There is a growing interest in how people conceptualise the legal domain for the purpose of legal knowledge systems. In this paper we discuss four such conceptualisations (referred to as ontologies): McCarty's language for legal discourse, Stamper's norma formalism, Valente's functional ontology of law, and the ontology of Van Kralingen and Visser. We present criteria for a comparison of the ontologies and discuss the strengths and weaknesses of the ontologies in relation to these criteria. Moreover, we critically review the (...) criteria. There has been much talk of the need to build intermediate models of the expertise required preparatory to constructing a knowledge-based system in the legal domain. Such models offer advantages for verification, validation, maintenance and reuse. As yet, however, few such models have been reported at a useful level of detail. In this paper we describe a method for conceptualising legal domains as well as its application to a substantial fragment of the Dutch Unemployment Benefits Act (DUBA).We first discuss the (...) intermediate models (called expertise models), then present a three-stage method for their construction, drawing on the CommonKADS work in knowledge acquisition, conceptual models of statute law, and the KANT method of knowledge analysis. Subsequently, we describe how these techniques were applied to the DUBA, and provide detailed examples of the resulting model. Finally, conclusions on the framework and guidelines are given as well as means of recording and presenting the various design choices. (shrink)

With an increasing use of artificial intelligence (AI) systems, theorists have analyzed and argued for the promotion of trust in AI and trustworthy AI. Critics have objected that AI does not have the characteristics to be an appropriate subject for trust. However, this argumentation is open to counterarguments. Firstly, rejecting trust in AI denies the trust attitudes that some people experience. Secondly, we can trust other non‐human entities, such as animals and institutions, so why can we not trust AI systems? (...) Finally, human–AI trust is criticized based on a conception of human–human trust, which does not recognize the distinctiveness of the human–AI relationship. This article aims to refute these counterarguments based on the genealogical analyses of ‘trust’ and ‘trustworthiness’ of Karen Jones and Thomas Simpson, who show that trust and trustworthiness help to overcome vulnerabilities. This function of trust gives reason to use human–human trust as a standard. For this function, it is important that trustees are responsive to trust. While animals and institutions could be responsive, narrow AI systems are unable to be responsive to trust. Therefore, we should not apply trust to AI and instead direct our trust to those who can be responsive to and held responsible for our trust. (shrink)

Direct-to-consumer advertising (DTCA) of prescription drugs has been a heavily contested issue over the past decade, touching on several issues of responsibility facing the pharmaceutical industry. Much research has been conducted on DTCA, but hardly any studies have discussed this topic from a corporate social responsibility (CSR) perspective. In this article, we use several elements of CSR, emphasising consumer autonomy and safety, to analyse differences in DTCA practices within two different policy contexts, the United States of America and the European (...) Union (EU). Doing so results in an alternative analysis of the struggle between proponents and opponents of DTCA from a CSR perspective, adding an alternative view on this debate. (shrink)

