En este capítulo se estudia la facultad a prevención contenida en la Ley 1333 de 2009, para analizar la forma en la que el derecho ambiental ha venido construyendo una dogmática y reglas propias, escapando de la tradición del derecho administrativo, así como creando la dogmática propia necesaria para lograr su independencia y consolidación como un área autónoma de la disciplina jurídica. Integrated approaches in the ethical decision-making (EDM) and practically wise decision-making literature are emerging as alternative perspectives to management theories that conceptualize decision-making in a rationalist and value-free manner. However, more dialogue between both perspectives and qualitative research that applies them is required. In addition, there is a need for empirical analysis on business engagement in the face of grand challenges in developing countries. This paper proposes an integrated practically wise EDM framework to study how Colombian councilors who, in 2013, (...) voted for or against the merger between the Colombian state-owned company UNE and the Swedish multinational Millicom interpret this decision and its public impact. Qualitative semi-structured interviews were conducted with a voluntary sample of 18 of 21 councilors. Supporters of the UNE-Millicom merger expressed open-mindedness, seeing the merger as a means to achieve justice. On the contrary, the merger’s opponents expressed circumspection, doubting that Millicom’s intentions really leaned toward justice. We conclude that practical wisdom—embodied by both supporters and detractors—fosters an understanding of EDM beyond what leaders should not do. It also includes a democratic and balanced deliberation on what leaders think they should do to promote the common good. (shrink)

Este trabajo analiza, desde una perspectiva sociodemográfica, el comportamiento de la mortalidad adolescente en Argentina, más allá de las causas externas, en los trienios 2005-2007 y 2015-2017. Para ello, se calculan y analizan tasas de mortalidad por sexo, grupo de edad, causas seleccionadas y regiones geográficas, con base en datos de la Dirección de Estadística e Información de Salud de la Nación y del Instituto Nacional de Estadísticas y Censos. También se calculan el Coeficiente de Gini y los Años de (...) Esperanza de Vida Perdidos a nivel regional para profundizar el análisis de la dinámica espacial de la mortalidad. Los resultados muestran una reducción de la mortalidad adolescente para el conjunto de causas no externas. Sin embargo, se observan además: (a) mayores tasas de mortalidad masculina; (b) un aumento de la mortalidad en la población de 15 a 19 años de ambos sexos; (c) el predominio de los tumores como principal causa de muerte no externa; (d) un aumento de la mortalidad por enfermedades del sistema nervioso central, del aparato circulatorio, respiratorias y causas maternas, fundamentalmente entre los 15 y 19 años; y (e) la persistencia de diferencias interregionales, mayormente en detrimento del Noreste y del Noroeste. Estos resultados refuerzan la importancia de emprender medidas focalizadas en las particularidades de cada región y los factores que inciden en la ocurrencia de las muertes registradas. Todo ello en favor de procurar una atención más integral de la salud de la población adolescente, y lograr así sociedades más saludables y sostenibles a futuro. (shrink)

Workplace bullying is a phenomenon that can have serious detrimental effects on health, work-related attitudes, and the behavior of the target. Particularly, workplace bullying exposure has been linked to lower level of general well-being, job satisfaction, vigor, and performance and higher level of burnout, workplace deviance, and turnover intentions. However, the psychological mechanisms behind these relations are still not well-understood. Drawing on psychological contract and self-determination theory (SDT), we hypothesized that perceptions of contract violation and the frustration of basic needs (...) mediate the relationship between workplace bullying exposure and well-being, attitudinal, and behavioral outcomes. Self-reported data were collected among employees with different working backgrounds (N= 1,257)viaAmazon's Mechanical Turk in an online survey. Results showed that feelings of contract violation and frustration of basic needs accounted for unique variation in well-being, work satisfaction, burnout, vigor, and turnover intentions, pointing to individual contributions of both psychological mechanisms. However, when controlled for frustration of basic needs, feelings of psychological contract violation were no longer a mediator between workplace bullying exposure and work performance. Helping employees to deal effectively with workplace bullying exposure might buffer its negative effects and reduce their experienced frustration of basic needs, preserving their well-being, vigor, and work performance and, eventually, prevent burnout. The present study is the first to concurrently elucidate the proposed psychological mechanisms and unique contributions of psychological contract violation and frustration of basic needs in the context of workplace bullying. Nowadays, the quality standards of higher education institutions pay special attention to the performance and evaluation of the students. Then, having a complete academic record of each student, such as number of attempts, average grade and so on, plays a key role. In this context, the existence of missing data, which can happen for different reasons, leads to affect adversely interesting future analysis. Therefore, the use of imputation techniques is presented as a helpful tool to estimate the value of missing (...) data. This work deals with the academic records of engineering students, in which imputation techniques are applied. More specifically, it is assessed and compared to the performance of the multivariate imputation by chained equations methodology, the adaptive assignation algorithm based on multivariate adaptive regression splines and a hybridization based on self-organisation maps with Mahalanobis distances and AAA algorithm. The results show that proposed methods obtain successfully results regardless the number of missing values, in general terms. (shrink)

