Recent theories on cognitive science have stressed the significance of moral intuition as a counter to and complementary part of moral reasoning in decision making. Thus, the aim of this paper is to create an integrated framework that can account for both intuitive and reflective cognitive processes, in order to explore the antecedents of ethical decision making. To do that, we build on Scholasticism, an important medieval school of thought from which descends the main pillars of the modern Catholic social (...) doctrine. Particularly, the focus will be on the scholastic concept of synderesis, which is an innate human faculty that constantly inclines decision makers toward universal moral principles. Managerial implications are discussed, stressing how a rediscovery of decision makers’ intuitive moral judgments could be relevant in the reflective thinking practice of managers’ ethical reasoning, thus saving them from rational insensitivity to ethical dilemmas. Since the 1980s, society's wealthiest members have claimed an ever-expanding share of income and property. It has been a true counterrevolution, says Pierre Rosanvallon--the end of the age of growing equality launched by the American and French revolutions. And just as significant as the social and economic factors driving this contemporary inequality has been a loss of faith in the ideal of equality itself. An ambitious transatlantic history of the struggles that, for two centuries, put political and economic equality (...) at their heart, The Society of Equals calls for a new philosophy of social relations to reenergize egalitarian politics. For eighteenth-century revolutionaries, equality meant understanding human beings as fundamentally alike and then creating universal political and economic rights. Rosanvallon sees the roots of today's crisis in the period 1830-1900, when industrialized capitalism threatened to quash these aspirations. By the early twentieth century, progressive forces had begun to rectify some imbalances of the Gilded Age, and the modern welfare state gradually emerged from Depression-era reforms. But new economic shocks in the 1970s began a slide toward inequality that has only gained momentum in the decades since. There is no returning to the days of the redistributive welfare state, Rosanvallon says. Rather than resort to outdated notions of social solidarity, we must instead revitalize the idea of equality according to principles of singularity, reciprocity, and communality that more accurately reflect today's realities. Mais en fait, elles sont très souvent des exercices spirituels que l'auteur pratique lui-même et fait (...) pratiquer à son lecteur. Elles sont destinées à former les âmes. This volume is the proceedings of a workshop to discuss the recent work on complex systems in physics and biology, its epistemological and cultural implications, and its effect for the development of these two sciences. The workshop is geared towards physicists, biologists, and science historians.

We propose a synthetic description of Merleau-Ponty’s phenomenology with the aim of providing physicists and philosophers with an alternative linguistic and conceptual framework to address the logical and ontological problematics emerged in quantum mechanics. Phenomenology’s cognitive devices such as the dynamical relationship between object and horizon, the presumptive synthesis and the constitution of an ontology based on the indivisibility of object and subject, not only show hermeneutic efficacy when applied to the study of human perception, but may prove to be (...) sufficiently innovative to lead to novel insights towards the understanding of the quantum mechanical theoretical structure: the traditional tenet of quantum physics being in discontinuity with the major characteristics of classical physics is shaken at its fundaments and a new perspective of continuity between the two worlds is opened. In the present manuscript, we comment upon a paper that strongly criticized an expert report written by the consultants of the defense in a case of pedophilia, in which clinical and neuro-scientific data were used to establish the causal link between brain alterations and onset of criminal behavior. These critiques appear to be based mainly on wrong pieces of information and on a misinterpretation of the logical reasoning adopted by defense consultants. Here we provide a point-by-point reply to the issues (...) raised in the above paper and also discuss the potential role that neuroscience may contribute in the forensic context. Did the forensic neuroscience defense consultants claim the existence of a deterministic relationship between brain structure or function and behavior? How did the neuroscientific logic work in this specific case? How may the classic psychiatric/neurologic examination and neuroscientific evidence work side by side? Does the rarity of a disease impact on the causal relationship between the disease and the crime? Do neuroscientific data need to be interpreted? We address the above questions and conclude that neuroscience may strengthen the results of psychiatric evaluations, thus reducing uncertainty in the forensic settings. (shrink)

