Research ethics committees are charged with providing an opinion on whether research proposals are ethical. These committees are overseen by a central office that acts for the Department of Health and hence the State. An advisory group has recently reported back to the Department of Health, recommending that it should deal with inconsistency in the decisions made by different RECs. This article questions the desirability and feasibility of questing for consistent ethical decisions.

Advance refusals of life-sustaining treatment involve three potentially conflicting interests: those of the patient; those of the doctor; and those of the law. The state's interest in protecting life can clash with the patient's right to self determination which, in turn, can conflict with the doctor's desire to act in the patient's best interests. Against this background, we present the case of a patient who was treated (arguably) contrary to his advance refusal but in accordance with English law.

Objectives—To study the value of taking an ethics history as a means of assessing patients' preferences for decision making and for their relatives' involvement.Design—Questionnaire administered by six junior doctors to 56 mentally competent patients, admitted into general and geriatric medical beds.Setting—A large district general hospital in the United Kingdom.Main measures—To establish whether patients were adequately informed about their illness and whether they minded the information being communicated to their relatives. To establish their preference regarding truthful disclosure and participation in decision (...) making with risk attached. To establish whether they wished to be involved in CPR decision making, and if not, who should make the decision. To establish whether they knew of living wills and whether they had any advance directives.Results—Twenty-four were inadequately informed of their illness.Forty-six said they would want to know were something serious to be found. Twenty-eight wanted to make their own decision if requiring risky treatment and 11 wanted family members involved. Thirty-one wanted to make a cardiopulmonary resuscitation decision and five of these decisions differed from those made by the doctors. Twenty-five preferred the doctors to decide. Eleven of the patients had heard of living wills but only one had executed such a will. Seven of the patients wished to provide advance directives. Three did not find the history taking helpful but none were discomforted.Conclusion—Taking an ethics history is a simple means of obtaining useful information about patients' preferences. (shrink)

Objectives: To compare non-treatment decision making by general practitioners and geriatricians in response to vignettes. To see whether the doctors’ decisions were informed by ethical or legal reasoning.Design: Qualitative study in which consultant geriatricians and general practitioners randomly selected from a list of local practitioners were interviewed. The doctors were asked whether patients described in five vignettes should be admitted to hospital for further care, and to give supporting reasons. They were asked with whom they would consult, who they believed (...) ought to make such decisions, and whether the relatives’ preferences would influence their decision making.Main measures: To analyse the factors influencing the doctors’ decisions not to admit otherwise terminally ill patients to hospital for life prolonging treatment.Results: Seventeen GPs and 18 geriatricians completed the interview. All vignettes produced strong concordance in decision making between both groups. Ten per cent of the doctors would provide life prolonging treatment to patients with severe brain damage. Most would admit a surgical patient regardless of age or disability. Medical reasons were largely used to explain decision making. The wishes of relatives were influential and resource considerations were not. There was variability regarding decision making responsibility.Conclusions: Little attempt was made to link decision making with ethical or legal concepts and there may have been non-recognition, or denial, of the ethical consequences of failure to admit. The process of decision making may involve deception. This may be conscious, because of the illegality of euthanasia, or unconscious , because of deepseated medical and societal reluctance to accept that intentionally withholding life prolonging treatment may equate with intentionally causing death. The paper by Szasz is about mental illness and its meaning, and like Procrustes, who altered hapless travellers to fit his bed, Szasz changes the meanings of words and concepts to suit his themes.1 Refuting the existence of “mental illness”, he suggests that the term functions in an apotropaic sense. He submits that in this sense it is used to avert danger, protect society, and hence justify preventive detention of “dangerous” people.But his arguments misrepresent the precise meaning of the term (...) “apotropaic”, which is an adjective, defined in Webster’s, Chambers and the New Shorter Oxford dictionaries as averting or turning aside evil. It is possible that amulets and incantations ward off evil, in the same way as garlic repels vampires, but evil and danger are different concepts. Yet Szasz talks of using phrases like ‘“dangerousness to self and others’ as apotropaics to ward off dangers we fear”, and the word “evil” does not appear in his paper.I will argue that “dangerousness to self and others” and “psychiatric treatment” have a prosaic rather than an apotropaic function.The word “danger” is familiar rather than arcane, and includes many risks. A predatory paedophile is usually both dangerous and evil, but many dangerous people are not evil. For example, a child who plays with a box of matches is dangerous, as is a demented person who drives a car, or a schizophrenic who, acting on delusional beliefs, arms herself with a knife and roams the streets believing she is an avenging angel.Suppose …. Since the 1980s, society's wealthiest members have claimed an ever-expanding share of income and property. It has been a true counterrevolution, says Pierre Rosanvallon--the end of the age of growing equality launched by the American and French revolutions. And just as significant as the social and economic factors driving this contemporary inequality has been a loss of faith in the ideal of equality itself. An ambitious transatlantic history of the struggles that, for two centuries, put political and economic equality (...) at their heart, The Society of Equals calls for a new philosophy of social relations to reenergize egalitarian politics. For eighteenth-century revolutionaries, equality meant understanding human beings as fundamentally alike and then creating universal political and economic rights. Rosanvallon sees the roots of today's crisis in the period 1830-1900, when industrialized capitalism threatened to quash these aspirations. By the early twentieth century, progressive forces had begun to rectify some imbalances of the Gilded Age, and the modern welfare state gradually emerged from Depression-era reforms. But new economic shocks in the 1970s began a slide toward inequality that has only gained momentum in the decades since. There is no returning to the days of the redistributive welfare state, Rosanvallon says. Rather than resort to outdated notions of social solidarity, we must instead revitalize the idea of equality according to principles of singularity, reciprocity, and communality that more accurately reflect today's realities. Mais en fait, elles sont très souvent des exercices spirituels que l'auteur pratique lui-même et fait (...) pratiquer à son lecteur. Elles sont destinées à former les âmes. Résumé La localisation des implantations des grands éléments d’infrastructure collective pose des problèmes de légitimation juridique spécifique. Ils délimitent en effet plusieurs territoires distincts en fonction de la nature des impacts qu’ils provoquent, lesquels, chacun, sont soumis à leurs propres législations et rentrent dans les compétences d’autorités différentes, y compris celle dont dépend la décision sur l’infrastructure envisagée. De telles situations normatives complexes empêchent la sémantisation légitimante que le droit est censé assurer dans les décisions de l’appareil étatique: elle sera (...) toujours partielle, voire lacunaire. Les compensations ne peuvent être que procédurales, et celles-ci sont insuffisantes à atteindre l’idéal postulé par le principe de légalité des activités publiques. Andrew Sayer undertakes a fundamental critique of social science's difficulties in acknowledging that people's relation to the world is one of concern. As sentient beings, capable of flourishing and suffering, and particularly vulnerable to how others treat us, our view of the world is substantially evaluative. Yet modernist ways of thinking encourage the common but extraordinary belief that values are beyond reason, and merely subjective or matters of convention, with little or nothing to do with the kind of beings (...) people are, the quality of their social relations, their material circumstances or well-being. The author shows how social theory and philosophy need to change to reflect the complexity of everyday ethical concerns and the importance people attach to dignity. He argues for a robustly critical social science that explains and evaluates social life from the standpoint of human flourishing. (shrink)

