Immanuel Kant’s major book on his legal and political philosophy, the Doctrine of Right, appears in 1797. Therefore, many scholars have argued that Kant’s entire legal philosophy has only been developed in the late 1790s and that it is for the most part independent from his critical writings on moral philosophy dating in the 1780s. This article, however, tries to proof the contrary by analyzing the1784 lecture notes Moral-Mrongovius II given by Christoph Coelestin Mrongovius, who attended Kant’s lecture on moral (...) philosophy at that time. Those lecture notes not only proof that Kant’s concept of right has already been worked out in 1784. Even more: Moral-Mrongovius II indicates that Kant considered his legal philosophy as an integral part of his overall critical moral philosophy. (shrink)

Many recent writers on democracy have lamented its decay and warned of its imminent death. We argue that the concerns are focused at three different levels of democracy. The most fundamental of these, celebrated by Tocqueville and by Dewey, recognizes the interactions and joint deliberations among citizens who seek sympathetic mutual engagement. Such engagement is increasingly rare in large-scale political life. In diagnosing and treating the problems, we recommend returning to the debate between Lippmann and Dewey, in which many of (...) the concerns now prominent were already voiced. This inspires the main work of the paper – the reconstruction of Dewey’s conception of democracy as a ‘mode of associated living’. We focus on the thesis that democracy is educative and explicate Dewey’s notion of growth, showing how democratic education contributes to three important functions: the capacity for sustaining oneself, the enrichment of individual experience, and the ability to enter into cooperative discussions with fellow citizens. Dewey’s conception of democratic education is directed at fostering particular virtues and, if citizens come to possess them, the need for Lippmann’s ‘omnicompetent individual’ vanishes. We conclude by suggesting that Dewey’s project of educating democratic character is pertinent for addressing the disaffection of our times. (shrink)

After some years of consideration and discussion he expressed his views in print in an essay entitled Matter and Energy: Are there two Real Things in the Physical Universe? Senior lecturers/lecturers in mental health nursing (11 in round one, nine in round two, and eight in the final round) participated in a three-round Delphi study into the teaching of health care ethics (HCE) to students of nursing. The participants were drawn from six (round one) and four (round three) UK universities. Information was gathered on the organization, methods used and content of HCE modules. Questionnaire responses were transcribed and the content analysed for patterns of interest and areas of convergence (...) or divergence. Findings include: the majority (72.8%) of the sample believed that insufficient time was allocated to the teaching of HCE; case studies were considered a popular, although problematic, teaching method; the ‘four principles’ approach was less than dominant in the teaching of HCE; and virtue ethics was taught by only 36.4% of the participants. The Delphi technique proved adequate and worth while for the purposes of this study. Further empirical research could aim to replicate or contradict these findings, using a larger sample and recruiting more university departments. Reflection is required on several issues, including the depth and breadth to which ethics theory and, more controversially, meta-ethics, are taught to nursing students. (shrink)

The readiness potential (RP) is one of the most controversial topics in neuroscience and philosophy due to its perceived relevance to the role of conscious willing in action. Libet and colleagues reported that RP onset precedes both volitional movement and conscious awareness of willing that movement, suggesting that the experience of conscious will may not cause volitional movement (Libet, Gleason, Wright, & Pearl, 1983). Rather, they suggested that the RP indexes unconscious processes that may actually cause both volitional movement and (...) the accompanying conscious feeling of will (Libet et al., 1983; pg. 640). Here, we demonstrate that volitional movement can occur without an accompanying feeling of will. We additionally show that the neural processes indexed by RPs are insufficient to cause the experience of conscious willing. Specifically, RPs still occur when subjects make self-timed, endogenously-initiated movements due to a post-hypnotic suggestion, without a conscious feeling of having willed those movements. Disagreement is a hot topic right now in epistemology, where there is spirited debate between epistemologists who argue that we should be moved by the fact that we disagree and those who argue that we need not. Both sides to this debate often use what is commonly called “the method of cases,” designing hypothetical cases involving peer disagreement and using what we think about those cases as evidence that specific normative theories are true or false, and as reasons for believing (...) as such. With so much weight being given in the epistemology of disagreement to what people think about cases of peer disagreement, our goal in this paper is to examine what kinds of things might shape how people think about these kinds of cases. We will show that two different kinds of framing effect shape how people think about cases of peer disagreement, and examine both what this means for how the method of cases is used in the epistemology of disagreement and what this might tell us about the role that motivated cognition is playing in debates about which normative positions about peer disagreement are right and wrong. This volume presents the long-awaited edition of the Cave 4 manuscripts of Serekh Ha-Yahad or The Rule of the Community, in which the Essenes detailed the guidelines for membership in their community. Also known as the Manual of Discipline, a complete scroll was found in Cave 1 at Qumran and this edition illuminates the textual and redactional history of Dead Sea literature. The document is extremely important for understanding the nature, practice, and ideology of the Qumran covenanters.

