Centuries before being included in Hugo Grotius’s De iure belli ac pacis and De iure praedae, the subject of reprisal was already being discussed in medieval literature. The aim of this paper is to examine the medieval and early modern practice and theory of reprisal as it developed before and during Grotius’s lifetime. Its first part investigates a number of important foundational elements, such as the issues of definition and terminology, and the common characteristics of a reprisal case. In the (...) second half, the author explores why reprisals were deemed to be a ‘perversus mos’ or ‘bad custom’ and how continued reliance on this practice was nonetheless justified by inserting it into the medieval just war doctrine. The paper does not provide a systematic study of Grotius’s own engagement with medieval reprisal sources. Rather, it should be read in conjunction with another publication in this same volume, ‘Grotius on Reprisal’ by Randall Lesaffer. (shrink)

From his long years of experience as a local executive until he was ushered into the presidency, Duterte was able to master the masses’ longings. He understands what the public expects in a leader-- gathered from information he collected in unorthodox fashion. He plunges into the grassroots even (at times) resorting to disguises; and sometimes he maintains his own intelligence group that feeds him necessary information. The shock that he generates in all corners, factions, sectors and even countries would qualify (...) him (perhaps) to be the unnamed monster that can disrupt the realm of Philippine politics. But despite his monstrous image, quite surprisingly, Duterte remains popular and appealing to the electorate. This essay foregrounds the ambivalent monster that the Philippine president wittingly or unwittingly assumes; a monster that is ready to devour victims while protecting those he (supposedly) loves. The essay argues that Duterte is a monster that represents a rapture—a kind of abrupt transition. He represents a monster leader that does not care about the elite’s and traditional pundits’ definition of a leader. He represents a leader that is hindi-iba (sa masa) but at the same time iba sa marami (trapo/traditional politicians). (shrink)

This paper is mainly a provisional survey of the engagement of the Filipinos with the thoughts of Paulo Freire, a Brazilian educator and philosopher. It presents first the main tenets of Freire’s liberating pedagogy. Then, it explores the Filipinos’ engagement with his ideas. Then, it gives some observations on the said engagement. This paper reports the policy-responses of different Philippine higher education institutions (HEIs) to the novel coronavirus, COVD-19 pandemic. It compares these responses with those made by HEIs in Indonesia, Thailand, and Vietnam. Publicly available data and news reports were used to gauge the general public’s reaction to these policies and how the Philippines’ responses fare with its Southeast Asian neighbors. The paper observes that despite the innovations made by Philippine HEIs in terms of alternative learning modes and technologies for (...) delivering education, there are still gaps and challenges in their responses. It recommends that policy-responses and learning innovations should be grounded on a deeper understanding of distance education and should be sensitive to the call of the times. (shrink)

Articles written in Filipino language were featured to highlight the Journal’s additional role—that is to be a venue for Philippine studies scholarship— while remaining true to its original interdisciplinary character. This is consistent with the University’s intention to establish a Center for Philippine Studies within the Institute for Culture and Language Studies. Academics from different universities contributed think pieces that explored, analyzed, and investigated Philippine reality through the lenses offered by (...) linguistics, cultural studies, ethics, history, and philosophy. The plurality of languages and ethnicities, the geographic fragmentation, the predominant Roman Catholic religion, together with the still relatively short experience in nationhood account for a very peculiar understanding of "business ethics" in the Philippines. The rapid growth and liberalization of the economy, coupled with the inequitable distribution of wealth, the destruction of the environment and corruption are the main ethical concerns. Businesspersons and the academe endeavor to find creative solutions for these unique challenges.

