As the poet T.S. Eliot said, 'Where is the wisdom lost in knowledge? Where is the knowledge lost in information?' Our postmodern 'information culture' forces us to be over-cerebral, but it doesn't teach us to think; consequently it becomes nearly impossible for us to imagine a knowledge that is beyond information, much less a Wisdom that is beyond knowledge. We all know what it is to uselessly 'spin our wheels' in barren thought and fantasy; certain valid contemplative disciplines even have (...) as their main goal the pacification of the 'monkey mind', the over-heated brain that prevents us from genuinely living our lives, from being fully present to the world, to each other, and to ourselves. But such pacification can also have a nihilistic side to it. It can subtly fool us into believing that the pursuit of meaning, the attainment of intellectual stability and certainty, is neither possible or desirable - a belief that is of great use to the political and economic Powers That Be in the emerging global society, who are always delighted to hear people express the opinion that there is no such thing as objective Truth, that we can't really know what is real, or if anything is real, beyond our own subjective experience. To the degree that the people start to believe that nothing can be known (our hidden masters reason), they will stop asking embarrassing and inconvenient questions. The notion of objective truth - not to mention Absolute truth - immediately suggests oppression, tyranny and fanaticism to the postmodern mind. Why? Because we have been systematically taught to see things this way by those Social Engineers who construct and impose the terms by which Reality is to be viewed. In order to break free from this socially-imposed subjectivism, we need to remember that Reality is not something determined by belief, but rather that belief is only true when it conforms itself to Reality. If we see nothing beyond this material/social world, we will be forced to take our own subjectivity as the only way to awaken from the social trance, and so fall even more deeply into that very trance, which is precisely a collective subjectivity. But if we know Objective Truth as metaphysical, beyond material nature and human society, then we have begun to catch a glimpse of the One Way Out. The traditional notion of Knowledge maintains that, 1) Truth can be known with certainty, and, 2) that the reason for knowing Truth is to transform our lives from a state of chaotic uncertainty, vulnerable to all the suffering that illusion and impermanence can produce, into one of eternal certainty and stability, where the knower becomes one with the Thing known - a state that goes by the name of bliss. To begin the path toward this bliss, however, we will need to know how to know; and this requires, as the necessary first step, that we know how to take knowledge seriously. As metaphysician Frithjof Schuon put it: 'Knowledge only saves us on condition that it enlists all that we are, only when it is a way and when it works and transforms and wounds our nature, even as the plough wounds the soil'. The shifting illusions of individual and collective subjectivity cannot protect us, and will always betray us. But if we are firmly rooted in that Truth which, in the words of Lew Welch, 'goes on whether we look at it or not', then we have a Protector - one Who is always there, upon Whom we can always rely, and to Whom we can always turn, when we can no longer remedy or deny or escape from the suffering and insecurity of conditional life. This article examines the evidence for the empirical argument that there is a slippery slope between the legalization of voluntary and non-voluntary euthanasia. The main source of evidence in relation to this argument comes from the Netherlands. The argument is only effective against legalization if it is legalization which causes the slippery slope. Moreover, it is only effective if it is used comparatively-to show that the slope is more slippery in jurisdictions which have legalized voluntary euthanasia than it is in (...) jurisdictions which have not done so. Slippery slope arguments appear regularly whenever morally contested social change is proposed. Such arguments assume that all or some consequences which could possibly flow from permitting a particular practice are morally unacceptable.Typically, “slippery slope” arguments claim that endorsing some premise, doing some action or adopting some policy will lead to some definite outcome that is generally judged to be wrong or bad. The “slope” is “slippery” because there are claimed to be no plausible halting points between the initial commitment to (...) a premise, action, or policy and the resultant bad outcome. The desire to avoid such projected future consequences provides adequate reasons for not taking the first step.Thus the legalization of abortion in limited circumstances is asserted to lead down the slippery slope towards abortion on demand and even infanticide; and the legalization of assisted suicide to lead inexorably to the acceptance of voluntary euthanasia and subsequently to the sanctioning of the practice of nonvoluntary euthanasia – even involuntary euthanasia of “undesirable” individuals. Procedures such as organ or tissue donation, elective ventilation and non‐therapeutic research can be said to be against the medical interests of the participant. Competent adults can consent to procedures such as these that are against their medical interests, but when, if ever, should incompetent persons participate in such procedures? Legal approaches to decision‐making in the area of the medical care of incompetent persons are generally based on respect for the patient's autonomy, or protection of her welfare, or some combination (...) of the two. The limitations of these approaches become apparent upon examination of their application in this context. Societal interests are also used to justify the participation of the incompetent in procedures which are against their medical interests, for example, the societal interest in pursuing non‐therapeutic research on incompetents in order to benefit future incompetents. These types of approaches