In response to the chronic overuse and misuse of pesticides in agriculture, governments in Southeast Asia have sought to improve food safety by introducing public standards of good agricultural practices (GAP). Using quantitative farm-level data from an intensive horticultural production system in northern Thailand, we test if fruit and vegetable producers who follow the public GAP standard use fewer and less hazardous pesticides than producers who do not adhere to the standard. The results show that this is not the case. (...) By drawing on qualitative data from expert interviews and an action research project with local litchi (“lychee”) producers we explain the underlying reasons for the absence of significant differences. The qualitative evidence points at poor implementation of farm auditing related to a program expansion that was too rapid, at a lack of understanding among farmers about the logic of the control points in the standard, and at a lack of alternatives given to farmers to manage their pest problems. We argue that by focusing on the testing of farm produce for pesticide residues, the public GAP program is paying too much attention to the consequences rather than the root cause of the pesticide problem; it needs to balance this by making a greater effort to change on-farm practices. Johannes Versor († after 1482) was a prominent philosopher in the late fifteenth century, whose works were widely diffused. In recent scholarship, Versor has been associated with two schools of thought: Thomism and Albertism. These, however, were rivals—especially in Cologne, where Versor's works were printed repeatedly. Given this historical context, how should Versor's position amidst the quarrels of the schools be interpreted? Although he evidently used the works of both Albert and Thomas, there is no evidence that Versor ever committed (...) himself to either Albertism or Thomism. In addition, the Cologne printings of his works suggest that Versor's contemporaries considered him an independent authority. Therefore, Versor cannot be rated among the members of either school. Community engagement is increasingly defended as an ethical requirement for biomedical research. Some forms of community engagement involve asking the consent of community leaders prior to seeking informed consent from community members. Although community consent does not replace individual consent, it could problematically restrict the autonomy of community members by precluding them from research when community leaders withhold their permission. Community consent is therefore at odds with one of the central principles of bioethics: respecting autonomy. This raises the question as (...) to how community consent can be justified or even required. This paper aims to provide an answer to this question by arguing, based on the work of Taylor and Kymlicka, that community practices are important for the identity and autonomy of community members. When these practices are incompatible with a solitary focus on individual informed consent, they need to be protected by making these decision‐making practices (including asking permission to community authorities) part of the consent process. Since these decision‐making practices are important for the autonomy of community members, community consent with the goal of protecting these practices is not necessarily in conflict with autonomy. The Dutch Republic holds a marginal position in the debate on the transition from feudalism to capitalism, despite its significance in the early stage of the development of global capitalism. While the positions of those Marxists who did consider the Dutch case range from seeing it as the first capitalist country to rejecting it as an essentially non-capitalist commercial society, all involved basically accept an image of Dutch development as being driven by commerce rather than real advances in the sphere (...) of production. Their shared interpretation of the Dutch ‘Golden Age’, however, rests on an interpretation of Dutch economic history that does not match the current state of historical knowledge. Rereading the debate on the Dutch trajectory towards capitalism in the light of recent economic historiography seriously challenges established views, and questions both major strands in the transition-debate. The book examines the evolution and current state of corporate social responsibility (CSR), using a five-stage maturity model: defensive, charitable, promotional, strategic and transformative CSR. The first four stages are dubbed CSR 1.0 and characterise most current CSR practice, while the fifth stage is named CSR 2.0 (also transformative or systemic CSR) and describes emergent and future CSR practices. Reasons are given why CSR 1.0 approaches have failed to have any significant impact on the most serious global social, environmental and (...) ethical challenges. The emergent CSR 2.0 will then be explored in detail by elaborating on five principles underlying the new approach, including: creativity, scalability, responsiveness, glocality and circularity. A four-part DNA Model is also introduced, covering value creation, good governance, societal contribution and ecological integrity, which provides the basis for defining and measuring CSR 2.0. Finally, a 70-question CSR 2.0 self-assessment diagnostic tool developed by the author is presented, with sample data to show how the tool can be used for future research and practitioner application. The core theme of the special issue in which this article appears is the inherent impossibility of confining the knowledge required to build and sustain the instruments of travel to a single space or institution. This is certainly true for the ships that built empires – the large sailing and later steam ships produced by navies and companies in the process of European expansion. Ships traveled between polities and required repairs overseas, taking the construction knowledge and practices with them. Skilled (...) laborers – experienced shipwrights and increasingly also trained engineers – helped to transfer shipbuilding practices across oceans, and to adapt these practices to local conditions based on forms of “blended know-how.” This article explores how the circulation of shipbuilding knowledge and practices within and between maritime empires changed with the increasing pace of industrialization. It does so on the basis of three moments: the Dutch East India Company’s shipbuilding activities in Asia in the seventeenth and eighteenth centuries; the interaction between private industry and the Dutch state in advancing machine-manufacturing in both the Netherlands and on Java in the 1830s and 1840s; and the aid provided by Dutch engineers in laying the groundwork for Japanese industrial warship-construction in the second half of the nineteenth century. Such transfers put high demands on the capacities of states and naval administrators in controlling the flows of necessary resources and skilled labor, requiring complex arrangements between states and private capital. Industrialization did not change this basic fact, but it did change the nature of these arrangements. Although shipbuilding knowledge always remained practice-driven, highly mobile and susceptible to local adaptation, the increasing technological demands created by the transition from sail to steam and wood to iron, combined with the extension of the power of states and transnationally operating manufacturing companies, considerably changed the institutional embeddings and societal consequences of its circulation. This paper is concerned with the logical structure of arithmetical theories. We survey results concerning logics and admissible rules of constructive arithmetical theories. We prove a new theorem: the admissible propositional rules of Heyting Arithmetic are the same as the admissible propositional rules of Intuitionistic Propositional Logic. We provide some further insights concerning predicate logical admissible rules for arithmetical theories.

