U Rusiji, dve decenije nakon urusavanja Sovjetskog Saveza, Staljinova popularnost je po anketama javnog mnjenja ogromna, posto se mnogi prisecaju nekadasnjeg ugleda zemlje i svog osecaja sigurnosti. Slicno tome, mnogi Srbi, koji su bili najveca grupa u bivsoj Jugoslaviji, s nostalgijom su gledali na vreme nacionalnog ponosa i materijalnog komfora. Nasuprot tome, potcinjene etnicke zajednice u isto to vreme osecale su frustraciju u teznji za nacionalnim ponosom. Svaki politicki poredak ima jednu pripovest sacinjenu od odabranih i povezanih dogadjaja koji promovisu (...) nacionalne interese. Iako se zavrsila oruzana borba, u bivsoj Jugoslaviji ostala je podeljenost koja je perpetuirana konkurentskim narativima o tome sta se i zbog cega dogodilo. U Rusiji,?nevidiljivi staljinizam? u porastu jos jednom je omalovazio iskustvo zrtava represije. Ovaj clanak pruza preliminarna razmatranja o razdvajanju narativa u Rusiji i Srbiji i pokusava da objasni jednu od kljucnih prepreki u pomirenju s prosloscu. (shrink)

Considering this issue to be particularly significant as a research challenge for the sociologies of religion in the so-called post-socialist countries, the subject of this research has been to determine the character, status and direction of religious changes in predominantly orthodox territories of Yugoslavia and Russia that became evident in the last decade of the twentieth century marked by turbulent socio-political changes in those countries. With the subject of the research being defined in that way, the main goal of (...) the research has been to identify and examine basic tendencies in religious changes. Relying on the huge empirical material on the changes in question, an attempt has been made to precisely detect the scope of these changes in the various areas of religious, spiritual and social lives of people in the period of the so-called post-socialist transformation. Therefore, the goal of the research has not been just to determine the scope and direction of changes of religiousness with people, but also to try to set the above mentioned religious changes into the proper social context, which is the starting point in their theoretical explanation. Smatrajuci da je predlozena tema posebno znacajana kao istrazivacki izazov za sociologije religije u zemljama tzv. postsocijalizma, predmet ovog istrazivanja je odredjen kao utvrdjivanje karaktera, stanja i smera religijskih promena na pravoslavno dominantnim prostorima Jugoslavije i Rusije aktuelnim u poslednjem desetlecu burnih socijalno-politickih previranja u njima. U ovako odredjenom predmetu istrazivanja glavni zadatak istrazivanja sastoji se u identifikovanju i preispitivanju osnovnih tendencija u religijskim promenama. Oslanjajuci se na obiman empirijski materijal o pomenutim promenama, u radu treba uciniti pokusaj preciznog detektovanja obima tih promena u razlicitim sferama religijskog, duhovnog i drustvenog zivota mnostva ljudi u tzv. postsocijalistickoj transformaciji drustva. Stoga cilj istrazivanja nije samo utvrdjivanje obima i smera promena religioznosti gradjana, nego je jedan od glavnih ciljeva istrazivanja pokusaj smestanja navedenih religijskih promena u odgovarajuci drustveni kontekst od koga se polazi u njihovoj teorijskoj eksplikaciji. Hardt and Negri's Empire pronounces the end of socialist/communist history based upon class and colonial struggles. The only dialectic of history is in the capacity of American capitalism for self-transformation and universalization. Empire presents a revisionary narrative of American republicanism, New Deal and post-war hegemony that has evolved into the current new world order. In this project, the struggle for social justice has shifted from national to international institutions of humanitarian justice and security sanctioned by US military and commercial (...) power. Yet Empire delivers its own post-communist manifesto, arguing that information capitalism cannot dominate the general intellect of its symbolic labour force. The latter must be understood in terms of Spinoza's concept of the constitutional capacity of the multitude for exercising its collective freedom, becoming-communist. Empire concedes the privatization of the industrial commons and ignores the repressive and violent interventions of old-order US imperialism. (shrink)

While the study of transitional justice, and especially truth commissions, has gained in popularity over the past two decades, the literature is overwhelmingly focused on activities in democratizing states. This introduces a selection bias that interferes with proper analysis of causes and consequences of transitional justice on a global scale. In this paper, I discuss conditions under which new repressive elites, and even old repressive elites who survive to rule and repress in nominally new systems, may choose to (...) launch broad investigations of the past. I argue that such a decision is based on two primary considerations, the presence of internally or externally based incentives (e.g., foreign aid) and the level of political control enjoyed by old elites in the new system. I apply this argument to post-Soviet Central Asia, including a detailed case study of Uzbekistan’s 1999 truth commission based on domestic media analysis and local elite interviews. (shrink)

