices should be critically interrogated. In this paper, we use the theoretical resources of poststructuralist thinking to explore gaps, ambiguities, and power relations implicit in the discourses that constituted this law. We argue that although the new law can be understood as a social and political device that will interfere in the organization of other health professions’ practices, such legislation is only part of what constitutes change in a consolidated professional practice. And while it is important to understand the effects of such legislation, healthcare practices are also realized or ‘made real’ through ongoing relations of knowledge and power, including, as we will see in this case, activities of resistance. The problem, then, is to understand the practical arrangements, including legislation, traditions and routines, values and knowledge that come to shape the practices of nursing in a particular context. Metascientists have studied questionable research practices in science. The present article considers the parallel concept of questionable metascience practices (QMPs). A QMP is a research practice, assumption, or perspective that has been questioned by several commentators as being potentially problematic for metascience and/or the science reform movement. The present article reviews ten QMPs that relate to criticism, replication, bias, generalization, and the characterization of science. Specifically, the following QMPs are considered: (1) rejecting or ignoring self-criticism; (2) a fast ‘n’ bropen (...) scientific criticism style; (3) overplaying the role of replication in science; (4) assuming a replication rate is “too low” without specifying an “acceptable” rate; (5) an unacknowledged metabias towards explaining the replication crisis in terms of researcher bias; (6) assuming that researcher bias can be reduced; (7) devaluing exploratory results as being more “tentative” than confirmatory results; (8) presuming that questionable research practices are problematic research practices; (9) focusing on knowledge accumulation; and (10) focusing on specific scientific methods. It is stressed that only some metascientists engage in some QMPs some of the time, and that these QMPs may not always be problematic. Research is required to estimate the prevalence and impact of QMPs. In the meantime, QMPs should be viewed as invitations to ask questions about how we go about doing better metascience. (shrink)

This is a controversial work of applied legal theory, addressing urgent contemporary questions about law and the state, about the character of the UK as a state, and about the juridical character of the European Union.

This article presents results from the national survey conducted in 2018 for the project Research Integrity in Norway. A total of 31,206 questionnaires were sent out to Norwegian researchers by e-mail, and 7291 responses were obtained. In this paper, we analyse the survey data to determine attitudes towards and the prevalence of fabrication, falsification and plagiarism and contrast this with attitudes towards and the prevalence of the more questionable research practices surveyed. Our results show a relatively low percentage of self-reported (...) FFPs, while the number of researchers who report having committed one of the QRPs during the last three years reached a troublesome 40%. The article also presents a ranking of the perceived severity of FFP and QRPs among Norwegian researchers. Overall, there is a widespread normative consensus, where FFP is considered more troublesome than QRPs. (shrink)

Considerable demand for academic research and publications is not a new subject of discussion in the academic field. In Indonesia, there is increasing challenge and pressure to conduct scientific publications, making it a very competitive field for academics, particularly for lecturers and postgraduate students. The present study examines Indonesian scholars’ perceptions of academic publishing as a demand from institutions and the government, as well as their understanding of academic misconduct. We conducted a survey with open-ended questions to 55 scholars. (...) The results suggest that Indonesian scholars are knowledgeable about academic publishing and believe that this obligation is inevitable and beneficial for them. To what extent academic misconduct in publications falls under their understanding, though, is still unclear. When presented with information on academic misconduct, in particular using unethical publication services, they show an ambiguous and inconsistent manner, as if the misconduct is understandable. Interestingly, they also reveal other ethically dubious behaviors that appear to be common among Indonesian scholars. The findings indicate that the issue of academic misconduct is still addressed ambiguously by using publication demands as a scapegoat to justify certain unethical publication practices. (shrink)