In this article, we deal with the evaluation of the losses suffered by persons living in urban areas as a result of energy services. In the first part, we analyse how by adopting different informational foci we obtain contrasting interpersonal evaluations regarding the same loss. In the second part, we distinguish between a diachronic and a hypothetical/moralised threshold for harm in order to assess whether individuals are benefiting from or being harmed by a given energy service. Our argument is that (...) the most accurate evaluation of an individual damage caused by an energy service can be obtained by using capabilities as informational focus, instead of realised wellbeing or means to wellbeing, and by interpreting the loss in relation to a hypothetical/moralised threshold that corresponds to a list of central capabilities. In the last part, we address monetary and non-monetary compensations for a loss that is evaluated in terms of capabilities. Accordingly, we expound how compensation policies can either restore the capabilities lost due to energy services or monetarily compensate the individual for the fact that a given capability (or set of capabilities) has been irremediably lost. The continental drift controversy has been deeply analysed in terms of rationalist notions, which seem to find there a unique topic to describe the weight of evidence for reaching consensus. In that sense, many authors suggest that Alfred Wegener’s theory of the original supercontinent Pangea and the subsequent continental displacements finally reached a consensus when irrefutable evidence became available. Therefore, rationalist approaches suggest that evidence can be enough by itself to close scientific controversies. In this article I analyse continental drift (...) debates from a different perspective which is based on styles of thought. I’ll argue that continental drift debate took much longer than it was usually recognized with two styles of thought coexisting for hundreds of years. These were fixism and mobilism and they were always confronting their own evidence and interpretations and functioning as general frameworks for the acceptability of a specific theory. Therefore, this text aims to bring much broader sociological elements than usually involved in the analysis of the continental drift theory. (shrink)

Résumé La localisation des implantations des grands éléments d’infrastructure collective pose des problèmes de légitimation juridique spécifique. Ils délimitent en effet plusieurs territoires distincts en fonction de la nature des impacts qu’ils provoquent, lesquels, chacun, sont soumis à leurs propres législations et rentrent dans les compétences d’autorités différentes, y compris celle dont dépend la décision sur l’infrastructure envisagée. De telles situations normatives complexes empêchent la sémantisation légitimante que le droit est censé assurer dans les décisions de l’appareil étatique: elle sera (...) toujours partielle, voire lacunaire. Les compensations ne peuvent être que procédurales, et celles-ci sont insuffisantes à atteindre l’idéal postulé par le principe de légalité des activités publiques. This study examines the implications of practical reason for entrepreneurial activities. Our study is based on Thomas Aquinas’ interpretation of such virtue, with a particular focus on the partition of practical reason in potential parts such as synesis, or common sense, and gnome, or perspicacity. Since entrepreneurial acts and actions deal with extremely uncertain situations, we argue that only this perspicacity, as the ability of correctly judging in exceptional cases, has the power to find wisdom under such blurred conditions. Perspicacity (...) frees entrepreneurs from their cognitive schemata rendering them able to be truly entrepreneurial. Based on this vision and thanks to a semantic analysis of the meaning of the Greek word gnome, we construct an interpretative model for entrepreneurial judgment composed of three dimensions, specifically, knowledge-cognitive, external-affective and personal-reflective. The model highlights how a ‘successful’ entrepreneurial judgment is also such from a holistic point of view. (shrink)

On the second part, taking into consideration the partial results of a research developed in the field of mental health that aims to understand the motives of internment (...) of children and adolescents in a psychiatric institution with the characteristics of an asylum, it will be developed an analysis of two distinct dimensions of this study considering the concepts of Spinoza’s Ethic. A recent Supreme Court decision, Kumho Tire Co., Ltd. v. Carmichael, may have substantial impact on psychological expert testimony. Previous criteria for admissibility of scientific expert testimony now apply broadly to expert testimony, not just testimony narrowly grounded in scientific evidence. Judges will determine the relevance and reliability of all expert testimony, including that based on clinical experience or training. Admissible testimony will either satisfy the criteria established in Daubert v. Merrell Dow Pharmaceuticals, Inc. or meet similarly rigorous standards judged (...) appropriate to the particular field involved. Because psychological testimony has varied in its evidentiary basis, sometimes relying on science and otherwise on clinical training or experience, court decisions will gradually determine the precedent for its admissibility. We also discuss long-term consequences for the credibility of psychological expert testimony and the relation between psychology and law. (shrink)