The paper is devoted to outlining the research topic to be dealt with by the author in the incoming period within the project of the Institute for Philosophy and Social Theory. Starting from "globalization" as the keyword of current debates on political, economic and cultural destiny of contemporary world, the author delineates the subject matter of his research as the critiques of the globalization process formulated in Russia and Serbia. In terms of contents, the research will be devoted to analyzing (...) and interpreting different philosophical-theoretical, political and ideological arguments used by the critics of the globalization process in political and cultural life of Russia and Serbia. The proposed comparative approach ought to provide an insight into the influence exerted by Russian opponents of globalization on domestic critics of the process, as well as to help understand the differences in resisting globalization that stem from different political, economic, military, cultural and international positions of the two countries in today's world. The basic aim of the research is to asses theoretical-argumentative and practical-political potentials of the critiques of globalization in these two post-communist countries. Sadrzinski, planirano istrazivanje ce biti posveceno analizi i interpretaciji razlicitih filozofsko-teorijskih, politickih i ideoloskih argumenata kriticara procesa globalizacije u politickom i kulturnom zivotu Rusije i Srbije. Predlozeni komparativni pristup treba da omoguci sagledavanje uticaja koji na domace kriticare globalizacije imaju protivnici tog procesa u Rusiji, kao i da olaksa razumevanje razlika u opiranju procesima globalizaciji koje su posledica razlicitog politickog, ekonomskog, vojnog, kulturnog i medjunarodnog polozaja ove dve zemlje u savremenom svetu. An imperfect “politics of justice” seems to be inevitable in the aftermath of genocide. In Rwanda, this is especially true, given the scale of the atrocities, the breadth of participation, and the need to build a justice system from scratch while establishing security and restoring the rule of law. Official contexts for survivor testimony and corresponding perpetrator punishment are crucial for establishing shared norms and narratives, but these processes can destabilize social relations in important ways. Accordingly, without development, these (...) justice mechanisms can undermine social stability and emerging cohesion. The converse is also true: without official contexts of testimony and judgment, development is only material support, and has no recognitive force. Learning from Rwanda’s post-’94 transitional justice, broadly construed, I argue that without development, platforms for testimony and the meting out of punishment yield insufficient recognition and so undermine social stability and emerging cohesion. The converse is also true: without official contexts of testimony and judgment, development is only material support, and lacks crucial recognitive force. The crucial interdependence of development, which provides distributive justice, with criminal proceedings, which offer retributive and restorative justice, has the potential to secure a lasting and stable peace. While scholars have suggested several explanations to how and why societies deal with an authoritarian past, to date there has been little discussion about religious legacies in postcommunist transitional justice. Building upon emerging qualitative research, this study breaks ground by showing that lustration, a transitional-justice mechanism which limits the political participation of former authoritarian actors, is statistically robustly affected by societies’ mainstream religious legacy. Analyzing thirty-four postcommunist states from 1990 to 2012, tobit regression models demonstrate that Catholic and (...) Protestant traditions affect lustration positively, Muslim traditions negatively, while the impact of Orthodox traditions remains statistically insignificant. The findings problematize but support an understanding of religious traditions as potentially corresponding to complicity with the former regime, which in turn affects lustration during postcommunist upheavals. Stories told about violence, trauma, and loss inform knowledge of post-conflict societies. Stories have a context which is part of the story-teller’s life narrative. Reasons for silences are varied. This article affirms the importance of telling and listening to stories and notes the significance of silences within transitional justice’s narratives. It does this in three ways. First, it outlines a critical narrative theory of transitional justice which confirms the importance of narrative agency in telling or withholding (...) stories. Relatedly, it affirms the importance of story-telling as a way to explain differentiated gender requirements within transitional justice processes. Second, it examines gendered differences in the ways that women are silenced by shame, choose silence to retain self-respect, use silence as a strategy of survival, or an agential act. Third, it argues that compassionate listening requires gender-sensitive responses that recognize the narrator’s sense of self and needs. (shrink)

Many countries have attempted to transition to democracy following conflict or repression, but the basic meaning of transitional justice remains hotly contested. In this book, Colleen Murphy analyses transitional justice - showing how it is distinguished from retributive, corrective, and distributive justice - and outlines the ethical standards which societies attempting to democratize should follow. She argues that transitional justice involves the just pursuit of societal transformation. Such transformation requires political reconciliation, which in turn has a complex (...) set of institutional and interpersonal requirements including the rule of law. She shows how societal transformation is also influenced by the moral claims of victims and the demands of perpetrators, and how justice processes can fail to be just by failing to foster this transformation or by not treating victims and perpetrators fairly. All efforts undertaken so far to establish peace between Israel and the Palestinians have failed to seriously address the right of return of the Palestinian refugees. This failure stemmed from a conviction that the question of historical justice in general had to be avoided. Since justice is a subjective construct, it was argued, allowing it to become a subject of negotiation would only perpetuate the conflict. However, the experience of these peace efforts has shown that without solving the problem of (...) the Palestinian refugees an agreement cannot be reached. And the problem cannot possibly be solved without addressing the key Palestinian demand on this issue — the right of return. For both sides, the right of return, more than any other issue, touches on the essence of their history since the beginning of the conflict between them, and on their future. The national narrative of each side thus centers on its version of the history of the 1948 Arab-Israeli war, in the course of which the Palestinian refugee problem was created. And each side maintains the fundamental belief that its future national existence hinges on whether, and how, the issue of the right of return is resolved. For the Palestinians, the right of return is an inalienable right that defines their national identity and their struggle for liberation. For Israeli Jews, the right of return is perceived as an existential threat to the Jewish character of their society, if not to its very existence. It is not surprising, therefore, that within each of the two societies a national consensus has been built around this issue and that the position of each society seems to stand in complete opposition to that of the other. However, we argue that a morally and politically sound basis could and should be established for a workable solution and that such a basis can be provided by the notion of "transitional justice." Transitional justice stresses two major steps as necessary for reconciliation between parties involved in an historic conflict: recognition and restitution. Recognition entails revealing the historical truth about the injustices committed and according their victims dignity and respect as rights-bearing human beings. Restitution is meant to alleviate some of the material deprivation suffered by the victims and is also a form of recognition. In the Israeli-Palestinian case, recognition by Israel of the right of return would entail its assumption of responsibility for the uprooting of the majority of Palestinian society in 1948. This would satisfy a demand that has become a fundamental element in Palestinian national identity. Recognition would then enable the two parties to enter negotiations over restitution, in particular the implementation of the right of return. In these negotiations, as many Palestinian political leaders have indicated, the concerns of Israeli Jews with their national identity would be taken into account. Only if the fundamental concerns of the two parties, which center on the issue of the right of return, are met can the road towards reconciliation between them be opened. (shrink)