In the paper, which pretends to be a program manifesto, its authors justify a necessity of the new theoretical approach to culture which they call a “strong program” in sociology of culture. While the existing sociological approaches to culture bear a reductionist character, the “strong program” treats culture in terms of its autonomy. After a general review of the sociological conceptions of culture authors analyze the most significant approaches within the “weak program.” In the core section of the paper they (...) discuss the required steps that will make a “strong program” possible on the grounds of synthesis of structuralism and hermeneutics. Because the notions of "anthropomorphism" and "sentimentality" often are used pejoratively to dismiss research in human-animal studies, there is much to be gained from ongoing and detailed analysis of the changing "structures of feeling" that shape representations and treatments of nonhuman animals. Literary criticism contributes to this project when it pays due attention to differences in historical and cultural contexts. We present several new studies focusing on “salience effects”—the decreased tendency to attribute knowledge to someone when an unrealized possibility of error has been made salient in a given conversational context. These studies suggest a complicated picture of epistemic universalism: there may be structural universals, universal epistemic parameters that influence epistemic intuitions, but that these parameters vary in such a way that epistemic intuitions, in either their strength or propositional content, can display patterns of genuine cross-cultural diversity.

This volume contains the texts from Cave 4 at Qumran which did not find a home in the earlier volumes of Discoveries in the Judaean Desert, which were arranged by literary genre. Although many compositions found at Qumran were works already known from the Bible, Apocrypha, or Pseudepigrapha, these texts were previously unknown and include some works composed by the Qumran community itself. In addition, the volume contains some literary and documentary texts from sites near Qumran.

I show that Armstrong’s view of laws as second-order contingent relations of ‘necessitation’ among categorical properties faces a dilemma. The necessitation relation confers a relation of extensional inclusion (‘constant conjunction’) on its relata. It does so either necessarily or contingently. If necessarily, it is not a categorical relation (in the relevant sense). If contingently, then an explanation is required of how it confers extensional inclusion. That explanation will need to appeal to a third-order relation between necessitation and extensional inclusion. (...) The same dilemma reappears at this level. BatsonIn late August 1546, Philip Melanchthon had some seriously strange dreams. One night, he saw a man in the Elbe struggling to keep his head above the river's powerful current. As Melanchthon approached to help, he recognized the drowning man's visage: Charles V. Despite Melanchthon's (...) attempts to save him, the river dragged the emperor under and carried him away. Another night, he dreamed that while translating Demosthenes with his friend Joachim Camerarius in the Wittenberg castle (a Melanchthon dream if there ever was one!) he looked out a window to see that the Elbe had turned to blood.1 [End Page 713]These ominous visions reflected the precarious world Melanchthon faced in late summer 1546. Martin Luther, the hero of the German Reformation, had died in February, leaving a gaping hole in the evangelical movement. Further, German Protestantism was facing the largest political crisis in its short history. The Schmalkaldic War had begun in July, only a few weeks prior, and the Reformation faced intense military pressure from Charles V. As the emperor slowly advanced, an anxious Melanchthon lived in constant tension between wild hope that Charles would be defeated and grim fear of massive bloodshed.As the war began, Melanchthon was greatly disturbed by the violence and the potential for disastrous defeat of the Protestant cause. In an August 26 letter, he wrote this to a friend: "Often now, when I look over the Elbe River gliding by me, I sigh and think that, even if I could pour forth a river of tears as great as the Elbe's flow, I would never be able to exhaust the sadness which surrounds my soul because of this civil war. If only Charles had not started it!"2 Should the Schmalkaldic League be defeated and political support for the Reformation be crushed, the true church would be in dangerous waters, just like the emperor in Melanchthon's dream.In the midst of this impending catastrophe, on September 1, 1546, Melanchthon published an unusual work: the Collatio actionum forensium Atticarum et Romanarum praecipuarum (A comparison of the principal Attic and Roman legal actions). In this study, Melanchthon organized and compared the legal actions of Athens and Rome, following the order of the Ten Commandments. In 1546, Greek law was a virtually unknown field. Contemporary legal humanists like Andrea Alciato, Ulrich Zasius, and François Baudouin had devoted their attention almost exclusively to Roman or feudal European law.3 Nearly a century before the publication of sprawling [End Page 714] tomes by the Greek legal scholars Samuel Petit, Claudius Salmasius, and Johannes Meursius, Melanchthon treated the law of ancient Athens as a worthy subject.4 Even more puzzling, Melanchthon devoted himself to this arcane work during a moment of dire political crisis. The unusual subject matter of the Collatio and the urgent circumstances surrounding its publication raise a pair of intriguing questions: Why did Melanchthon think Attic legal actions were important? And why did he think they were worth studying while a military and political disaster loomed on the horizon?Melanchthon valued the ancient pagan laws because they showed how God had revealed legal and moral principles to the gentiles. His study of Attic and Roman law demonstrated how, through natural reason, the classical pagans had attained knowledge of the natural law and implemented it in their own societies.5 As a result, the ancient laws became indispensable to Christians studying law and moral philosophy.6 This work on ancient Greek law was an essential part of Melanchthon's pedagogical project of integrating Christianity and the classical world. As he wrote in the introduction, he had decided to write on Attic legal actions "so that students may know that they are not only formulas for litigation, but also a philosophy and a doctrine of virtue."7 By reconstructing the laws of ancient Athens and comparing them with those of Rome, Melanchthon demonstrated that classical moral and legal thought was in complete agreement with the Decalogue and essential for Christian moral development. Generalized anxiety disorder is among the world’s most prevalent psychiatric disorders and often manifests as persistent and difficult to control apprehension. Despite its prevalence, there is no integrative, formal model of how anxiety and anxiety disorders arise. Here, we offer a perspective derived from the free energy principle; one that shares similarities with established constructs such as learned helplessness. Our account is simple: anxiety can be formalized as learned uncertainty. A biological system, having had persistent uncertainty in its past, will (...) expect uncertainty in its future, irrespective of whether uncertainty truly persists. Despite our account’s intuitive simplicity—which can be illustrated with the mere flip of a coin—it is grounded within the free energy principle and hence situates the formation of anxiety within a broader explanatory framework of biological self-organization and self-evidencing. We conclude that, through conceptualizing anxiety within a framework of working generative models, our perspective might afford novel approaches in the clinical treatment of anxiety and its key symptoms. Measuring and assessing the different aspects of gambling behavior and its consequences is crucial for planning prevention, treatment, and understanding the development of at-risk and problem gambling. Studies indicate that instruments measuring problem gambling produce different results based on the characteristics of the population assessed. To accurately measure at-risk and problem gambling behavior, especially in a low-risk population, measures must cover a wider set of dimensions than the negative consequences already manifest. The Jonsson-Abbott Scale includes items that cover overconsumption, actions (...) that reinforce gambling behavior, and belief in gambling fallacies, based on a three-factor structure and has previously demonstrated good psychometric properties. However, there is a need to investigate how the instrument also functions in low-risk populations. This study aims to do so using both confirmatory factor and Rasch analysis; this research included 1,413 Swedish participants who endorsed at least one JAS item. The results replicated the previous three-factor solution and indicated that the instrument had good reliability. In addition, the results demonstrated that the three factors are independent, and the overall score per factor needs to be analyzed. In summary, the JAS appears suitable for use in low-risk populations to measure various aspects of gambling behavior. (shrink)