Breaches of research integrity have gained considerable attention due to high-profile scandals involving questionable research practices by reputable scientists. These practices include plagiarism, manipulation of authorship, biased presentation of findings and misleading reports of significance. To combat such practices, policymakers tend to rely on top-down measures, mandatory ethics training and stricter regulation, despite limited evidence of their effectiveness. In this study, we investigate the occurrence and underlying factors of questionable research practices (QRPs) through an original survey of 3,005 social and (...) medical researchers at Swedish universities. By comparing the role of the organizational culture, researchers´ norms and counter norms, and individual motivation, the study reveals that the counter norm of Biasedness—the opposite of universalism and skepticism—is the overall most important factor. Thus, Biasedness was related to 40–60% of the prevalence of the questionable practices. The analysis also reveals the contradictory impact of other elements in the organizational environment. Internal competition was positively associated with QRP prevalence, while group-level ethics discussions consistently displayed a negative association with such practices. Furthermore, in the present study items covering ethics training and policies have only a marginal impact on the prevalence of these practices. The organizational climate and normative environment have a far greater influence. Based on these findings, it is suggested that academic leaders should prioritize the creation and maintenance of an open and unbiased research environment, foster a collaborative and collegial climate, and promote bottom-up ethics discussions within and between research groups. We begin by considering how questioning as a discursive practice is a central vehicle for constructing social worlds and reflecting existing ones. Then we describe the different ways questions and question have been defined, typologized, and critiqued, in general and within seven institutions including policing, the courts, medicine, therapy, research interviews, education, and mediated political exchanges. Misconduct in science is often viewed and analyzed through the lenses of normative ethics and moral philosophy. However, notions and methods in the philosophy of science could also provide rather penetrative explanatory insights into the nature and causes of scientific misconduct. A brief illustration in this regard, using as examples the widely popular Popperian falsification and the Kuhnian scientific paradigm, is provided. In multiple areas of scientific research, failure to seek falsification in a Popperian manner constitutes a questionable research practice (...) and could lead to “falsification” in the context of research misconduct. On the other hand, scientific misconduct is often facilitated by its perpetrators using the familiarity, expectations and confines of a Kuhnian paradigm to blend in fabricated data/results. A rudimentary application of these philosophical notions could be useful in our understanding of the nature and cause of research misconduct, and facilitate mitigation of the latter through educational means. Purpose Intellectual honesty and integrity are the cornerstones of conducting any form of research. Over the last few years, scholars have shown great concerns over questionable research practices (QRPs) in academia. This study aims to investigate the questionable research practices amongst faculty members of medical and dental colleges in Pakistan. Method A descriptive multi-institutional online survey was conducted from June-August 2022. Based on previous studies assessing research misconduct, 43 questionable research practices in four domains: Data collection & storage, Data analysis, (...) Study reporting and Collaboration & authorship were identified and investigated. Descriptive (Frequencies, Percentages, Mean, SD) and Inferential (chi square) statistics were calculated. Results A total of 654 faculty members responded. Every respondent reported committing at least one QRP in their career. The most common QRPs included deliberately failing to mention funding, publishing program evaluation data not meant for research purposes or approved by an ethical body, inappropriately storing identifiable information and non-disclosure of any conflicts. There was significant association of age, gender and academic rank with QRPs in ‘Data collection and storage’ and ‘Data Analysis’ domains. Conclusion Medical and dental faculty members participating in this study are involved in a range of questionable research practices (QRPs) in Pakistan. Their confession might have contributed to the faculty developing self-awareness and reinforcing academic integrity. There is a need for reviewing policies and practices to improve research culture. Future research should explore the factors resulting in such practices. (shrink)

