This study discusses the mediating role of statistics anxiety and motivation in the relationship comprising academic dishonesty, personality traits, and previous academic achievements in three different learning environments. Self-determination theory provides a broad psychological framework for these phenomena. Data were collected from 649 bachelor-degree students in the Social Sciences in five Israeli academic institutions. Structural equation modelling was employed to investigate the research variables’ relationships. Findings indicate that statistics anxiety mediates the relationship between personality traits and academic dishonesty in the (...) POE and the ERT learning environments. Findings also indicate the relationship between students’ achievements and academic dishonesty, but only in the ERT learning environment. In contrast, motivation mediates the relationship between students’ achievements and statistics anxiety only in the POE learning environment. This study unveils that learning environments determine the mediating role of statistical anxiety. In digital learning environments, mediation has been found between students’ personality traits and academic dishonesty. No similar parallel mediation could be established in the physical learning environment, F2F. Thus, we conclude that online courses should be designed according to student-centred approaches. According to tradition, logic is normative for reasoning. Gilbert Harman challenged the view that there is any straightforward connection between logical consequence and norms of reasoning. Authors including John MacFarlane and Hartry Field have sought to rehabilitate the traditional view. I argue that the debate is marred by a failure to distinguish three types of normative assessment, and hence three ways to understand the question of the normativity of logic. Logical principles might be thought to provide the reasoning agent with (...) first-personal directives; they might be thought to serve as third-personal evaluative standards; or they might underwrite our third-personal appraisals of others whereby we attribute praise and blame. I characterize the three normative functions in general terms and show how a failure to appreciate this threefold distinction has led disputants to talk past one another. I further show how the distinction encourages fruitful engagement with and, ultimately, resolution of the question. (shrink)

Logic, the tradition has it, is normative for reasoning. But is that really so? And if so, in what sense is logic normative for reasoning? As Gilbert Harman has reminded us, devising a logic and devising a theory of reasoning are two separate enterprises. Hence, logic's normative authority cannot reside in the fact that principles of logic just are norms of reasoning. Once we cease to identify the two, we are left with a gap. To bridge the gap one would (...) need to produce what John MacFarlane has appropriately called a bridge principle, i.e. a general principle articulating a substantive and systematic link between logical entailment and norms of reasoning. This is Harman's skeptical challenge. In this paper I argue that Harman's skeptical challenge can be met. I show how candidate bridge principles can be systematically generated and evaluated against a set of well‐motivated desiderata. Moreover, I argue that bridge principles advanced by MacFarlane himself and others, for all their merit, fail to address the problem originally set forth by Harman and so do not meet the skeptical challenge. Finally, I develop a bridge principle that meets Harman's requirements as well as being substantive. (shrink)

Persons exhibiting mutations in two tumor suppressor genes, BRCA1 and BRCA2, have a greatly increased risk of developing breast and/or ovarian cancer. The incidence of BRCA gene mutation is very high in Ashkenazi Jewish women of European descent, and many issues can arise, particularly for observant Orthodox women, because of their genetic status. Their obligations under the Jewish code of ethics, referred to as Jewish law, with respect to the acceptability of various risk-reducing strategies, may be poorly understood. In this (...) article the moral direction that Jewish law gives to women regarding testing, confidentiality, and other issues is explored. The intent is to broaden nurses' knowledge of how a particular religious tradition could impact on decision making around genetics testing, with the aim of enhancing their understanding of culturally sensitive ethical care. In The Afterlife of Moses, Steinberg addresses the story of Moses and the Exodus as a foundational myth of politics, of the formation not of a nation but of a political community grounded in universal law. Motivated in part by this recent period of reactionary insurgency in the US, Europe, and Israel, this work of intellectual history articulates the way in which a critique of myths of origin as a principle of democratic government, affect, and citizenship has equal relevance in (...) these places and equal fragility. This chapter considers the challenges to, and the resources for, cultivating a personal capacity for tolerance, given a Spinozist account of belief-formation. After articulating two main components of personal tolerance, I examine the features of Spinoza’s theory of cognition that make the cultivation of tolerance so difficult. This is followed by an analysis of Spinoza’s account of overcoming intolerant tendencies. Ultimately, I argue that the capacity of individuals to be tolerant depends crucially on the establishment of conditions of trust, conditions (...) that are conspicuously lacking in many modern democracies. The purpose of this paper is to emphasize a social phenomenon that exists in Israel: immoral medicine.In recent years, nurses have been exposed to many instances of immoral medicine in hospitals. We want to protest about the demands for money from patients who are waiting for surgical intervention, arouse the medical community’s conscience concerning these immoral activities, and improve professional and moral behaviour.