Over the past thirty years, transitional justice scholars have grappled with whether, and to what extent, post-conflict societies should foster forgiveness. In response to this question, this article argues that forgiveness is a legitimate goal of transitional justice, but that interpersonal forgiveness cannot be mandated by the government. It will look to the example of Guatemala to demonstrate how the recovery of narrative truth through individual and communal acts of remembrance enabled forgiveness while at the same time (...) affirmed the need for justice. The article proceeds in two parts. First, it explores the praxis of forgiveness and the role of narrative truth and the healing of memory as constitutive elements of forgiveness. Second, it argues that Guatemala’s Recovery of Historical Memory Project (REMHI) is an illustration of this praxis. Finally, this article argues against conceptions of forgiveness that promote forgetting the past and forgoing justice. (shrink)

Processes of transitional justice deal with large-scale wrongdoing committed during extended periods of conflict or repression. This paper discusses three common moral objections to processes of transitional justice, which I label shaking hands with the devil, selling victims short, and entrenching the status quo. Given the scale of wrongdoing and the context in which transitional justice processes are adopted, compromise is necessary. To respond to these objections, I argue, it is necessary to articulate the conditions that make (...) a compromise principled. I defend three criteria that distinguish principled from unprincipled compromises. (shrink)

This volume examines the property transformations in post-communist Central Eastern Europe (CEE) and focuses on the role of restitution and privatisation in such transformations. It argues that the theorisation of 'restitution' in post-communist CEE is incomplete in the transitional justice scholarship and in the literature on correction of historical wrongs. The book also argues that, for a more complete theorisation of (post-communist) restitution, the transformations of property in post-communist societies ought to be studied in a (...) more holistic way. The main legal vehicles used for such transformations, privatisation and restitution, should not be studied separately and in abstract, but in their reciprocal relationship, and in connection to the dimension of justice which each could achieve. ABSTRACTTransitional justice encompasses a global body of scholarship and practice that concentrates on responses to large-scale wrongdoing in the context of an attempted shift from conflict and/or repression. In my book, The Conceptual Foundations of Transitional Justice I argue that transitional justice is a distinctive type of justice. Transitional justice requires the just pursuit of societal transformation. I define transformation relationally, as the terms defining interaction among citizens and between citizens and officials. Transformation is necessary because of (...) the presence of pervasive structural inequality and wrongdoing. Transformation is a practical possibility because of the uncertainty characteristic of transitions. Processes of transitional justice pursue transformation by dealing with past wrongs. The just pursuit of societal transformation requires heeding the moral claims of victims and moral demands on perpetrators. In this paper, I address four issues raised by Sirkku Hellsten, George Hull, Thaddeus Metz, and Margaret Urban Walker. I first discuss the methodological questions pressed. I then consider challenges to the substantive view of transitional justice I propose. I next turn to queries about the distinctiveness of transitional justice. Finally, I respond to skepticism about the necessity and value of a substantive normative theory of transitional justice. (shrink)

This article deals with women-centred prose texts of the 1990s and 2000s in Russia written by women, and focuses especially on generation narratives. By this term the author means fictional texts that explore generational relations within families, from the perspective of repressed experiences, feelings and attitudes in the Soviet period. The selected texts are interpreted as narrating and conceptualizing the consequences of patriarchal ideology for relations between mothers and daughters and for reconstructing connections between Soviet and post-Soviet by (...) revisiting and remembering especially the gaps and discontinuities between (female) generations. The cases discussed are Liudmila Petrushevskaia’s ‘povest’ Vremia noch [The Time: Night] (1991), Liudmila Ulitskaia’s novel Medeia i ee deti [Medea and her Children] (1996) and Elena Chizhova’s novel Vremia zhenshchin [The Time of Women] (2009). These novels reflect on the one hand the woman-centredness and novelty of representation in women’s prose writing in the post-Soviet period. On the other hand, the author suggests that they reflect the diverse methods of representing the Soviet era and experience through generation narratives. The texts reassess the past through intimate, tactile memories and perceptions, and their narration through generational plots draws attention to the process of working through, which needs to be done in contemporary Russia. The narratives touch upon the untold stories of those who suffered in silence or hid the family secrets from the officials, in order to save the family. The narration delves into the different layers of experience and memory, conceptualizing them in the form of multiple narrative perspectives constructing different generations and traditions. In this way they convey the ‘secrets’ hidden in the midst of everyday life routines and give voice to the often silent resistance of women towards patriarchal and repressive ideology. The new women’s prose of the 1980s–90s and the subsequent trend of women-centred narratives and generation narratives employ conceptual metaphors of reassessing, revisiting and remembering the cultural, experiential, and emotional aspects of the past, Soviet lives. This article seeks to examine the ways in which courts of constitutional review have tried to deal with public sentiments within societies emerging from large-scale oppression and conflict. A comparative analysis of judicial review decisions from post-communist Hungary, post-apartheid South Africa and post-dictatorial Argentina is meant to show-case how judges have, more or less successfully, recognised and pedagogically engaged social negative feelings of resentment and indignation towards former victimisers and beneficiaries of violence. Thus, the article hopes to (...) pave the way for more in-depth research on one of the most neglected dimensions of post-conflict societies: public affect. (shrink)

