As a scientific discipline and profession, law has been for centuries at the heart of social and political power of many Western societies. Professors of law, as influential representatives of the profession, are important powerbrokers between academia, politics and the corporate world. Their influence is based on scientific reputation, institutional mandates inside and outside academia or privileged network connections with people in powerful positions. In this study, based on a full sample of all Swiss law professors in the years 1957, (...) 1980 and 2000, we contrast two theories of the distribution of power among law professors: Bourdieu’s thesis on the trade-off between scientific reputation and -academic institutional power vs. the thesis of an opposition between a group of established incumbents and socio-demographically marginal challengers who try to gain access to the profession. We show that among Swiss law professors the endowment with scientific capital is not opposed to the possession of institutional power within academia. Our findings reveal rather an opposition between a challenging group of professors devoid of resources and an incumbent fraction with a high amount of scientific, institutional and social capital alike. In the conclusion we discuss a series of explanations of this specific power structure, including the specific status scientific reputation and social capital can have for law professors. (shrink)

The past decade has been marked by a series of global crises, presenting an opportunity to reevaluate the relationship between science and politics. The biological sciences are instrumental in understanding natural phenomena and informing policy decisions. However, scholars argue that current scientific expertise often fails to account for entire populations and long-term impacts, hindering efforts to address issues such as biodiversity loss, global warming, and pandemics. This article explores the structural challenges of integrating an evolutionary perspective, historically opposed to functional (...) determinants of health and disease, into current biological science practices. Using data on Swiss biology professors from 1957, 1980, and 2000, we examine the structural power dynamics that have led to the division between these competing epistemologies, and how this division has influenced resource allocation and career trajectories. Our analysis suggests that this cleavage presents a significant obstacle to achieving fruitful reconciliations, and that increased academicization and internationalization may benefit functional biologists at the expense of evolutionary biologists. While evolutionary biologists have gained symbolic recognition in recent years, this has not translated into valuable expertise in the political domain. (shrink)

Cosmic fine-tuning and other coincidences are no proof of God, but are amazing, astounding and will never be fully explained. Amazement is the appropriate emotional perception of reality. The objective world is not a matter of course and may well (...) not exist at all; thus reality, at times, is experienced to be very special. Human life, the beauty of nature, the habitability of planet Earth can be considered undeserved gifts. In the light of these gifts, the universe is metaphorically interpreted and existentially believed as a divine Creation. Science cannot create such faith but can foster it. Is God necessary to explain the universe? Is the idea of a Creator excluded by modern science? Why continue speaking of a Creator and to believe (trust and hope) in His continuing creation when God cannot be demonstrated in scientific data? Arnold Benz, a renowned astrophysicist and Christian, insists that human perception reaches further than science and demonstrates this in various examples, personal, biblical, and literary.". Aus einer philosophisch-phanomenologischen und literaturwissenschaftlichen Perspektive heraus gewinnt Nadine Benz nahere Erkenntnisse uber das temporale Phanomen des Wartens. Zunachst wird die historische Entwicklung der Zeitvorstellung aus philosophisch-phanomenologischer Sicht thematisiert, spezifisch im Hinblick auf die Fragen nach Messbarkeit, Vermitteltheit und nach objektiven und subjektiven Komponenten von Zeiterfahrung in ihrer Aporetik. Im Anschluss wird vom Konzept der Lebenswelt zur Literatur ubergeleitet: Die vorliegende Studie bindet die Aporien der Zeit zunachst theoretisch in eine Narratologie von Zeiterfahrung ein, die vor allem den Faktor (...) des Fiktiven produktiv berucksichtigt. Schliesslich werden die gewonnenen Erkenntnisse und Instrumente fur eine Analyse von Erzahltexten des 20. und 21. Jahrhunderts fruchtbar gemacht. Two classes of account have been proposed to explain the memory processes subserving the processing of reflexive-antecedent dependencies. Structure-based accounts assume that the retrieval of the antecedent is guided by syntactic tree-configurational information without considering other kinds of information such as gender marking in the case of English reflexives. By contrast, unconstrained cue-based retrieval assumes that all available information is used for retrieving the antecedent. Similarity-based interference effects from structurally illicit distractors which match a non-structural retrieval cue have been interpreted (...) as evidence favoring the unconstrained cue-based retrieval account since cue-based retrieval interference from structurally illicit distractors is incompatible with the structure-based account. However, it has been argued that the observed effects do not necessarily reflect interference occurring at the moment of retrieval but might equally well be accounted for by interference occurring already at the stage of encoding or maintaining the antecedent in memory, in which case they cannot be taken as evidence against the structure-based account. We present three experiments (self-paced reading and eye-tracking) on German reflexives and Swedish reflexive and pronominal possessives in which we pit the predictions of encoding interference and cue-based retrieval interference against each other. We could not find any indication that encoding interference affects the processing ease of the reflexive-antecedent dependency formation. Thus, there is no evidence that encoding interference might be the explanation for the interference effects observed in previous work. We therefore conclude that invoking encoding interference may not be a plausible way to reconcile interference effects with a structure-based account of reflexive processing. (shrink)