Following independence in 1948, the Hebrew University of Jerusalem founded a law faculty and modeled it on the European example. Today, the Israeli law faculty is much more similar to the U.S. law school than to institutions of legal education in Europe. This Article traces the history of the changes in Israeli legal education. It argues that the shift began after 1967, faced resistance in the 1980s, and gained momentum in the 1990s. Presently we may be witnessing the beginning of (...) a shift away from U.S. influence and back to Continental Europe or even Asia. The Article discusses three major educational components, which together signaled the shift to U.S. influence: a student-run law review, curricular reform, and open and lively class discussion. The Article then offers several factors to explain the shift: judicial opinions that began to rely on American decisional law, the adoption of the U.S. model of practice by the legal profession, the privatization of law schools, globalization, and Americanization and foreign affairs. Finally, the Article considers the contribution to Americanization made by active U.S. attempts to export American law to other legal systems. (shrink)

Recent marketing theory uses the Jungian concept of the archetype to design strategies for the improvement of product selling. Mark and Pearson propose that archetypes such as the ruler, the hero, the outlaw, and the sage are useful in promoting a product. This article suggests that the concept of archetypes as well as myths such as the Prometheus myth and the myth of the expulsion from Paradise, when combined with the insights offered by Mark and Pearson, may help in understanding (...) the management of trials of dissent as well. The article presents seven motifs that recur in trials of dissent and shows how they form a part of the phenomenon of the political management of dissent: the demonization and otherization of defendants and their supporters; the tendency to employ the charge of conspiracy and thus target a group rather than a single individual; the bending of the laws of procedure; the utilization of previously-untested substantive charges; the appeal made by each side to an external principle or vision--typically, the government resorts to the law of necessity whereas the defense resorts to natural law or a vision of "true justice" ; focus on the judge as manipulator of laws; and the appellate court assuming the role of the ultimate sage, performing its task with balance and detachment. The appellate court may use softer rhetoric in an effort to minimize the damage to the appearance of legality. When it does so, the rule of law is reaffirmed as a concept that benefits all sides; there is thus unity in the commitment to the rule of law, not to patriotism or to identification with the government. In addition, an effort is made to reaffirm the maxim that the government is a government of law, not of men. (shrink)

Politics is, at its core, a kind of activity, a particular type of doing. It comprises a distinctive and varied repertoire of human practices that we regularly characterize as political and that we think of as somehow defining the essence of public life. One might say that specific forms of political engagement are to politics as batting, throwing, catching and running are to baseball. They constitute, in effect, the sum and substance of the enterprise.

Daniel and Frances Howard-Snyder suggest that it is possible for an omnipotent being, Jove, to create randomly a world from a continuum of ever more perfect possible worlds. They then go on to argue that Jove could be characterized as morally unsurpassable despite creating a surpassable world. I raise a number of problems for the view that Jove could be characterized as morally unsurpassable when he creates (randomly or not) a surpassable world.

This chapter argues that Spinoza's commitment to an essentialist reading of striving helps to explain his profound, and somewhat underappreciated, break with Thomas Hobbes not only in terms of his views of right and obligation, but also in terms of his conceptions of happiness and the good. It examines the similarities between Thomas Hobbes's and Spinoza's views on motivation. This is followed by an analysis of the distinct ways in which they understand striving, and in turn agency and artifice, showing (...) how these differences are reflected in their conceptions of civil life. Spinoza adopts a fundamentally different conception of action and agency, one that is rooted, unsurprisingly, in his conception of essence. The chapter considers how the differences yield fundamentally different views of goodness, happiness, liberty, and the function of the state. Spinoza's account of happiness and the agreement of essences profoundly shapes his view of the function of the state. (shrink)