In this paper we describe a framework for the construction of entities that can serve as interpretations of arbitrary contiguous chunks of text. An important part of the paper is devoted to describing stacking cells, or the proposed meanings for bracket-structures.

A possible way out of the conundrum of quantum gravity is the proposal that general relativity (GR) emerges from an underlying microscopic description. Despite recent interest in the emergent gravity program within the physics as well as the philosophy community, an assessment of the general motivation for this idea is lacking at the moment. We intend to fill this gap in the literature by discussing the main arguments in favour of the hypothesis that the metric field and its dynamics are (...) emergent. First, we distinguish between microstructure inspired from GR, such as through quantization or discretization, and microstructure that is not directly motivated from GR, such as strings, quantum bits or condensed matter fields. The emergent gravity approach can then be defined as the view that the metric field and its dynamics are derivable from the latter type of microstructure. Subsequently, we assess in how far the following properties of (semi-classical) GR are suggestive of underlying microstructure: (1) the metric's universal coupling to matter fields, (2) perturbative non-renormalizability, (3) black hole thermodynamics, and (4) the holographic principle. This article critically evaluates the possible impact of the Charter on the relationship between the Court of Justice of the European Union and national constitutional courts. While it is premature to provide a definitive assessment of the kind of collaboration that these courts will develop, it is crucial to identify a number of features of the new landscape that will influence the direction in which the relationship between the CJEU and constitutional courts will evolve. This article discusses several reasons that (...) may result in better or a higher number of judicial interactions, as well as factors that may create tension or cause problems in the relationship between the CJEU and national constitutional courts. As such, it offers a framework that may help us to understand future post-Charter judgments by these courts setting out how they conceive their engagement with their counterpart on fundamental rights issues. We prove that all extensions of Heyting Arithmetic with a logic that has the finite frame property possess the de Jongh property.

In this note we compare propositional logics for closed substitutions and propositional logics for open substitutions in constructive arithmetical theories. We provide a strong example where these logics diverge in an essential way. We prove that for Markov's Arithmetic, that is, Heyting's Arithmetic plus Markov's principle plus Extended Church's Thesis, the logic of closed and the logic of open substitutions are the same.

In this paper, we show that the predicate logics of consistent extensions of Heyting's Arithmetic plus Church's Thesis with uniqueness condition are complete $\Pi _{2}^{0}$. Similarly, we show that the predicate logic of HA*, i.e. Heyting's Arithmetic plus the Completeness Principle (for HA*) is complete $\Pi _{2}^{0}$. These results extend the known results due to Valery Plisko. To prove the results we adapt Plisko's method to use Tennenbaum's Theorem to prove 'categoricity of interpretations' under certain assumptions.

In this paper, we study finitely axiomatizable conservative extensions of a theoryUin the case whereUis recursively enumerable and not finitely axiomatizable. Stanisław Krajewski posed the question whether there are minimal conservative extensions of this sort. We answer this question negatively.Consider a finite expansion of the signature ofUthat contains at least one predicate symbol of arity ≥ 2. We show that, for any finite extensionαofUin the expanded language that is conservative overU, there is a conservative extensionβofUin the expanded language, such that$\alpha (...) \vdash \beta$and$\beta \not \vdash \alpha$. Studies in the neurobiological underpinnings of social information processing bypsychologists, neurobiologists, psychiatrists, radiologists, and neurologists, using methods thatrange from brain imaging techniques to comparative analyses.