Since the 1980s, society's wealthiest members have claimed an ever-expanding share of income and property. It has been a true counterrevolution, says Pierre Rosanvallon--the end of the age of growing equality launched by the American and French revolutions. And just as significant as the social and economic factors driving this contemporary inequality has been a loss of faith in the ideal of equality itself. An ambitious transatlantic history of the struggles that, for two centuries, put political and economic equality (...) at their heart, The Society of Equals calls for a new philosophy of social relations to reenergize egalitarian politics. For eighteenth-century revolutionaries, equality meant understanding human beings as fundamentally alike and then creating universal political and economic rights. Rosanvallon sees the roots of today's crisis in the period 1830-1900, when industrialized capitalism threatened to quash these aspirations. By the early twentieth century, progressive forces had begun to rectify some imbalances of the Gilded Age, and the modern welfare state gradually emerged from Depression-era reforms. But new economic shocks in the 1970s began a slide toward inequality that has only gained momentum in the decades since. There is no returning to the days of the redistributive welfare state, Rosanvallon says. Rather than resort to outdated notions of social solidarity, we must instead revitalize the idea of equality according to principles of singularity, reciprocity, and communality that more accurately reflect today's realities. In this article, we compare two fixed-point constructions of common knowledge in sequential coordination problems. The first one corresponds to the standard maximal fixed-point construction of common knowledge in a possible worlds framework; the second construction provides an even larger fixed-point and involves iterated epistemic updates. We call the first fixed-point the maximal fixed-point, and the second the update fixed-point. Both fixed-points define a set of sequential actions that solve the coordination problem such that success is mutually guaranteed. The main (...) application intended is the study of signalling games as introduced by [15]. We introduce a non-probabilistic version of these games as multi-agent signalling games. We use them for modelling prototypical accommodation phenomena following [16]. We show especially that accommodation, which involves presupposition violation, is only licensed due to the existence of the super large update fixed-point, whereas the literal language use without presupposition violations can be characterized by the maximal fixed-point. It has been argued that some animals are moral subjects, that is, beings who are capable of behaving on the basis of moral motivations. In this paper, we do not challenge this claim. Instead, we presuppose its plausibility in order to explore what ethical consequences follow from it. Using the capabilities approach, we argue that beings who are moral subjects are entitled to enjoy positive opportunities for the flourishing of their moral capabilities, and that the thwarting of these capabilities entails (...) a harm that cannot be fully explained in terms of hedonistic welfare. We explore the implications of this idea for the assessment of current practices involving animals. (shrink)

African (Bantu) philosophy conceptualizes morality through ubuntu, which emphasizes the role of community in producing moral agents. This community is characterized by practices that respond to and value interdependence, such as care, cooperation, and respect for elders and ancestral knowledge. While there have been attributions of morality to nonhuman animals in the interdisciplinary animal morality debate, this debate has focused on Western concepts. We argue that the ubuntu conception of morality as a communal practice applies to some nonhuman animals. African (...) elephant communities are highly cooperative and structured around elders; they alloparent, protect their communities, mourn their dead, and pass on cultural knowledge between generations. Identifying these as important moral practices, ubuntu provides a theoretical framework to expand our ethical concern for elephants to their communities. In practice, this will deepen our understanding of the wrongness of atrocities like culling for population management or trophy hunting. (shrink)