The question initially raised in this paper was on how one’s religious sensibility affects one’s response to suffering. Focusing on three particular disasters that hit the Philippines, we look at the various media sources: the writing about the rains and flooding found in broadsheets and online media, and some ethnographic descriptions coming from the social sciences; we also look at experiential or anecdotal sources. All this provides us with material to establish certain traits and topics that come to fore (...) in times of disaster, including such concerns as the lessons learned during disaster, the wrath of God, and points of cultural pride such as notions of solidarity and resilience. A significant upshot of this study has been the recognition of epistemic and methodological reevaluations that had to constantly be taken. This concludes in a retrieval of the contextuality of suffering, a redefinition of what it means to say that the response is a Christian one, and finally a proposal that paying closer attention to these points, in addition to non-philosophical sources, might be a way of rethinking the problem of suffering beyond the scope of traditional theodicies. The neoliberal globalization project of expanding and maintaining capitalism globally requires the shaping of neoliberal nation-states that will entrench its ideology, political structures, and practices. In that sense, the neoliberal nation-state provides an appropriate conceptual site for investigating the local-global nexus in the dynamics of global capitalism. Using the Philippines as an example, this paper investigates the various factors or dimensions in the making of the Philippines as a neoliberal nation-state from the colonial era to the supranational structures (...) that exert external control on the Philippine political economy: the global power of transnational corporations, the IMF, American and Chinese imperialism, including the American military aid that supports militarization and counter-insurgency against movements that challenge the neoliberal agenda of the past and current regimes. Emérita Quito was the first woman from the Philippines to complete a Ph.D. in Philosophy. Her early Scholastic training as an undergraduate was at the University of Santo Tomas expanded to include phenomenology and existentialism during her graduate studies at major European universities. Upon returning home she began to focus on the idea of developing a methodology for investigating indigenous Filipino philosophy. How does one reveal the concepts and principles underlying the belief systems within a country that has suffered (...) a thousand years of occupation by foreign forces, that speaks with hundreds of different dialects across more than seven thousand islands spread across more than one hundred thousand square miles? This amazing philosopher published extensively not only in western philosophy, but on that indigenous to this island nation, prior to the incursions of western nations and the introduction to the Philippines of western philosophical views. Food security is one of the major concerns in the Philippines. Although livestock and poultry production accounts for a significant proportion of the country’s agricultural output, smallholder households are still vulnerable to food insecurity. The current study aims to examine how livestock production and selling difficulties affect smallholder households’ food-insecure conditions. For this objective, Bayesian Mindsponge Framework (BMF) analytics was employed on a dataset of the Food and Agriculture Organization’s Data in Emergencies Monitoring (DIEM) system. We found that production (...) and selling difficulties significantly adversely affect food insecurity in the Philippines. However, their effects vary according to the severity of food insecurity. In particular, production and selling difficulties affect the households’ likelihood of eating less healthy and nutritious food equally. However, the production difficulties have more negligible impacts on the possibility of skipping meals and even ambiguous impacts on the likelihood of not eating for a whole day compared to the effects of selling difficulties. Moreover, we also found that the market plays a crucial role in facilitating not only livestock trading but also livestock production (e.g., purchase of feed and medicines). Based on these findings, we suggest that the livestock market needs to be expanded and regulated to maintain the balancing prices between livestock products and products and services used for livestock production, and facilitate the product-exchanging mechanism. The article examines the erasure of any concept of the ‘public kitchen’ in the Philippines as demonstrative of statewide suppression of marginal identities that continues to facilitate the simplistic and uncomplicated entry of neocolonial modernity. As a yardstick of growth and progress under the US colonial government, the battle to modernize the Philippines extends far beyond the political and administrative terrains and into the reconfiguration of domestic space. In particular, the kitchen was to become an important site that (...) demonstrated the efficiency and power of American science. Accorded with new functions emanating from a colonial ideology, the induction of cooking and eating as expressions of collective identity have considerable implications for the manner in which public and private spaces are imagined. In the essay “Police Power: The Biopolitical State Apparatus and Differential Interpellations,” Banu Bargu developed the notion of the Biopolitical State Apparatus (BSA). This essay deploys Bargu’s notion of the BSA within what it claims is a