In this paper we examine various requirements on the formalisation choices under which self-reference can be adequately formalised in arithmetic. In particular, we study self-referential numberings, which immediately provide a strong notion of self-reference even for expressively weak languages. The results of this paper suggest that the question whether truly self-referential reasoning can be formalised in arithmetic is more sensitive to the underlying coding apparatus than usually believed. This paper starts out with a theoretical argument, based on panel data, that public mood in general and societal pessimism in particular should be measured from an explicitly temporal perspective. Next, based on a survey among more than 200 Japanese students and a wide array of existing data sources in three different languages and covering several decades it is shown that public mood in three quite different countries – first and foremost Japan, but also the United States and The Netherlands (...) – is quite apprehensive. In all these three countries societal pessimism can be observed during the past quarter century. Finally, utilizing a MDSD approach a few possible tentative explanations for this observed pessimism are sought. The hallmark of implicit learning is that complex knowledge can be acquired unconsciously. The second order conditionals of Reed and Johnson were developed to be complex, and they are popular materials for implicit learning research. Recently, it was demonstrated that in a sequence made noisy , shared features of the SOCs may be learned explicitly . What are these shared features? We hypothesized that low reversal frequency may play a significant role. We have varied reversal frequency, and discovered that reversal (...) frequency affected response times, inclusion exclusion behavior, and recognition ratings. Not only does it appear to be important to distinguish implicit and explicit knowledge, but also to distinguish what the knowledge is of. (shrink)

With direct-to-consumer advertisements (DTCA), pharmaceutical companies can market their prescription drugs directly to consumers. In order to properly study the argumentative aspect of these advertisements from a pragma-dialectical perspective, it is necessary to characterize DTCA as an ‘argumentative activity type’. This characterization shows that in DTCA, the advertiser combines two genres of communicative activity: promotion and consultation. The use of promotion stems from the advertiser’s commercial objective of selling products, while the use of consultation is a result of the legal (...) obligation to present a fair balance between arguments for and against the use of a drug. A good place to start in assessing a theory of truth is to ask whether the theory under discussion is consistent with Aristotle’s commonsensical definition of truth from Metaphysics 4: “What is false says of that which is that it is not, or of that which is not that it is; and what is true says of that which is that it is, or of that which is not that it is not.”1 Philosophers of a realist bent will be delighted (...) to see that Anselm unambiguously adopts the Aristotelian commonplace. A statement is true, he says, “when it signifies that what‐is is.”2 But the theory of truth that Anselm builds on this observation is one that would surely have confounded Aristotle. For no matter what the topic, Anselm’s thinking always eagerly returns to God; and the unchallenged centrality of God in Anselm’s philosophical explorations is nowhere more in evidence than in his account of truth. Indeed, we see in the student’s opening question in De veritate that the entire discussion has God as its origin and its aim: “Since we believe that God is truth, and we say that truth is in many other things, I would like to know whether, wherever truth is said to be, we must acknowledge that God is that truth.”3 The student then reminds Anselm that in the Monologion he had argued from the truth of statements to an eternal Supreme Truth. Does this not commit Anselm (the student seems to be asking) to holding that God himself is somehow the truth of true statements? But what definition of truth could make sense of such an odd claim? Anselm is happy to take up the challenge of showing that his description of God as “Supreme Truth” is no mere metaphor, but the expression of the deepest insight into the nature of truth. An account of truth is just theology under a different name. This first distinctive characteristic of Anselm’s theory, the centrality of God as Supreme Truth, helps account for a second distinctive characteristic: its strong insistence on the unity of truth. Over the past decade land has again moved to the centre of resource conflicts, agrarian struggles, and competing visions over the future of food and farming. This renewed interest in land necessitates asking the seemingly simple, but pertinent, question ‘whatisland?’ To reach a more profound understanding of the uniqueness of land, and what distinguishes land from other resources, this symposium suggests the notion of ‘land imaginaries’ as a crucial lens in the study of current land transformations. Political-economy, and the particular (...) economic, financial, or political interests of various actors involved in land projects do not directly result in, or translate into, outcomes, such as dispossession and enclosure, increased commodification, financialization, and assetization, or mobilization and resistance. All these processes are informed by different imaginaries of land—the underlying understandings, views, and visions of what land is, can, and should be—and associated visions, hopes, and dreams regarding land. Drawing on a variety of case studies from across the world, crossing Global North/South and East/West, and including contemporary and historical instances of land transformation, this symposium addresses the multifaceted ways in which implicit, explicit, and emergent understandings of land shape current land transformations. We study the arithmetical schema asserting that every eventually decreasing elementary recursive function has a limit. Some other related principles are also formulated. We establish their relationship with restricted parameter-free induction schemata. We also prove that the same principle, formulated as an inference rule, provides an axiomatization of the Σ2-consequences of IΣ1.Using these results we show that ILM is the logic of Π1-conservativity of any reasonable extension of parameter-free Π1-induction schema. This result, however, cannot be much improved: by adapting a (...) theorem of D. Zambella and G. Mints we show that the logic of Π1-conservativity of primitive recursive arithmetic properly extends ILM.In the third part of the paper we give an ordinal classification of -consequences of the standard fragments of Peano arithmetic in terms of reflection principles. This is interesting in view of the general program of ordinal analysis of theories, which in the most standard cases classifies Π-classes of sentences. (shrink)