This chapter introduces inferential role semantics (IRS) and some of the challenges it faces. It also introduces inferentialism and places it into the wider context of contemporary philosophy of language. The chapter focuses on what is standardly considered both the most important test case for and the most natural application of IRS: logical inferentialism, the view that the meanings of the logical expressions are fully determined by the basic rules for their correct use, and that to understand a logical expression (...) is to use it in accordance with the appropriate rules. It discusses some of the benefits of logical inferentialism, chiefly with regard to the epistemology of logic, and considers a number of objections. The chapter critically examines Robert Brandom's inferentialism about linguistic and conceptual content in general. In response to Bourdieu and Wacquant, I argue that American hegemony in setting the terms of debate on ethnicity and racism is nothing new, led in the first half of the century by US heterotopic intellectuals, immigrants, outsiders and descendants of slaves. Ironically, in the light of claims made by the authors, in the post-war era the debate is increasingly dominated by ex-imperial British and French postcolonial thinkers. The authors' disquiet is more explicable, however, if viewed against the background of (...) French republican discourses that deny the legitimacy of `difference' in the public sphere. But in the final analysis, terms such as multiculturalism or ethnicity are not legislated from above but respond to grassroots social movements, and in France minority groups are presently claiming a voice and presence in the public sphere. The rise of Islamic fundamentalism in Europe seems to be tangibly signalled by an increase in women and young girls wearing the Muslim veil, the hijab. In France, this has led to the legal banning of all headscarves and other religious symbols in state schools in the name of French secularism. The article considers the ambiguities and ambivalences associated with the politics of embodiment surrounding veiling and honour killings comparatively, in Britain and France, and the implications for ongoing debates on (...) multiculturalism. The article argues that the publicity surrounding symbolic practices of sexual intimacy in the context of modernity may come to be loaded with secondary symbolic connotations, often highly politicized, for both Muslims and Europeans, leading to irresolvable conundrums. The processes of higher order symbolization outlined here raise critical questions of authority: who has the authority to interpret the scriptures, in this case the Koran and ideas about individual liberty? Who has the right to determine the limits of modesty, or whom a young person should marry? As in the earlier confrontations in South Asia between Sufi saints and learned Muslim clerics, the current contestation involves a range of actors claiming authoritative sacred knowledge. (shrink)

In a series of recent papers, Corine Besson argues that dispositionalist accounts of logical knowledge conflict with ordinary reasoning. She cites cases in which, rather than applying a logical principle to deduce certain implications of our antecedent beliefs, we revise some of those beliefs in the light of their unpalatable consequences. She argues that such instances of, in Gilbert Harman’s phrase, ‘reasoned change in view’ cannot be accommodated by the dispositionalist approach, and that we would do well to conceive of (...) logical knowledge as a species of propositional knowledge instead. In this paper, we propose a dispositional account that is more general than the one Besson considers, viz. one that does not merely apply to beliefs, and claim that dispositionalists have the resources to account for reasoned change in view. We then raise what we take to be more serious challenges for the dispositionalist view, and sketch some lines of response dispositionalists might offer. (shrink)

Israeli courts were recently faced with the question whether an employer is allowed to voice objections to unionization during an organizing drive. Since the legislation fails to provide an answer to this question, it was up to the courts to come up with a solution. The National Labor Court in Histadrut v. Pelephone held that employers have no say and must refrain from any communications whatsoever with the workers regarding the decision whether or not to join the union. The Supreme (...) Court later affirmed this decision. This Article explores this legal question and examines whether this decision was justified, and whether it should be adopted in other countries as well. It first discusses the justifications for the conflicting freedoms in this scenario — the workers’ freedom of association and the employer’s freedom of speech — to appreciate their relative strength in the circumstances. It then examines whether it is possible to achieve a certain balance. To this end, the Article critically reviews the legal mechanisms adopted by other legal jurisdictions in this regard, shedding light on their effectiveness and the difficulties of organizing in practice in each jurisdiction. The main argument advanced in this Article is that the solution has to be purposive — to advance the goals of labor law, specifically freedom of association — and that the purposive analysis must be contextual. A rule prohibiting the employer from voicing opinions is surely an infringement of freedom of speech, and strong reasons are needed to justify it. Whether strong enough reasons exist depends on several contextual factors. Essentially, the question is whether it is possible, given the current context, to secure real freedom of association without such a rule. By context we mean two main things: first, the real-life current experience concerning the struggles of organizing; and second, the existence of alternative legal mechanisms that might address this problem. This article focuses on the construction of two types of non-logical paradoxes in news discourse: 1) inconsistencies of positions and acts; 2) conflicts between reality and expectations or common sense. I will argue that these paradoxes are constructed by various discursive devices and will demonstrate the key role played by conventional and conversational implicatures in this regard. The discussion will focus on 23 items covering disputes between ultra-Orthodox and secular Jews, broadcast on mainstream Israeli television news in 2009. I will (...) show that the journalists consistently attribute paradoxicality to Haredim, and that this corresponds with the common public bitterness towards them because they enjoy financial support from the government, while sharing little of the economic and security burden. Moreover, I will argue that the paradoxical representations of Haredim rely on the secular ‘we’ group view and serve to base its common sense and norms. (shrink)