This paper explores the failure of modernisation theory and its more recent offspring as represented by 'transition to democracy' and 'construction of capitalism' theories to explain the post-communist development of Russia. Some post-modern theories, though, reinterpreted to emphasise the disintegration and fragmentation of the 'hard core' of social structures rather than the 'post-philosophical' mode of thinking and 'aestheticised' styles of consumption, are looked at for a more fruitful conceptual alternative. In the conclusion, the idea of 'multiple fragile (...) modernities' is argued for as the most promising starting point for the conceptualisation of post-communism as well as its correlation with global 'late capitalism'. This article discusses the political possibilities of personal forgiveness in transitional justice. Personal forgiveness is extended by a single human victim who has been harmed by a wrongdoer. The victim forgives only that harm which has been done to him or to her. Personal forgiveness is distinguishable from three other forms of forgiveness: group forgiveness, legal forgiveness (a form of group forgiveness), and political forgiveness. In the context of transitional justice, I argue that: (1) personal forgiveness is a (...) necessary condition for political forgiveness; (2) group forgiveness (including legal forgiveness), while not without a normative function, cannot effectuate either personal or political forgiveness, and (3) personal forgiveness requires a shared narrative framework to lead to political forgiveness. These assertions lead to two further observations. First, because the state has a normative role in its (limited) capacity to forgive on its own behalf and a practical role in its ability to spread and to transmit a shared narrative framework, the state is an important actor in political forgiveness. Second, because the primary historical example of political forgiveness in transitional justice is the South African Truth and Reconciliation Commission that unfolded within an explicitly Christian theological framework, it may be that the shared narrative framework need be religious or even Christian in nature. The trend to centralization of the Mizrahi narrative has become an integral part of the nationalistic, ethnic, religious, and ideological-political dimensions of the emerging, complex Israeli identity. This trend includes several forms of opposition: strong opposition to "melting pot" policies and their ideological leaders; opposition to the view that ethnicity is a dimension of the tension and schisms that threaten Israeli society; and, direct repulsion of attempts to silence and to dismiss Mizrahim and so marginalize them hegemonically. The Mizrahi Democratic (...) Rainbow [The Keshet], the most prominent proponent and representative of this trend, was established in the 1990s with the intention of being a leading civic and political body in Israeli society. While it was the Mizrahi worldview that led to selection of the organization's name and aims, their vision was to be involved in social struggle on behalf of other groups in Israeli society. Since it was established, The Keshet has aimed to function as an assertive, long-term alternative coalition exerting influence, power, and pressure on the Israeli narrative network. And, indeed, the organization has succeeded in disrupting Israeli discourse, principally, by challenging the ideological foundations of the Zionist meta-narrative. Nearing the end of the first decade of the 21st century and nearly a decade since it was established, The Keshet not only represents the most current wave of Mizrahi discourse, it has changed it to such a great degree that it is impossible to ignore its influence. Further, this alternative narrative may have significant potential to advance the internal Jewish discourse so fundamental at this time given the changing Israeli situation and regional conditions. And, while it is possible to view The Keshet and this new narrative as a continuation of the Mizrahi struggle, as a narrative The Keshet's agenda represents a post-colonial perspective and multi-cultural alternative to Zionism as a social vehicle. Amidst all of this, The Keshet continues to offer concrete proposals to change the Jewish character of the state as well as its internal and external relations. One of the primary goals of this study was to examine the rise of the Mizrahi narrative over the last two decades and the new Mizrahi discourse in Israeli society. More specifically, the study sought to attain an in-depth understanding of the central narrative created and represented by The Keshet. An additional goal was to investigate the influence of The Keshet's activity and the narrative it constructed in regard to other narratives. In particular, the study focused on The Keshet's opposition to the central Zionist narrative that infuses civic, political, and academic frameworks in Israel. Accordingly, the primary research questions investigated in the study sought to determine: What has been the influence of the Mizrahi Democratic Rainbow on the Mizrahi narrative in Israel? And, what are implications of such influence for the central Zionist narrative? Methodologically, the study was based on narrative and comparative analyses of texts from different periods of the older and newer Mizrahi narratives. The corpus included two types of texts: First, academic texts and opinion pieces, both philosophical and programmatic in nature, published in magazines, journals, books, as well as position papers; second, all of the texts published by prominent and influential figures who charted the path of The Keshet or led it organizationally and/or intellectually over the last twenty years (e. g., Yehudah Shenhav, Yossi Yona, Moshe Krief among others). All texts were examined by means of philosophical, historical and critical hermeneutic tools. This analysis revealed different levels of Mizrahi and civic discourse in Israel as well as among The Keshet's founders and leading ideologues. The study was based on a three stage process model, developed for purposes of this study, for investigation and analysis of the new Mizrahi narrative as well as other oppositional narratives, in particular opposition to the hegemonic meta-narrative. The stages are: issuing the challenge, dissolution and, liberation; that is, liberation is the measure of the ultimate success of the struggle for narrative change. Such change is not based on success in the field, but rather on a radical, fundamental reversal of thought, discourse patterns, stylistic structures, as well as forms of questioning - in this case of taken-for-granted racist mechanisms. However, the principal change is in achieving a deep, inner de-legitimization of the signifiers, categories, and reproductions of all manner of mockery that are based on immoral colonialist processes that are reinforced by regimes of fear and intimidation whose self-destruction began upon their very creation. This three stage model charts the course of the oppositional Mizrahi narrative from: accounting for the past (passing judgment on the so-called historic colonialist Zionism) to writing a new (pure Mizrahi) history and creation of a Mizrahi-Arab identity separate from the Ashkenazic, identified as Zionist. Contemporary post-colonialist discourse is integral in these stages. Such a perspective has been transformed by transitions from - binarism to hybridity, Orientalism to Occidentalism, the politics of "liberation" to "constructive" politics, from the history of consciousness to the history of change, as well as from nationalist to post-nationalist questions. Fundamentally, according to this approach, political and other struggles for the emerging narrative of Mizrahi (or Arab) history seek