Humanistic theory for more than the past 100 years is marked by extensive attention to practice and practices. Two prominent streams of thought sharing this focus are pragmatism and theories of practice. This volume brings together internationally prominent theorists to explore key dimensions of practice and practices on the background of parallels and points of contact between these two traditions. The contributors all are steeped in one or both of these streams and well-known for their work on practice. This paper presents an analysis of the applicability of a principalist approach for a global, or cross-cultural, bioethics. We focus especially on the principle of individual autonomy, a core value in ethical discourse. We echo some long-standing criticisms of other anthropologists, sociologists, and many medical ethicists that the individualistic approach to autonomy is a Euro-American value and cannot be ethically applied in all settings. As a remedy, we suggest an adaptation of Kleinman's Explanatory Model approach to questions of decisionmaking. (...) We argue that the analysis and resolution of ethical dilemmas might also benefit from forms of pedagogy that integrate anthropological and other social science perspectives, and the incorporation of ethnographic techniques in ethical practice. ZusammenfassungEthische Fragen der Pflegepraxis haben sich in den letzten Jahren zugespitzt. Sie sind häufig verbunden mit einer grundsätzlichen Sorge um eine kompetente und verantwortliche Pflege, die den Bedürfnissen von Patient*innen gerecht wird. Forschungen aus drei Jahrzehnten zeigen, dass strukturelle Beschränkungen, Konflikte mit Kolleg*innen, Patient*innen und Angehörigen sowie eine Managementorientierung und die Unsichtbarkeit der Pflegearbeit, Ursachen für die grundsätzlichen Sorgen sind. Sie führen zu moralischem Stress, fehlenden Beziehungen und einer Fragmentierung der Pflege. Teilweise reagieren Pflegende widerständig, indem sie beispielsweise die Regeln (...) beugen und eine passive „wait and see“ Position einnehmen. Einige Pflegende erheben ihre Stimme und suchen ein Klinisches Ethikkomitee auf. Klinische Ethikkomitees bieten eine Möglichkeit, die komplexen ethischen Fragen der Pflegepraxis zu thematisieren. Allerdings verweisen die Studien aus drei Dekaden auf einen Mangel der Thematisierung. Die Analyse der Ursachen lässt die Schlussfolgerung zu, demokratischen Lernprozessen Raum zu geben. (shrink)

Culinary traditions and food practices are at the center of our daily lives and therefore constitute an important part of culture. Whether they are part of significant rituals or simply routinely enacted, they tell us something about the way we relate to each other and to the non-human world. In other words, food practices have an ethical dimension. Our paper focuses on the possibility to make objective ethical assessments of problematic cultural practices rooted in culinary traditions as a reply to (...) arguments associated with an ethical relativism according to which cultures produce ethical systems that are self-validating and therefore that cannot be criticized objectively. Drawing from examples involving animal cruelty and production methods harmful to the environment, we argue that it is possible to judge ethically questionable food practices from an objectivist standpoint inspired by moral progress, in contrario to a relativist point of view. Following a short discussion of ethical relativism, we present the outline of an acceptability test for questionable food practices and use it to analyse the case of the dog meat industry in South Korea. This paper investigates how the credit incentive to engage in questionable research practices interacts with cumulative advantage, the process whereby high-status academics more easily increase their status than low-status academics. I use a mathematical model to highlight two dynamics that have not yet received much attention. First, due to cumulative advantage, questionable research practices may pay off over the course of an academic career even if they do not appear attractive at the level of individual publications. Second, because of the (...) role of bottleneck moments in academic careers, questionable research practices may be selected for even if they do not provide a benefit in expectation. Nuestro análisis empieza por reconstruir el contexto en el que esta obra vio la luz, para luego abordar la cuestión de la "socialidad", entre otras nociones clave vinculadas a la teoría sartreana de los conjuntos prácticos. When praxis is conceived broadly as a dialectical perspective on human action—that agents and structures interact in mutually determining ways—the term becomes, in fact, an accurate summary of the entire Burkean corpus: "If we understand it as Burke does," Crusius continues, "all that he wrote is praxis" (1999, 198). While the activities of agents will tend to reify the dominant external conditions in which agents act, these external conditions are nonetheless open to change inasmuch as the evolving practices of individuals might come to challenge them. This perspective of the determined, yet determining nature of human practice is aptly summarized in The German Ideology, where Marx and Engels famously argue that "circumstances make men just as much as men make circumstances" (2000, 189).3 As Michel de Certeau's seminal studies of practice have demonstrated (de Certeau 1984; de Certeau, Giard, and Mayol 1998), the power of this relationship of mutual constitution between individuals and their worlds of external circumstances owes directly to the banality of the actions through which such constitution is accomplished—actions ranging from the way bread is served in a given household, to the way cosmetics are purchased in department stores, to the general "ways of operating" in urban spaces, including simply walking in one's own neighborhood (de Certeau, Giard, and Mayol 1998; Mayol 1998, 7-13). But while Dramatism and practice rest on similar perspectives of the dialectically constitutive nature of human action, several aspects of the grammar through which Burke investigates motive might appear to limit, or even to preclude, the Dramatistic examination of practice as a kind of motivated action. It is practically impossible not to be impressed by Stalnaker's breadth of knowledge, deep understanding of early Chinese texts, and keen observations about how the early Chinese philosophers offer intellectual resources still very much relevant to us today. My comments will focus on the relationship between skill and virtue. In international politics, bridging the gap between the real and knowledge poses a persistent challenge as translating the real into concepts and narratives can nurture the epistemic fallacy. Critical realism addresses this by separating ontology from epistemology at the meta-theoretical level, yet in practical research, critical realism tends to impose assumptions about the ontological complexity of the real at the transcendental level. This paper examines the practical difficulty of overcoming the epistemic fallacy in International Relations inquiries, asserting that (...) critical realism does not effectively guide practical inquiries in separating ontology from epistemology at a methodological level. Despite the meta-theoretical separation, research inquiries can remain theory-laden and epistemically dependent. The solution lies in problematizing ontological presentation, and sustaining critique at the discursive level on International Relations theories, methodologies, and implications. This approach maintains a critical focus on ontological aspects at the practical level to deal with the challenge of the epistemic fallacy. (shrink)