The Purpose in Life Test is a measure of purpose in life widely used in many cultures and countries; however, cross-cultural assessments are scarce. The present study aimed to evaluate the cross-cultural measurement invariance of the PIL in the general population of seven Latin American countries. A total of 4306 people participated, selected by non-probabilistic convenience sampling, where Uruguay has the highest mean age ; while Ecuador has the lowest mean age. Furthermore, in each country, there is a higher proportion (...) of women than men. Using Multi-Group Confirmatory Factor Analysis, the factorial structure does not show evidence of invariance among the included countries. However, based on the Multi-Group Factor Analysis Alignment, there is evidence that a three-dimensional structure of the PIL is the same in the participating countries. Results based on item response theory indicate that most PIL items can significantly differentiate responses according to the level of life purpose. In addition, people with low life purpose will tend to choose the lower response alternatives on the PIL; while people with higher life purpose will choose higher response alternatives. The findings indicate that the PIL has the potential to increase knowledge about how people conceive and experience their purpose in life in different countries. (shrink)

The assembly of products or components by operators in industries is a complex task with recurring problems. In these processes, operators often make errors that can lead to defective products. Therefore, they need to be inspected later to verify their correct assembly. The main problems are caused by several reasons including high employee turnover, lack of experience in manufacturing specific products or confusion in interpreting instructions to assemble similar components. In this paper, a novel structured language aimed to describe the (...) required actions to manufacture a product in industrial assembly environments is presented. The main contribution is to provide a formal language to feed automatic systems that can verify through visual control whether the actions performed by the operator are carried out following the standard described by this language. In general, the use of this formal language will allow to minimize the negative impact of errors during assembly and to reduce waste in many forms in the industry. (shrink)

The introduction of the notion of family resemblance represented a major shift in Wittgenstein’s thoughts on the meaning of words, moving away from a belief that words were well defined, to a view that words denoted less well defined categories of meaning. This paper presents the use of the notion of family resemblance in the area of machine learning as an example of the benefits that can accrue from adopting the kind of paradigm shift taken by Wittgenstein. The paper presents (...) a model capable of learning exemplars using the principle of family resemblance and adopting Bayesian networks for a representation of exemplars. An empirical evaluation is presented on three data sets and shows promising results that suggest that previous assumptions about the way we categories need reopening. (shrink)

En este capítulo se analiza la figura de la obtención vegetal: su alcance, dimensión, requisitos y caracterización frente a otros derechos de propiedad intelectual, para así abordar su ámbito de protección y su tratamiento en el ámbito internacional. Se pretende en este sentido plantear que la tendencia regulatoria en materia de obtenciones vegetales en Colombia no sólo va en contravía de los intereses de los pueblos indígenas, sino además de su patrimonio colectivo que les ha garantizado una gran diversidad que (...) hoy por hoy es sustento de su alimentación. Con lo anterior se lleva a cabo un singular esfuerzo para tratar de forma comprensiva este asunto, buscando la primacía del consentimiento libre, previo e informado de las comunidades potencialmente afectadas. Aguiñaga Fernández, de México.