to centralize it in society and weave it amidst the models of multiculturalism. Undertaken in parallel, the central characteristics of all these stages are borrowed from countries in which the need for national reconciliation led to renunciation of apartheid and racist policies and historical judgment of the hegemony supported by racist leaders. In addition, these three moves were undertaken in Keshet and its ideologues by means of substantive symbolic violence directed at the hegemonic Ashkenazic discourse, which included creation of hatred of it, use of stereotypes the opposite of oppressive discourse, and adoption of an arrogant point of view toward it. This stands in stark contrast to the claims of the self-proclaimed new Mizrahi stance of a discourse established on purely ethical grounds that sought to cleanse itself of these very same oppressive elements. The model developed for and demonstrated in this study allows for analysis of oppositional narratives in which the libratory stage evolves into a form of entrapment, as appears to be occurring to the new Mizrahi discourse. This conclusion is based on the observations shared by many Keshet proponents including leading intellectuals who worked on the manifestos that were the subject of criticism from the Zionist camp. The study identified and defined the following six interwoven strata, which for purposes of explication are each discussed in a separate chapter: The first chapter presents a general theoretical discussion of the issue of the narrative and the inter-narrative struggle that has become central and applicable in various ways in the latest generation (e. g., anthropologically, hermeneutically, and philosophically). The analysis surveys different discussions in the inter-narrative struggle and locates them in the contexts, relations, and meanings derived from, representing, and indeed reproducing the narrative of national identity. The second chapter includes a historical survey of the older Mizrahi struggle that existed prior to the ascendance of the new Mizrahi narrative. Initially, Mizrahi discourse focused on expressing the ethnic protest that grew in years to follow. These feelings of discrimination and social distancing of the immigrants from Islamic countries gave birth to expressions of protest, the most prominent of which were Wadi Salib and the Black Panther Movement's various activities. The research literature contains many explanations for the exacerbation of the ethnic problem and creation of a situation that could not be ignored. The consensus academic view reached at the end of the 1970s identified a number of primary factors for this situation: the existence and extensive numbers of different ethnic groups; the relative or absolute segregation of frameworks within which members of these ethnic groups lived and acted; and the significant overlap between socio-economic status and feelings of discrimination retained by members of the Mizrahi group due years of neglect by the Ashkenazic establishment, the strengthening of Mizrahi social, cultural, and political power, as well as the emergence of a Mizrahi elite that identified with Mizrahi problems. The severe consequences of feelings of discrimination were expressed in a long series of events, such as: rioting by residents of the Rehovot Sharayim neighborhood in 1956; events of Wadi Salib in Haifa in 1959; and a chain of activities involving the Black Panthers in the 1970s. Protest was also an aspect of the "tent movement" in the 1970s and 1980s. Political activities were advanced by the Tami Movement that competed in the election for the 10th Knesset in 1981 and the Shas Movement that has continued to garner political power since being found in 1984. The 1980s and 1990s were characterized as the era of radical consciousness of Mizrahi discourse as well as by the rise to power, in consecutive order, of the political parties – Tami, Shas, and the Mizrahim HaHadashim [the New Mizrahi]. The latter party laid the foundations of the new radical Mizrahi discourse from which emerged such cultural activities as: Iton Aher [A Different Newspaper]; Bimat Kivon Aher [Another Direction Forum]; Efir'yon journal; the Halah Organization for Education in Neighborhoods, Development Towns, and Villages; Kedma; the newspaper – Patish [Hammer]; and, eventually the establishment of Keshet. The third chapter presents an examination of the materialization of the inter-narrative struggle in the case of Israel, with a specific focus on The Keshet and the new Mizrahi narrative advanced by it and intellectuals. The Keshet ideology is examined in the context of its grounding in post-colonial thought, especially that of Edward Said; the directions proposed by Ella Shohat and her followers; the central thinkers of the narrative in Israel in the last decade; and the harsh critique leveled at the Ashkenazic-Zionist narrative. The practical steps proposed for implementation within the multicultural model are also examined. Here the effort to reduce the centrality of Zionism while revealing its oppressive mechanisms was undertaken in parallel with use of these mechanisms in order to create a Mizrahi space with broad margins inclusive of alternative forms of Israeli identity in the Middle East and in conjunction with Arabs within and beyond Israel. Mizrahi traditionalism is examined in the fourth chapter in two particular respects. First, the criticism of the new Mizrahi narrative leveled by the renewed view and, second, the implications of the alternative in terms of creating a Mizrahi space that does not oppose Zionism. Rather, in opposing the post-colonialist perspective, this renewed traditionalist perspective criticizes as well as values Zionism. This space seeks to be both Jewish and Mizrahi. It does not detach itself from nationalist Zionism but rather views itself as a continuation of this tradition and, accordingly, is an effort to develop a next stage in its development. For example, an essential dimension of the traditionalist perspective, "commitment," is considered in this stage to be a fertile basis for dialogue with the past and as an anchor for contemporary interpretation of Mizrahi and other Jews' identities in Israel. The fifth and sixth chapters deal with all of the vectors of criticism directed at the new Mizrahi narrative, including its ideological foundations, philosophical stance, as well as intellectual and practical basis in the Israeli sphere in the face of Palestinian nationalism. These vectors of criticism from within and beyond The Keshet deal with issues, such as, the meaning of the movement's activities and the narrative that it offers regarding questions of Israeli identity, Israeli collective memory, and Mizrahi self-perception. At the same time, it must confront the capitalist neo-liberal narrative in a global world and thrive in a context in which it must make itself manifest amidst oppositional narratives. The final chapter presents a comprehensive, critical analysis of the new Mizrahi narrative. It does so by means of a theoretical model that examines it as an oppositional narrative – one that seeks to challenge the hegemonic meta-narrative, to dissolve the boundaries of the narrative discourse, and to propose liberation and redemption that may led to entrapment amidst a changing, a-dichotomous realities (e. g., global economic development in the face of Zionist nationalisms that display ideological strength as well as development of the sense of being an Israeli that maintains its vitality and continuity while being constituted by sectors that challenge being a Mizrahi, such as co-ethnic subjects. The Keshet's influence is dramatic and extends in a number of central directions. Its political activity and non-entry into the domains of the Israeli parliament