This paper presents a theory of reasoning with evidence in order to determine the facts in a criminal case. The focus is on the process of proof, in which the facts of the case are determined, rather than on related legal issues, such as the admissibility of evidence. In the literature, two approaches to reasoning with evidence can be distinguished, one argument-based and one story-based. In an argument-based approach to reasoning with evidence, the reasons for and against the occurrence of (...) an event, e.g., based on witness testimony, are central. In a story-based approach, evidence is evaluated and interpreted from the perspective of the factual stories as they may have occurred in a case, e.g., as they are defended by the prosecution. In this paper, we argue that both arguments and narratives are relevant and useful in the reasoning with and interpretation of evidence. Therefore, a hybrid approach is proposed and formally developed, doing justice to both the argument-based and the narrative-based perspective. By the formalization of the theory and the associated graphical representations, our proposal is the basis for the design of software developed as a tool to make sense of the evidence in complex cases. Peter Bowler has spent 40 years doing Darwinian calisthenics, researching and writing on the development of evolutionary ideas with special attention to Darwin and subsequent filiations among scientists exploring (...) evolution . Therefore, we would expect that when Bowler engages in a counterfactual history—imagining a world without Darwin—he is able to avoid historical injury and generate novel insights. Attentional bias has been suggested to contribute to the persistence of substance use behavior. However, the empirical evidence for its proposed role in addiction is inconsistent. This might be due to the inability of commonly used measures to differentiate between attentional engagement and attentional disengagement. Attesting to the importance of differentiating between both components of AB, a recent study using the odd-one-out task showed that substance use was differentially related to engagement and disengagement bias. However, the AB measures derived from (...) the OOOT showed insufficient reliability to be used as a solid measure of individual differences. Therefore, the current study aimed to improve the reliability of the AB measures derived from the OOOT by using more distinct contrast stimuli, adding practice trials, increasing the number of trials, and by having participants perform the task in an alcohol-relevant context. We contrasted the original OOOT with the adapted OOOT and assessed AB in low- and high-drinking individuals. Participants were 245 undergraduate students who typically tend to drink either low or high amounts of alcohol. In one condition, AB was measured with the original OOOT in a typical laboratory context, whereas in the other condition, AB was measured with the OOOT-adapt in a bar context. The OOOT-adapt showed superior internal consistency, especially for the high-drinking group. Further, specifically the OOOT-adapt differentiated between low- and high-drinking participants showing that high drinkers engaged faster with alcohol cues than did low drinkers. Thus, the OOOT-adapt was found to be a promising candidate to reliably index AB in the context of alcohol use. The OOOT-adapt further showed superior criterion validity as it could differentiate between low- and high-drinking individuals, thereby adding to the evidence that AB might be involved in substance use behavior. Although much has been written about the vigorous debates over science and religion in the Victorian era, little attention has been paid to their continuing importance in early twentieth-century Britain. Reconciling Science and Religion provides a comprehensive survey of the interplay between British science and religion from the late nineteenth century to World War II. Peter J. Bowler argues that unlike the United States, where a strong fundamentalist opposition to evolutionism developed in the 1920s (most famously expressed in the (...) Scopes "monkey trial" of 1925), in Britain there was a concerted effort to reconcile science and religion. Intellectually conservative scientists championed the reconciliation and were supported by liberal theologians in the Free Churches and the Church of England, especially the Anglican "Modernists." Popular writers such as Julian Huxley and George Bernard Shaw sought to create a non-Christian religion similar in some respects to the Modernist position. Younger scientists and secularists—including Rationalists such as H. G. Wells and the Marxists—tended to oppose these efforts, as did conservative Christians, who saw the liberal position as a betrayal of the true spirit of their religion. With the increased social tensions of the 1930s, as the churches moved toward a neo-orthodoxy unfriendly to natural theology and biologists adopted the "Modern Synthesis" of genetics and evolutionary theory, the proposed reconciliation fell apart. Because the tensions between science and religion—and efforts at reconciling the two—are still very much with us today, Bowler's book will be important for everyone interested in these issues. The story of "natural law" - the idea that God has written a law on the human heart so that ethical norms derive from human nature - in twentieth-century Protestant ethics is one of rejection and resurgence. For half a century, luminaries like Karl Barth, Carl F. H. Henry, and Cornelius Van Til cast a shadow over natural law moral reflection because of its putative link to natural theology, autonomous reason, associations with Catholic theology, and ethical witness devoid of special (...) revelation. However, over the past twenty years, Protestant theologians have renewed their interest in the subject, often animated by debates on Christian involvement in the public arena and on matters of life, death, and gender and sexuality. Much of this engagement has happened within Reformed circles and has largely been conducted without reference to Roman Catholic construals of the natural law. Conversely, Catholic developments in natural-law thinking have paid little attention to the surge of interest on the Protestant side. As a result, Protestant and Catholic natural proponents - and even those skeptical of the natural law - are not in conversation with one another.The lack of dialog between the various schools of natural law has left a historic tradition within Christan moral thought underdeveloped in contemporary Protestant theology. I argued that anyone who adopts the Everettian approach to the foundations of quantum mechanics must also accept the (unpopular) ‘halfer’ solution to the Sleeping Beauty puzzle. Papineau and Durà-Vilà have responded with an argument that it is perfectly cogent both to be an Everettian and to accept the (popular) ‘thirder’ solution to Sleeping Beauty. Here I attempt to rebut their argument, and to clarify my original position.