In his important paper "1953 and All That: A Tale of Two Sciences" (1984), Philip Kitcher defends biological antireductionism, arguing that the division of biology into subfields such as classical and molecular genetics is "not simply... a temporary feature of our science stemming from our cognitive imperfections but [is] the reflection of levels of organization in nature" (p. 371). In a recent discussion of Kitcher's views, Alexander Rosenberg has argued, first, that Kitcher has shown that the reduction of (...) classical to molecular genetics is impossible only because of our intellectual limitations and, second, that this kind of antireductionism supports an instrumentalist approach to biological theory. I argue that both of Rosenberg's claims should be rejected despite the fact that Kitcher misdiagnoses the central reason for the failure of reduction. (shrink)

The debate about the credentials of sociobiology has persisted because scholars have failed to distinguish the varieties of sociobiology and because too little attention has been paid to the details of the arguments that are supposed to support the provocative claims about human social behavior. I seek to remedy both deficiencies. After analysis of the relationships among different kinds of sociobiology and contemporary evolutionary theory, I attempt to show how some of the studies of the behavior of nonhuman animals meet (...) the methodological standards appropriate to evolutionary research. I contend that the efforts of E. O. Wilson, Richard Alexander, Charles Lumsden, and others to generate conclusions about human nature are flawed, both because they apply evolutionary ideas in an unrigorous fashion and because they use dubious assumptions to connect their evolutionary analyses with their conclusions. This contention rests on analyses of many of the major sociobiological proposals about human social behavior, including: differences in sex roles, racial hostility, homosexuality, conflict between parents and adolescent offspring, incest avoidance, the avunculate, alliances in combat, female infanticide, and gene–culture coevolution.Vaulting Ambitionthus seeks to identify what is good in sociobiology, to expose the errors of premature speculations about human nature, and to prepare the way for serious study of the evolution of human social behavior.