granted the movement significant power in civic discourse and contributed to changing the persona of the Mizrahi discourse; for example, from political-party struggles over budgets and obtaining shares of the regime to changing the face of Israeli society and the centrality of the Mizrahi narrative. This change included deconstructing the Ashkenazic narrative and constructing comprehensive Ashkenazic-Zionist guilt, as evident in the Ehud Barak's request for collective forgiveness. This was accomplished through the participation of leading members of Keshet who appeared in prominent intellectual forums and engaged in lively discourse - principally in academic, social, and media domains. Such participation gave new meaning to various aspects of Israeli society while establishing different models of multiculturalism. The rise of the new Mizrahi narrative is a significant marker in the inter-narrative struggle as it represents a desire for separate or hybrid identities. And, the deep probing of the narrative constructed by leaders of The Keshet and those who identify with the movement produced a number of clear ways to distinguish it from the old Mizrahi struggle, whose history was portrayed through social protests, in a manner similar to linear vectors marked with wars and elections. The old Mizrahi struggle selected the traditional tactical struggle identified usually with social and political movements that seek to change political, social, and economic reality - from the bottom up. Their primary demand was to change decisions as well as the division of social goods and resources. Hence, this older period of struggle was not aimed at opposing the ideological foundations of the hegemonic narrative nor did it seek to undermine in a radical manner the unique nature of the state of Israel as a revolutionary solution for the problems of the Jews according to the Zionist approach, as a national home for the Jewish people, and recognition of the right to an preferred and meta-definition of Jewish nationalism. In contrast, the top down struggle advanced by the new narrative is part of an ideological movement led by the educated that is assertive and ground in post-colonialist theory. Accordingly, it was critical of the techniques and mechanisms of oppression as well as sought to attack the Zionist ideological foundations and to reveal its racist operations and the regimes that have preserved it so efficiently for many years. The uniqueness of this narrative is the intellectual offensive that continues to be advanced and, in parallel, development of the discourse struggle in Israel concerning the justification for Zionism and the concrete political proposal that Jews reject the taken-for-granted status of it as an ideology. This new narrative recognizes the historic difficulties of subversion as an emancipatory and, principally, moral effort. In addition, the new Mizrahi narrative shares the foundations and narrative of Palestinian victimization. In its radical version, the new Mizrahi narrative seeks to connect to the Palestinian narrative in order to create a new space here. According to this version, this action will take place gradually. The first stage will be characterized by opposition to Western European, Ashkenazic Zionism. The Eurocentric Zionism will surrender in the second stage, to be followed in the last stage by creation of a coalition of Jews and Arabs that will be establish through concrete actualization of the refugee status and victimization that is shared by both Palestinians and Mizrahim (whether as Mizrahim or Jewish-Arab). Not a speculative academic exercise, the goal sought by this narrative is delineate and to achieve a multicultural model in which equality, liberty, and social justice will overcome the nationalism and colonialism of either side; that is it will be neither Zionist nor Jewish. Thus, this approach stresses what is shared (e.g., acceptance of the Arab space and not a rejection of it; the legitimacy of the Arab language and culture). This is part of detachment from and historic judgment of the colonialist Zionist enterprise. This possibility includes moral elements that remove the evil and harm caused by Zionism for many years as well as inner cleansing – primarily among Ashkenazim – of attitudes towards Jews and non-Jews. Though, in this regard, it should be noted that, to date, the new narrative has not made similar claims that Palestinians undergo a similar process. The assumption seems to be that this should be tested, that the coalition proposed is a possibility that will be recognized by the Palestinians, and that they are prepared to undergo a similar, shared moral process that involves negating the state of Israel as a Jewish, Western state, a state of the Jewish people, and not only for those who live within it. These Mizrahi thinkers conducted a significant move through deconstruction and substitution of the Eurocentric narrative with a multi-cultural proposal that is optimistic and even attractively naïve. Today, they acknowledge that they did not take into account Palestinian nationalist violence directed to citizens, the traditionalist alternative, and widespread opposition within the Mizrahi community toward what is perceived to be Mizrahi seclusion. They also did not take into account the harsh criticism rendered by young and educated Mizrahim who claim that they were born into a complex, multi-dimensional, multi-layered identity that includes internalization of the language of the West and rules of the game of this complex identity. And, though they are critical of some of its values, this makes it difficult to mount internal emotional opposition to the West and to the globalization contained within this world. Hence, this more familiar world is preferred over the values of the Mizrahi-Arab alternative, particularly in regard to problems in the domains of democratic citizenship, stance taken toward women, and freedom of speech. Further, educated Mizrachim reject the post-colonialist perspective and are stridently critical of its dichotomization. They claim that such a division is irrelevant in a world in which older ideologies have collapsed and new spheres – such as cyberspace and others – are open to them in which they can present themselves with an Israeli identity that is not categorized as necessarily Mizrahi. Croatian writer Slavenka Drakulic here presents an unorthodox, imaginative take on the transition from Communism to capitalism in the former Soviet Union. Three characters—a dog, an underdog, and a cat—offer the reader narratives that reflect on life under Communism and what has followed in its wake. The first, “An Interview with the Oldest Dog in Bucharest,” is about a dog named Charlie, whose mother, Mimi, together with thousands of other pets, was thrown out into the street during the Ceausescu (...) regime. In this interview, Charlie describes how not only people but animals, too, became victims during the destruction of downtown neighborhoods in Bucharest in order to build a pyramid-like “Palace of the People.” In “A Guided Tour of the Museum of Communism,” a 60-year-old souvenir vendor-cum-cleaning woman in Prague reflects upon the meaning of such a museum and concludes wryly that she herself is possibly the Museum’s best exhibit. Finally, “A Cat-keeper in Warsaw” describes an encounter with a person “of feline origin” who claims to be in possession of the cat-keeper called “General”—who declared martial law in Poland on December 13, 1981. The three stories are unified by powerful, but troubling questions: Are democracy and capitalism really a change for the better? Is the idea of social justice lost forever? Is there is such a thing as collective responsibility? And how do we remember and understand our past? (shrink)