militarized police power in the Philippines during the COVID-19 pandemic. Illustrating how the functioning of militarized police power underpins the implementation of public-health policy and the enforcement of laws that complement such power, the essay will further demonstrate through the BSA concept what (...) police power says about the state under the Duterte regime, how this regime relates to the state of exception and posttruth politics, and how its policing operates in contrast to other states. In general, existential threats are those that may potentially result in the extinction of the entire human species, if not significantly endanger its living population. Among the said threats include, but not limited to, pandemics and the impacts of a technological singularity. As regards pandemics, significant work has already been done on how to mitigate, if not prevent, the aftereffects of this type of disaster. For one, certain problem areas on how to properly manage pandemic responses have already been identified, (...) like the following: (a) not being able to learn from previous experiences, (b) the inability to act on warning signals, and (c) the failure to reach a global consensus on a problem (i.e., in a timely manner). In terms of a singularity, however, it may be said that further research is still needed, specifically on how to aptly respond to its projected negative outcomes. In this paper, by treating the three problem areas noted above as preliminary assessment measures of a country’s capacity to coordinate a national response to large-scale disasters, we examine the readiness of the Philippines in preparing for an intelligence explosion. By citing certain instances of how the said country, specifically its national government, faced the coronavirus disease 2019 pandemic, it puts forward the idea that the likely Philippine disaster response towards a singularity needs to be worked on, appealing for a more comprehensive assessment of such for a more informed response plan. In this paper, I provide a brief overview of the development of analytic philosophy in the Philippines. I first highlight the circumstances that led to its inception in the late 1930s, and some of the notable works by prominent Filipino analytic philosophers that helped shape the tradition. Next, I discuss the socio-political climate in the late 1950s through the 1970s that may have led some Filipino philosophers to move away from analytic philosophy. The construction of the Philippine''s first nuclear power plant by Westinghouse has come to symbolize the corruption and cronyism of the Marcos'' years. The plant has created so much controversy that it has yet to operate, in a country that desperately needs electrical power. The entire affair suggests that American multinationals cannot simply adopt the business practices of the host country, but instead must carefully analyze the political and business environments of their foreign based operations, and then take into account (...) the long-term ethical implications of their decisions. This paper is aimed at assessing how power, control, and resistance come into play and how resistance counteracts power and control in police investigative interviewing. Considering that the Philippines was once a colony of the United States, it is essential to compare the two samples as the Philippine legal system is highly patterned after the American jurisprudence (Mercullo in JForensicRes 11:1–4, 2020). A total of 10 Philippine and American police interviews were examined. While the Philippine corpus was obtained from the Pasay City Police Station, Metro Manila, the American corpus was culled from forensicling.com, an open-access website containing forensic linguistic data. Findings revealed that power and control were employed by the police in both contexts with 109 evidential markers (50.7%) and 2,443 representative speech acts (63.3%) having the highest frequency of occurrence. What is striking is the fact that police officers in both Philippine and American contexts show power and control in their utterances to be able to achieve the goal of police interviewing, that is, to gather information and elicit voluntary responses from the interviewees. Through this study, it is hoped that interviewers will be able to explore a better system of the questioning process that may lead the interviewees to cooperate more with them and arrive at a more accurate information. Practical medical decisions are closely integrated with ethical and religious beliefs in the Philippines. This is shown in a survey of Filipino physicians' attitudes towards severely compromised neonates. This is also the reason why the ethical analysis of critical care practices must be situated within the context of local culture. Kagandahang loob and kusang loob are indigenous Filipino ethical concepts that provide a framework for the analysis of several critical care practices. The practice of taking-from-the-rich-to-give-to-the-poor in public hospitals is (...) not compatible with these concepts. The legislated definition of death and other aspects of the Philippine Law on Organ Transplants also fail to be compatible with these concepts. Many ethical issues that arise in a critical care setting have their roots outside the seemingly isolated clinical setting. Critical care need not apply only to individuals in a serious clinical condition. Vulnerable populations require critical attention because potent threats to their lives exist in the water that they drink and the air that they breathe. We cannot ignore these threa ts even as we move inevitably towards a technologically dependent, highly commercialized approach to health management. (shrink)