In this paper we offer a reconstruction of Anselm’s account of freedom that resolves various apparent inconsistencies. The linchpin of this account is the definition of freedom. Anselm argues that the power to preserve rectitude for its own sake requires the power to initiate an action of which the agent is the ultimate cause, but it does not always require that alternative possibilities be available to the agent. So while freedom is incompatible with coercion and external causal determination, an agent (...) can, under certain circumstances, act freely even though he cannot act otherwise than he does. The problem of Uniqueness and Explicit Definability of Fixed Points for Interpretability Logic is considered. It turns out that Uniqueness is an immediate corollary of a theorem of Smoryński.

In this paper we prove that the preordering $\lesssim $ of provable implication over any recursively enumerable theory $T$ containing a modicum of arithmetic is uniformly dense. This means that we can find a recursive extensional density function $F$ for $\lesssim $. A recursive function $F$ is a density function if it computes, for $A$ and $B$ with $A\lnsim B$, an element $C$ such that $A\lnsim C\lnsim B$. The function is extensional if it preserves $T$-provable equivalence. Secondly, we prove a (...) general result that implies that, for extensions of elementary arithmetic, the ordering $\lesssim $ restricted to $\Sigma_{n}$-sentences is uniformly dense. According to Anselm's official definition, freedom of choice is ‘the power to preserve rectitude of will for the sake of that rectitude itself.’ From the point of view of contemporary metaphysics, this is one of the most unhelpful definitions imaginable. Does such freedom require alternative possibilities, for example? Is it compatible with causal determination? Is the exercise of such freedom a necessary and sufficient condition for moral responsibility? The definition sheds no light on these questions.And so we need to move (...) on from Anselm's definition to Anselm's account of freedom. Here, though, we encounter the opposite problem. Where Anselm's definition seems not to answer these questions at all, Anselm's account seems to answer all these questions, sometimes with a yes and sometimes with a no. Consider the question about alternative possibilities. In De libertate arbitrii, Anselm seems clearly to deny that freedom involves alternative possibilities. God, the good angels, and the blessed dead cannot do otherwise than preserve rectitude, but they are still free- freer, in fact, than those who are capable of abandoning rectitude. (shrink)