The first political theory of post-Communism examines its implications for understanding liberty, rights, transitional justice, property rights, privatization, rule of law, centrally planned public institutions, and the legacies of totalitarian thought in language and discourse. The transition to post-totalitarianism was the spontaneous adjustment of the rights of the late-totalitarian elite to its interest. Post-totalitarian governments faced severe scarcity in the supply of justice. Rough justice punished the perpetrators and compensated their victims. Historical theories of property rights (...) became radical, and consequentialist theories, conservative. Totalitarianism in Europe disintegrated but did not end. The legacies of totalitarianism in higher education met New Public Management, totalitarian central planning under a new label. Totalitarianism divorced language from reality through the use of dialectics that identified opposites and the use of logical fallacies to argue for ideological conclusions. This book illustrates these legacies in the writings of Habermas, Derrida, and Žižek about democracy, personal responsibility, dissidence, and totalitarianism. (shrink)

Since the collapse of the Soviet regime, post-communist states have rapidly learned the modern face of slavery. Slavic women have been trafficked to the sex markets of Western Europe, Asia, and North America. The surge in human trafficking is the result of numerous factors, including the dramatic fall of the economic system and complete deterioration of the social safety net. This paper explores the causes and conditions of the growth of the trade in persons in the region, the profile (...) and typical behavior of the victims, and the public perception of the trafficking problem. The majority of studies of post-communism – habitually grouped under the heading of 'transitology' – understand the transition ultimately as a political and cultural convergence of the ex-communist societies with Western Europe. Even those critical approaches that regard the post-communist transition as a relatively unique phenomenon (as in the approaches of path dependency and neo-classical sociology) tend to conflate normative prescriptions with empirical descriptions and to move within an overall framework of what Michael Kennedy has aptly called 'transition (...) culture'. This article argues instead that the transition's nature can only be fully grasped if a case-specific and historical-contextual approach is taken. In theoretical terms, a three-step movement to grasp diversity in Central and Eastern Europe is proposed: (1) the acknowledgement of the plurality of modernizing agency and its creativity; (2) the acknowledgement of multi-interpretability and difference as primary elements of modernity; and (3) a sensitivity to the resulting institutional variety in societal constellations. In substantive terms, it is argued that diversity is a distinctive mark of Europe that is bound to persist in an enlarged Europe, despite the spirit of assimilation in the accession process. This article attempts to demonstrate that the use of the International Criminal Court (ICC), which is retributive in praxis to address crimes against humanity in post-conflict societies without concurrent comprehensive political restorative processes, is ineffective. This article uses the Kenyan case after the 2007/8 post-election violence (PEV) to demonstrate the ineffectiveness of a retributive justice approach toward social reconstruction. The main weakness of the ICC as an institution using lies in its narrow focus on and use of retributive (...) justice, as an essential transitional process. This article shows that such an approach, fails, though not absolutely, to efficiently offer a comprehensive process likely to promote possibilities for peace and reconciliation. Thus, the article suggests restorative justice as a necessary political strategy to foster peace and unity in Kenya. (shrink)