Résumé La localisation des implantations des grands éléments d’infrastructure collective pose des problèmes de légitimation juridique spécifique. Ils délimitent en effet plusieurs territoires distincts en fonction de la nature des impacts qu’ils provoquent, lesquels, chacun, sont soumis à leurs propres législations et rentrent dans les compétences d’autorités différentes, y compris celle dont dépend la décision sur l’infrastructure envisagée. De telles situations normatives complexes empêchent la sémantisation légitimante que le droit est censé assurer dans les décisions de l’appareil étatique: elle sera (...) toujours partielle, voire lacunaire. Les compensations ne peuvent être que procédurales, et celles-ci sont insuffisantes à atteindre l’idéal postulé par le principe de légalité des activités publiques. Many nonhuman animals have the emotional capacities to form caring relationships that matter to them, and for their immediate welfare. Drawing from care ethics, we argue that these relationships also matter as objectively valuable states of affairs. They are part of what is good in this world. However, the value of care is precarious in human-animal interactions. Be it in farming, research, wildlife ‘management’, zoos, or pet-keeping, the prevention, disruption, manipulation, and instrumentalization of care in animals by humans is ubiquitous. (...) We criticize a narrow conception of welfare that, in practice, tends to overlook non-experiential forms of harm that occur when we interfere with caring animals. Additionally, we point out wrongs against caring animals that are not just unaccounted for but denied by even an expansive welfare perspective: The instrumentalization of care and caring animals in systems of use can occur as a harmless wrong that an approach purely focused on welfare may, in fact, condone. We should therefore adopt an ethical perspective that goes beyond welfare in our dealings with caring animals. (shrink)

The portrayal of animals in the media is often criticised for instrumentalising, objectifying and anthropomorphising animals :53–79, 1997; Lerner and Kalof in Sociol Q 40:565–586, 1999; Stewart and Cole in Int J Multidiscip Res 12:457–476, 2009). Although we agree with this criticism, we also identify the need for a more substantiated approach to the moral significance of instrumentalisation, objectification and anthropomorphism. Thus, we propose a new framework which is able to address the morally relevant aspects of animal portrayal in the (...) media. We closely examine the normative messages communicated by an unusual TV commercial in which an anthropomorphised piglet advertises organic beef. This serves as a case example to relate the philosophical and ethical concepts of objectification and anthropomorphism to each other and show how they can be applied. We conclude that the commercial conveys a message of animal instrumentalisation as being normatively correct within the constraint of good animal welfare. The depicted form of instrumentalisation is, nonetheless, associated with harm for the animals and thus, needs to overcome cognitive dissonance. To achieve this, animals are directly objectified by a trivialised and de-individualised portrayal. Moreover, animals are indirectly objectified even when they are anthropomorphised as they are granted significance only through being human-like. Thus, objectification and anthropomorphism are not opposing terms in our proposed framework. In addition, objectification, together with the reference to the dominant ideology, and combined with humorous anthropomorphism weakens scrutiny of these normative messages by the viewers. This eventually augments a decrease of moral concern for farmed animals in advertisement employing such portrayals. (shrink)

Cet ouvrage présente le destin de la métaphysique au siècle des Lumières. Derrière le schéma classique d'une substitution de l'anthropologie à la métaphysique caractérisant les Lumières, les études réunies dans ce volume montrent l'évolution du champ de la métaphysique, sa redéfinition, ses métamorphoses au sein d'une modernité en pleine évolution. L'intérêt est de dévoiler comment la métaphysique évolue, s'adapte à de nouvelles problématiques, et cela en tenant compte de la complexité des situations particulières propres aux Lumières européennes.