SummaryDo we need to recognize distinctive forms of reasoning about what should be done that are not reducible to deductive or inductive forms? A canonical form for such deliberative reasoning is proposed, in which the conclusion is a “praxigenic dictum” . It is argued that a deliberative argument has a kernel that can be viewed as the proposed solution to a specified problem or task. In evaluating such a solution no distinctively “practical” principles seem to be needed.

Examinations form part of the assessment processes that constitute the basis for benchmarking individual educational progress, and must consequently fulfill credibility, reliability, and transparency standards in order to promote learning outcomes and ensure academic integrity. A randomly selected question examination is considered to be an effective solution to mitigate sharing of questions between students by addressing replicated inter-examination questions that compromise examination integrity and sequential intra- examination questions that compromise examination comprehensivity. In this study, a Monte Carlo (...) approach was used to design six examination schemes for the purpose of generating and evaluating 600 RSQEs in order to investigate the effects of RSQE design on replicated inter-examination and sequential and intra-examination questions. Results revealed that the number of randomly selected questions from the pool and the number of sub-pools inversely affected the replication and sequencing of the examination questions. Thus, by designing the RSQE in many sub-pools, in equivalence to the number of examination questions and selecting only one question from each sub-pool, and updating the sub-pools after each examination, the passing of information can be prevented, ensuring the integrity of the examinations. Through an absorbing investigation into recent, high-profile scandals involving one of the largest kosher slaughterhouses in the world, located unexpectedly in Postville, Iowa, Aaron S. Gross makes a powerful case for elevating the category of the animal in the study of religion. Major theorists have almost without exception approached religion as a phenomenon that radically marks humans off from other animals, but Gross rejects this paradigm, instead matching religion more closely with the life sciences to better theorize human nature. Gross (...) begins with a detailed account of the scandals at Agriprocessors and their significance for the American and international Jewish community. He argues that without a proper theorization of "animals and religion," we cannot fully understand religiously and ethically motivated diets and how and why the events at Agriprocessors took place. Subsequent chapters recognize the significance of animals to the study of religion in the work of Ernst Cassirer, Emile Durkheim, Mircea Eliade, Jonathan Z. Smith, and Jacques Derrida and the value of indigenous peoples' understanding of animals to the study of religion in our daily lives.