I would have preferred that the Special Section on Children as Organ Donors had focused on the donation of a specific organ because morally relevant differences are obscured when the subject is discussed in general terms. The donation of a lobe of liver and peripheral blood or bone marrow stem cells does not result in the permanent loss of vital tissue because these organs regenerate; however, a kidney does not regenerate and its donor loses a vital organ permanently. Liver tissue (...) and peripheral blood or bone marrow stem cells are typically required to save a life, but, because most patients with end-stage renal disease can be kept alive on dialysis, the donation of a kidney is rarely life saving. Also, donor risk is organ specific; for example, it is more dangerous to donate a lobe of liver than it is to donate peripheral blood or bone marrow stem cells. (shrink)

The argument for modal collapse is partly responsible for the widespread rejection of the so-called Principle of Sufficient Reason in recent times. This paper discusses the PSR against the background of the recent debate about grounding and develops principled reasons for rejecting the argument from modal collapse.

Philosophers of mathematics commonly distinguish between explanatory and non-explanatory proofs. An important subclass of mathematical proofs are proofs by induction. Are they explanatory? This paper addresses the question, based on general principles about explanation. First, a recent argument for a negative answer is discussed and rebutted. Second, a case is made for a qualified positive take on the issue.

BackgroundThe terminal illness of late-stage Alzheimer’s and related dementias is progressively cruel, burdensome, and can last years if caregivers assist oral feeding and hydrating. Options to avoid prolonged dying are limited since advanced dementia patients cannot qualify for Medical Aid in Dying. Physicians and judges can insist on clear and convincing evidence that the patient wants to die—which many advance directives cannot provide. Proxies/agents’ substituted judgment may not be concordant with patients’ requests. While advance directives can be patients’ last resort (...) to attain a peaceful and timely dying consistent with their lifelong values, success depends on their being effective and acceptable. A single flaw can provide opponents justification to refuse the directive’s requests to cease assisted feeding.AimThis article considers 24 common advance directive flaws in four categories. Process flaws focus on how patients express their end-of-life wishes. Content flaws reflect drafters’ selection of conditions and interventions, and how they are described. Inherent flaws can make advance directives unacceptable to authorities concerned about premature dying. Strategies are needed to compel physicians to write needed orders and to prevent third parties from sabotaging these orders after they are implemented. The article includes excerpts from “dementia-specific” directives or supplements that exemplify each flaw—mostly from the US and Europe. No directive critiqued here included an effective strategy to resolve this long-debated bioethical conflict: the past directive requests “Cease assisted feeding” but the incapacitated patient apparently expresses the desire to “Continue assisted feeding.” Some opponents to the controversial request, cease assisted feeding, use this conflict as a conceptual wedge to practice hard paternalism. This article proposes a protocol to prevent this conflict from emerging. These strategies may prevent authorities from requiring patients to fulfill authorities’ additional clinical criteria as a prerequisite to honor the requests in patients directives.ConclusionThis critique of flaws may serve as a guide to drafting and to selecting effective and acceptable advance directives for dementia. It also poses several bioethical and clinical questions to those in authority: Does your paternalistic refusal to honor patients’ wishes respect their self-determination? Protect vulnerable patients from harm? Force patients to endure prolonged suffering? Violate the principles of bioethics? Violate the very foundation of patient-centered care? (shrink)