Les sociétés contemporaines tendent à ne plus connaître que les réalités individuelles et une perspective générale hors déterminations spécifiées. D'où la mise à l'écart de toute tradition, religieuse ou culturelle, et un refoulement de ce qui les portait. Cet ouvrage entend promouvoir une reconnaissance de la pluralité des voies de l'humain, mais sans juxtaposition communautariste, et préconise la mise en place de conditions de confrontations sur fond de différends fructueux et d'hétérogénéité foncière. C'est peut-être notre seule chance pour l'avènement de (...) chacun et un renouvellement social. Cela passera par des enjeux à faire réapparaître à l'encontre d'insidieuses neutralisations, et requiert des régimes de raison divers mais tous développés suivant un mode de rationalité publique. L'erreur du populisme politique est de croire que la souveraineté du peuple est le fondement de la démocratie. On le sait, c'est plutôt le respect des Droits de l'Homme qui est déterminant : il en résulte le principe de la laïcité, qui a fait obstacle à la volonté de puissance de la chrétienté traditionnelle. Or, voici qu'aujourd'hui le fanatisme religieux renaît de ses cendres, ici ou là, et s'acoquine avec le populisme pour se légitimer. Comment se distancer, par la réflexion (...) critique, de ce genre de phénomène? L'intention de dominer autrui, quand on le rencontre, peut céder la place au sens de la réciprocité. Guidée par l'esprit de géométrie, la réflexion formelle le montre. Et l'alternative entre la violence et la bienveillance se répète au niveau des structures mentales : il n'est pas nécessaire de penser que tout, dans le monde humain, se réduit à des rapports de force ; il n'est pas nécessaire de s'en tenir à de telles simplifications idéologiques. On peut aussi se montrer un peu plus fin, et, pour s'y habituer, relire les origines de la philosophie démocratique moderne, de Hobbes (1588-1679) à Locke (1632-1704). (shrink)

Economics and psychology are both sciences of human behaviour. This paper gives a survey of their interaction. First, the changing relationship between the two sciences is discussed: while economics was once imperialistic, it has become a science inspired by psychological insights. In order to illustrate this, recent developments and evidence for three major areas are presented: bounded rationality, non-selfish behaviour, and the economics of happiness.

Recognized as a masterpiece of Nietzsche scholarship, NIETZSCHE AND THE VICIOUS CIRCLE is available here for the first time in English. Author Pierre Klossowski suggests that Nietzsche's ideas and beliefs did not stem from his personal pathology, but rather were applied in a pathological manner. Thereby Nietzsche's beliefs resonated dynamically and intellectually with his alternating lucidity and delirium.

Le croisement entre le point de vue phenomenologique et celui du physicien sur l'affectivite montre aussi qu'expliquer et comprendre ne sont pas comme des mondes paralleles. Pierre Guenancia est professeur d'histoire de la philosophie moderne a l'universite de Bourgogne. Apres plusieurs livres et articles sur Descartes et la pensee classique, il a publie recemment Le Regard de la pensee. Philosophie de la representation (PUF 2009), Descartes chemin faisant (Encre Marine, 2010), Divertissements pascaliens (Hermann, 2011), ainsi que la reedition de Descartes et l'ordre politique (Tel, Gallimard 2012). Entré en khâgne pour y devenir traducteur de Virgile et d'Homère, Pierre Magnard reçut de Jean Beaufret l'interpellation de Heidegger, qui fit vaciller ses certitudes et certaine manière d'être chrétien. Ce vacillement le conduisit vers Pascal, dont l'angoisse colore la foi d'une manière inoubliable, lequel Pascal le conduisit à Montaigne, ami de toute une vie. Deux figures en miroir entre lesquelles il lui parut urgent de ne jamais choisir, et auxquelles il consacra beaucoup de son industrie, comme à ces (...) philosophes de la fin de Moyen Age et de la Renaissance que Char eût dit des Matinaux. Un humanisme faisant l'épreuve du néant en l'homme et du silence de Dieu était possible, dont Maître Eckhart et Nicolas de Cues montrent le chemin ; un christianisme aussi, fondé non sur l'usage d'une raison dogmatique mais d'une raison joueuse, laquelle, tout en sachant que c'est le coeur qui lui donne ses principes, se déploiera en toute liberté. In the debates on phenomenal consciousness that occurred over the last 20 years, Sartre’s analysis of pre-reflective consciousness has often been quoted in defence of a distinction between first- and third-personal modes of givenness that naturalists reject. This distinction aims both at determining the specificity of the access one has to their own thoughts, beliefs, intentions, or desires, and at justifying the particular privilege that one enjoys while making epistemic claims about their own mental states. This chapter defends an interpretation (...) of Sartre’s theory of pre-reflective consciousness that does not put him completely at odds with the naturalist critique and stresses that one’s pre-reflective experience should not be understood in terms of first-/third-person differentiation. This pre-reflective dimension of experience nevertheless allows a peculiar access to oneself, which grants no infallible epistemic privilege to the first-person, but lays the ground for a transformative process that makes self-knowledge possible.