New and recent axioms for cooperative games with transferable utilities are introduced. The non-negative player axiom requires to assign a non-negative payoff to a player that belongs to coalitions with non-negative worth only. The axiom of addition invariance on bi-partitions requires that the payoff vector recommended by a value should not be affected by an identical change in worth of both a coalition and the complementary coalition. The nullified solidarity axiom requires that if a player who becomes null weakly loses (...) from such a change, then every other player should weakly lose too. We study the consequence of imposing some of these axioms in addition to some classical axioms. It turns out that the resulting values or set of values have all in common to split efficiently the worth achieved by the grand coalition according to an exogenously given weight vector. As a result, we also obtain new characterizations of the equal division value. (shrink)

Este artículo muestra los resultados de un estudio de caso centrado en la puesta en marcha de un programa didáctico en un centro de primaria. El programa constó de dos actuaciones didácticas distintas en dos períodos de prácticum de magisterio. La primera se realizó con 2 grupos de 6º durante 5 sesiones y la segunda con 2 grupos de 5º durante 4 sesiones. Participaron 53 estudiantes. El tema escogido fue la Guerra Civil. Se combinaron conocimientos y emociones. De las observaciones (...) de la docente en prácticas, así como del análisis temático realizado sobre las intervenciones y producciones del alumnado, se evidencia cómo la simbiosis entre una educación patrimonial crítica, asentada sobre la memoria como forma de entender el paisaje, y la realización de salidas contextualizadas al entorno, refuerzan en el alumnado destrezas cívico-sociales. El paper realiza una exposición sobre el concepto y contenido de la nulidad y el restablecimiento del derecho como medio de control a la luz de la Ley 1437 de 2011; enfocándola en asuntos ambientales a través del estudio de la licencia ambiental.

En los últimos tiempos el derecho ambiental ha ganado un puesto importante en el ámbito jurídico, hecho que refleja la preocupación que hoy se tiene por la relación del hombre con su entorno. Desde hace quince años, la Universidad Colegio Mayor de Nuestra señora del Rosario, por intermedio de su Facultad de Jurisprudencia y concretamente de la Especialización y la línea de investigación en Derecho Ambiental, ha propuesto a través de diversos proyectos avanzar en el conocimiento y análisis del ordenamiento (...) jurídico ambiental, aportando así al desarrollo, estructura y consolidación de esta rama jurídica. Bajo estos parámetros, el objetivo de esta publicación es hacer algunas reflexiones en torno a distintos temas que dentro del derecho público impactan o influyen al derecho ambiental y responder a los enormes desafíos que se presentan en la materia. Por tanto, el programa quiere contribuir desde la academia al diálogo crítico y propositivo que permita dar solución a los problemas encontrados en la aplicación del derecho ambiental. En el primer capítulo, Gloria Amparo Rodriguez describe los ordenamientos jurídicos constitucionales de Colombia, Ecuador y Bolivia a fin de analizar la forma en que cada uno de ellos consagra el derecho a un ambiente sano. A continuación, Martha Ovalle y Zelba Nidia Castro de Perez realizan un estudio de los principios de precaución y prevención, exponiendo su alcance, su fundamento desde el derecho internacional y cómo vienen siendo entendidos por nuestro ordenamiento jurídico, tanto jurisprudencial como legal. Luis Adolfo Diazgranados se ocupa de la responsabilidad de los funcionarios públicos en materia ambiental, para lo cual realiza un análisis de los deberes consagrados en la normatividad vigente. Continuando con esta temática, el profesor Jorge Agudo Gonzalez, de la Universidad Autónoma de Madrid, explora la incidencia del ambiente y los recursos naturales en los procesos contractuales, a fin de mostrar cómo estas materias se han constituido en variable fundamental en el devenir de la formación, celebración y ejecución de los contratos, desde un punto de vista crítico, los aspectos importantes del proceso sancionatorio ambiental, evidenciando las falencias y vacios del a Ley 1333 de 2009. Jairo Cabrera plantea algunas reflexiones sobre la responsabilidad, valiéndose de la doctrina internacional, sobre la problemática de la reparación por daño ambiental. Por su parte, Leonardo Güiza Suárez explica el régimen general de la responsabilidad ambiental en el ordenamiento jurídico a partir del daño de los bosques naturales y su incidencia sobre los derechos humanos. Andres Gomez Rey, desde la teoría del acto administrativo, desarrolla el análisis crítico del régimen jurídico de las aguas superficiales en el derecho ambiental. Giovani J. Herrera Carrascal realiza una disertación sobre los recursos naturales y el ambiente como elementos del espacio público que a su vez constituye en un componente del medio ambiente urbano a partir de la jurisprudencia y de las competencias respectivas. Por último, Marybell Ochoa Miranda trate el tema de los residuos hospitalarios en Colombia, exponiendo su régimen jurídico, las competencias de las autoridades ambientales, los deberes que en estos asuntos tienen los ciudadanos, proponiendo lineamientos para avanzar en la consolidación de la gestión integral de residuos hospitalarios y similares.