The article appearing previously in this journal entitled “Styles of Thought on the Continental Drift Debate” (Pellegrini 2019) prompted a response from Weber and Šešelja (2020) which they termed as “a defence of rationalist accounts”. They argue that their self-designated “sophisticated rationalism” explains the closure of the continental-drift debate without being affected by my critiques to rationalist approaches. While ignoring the empirical evidence that shows the complexity of the debate and the necessity to include broader social elements in the (...) analysis (such as scientists denying continental drift even after the plate tectonics theory, others supporting it without being familiarized with the literature), they proclaim to be unconvinced about the analysis of the styles of thought. In order to clarify differences in the approach to the continental-drift historical controversy, I respond here to the criticism my paper drew while discussing the place of rationalism when explaining the acceptance of a theory. I will argue that their distinction between “crude” and “sophisticated” rationalism does not solve the problem of social aspects being left aside by rationalists in view of the acceptance of a theory. I will also argue that in order to understand what leads people to embrace a belief (namely scientists in accepting a theory), the analysis of mere cognitive or epistemic arguments is not enough and it leads to a reductionist explanation as to social behaviour. In this work, we discuss how both contractualism, in the Western tradition, and communitarianism, in the African interpretation based on the idea of Ubuntu, conceptualise intergenerational justice. Even though both philosophical theories, taking into account differences and shortcomings, provide theoretical answers to intergenerational justice dilemmas, the implementation of actual policies in the interest of future individuals does not follow straightforwardly. Accordingly, in the second part of the chapter, we analyse what policy tools have been implemented or conceived to deliver intergenerational (...) justice and we advocate a pragmatic approach pointing towards a mix of different policy tools. Practices related to research misconduct seem to have been multiplied in recent years. Many cases of scientific fraud have been exposed publicly, and journals and academic institutions have deployed different measures worldwide in this regard. However, the influence of specific social and cultural environments on scientific fraud may vary from society to society. This article analyzes how scientists in Japan deal with accusations of scientific fraud. For such a purpose, a series of scientific fraud cases that took place in Japan (...) has been reconstructed through diverse sources. Thus, by analyzing those cases, the social basis of scientific fraud and the most relevant aspects of Japanese cultural values and traditions, as well as the concept of honour which is deeply involved in the way Japanese scientists react when they are accused of and publicly exposed in scientific fraud situations is examined. The "religious and secular divide" cannot be understood unless we think about the way sex gets mobilized on both sides of this supposed divide. In our joint writing, we have resisted thinking of the religious and the secular as a divide; we have rather been interested to think them relationally—as relations. Thus, the larger suggestion of this paper is that we cannot truly imagine and practice democratic politics—to name some keywords for this discussion—unless we rethink the relations between sex, secularism, (...) and religion. Cet ouvrage présente le destin de la métaphysique au siècle des Lumières. Derrière le schéma classique d'une substitution de l'anthropologie à la métaphysique caractérisant les Lumières, les études réunies dans ce volume montrent l'évolution du champ de la métaphysique, sa redéfinition, ses métamorphoses au sein d'une modernité en pleine évolution. L'intérêt est de dévoiler comment la métaphysique évolue, s'adapte à de nouvelles problématiques, et cela en tenant compte de la complexité des situations particulières propres aux Lumières européennes.

Les sociétés contemporaines tendent à ne plus connaître que les réalités individuelles et une perspective générale hors déterminations spécifiées. D'où la mise à l'écart de toute tradition, religieuse ou culturelle, et un refoulement de ce qui les portait. Cet ouvrage entend promouvoir une reconnaissance de la pluralité des voies de l'humain, mais sans juxtaposition communautariste, et préconise la mise en place de conditions de confrontations sur fond de différends fructueux et d'hétérogénéité foncière. C'est peut-être notre seule chance pour l'avènement de (...) chacun et un renouvellement social. Cela passera par des enjeux à faire réapparaître à l'encontre d'insidieuses neutralisations, et requiert des régimes de raison divers mais tous développés suivant un mode de rationalité publique. Sont ici en cause nos identités, nos rapports au passé et nos imaginations d'avenir, ainsi que ce qui nous y mobilise. (shrink)