are implicit in much current policy and reform proposals on non‐therapeutic research, contributing to the disrespect for incompetent persons that is implicit in many research projects and much argument on the categorization of risks, and the repeated failure to consider the burdens imposed on incompetent persons in the interests of society. While philosophers of mind have devoted abundant time and attention to questions of content and consciousness, philosophical questions about the nature and scope of mental action have been relatively neglected. Galen Strawson’s account of mental action, arguably the most well-known extant account, holds that cognitive mental action consists in triggering the delivery of content to one’s field of consciousness. However, Strawson fails to recognize several distinct types of mental action that might not reduce to triggering content delivery. In this paper, (...) we argue that meditation provides a useful model for understanding a wider range of types of mental action than heretofore recognized. Conclusions yielded by two distinct bodies of current psychological research on meditation and cognition, and meditation and introspection, buttress meditation’s suitability for this role. (shrink)

Some form of assisted dying (voluntary euthanasia and/or assisted suicide) is lawful in the Netherlands, Belgium, Oregon, and Switzerland. In order to be lawful in these jurisdictions, a valid request must precede the provision of assistance to die. Non-adherence to the criteria for valid requests for assisted dying may be a trigger for civil and/or criminal liability, as well as disciplinary sanctions where the assistor is a medical professional. In this article, we review the criteria and evidence in respect of (...) requests for assisted dying in the Netherlands, Belgium, Oregon, and Switzerland, with the aim of establishing whether individuals who receive assisted dying do so on the basis of valid requests. We conclude that the evidence suggests that individuals who receive assisted dying in the four jurisdictions examined do so on the basis of valid requests and third parties who assist death do not act unlawfully. However, further research on the elements that may undermine the validity of requests for assisted dying is warranted. More research on the reasons why requests for assisted dying are refused is also desirable. (shrink)

ABSTRACT This paper takes issue with the idea that there is a variety of moral theories available which can in some way usefully be applied to problems in ethics. The idea is reflected in the common view that those favouring a systematic approach would do well to abandon consequentialist thinking and turn to some alternative theory. It is argued here that this is not an option, since each of the usual supposed alternatives lacks the independent resources to meet the minimal (...) requirements of being a moral theory at all. The aim is to demonstrate that virtue ethics, rights theory and deontology lack the different forms of explanation that would make them genuinely alternative theories. The conclusion is that this part of ethics is much more of a unity than is standardly assumed and that, far from our being able to move on from consequentialism, certain problems that arise from its very nature are bound to remain central to any attempt at moral theory. Utilitarianism faces a difficulty in that what are typically regarded as natural goods seem to have possible occurrences that strike most people as morally reprehensible, yet which according to the theory must be taken to add to the good in the world. Thus, totake a recent treatment of the problem by Geoffrey Scarre, it would seem that even sadistic pleasures must contribute to human happiness and thus morally offset the concomitant suffering of the victim. Scarre has offered a defence of (...) utilitarianism, arguing that in fact such pleasures will undermine the self-respect that is required for happiness. In this paper I argue that a partial undermining is plausible but leaves the problem untouched, while a complete undermining can be established only by a stipulation that is unmotivated from a utilitarian point of view. What makes for a good book on ethics in medicine? Given that no one can do another’s moral thinking for them, this much at least: it should stimulate in the reader an inclination to critical reflection that will persist when the book goes back on the shelf. And, since no one can do another’s philosophical thinking for them either, this requirement is doubly true when the basis of the work lies in moral philosophy. In addition, where the book is likely (...) to be used as an introduction, it has to achieve this for readers who may have little experience of philosophy or natural sympathy with its problems and methods. No doubt there are various ways of attempting this task, but one is to try to draw readers into the subject by giving them a sense of what it is to be involved in doing philosophy, with all its characteristic difficulties and doubts, rather than merely studying the results of some that was done earlier. I think that Jennifer Jackson has produced an excellent book of this kind; one that should engage the interest of anyone prepared to make a little effort. It is a lively and refreshing work, full of argument and comprising a good mixture of scholarly caution and forthright commitment. Rather than looking at the many specific issues, however, I will concentrate on the philosophical position that underlies the work as a whole.The book begins by taking seriously the doubts that exist about the place of philosophy in medical ethics and does particularly well in making the appropriate concessions, while still giving a firm defence of its …. Sinclair's goal was to attempt to tell the reader how to live, how to find health, happiness and success, and how to develop fully both the mind and the body. A collection of essays that cover a range of topics of relevance to health care professionals. The book is intended to fill a gap between introductory texts on medical ethics and in-depth specialized books. It shows the importance of combining philosophical and ethical discussion.