Cet ouvrage présente le destin de la métaphysique au siècle des Lumières. Derrière le schéma classique d'une substitution de l'anthropologie à la métaphysique caractérisant les Lumières, les études réunies dans ce volume montrent l'évolution du champ de la métaphysique, sa redéfinition, ses métamorphoses au sein d'une modernité en pleine évolution. L'intérêt est de dévoiler comment la métaphysique évolue, s'adapte à de nouvelles problématiques, et cela en tenant compte de la complexité des situations particulières propres aux Lumières européennes.

Les sociétés contemporaines tendent à ne plus connaître que les réalités individuelles et une perspective générale hors déterminations spécifiées. D'où la mise à l'écart de toute tradition, religieuse ou culturelle, et un refoulement de ce qui les portait. Cet ouvrage entend promouvoir une reconnaissance de la pluralité des voies de l'humain, mais sans juxtaposition communautariste, et préconise la mise en place de conditions de confrontations sur fond de différends fructueux et d'hétérogénéité foncière. C'est peut-être notre seule chance pour l'avènement de (...) chacun et un renouvellement social. Cela passera par des enjeux à faire réapparaître à l'encontre d'insidieuses neutralisations, et requiert des régimes de raison divers mais tous développés suivant un mode de rationalité publique. Sont ici en cause nos identités, nos rapports au passé et nos imaginations d'avenir, ainsi que ce qui nous y mobilise. (shrink)

L'erreur du populisme politique est de croire que la souveraineté du peuple est le fondement de la démocratie. On le sait, c'est plutôt le respect des Droits de l'Homme qui est déterminant : il en résulte le principe de la laïcité, qui a fait obstacle à la volonté de puissance de la chrétienté traditionnelle. Or, voici qu'aujourd'hui le fanatisme religieux renaît de ses cendres, ici ou là, et s'acoquine avec le populisme pour se légitimer. Comment se distancer, par la réflexion (...) critique, de ce genre de phénomène? L'intention de dominer autrui, quand on le rencontre, peut céder la place au sens de la réciprocité. Guidée par l'esprit de géométrie, la réflexion formelle le montre. Et l'alternative entre la violence et la bienveillance se répète au niveau des structures mentales : il n'est pas nécessaire de penser que tout, dans le monde humain, se réduit à des rapports de force ; il n'est pas nécessaire de s'en tenir à de telles simplifications idéologiques. On peut aussi se montrer un peu plus fin, et, pour s'y habituer, relire les origines de la philosophie démocratique moderne, de Hobbes (1588-1679) à Locke (1632-1704). (shrink)

The management of “wisdom” has been mooted in knowledge management (KM) theory mostly in relation to what is known as the “knowledge hierarchy”. We argue that there are unquestioned assumptions inherent in KM leading to wisdom being included in KM theory because of rhetorical “urges” more than theoretical ones. These rhetorical urges impel a drive towards perfection that excludes more than is included. Our interrogation of the KM literature uncovers some of the questionable implications in understanding knowledge as a resource (...) and an asset and of understanding wisdom as a pinnacle to a knowledge hierarchy. We urge caution regarding theorising of wisdom at the top of a hierarchy, as it should not be mooted as a perfect final solution to Knowledge Management. We suggest the theorising of wisdom be opened out to its fullest “poetic possibilities”, and that attempts to close off its meaning be resisted. (shrink)

Author Pierre Klossowski suggests that Nietzsche's ideas and beliefs did not stem from his personal pathology, but rather were applied in a pathological manner. Thereby Nietzsche's beliefs resonated dynamically and intellectually with his alternating lucidity and delirium.