L'erreur du populisme politique est de croire que la souveraineté du peuple est le fondement de la démocratie. On le sait, c'est plutôt le respect des Droits de l'Homme qui est déterminant : il en résulte le principe de la laïcité, qui a fait obstacle à la volonté de puissance de la chrétienté traditionnelle. Or, voici qu'aujourd'hui le fanatisme religieux renaît de ses cendres, ici ou là, et s'acoquine avec le populisme pour se légitimer. Comment se distancer, par la réflexion (...) critique, de ce genre de phénomène? L'intention de dominer autrui, quand on le rencontre, peut céder la place au sens de la réciprocité. Guidée par l'esprit de géométrie, la réflexion formelle le montre. Et l'alternative entre la violence et la bienveillance se répète au niveau des structures mentales : il n'est pas nécessaire de penser que tout, dans le monde humain, se réduit à des rapports de force ; il n'est pas nécessaire de s'en tenir à de telles simplifications idéologiques. On peut aussi se montrer un peu plus fin, et, pour s'y habituer, relire les origines de la philosophie démocratique moderne, de Hobbes (1588-1679) à Locke (1632-1704). (shrink)

We examine the ontogeny and phylogeny of object and fantasy play from a functional perspective. Each form of play is described from an evolutionary perspective in terms of its place in the total time and energy budgets of human and nonhuman juveniles. As part of discussion of functions of play, we examine sex differences, particularly as they relate to life in the environment of evolutionary adaptedness and economic activities of human and nonhuman primates. Object play may relate to foraging activities. (...) Although fantasy play has been viewed as limited to humans, we speculate that certain types of fantasy play may be present in some nonhuman primates. Fantasy play may enable juveniles to see situations from different perspectives. We conclude that fantasy play may have immediate effects and object play may have deferred effects. (shrink)

Recognized as a masterpiece of Nietzsche scholarship, NIETZSCHE AND THE VICIOUS CIRCLE is available here for the first time in English. Author Pierre Klossowski suggests that Nietzsche's ideas and beliefs did not stem from his personal pathology, but rather were applied in a pathological manner. Thereby Nietzsche's beliefs resonated dynamically and intellectually with his alternating lucidity and delirium.

Le croisement entre le point de vue phenomenologique et celui du physicien sur l'affectivite montre aussi qu'expliquer et comprendre ne sont pas comme des mondes paralleles. Pierre Guenancia est professeur d'histoire de la philosophie moderne a l'universite de Bourgogne. Apres plusieurs livres et articles sur Descartes et la pensee classique, il a publie recemment Le Regard de la pensee. Philosophie de la representation (PUF 2009), Descartes chemin faisant (Encre Marine, 2010), Divertissements pascaliens (Hermann, 2011), ainsi que la reedition de Descartes et l'ordre politique (Tel, Gallimard 2012). Entré en khâgne pour y devenir traducteur de Virgile et d'Homère, Pierre Magnard reçut de Jean Beaufret l'interpellation de Heidegger, qui fit vaciller ses certitudes et certaine manière d'être chrétien. Ce vacillement le conduisit vers Pascal, dont l'angoisse colore la foi d'une manière inoubliable, lequel Pascal le conduisit à Montaigne, ami de toute une vie. Deux figures en miroir entre lesquelles il lui parut urgent de ne jamais choisir, et auxquelles il consacra beaucoup de son industrie, comme à ces (...) philosophes de la fin de Moyen Age et de la Renaissance que Char eût dit des Matinaux. Un humanisme faisant l'épreuve du néant en l'homme et du silence de Dieu était possible, dont Maître Eckhart et Nicolas de Cues montrent le chemin ; un christianisme aussi, fondé non sur l'usage d'une raison dogmatique mais d'une raison joueuse, laquelle, tout en sachant que c'est le coeur qui lui donne ses principes, se déploiera en toute liberté. Le chemin d'un philosophe, professeur émérite en Sorbonne, jusqu'à la couleur du matin profond. (shrink)

In the debates on phenomenal consciousness that occurred over the last 20 years, Sartre’s analysis of pre-reflective consciousness has often been quoted in defence of a distinction between first- and third-personal modes of givenness that naturalists reject. This distinction aims both at determining the specificity of the access one has to their own thoughts, beliefs, intentions, or desires, and at justifying the particular privilege that one enjoys while making epistemic claims about their own mental states. This chapter defends an interpretation (...) of Sartre’s theory of pre-reflective consciousness that does not put him completely at odds with the naturalist critique and stresses that one’s pre-reflective experience should not be understood in terms of first-/third-person differentiation. This pre-reflective dimension of experience nevertheless allows a peculiar access to oneself, which grants no infallible epistemic privilege to the first-person, but lays the ground for a transformative process that makes self-knowledge possible.