In the wake of the Cold War a characteristic style of genocide narratives emerged in the West. For the most part, philosophers did not pay attention to this development even though they are uniquely qualified to address arguments and conceptual issues discussed in this burgeoning genocide genre. While ostensibly a response to a specific recent article belonging to the genre, this essay offers an outline of an ethics of genocide narratives in the form of four lessons on how (...) not to write about genocide. It is argued that to the extent that works on the subject of genocide are dominated by narrativism, genocidalism, activism, or extreme pacifism, they cannot properly be classified as scholarly endeavors and must be met with resistance per the requirements of academic ethics and proper scholarly methodology. In the light of the dramatic events in political society in Serbia the author examines the most basic question of political theory of constitutionalism, i.e. how is it possible for a revolution to culminate in a viable form of constitutional government.

This paper examines post-communist managerial ethics during the emergence and transition of charismatic leadership in two privately owned media holdings in Russia and Kyrgyzstan. These media holdings were bootstrapped in the 1990s and 2000s by people without management experience and connections. This paper argues that Weberian charismatic leadership was a necessary leadership style to start a private business for people without links to elite networks. However, once firms establish themselves on the market, charisma fades and yields itself to a (...) legal-rational leadership style. In particular, the paper compares and contrasts the managerial ethics issues arising from the loyalty-based leader–follower relations in the charismatic leadership phase and the legal-rational phase of a firm’s development and maturation. While the legal-rational phase brings positive changes to workload management and employees’ rights for vacation and p/maternity leave, task delegation remains an unsolved issue. Ambiguous career advancement criteria of the legal-rational phase replace rapid career progression of junior and middle managers during the charismatic phase. By examining the dynamics of managerial ethics transformation, this study adds to the literature on post-communist leadership, management and governance. Recommendations are provided for privately owned firms on how to advance managerial ethics to attract and retain qualified talent. (shrink)

This collection of essays brings together jus post bellum and transitional justice theorists to explore the legal and moral questions that arise at the end of war and in the transition to less oppressive regimes. Transitional justice and jus post bellum share in common many concepts that will be explored in this volume. In both transitional justice and jus post bellum, retribution is crucial. In some contexts criminal trials will need to be held, and (...) in others truth commissions and other hybrid trials will be considered more appropriate means for securing some form of retribution. But there is a difference between how jus post bellum is conceptualized, where the key is securing peace, and transitional justice, where the key is often greater democratization. This paper seeks to contribute to the field of transitional justice by adding new insights about the role that trials of victimizers can play within democratization processes. The main argument is that criminal proceedings affirming the value of equal respect and concern for both victims and abusers can contribute to the socialization of citizens’ politically relevant emotions. More precisely, using law constructively to engage public resentment and indignation can be successful to the extent that legality is not sacrificed. In (...) order to locate this argument within the rich literature on the pedagogical functions of transitional trials this paper enters a dialogue with three emblematic texts. Lawrence Douglas’s narrative jurisprudence approach, Judith Shklar’s critique of the limits of legalism, and Marc Osiel’s interest in ‘discursive solidarity’ represent starting points for a more complex conceptualization of the relationship between democracy, law and emotional education within transformational periods. Societies in transition aiming at positive peace have the crucial task of redefining the moral relationships among their members. Once a violent conflict ends, children are both members of the society who have suffered, and those who will inherit the results of the transition. Children are victims, witnesses and at times perpetrators of crimes, but also part of the moral community and potentially key actors in peace processes: which would be the morally right attitude towards children in post-conflict scenarios? (...) I argue that exposure to violent conflict grounds a ‘special’ moral status that children are entitled to have recognized, while its impact on their lives results in severe denials of their moral worth. However, acknowledging their moral status and recognizing their past and present sufferings, through mechanisms of transitional justice in particular, has the potential to change their status within society without denying their moral worth. I thus suggest that the morally right attitude of societies in transition should be sensitive to children’s claims of moral ‘recognition’, where recognition can act as the informing principle behind the morally right attitude towards them, and ‘transitional justice’ as the set of theories and mechanisms to possibly translate that attitude into practice. Hardt and Negri's Empire pronounces the end of socialist/communist history based upon class and colonial struggles. The only dialectic of history is in the capacity of American capitalism for self-transformation and universalization. Empire presents a revisionary narrative of American republicanism, New Deal and post-war hegemony that has evolved into the current new world order. In this project, the struggle for social justice has shifted from national to international institutions of humanitarian justice and security sanctioned by US military and commercial (...) power. Yet Empire delivers its own post-communist manifesto, arguing that information capitalism cannot dominate the general intellect (Marx, Grundrisse) of its symbolic labour force. The latter must be understood in terms of Spinoza's concept of the constitutional capacity of the multitude for exercising its collective freedom, becoming-communist. Empire concedes the privatization of the industrial commons (loss of welfare state functions) and ignores the repressive and violent interventions of old-order US imperialism. (shrink)

In the last 7 years, Russia has seen deep changes in all spheres of political and economic life. Some new realities have appeared in Russian medicine as well. This paper tells the story of how these changes came about, what kind of unusal situation were created, and how these situation are recognized in professional and public debates.

In this paper we theorize that cognitive ethical orientations play an influential role in the beliefs of consumers when faced with different ranges of moral dilemmas. We examine this proposition in transitional Eastern Europe and results from a sample of 210 Romanian consumers suggest that Romanians are faced with a moral situation where low levels of Machiavellianism and high levels of idealism appear to relate to a higher ethical concern about passively benefiting at the expense of others.

Some Romanian feminist scholars argue that welfare policies of post-communist states are deeply unjust to women and preclude them from reaching economic autonomy. The upshot of this argument is that liberal economic policy would advance feminist goals better than the welfare state. How should we read this dissonance between Western and some Eastern feminist scholarship concerning distributive justice? I identify the problem of dependency at the core of a possible debate about feminism and welfare. Worries about how decades of (...) communism have shaped citizenry feed feminists' suspicion of the welfare state and fears of paternalist policies. I criticize the arguments in favour of neoliberal policies and I suggest a crucial distinction between legitimate, universal forms of human dependency and dependencies that result from particular social arrangements. Transitional justice refers to the process of dealing with widespread wrongdoing characteristically committed during the course of conflict and/or repression. Examples of such processes include criminal trials, truth commissions, reparations, and memorials. Technology is altering the forms that widespread wrongdoing takes. Technology is also altering the form of processes of transitional justice themselves. This essay provides a map of these changes and their normative implications.

Boettke and Butkevich argue that a vibrant society is an entrepreneurial society. Entrepreneur- ial effectiveness is a function of the free movement of economic actions – their alertness to opportunities for mutual gain, and their sense of when and where to enter and exit a market. Boettke and Butkevich focus not so much on the behavior of entrepreneurship, but the institutional conditions within which entrepreneurship takes place. They argue that policies which hinder the above ground legitimate expression of entrepreneurial discovery (...) must be eliminated for the further development of the Russian economy towards a market system and away from the current “virtual economy”. Institutions of governance must be established which reduce political uncertainty and encourage individuals to be willing to bet on their ideas and find the financing to bring those bets to life.Boettke et Butkevich suggèrent que l’activité entrepreneuriale est la force motrice d’une société.