When research concludes, post-trial access to the trial intervention or standard healthcare can be crucial for participants who are ill such as those in resource-poor countries with inadequate healthcare, British participants testing ‘last-chance drugs’ unavailable on the National Health Service and underinsured US participants. Yet, many researchers are unclear about their obligations regarding the post-trial period, and many research ethics committees do not know what to require of researchers. Consequences include participants who reasonably expect but lack PTA to the trial (...) intervention, unplanned financial liabilities for NHS Trusts forced to fund this, negative press and potential to undermine public trust.1–3,iOne reason for the lack of clarity is controversy over whether and when participants should have access, after the study, to the study intervention. At one extreme is the view that continued access should be ensured when the intervention has benefited the participant or when it has proven safe and effective for the participant population, irrespective of the cost and burden of ensuring continued access. At the other extreme is the view that continued access need never be provided so long as non-availability of the study intervention post-trial was adequately disclosed when participants were invited to participate.6 There is also disagreement about when poststudy access to the study intervention should be considered beneficial for participants. This article presents a seven-step corpus-based approach to discourse analysis that starts with a detailed analysis of each individual text in a corpus that can then be generalized across all texts of a corpus, providing a description of typical patterns of discourse organization that hold for the entire corpus. This approach is applied specifically to a methodology that is used to analyze texts in terms of the functional/communicative structures that typically make up texts in a genre: move analysis. The resulting (...) corpus-based approach for conducting a move analysis significantly enhances the value of this often used methodology, while at the same time providing badly needed guidelines for a methodology that lacks them. Care after research is for participants after they have finished the study. Often it is NHS-provided healthcare for the medical condition that the study addresses. Sometimes it includes the study intervention, whether funded and supplied by the study sponsor, NHS or other party. The NHS has the primary responsibility for care after research. However, researchers are responsible at least for explaining and justifying what will happen to participants once they have finished. RECs are responsible for considering the arrangements. There are (...) ethical and practical issues, in particular when participants may wish to continue on the study intervention after the study. There are also various guidelines and legislation. This article discusses the merits of teaching legal analysis and writing and of developing a legal writing program at a faculty of law, and recommends that law faculties around the world incorporate this subject. Once absent from the American law school curriculum, this subject has become a required subject in all American law schools over the past 25+ years. The article suggests steps for implementing a legal writing course or program, and offers a variety of resources for doing so.

The Iowa Gambling Task (IGT) and the Soochow Gambling Task (SGT) are two experience-based risky decision-making tasks for examining decision-making deficits in clinical populations. Several cognitive models, including the expectancy-valence learning model (EVL) and the prospect valence learning model (PVL), have been developed to disentangle the motivational, cognitive, and response processes underlying the explicit choices in these tasks. The purpose of the current study was to develop an improved model that can fit empirical data better than the EVL and PVL (...) models and, in addition, produce more consistent parameter estimates across the IGT and SGT. Twenty-six opiate users (mean age 34.23; SD 8.79) and 27 control participants (mean age 35; SD 10.44) completed both tasks. Eighteen cognitive models varying in evaluation, updating, and choice rules were fit to individual data and their performances were compared to that of a statistical baseline model to find a best fitting model. The results showed that the model combining the prospect utility function treating gains and losses separately, the decay-reinforcement updating rule, and the trial-independent choice rule performed the best in both tasks. Furthermore, the winning model produced more consistent individual parameter estimates across the two tasks than any of the other models. (shrink)