As science learns more about how the brain works, and fails to work, the possibility for developing “cognition enhancers” becomes more plausible. And the demand for drugs that can help us think faster, remember more, and focus more keenly has already been demonstrated by the market success of drugs like Ritalin, which tames the attention span, and Prozac, which ups the competitive edge. The new drug Aricept, which improves memory, most likely will join them. Whether such drugs are good for (...) individuals, or for society, is an open question, one that demands far more public discussion. (shrink)

Realists and supporters of ‘democratic underlabouring’ have recently challenged the traditional separation between political theory and practice. Although both attack Jürgen Habermas for being an idealist whose philosophy is too removed from politics, I argue that this interpretation is inaccurate. While Habermas’s social and political theory is indeed oriented to truth and understanding, he has sought realize his communicative conception of democracy by increasing the quality of political debate as a public intellectual. Building on his approach, I argue that giving (...) the theorist a direct role in public policy undermines theory as an enterprise oriented towards truth while overlooking the contingency, participatory nature and complicated internal logics of social and political practice. My basic thesis is that Habermas’s understanding of the relationship between theory and practice overcomes these difficulties by providing an account of theory that is independent but simultaneously also allows philosophers to participate in politics as public intellectuals. A few years ago, I argued that according to spontaneous collapse theories of quantum mechanics, arithmetic applies to macroscopic objects only as an approximation. Several authors have written articles defending spontaneous collapse theories against this charge, including Bassi and Ghirardi, Clifton and Monton, and now Frigg. The arguments of these authors are all different and all ingenious, but in the end I think that none of them succeeds, for reasons I elaborate here. I suggest a fourth line of response, based (...) on an analogy with epistemic paradoxes, which I think is the best way to defend spontaneous collapse theories, and which leaves my main thesis intact. Radical skepticism about the external implies that no belief about the external is even prima facie justified. A theoretical reply to skepticism has four stages. First, show which theories of epistemic justification support skeptical doubts (show which theories, given other reasonable assumptions, entail skepticism). Second, show which theories undermine skeptical doubts (show which theories, given other reasonable assumptions, do not support the skeptic’s conclusion). Third, show which of the latter theories (which non-skeptical theory) is correct, and in so doing show (...) that all of the rival theories of justification, skeptical and non-skeptical alike, are mistaken. Fourth, explain why skeptical doubts are sometimes (or sometimes merely seem) intuitive, and thereby accommodate skeptical doubts without capitulation. Michael Williams has pioneered the very idea of a theoretical reply. A theoretical diagnosis consists in just the first two stages. An adequate reply, which is correct at each stage, would rebut the skeptic entirely. Williams’ own reply, I argue, is inadequate. I offer in its place an exhaustive and accurate diagnosis of skepticism. I distinguish four kinds of skepticism and five theories of justification. I then show which theories do, and which theories do not, support which kinds of skepticism. (shrink)

What is the best account of process reliabilism about epistemic justification, especially epistemic entitlement? I argue that entitlement consists in the normal functioning (proper operation) of the belief-forming process when the process has forming true beliefs reliably as an etiological function. Etiological functions involve consequence explanation: a belief-forming process has forming true beliefs reliably as a function just in case forming-true beliefs reliably partly explains the persistence of the process. This account paves the way for avoiding standard objections to process (...) reliabilism and situations epistemic entitlement within a normative framework of functions and functional norms. (shrink)

These models are as serviceable to the right as to the left: they allow the economist either to condemn capitalism for failing to measure up to the model of perfect competition, or to praise capitalism as a utopia of perfect knowledge and rational expectations. Hayek, by contrast, used equilibrium to show that while capitalism is not perfect, it contains (...) error‐correcting institutions that bring it closer to perfection than is intuitively apparent. It is widely acknowledged that the link between quantum language and ordinary language must be "fuzzier" than the traditional eigenstate-eigenvalue link. In the context of spontaneous-collapse theories, Albert and Loewer argue that the form of this fuzzy link is a matter of convention, and can be freely chosen to minimize anomalies for those theories. I defend the position that the form of the link is empirical, and could be such as to render collapse theories idle.