The virtues are under fire. Several decades’ worth of social psychological findings establish a correlation between human behavior and the situation moral agents inhabit, from which a cadre of moral philosophers concludes that most moral agents lack the virtues. Mark Alfano and Christian Miller introduce novel versions of this argument, but they are subject to a fatal dilemma. Alfano and Miller wrongly assume that their requirements for virtue apply universally to moral agents, who vary radically in their psychological, physiological, and (...) personal situations; I call this the ‘content problem.’ More troubling, however, the content problem leads to what I call the ‘structural problem:’ Alfano and Miller each structure their argument against the virtues as a modus tollens argument and, owing to the breadth of the content problem, each must constrain their argument with a ceteris paribus clause. But the ceteris paribus clause precludes each argument’s validity. More important, however, the resulting conception of virtue implicitly endorsed by Alfano and Miller holds that virtues are idealized models; but since idealized models do not even purport accurately to describe the world, neither novel version of EAV gains any empirical traction against the virtues. The upshot is an old story whose moral has yet, within the empirical study of the virtues, adequately to be internalized: it is imperative that the empirical observation of character traits proceed via longitudinal studies. In this paper, I defend a local account of character traits that posits traits like close-friend-honesty and good-mood-compassion. John Doris also defends local character traits, but his local character traits are indistinguishable from mere behavioral dispositions, they are not necessary for the purpose which allegedly justifies them, and their justification is only contingent, depending upon the prevailing empirical situation. The account of local traits I defend posits local traits that are traits of character rather than behavioral dispositions, local traits that (...) are necessary to satisfy one of their central purposes, and local traits whose justification is dependent upon theoretical rather than empirical considerations. In October 2000, just a few weeks before the US presidential election, a young, fashionable, handsome man handed me a (...) political leaflet while I crossed Christopher Street in Greenwich Village. I didn't give it much thought at the time (apart from noticing that the boy was kind of cute): I was in transit toward the 4th Street subway station and the Port Authority where I would catch the bus back to Cornell. When I decided to write a review essay on the current state of poststructuralism, Marxism, and queer theory through the lens of the two books listed above, I discovered I had lost the pamphlet, certain that my hostile reaction to what I considered its fundamental conservatism and trendy political correctness had unconsciously caused its mysterious disappearance.When I rediscovered the leaflet in the chaos of my move away from Ithaca, I realized that my relation to it had been hysterical: I was reluctant to address its traumatic content, unwilling to excavate my multiple frustrations at the apparent impossibility of being a homosexual and a socialist in America. And yet I couldn't really forget about it either: though not an American citizen and therefore unable to vote, I found myself equally unable simply to dismiss the leaflet as a mere inconsequential symptom of the pseudo-democracy that America has always been, or unequivocally to endorse the snooty CBC/Queen Street condescension of my fellow Canadian Lefties toward the primitive, superficial, liberal (in the worst psychologistic sense), irremediably ideological, and thoroughly depressing state of American political discourse. "Those poor Americans," the far-from-irrelevant logic goes. "They either unquestioningly submit to the individualistic fantasy of the American Dream in order to participate in the 'political process,' or they become hermetically imprisoned in their pseudo-political anti-statist minoritarianism, too cool and too radical to condescend to the public sphere." After six years in the United States, I've now become aware that my inability to swallow much of contemporary queer theory—authored overwhelmingly by young, elite-educated Americans with relatively narrow political horizons—is mostly due to the manner in which it articulates numerous political assumptions fundamentally alien to my own socialization in a country whose political differences from the US are insufficiently appreciated in that nation, and in which extremes of climate and geography have engendered a collectivist ethos in many ways fundamentally hostile to the American-style extreme individualism with which I had lived for so many years.But the interest of this sort of political autobiography is in this context undoubtedly limited. What—you might now find yourself impatiently wondering if you don't already [End Page 3] know—were the contents of this famous pamphlet? And what exactly was my problem with it? Published by a coalition of queer voters in New York called the Empire State Pride Agenda, the pamphlet presented extremely selective profiles of the main candidates, both Democrat and Republican, running for the offices of President, US Senator, State Senator, and Member of the State Assembly. Each profile summarized the history of a candidate's positions with respect to rights issues of concern to gay, lesbian, bisexual, and transgendered persons. The profiles made no concerted effort to represent the candidates' perspectives on any other issue: gun control, education, foreign policy, the death penalty, taxation, health care (generally speaking, that is to say above and beyond the issues related to AIDS-related illness and reproductive rights); only policies directly concerning civil rights for nonheterosexual citizens were thoroughly broached.I should confess that once I got the general idea I threw the pamphlet away in disgust: "Am I supposed to feel interpellated," I asked myself in full hysterical Althusserian mode, "by this utterly pseudo-political claptrap?"
