In the case of an intellectually disabled patient, the attending physician was restricted from writing a Do-Not-Resuscitate (DNR) order. Although the rationale for this restriction was to protect the patient from an inappropriate quality of life judgment, it resulted in a worse death than the patient would have experienced had he not been disabled. Such restrictions that are intended to protect intellectually disabled patients may violate their right to equal treatment and to a dignified death.

The original essays in this volume, while written from diverse perspectives, share the common aim of building a constructive dialogue between two currents in philosophy that seem not readily allied: Wittgenstein, who urges us to bring our words back home to their ordinary uses, recognizing that it is our agreements in judgments and forms of life that ground intelligibility; and feminist theory, whose task is to articulate a radical critique of what we say, to disrupt precisely those taken-for-granted agreements in (...) judgments and forms of life. Wittgenstein and feminist theorists are alike, however, in being unwilling or unable to "make sense" in the terms of the traditions from which they come, needing to rely on other means—including telling stories about everyday life—to change our ideas of what sense is and of what it is to make it. For both, appeal to grounding is problematic, but the presumed groundedness of particular judgments remains an unavoidable feature of discourse and, as such, in need of understanding. For feminist theory, Wittgenstein suggests responses to the immobilizing tugs between modernist modes of theorizing and postmodern challenges to them. For Wittgenstein, feminist theory suggests responses to those who would turn him into the "normal" philosopher he dreaded becoming, one who offers perhaps unorthodox solutions to recognizable philosophical problems. In addition to an introductory essay by Naomi Scheman, the volume’s twenty chapters are grouped in sections titled "The Subject of Philosophy and the Philosophical Subject," "Wittgensteinian Feminist Philosophy: Contrasting Visions," "Drawing Boundaries: Categories and Kinds," "Being Human: Agents and Subjects," and "Feminism’s Allies: New Players, New Games." These essays give us ways of understanding Wittgenstein and feminist theory that make the alliance a mutually fruitful one, even as they bring to their readings of Wittgenstein an explicitly historical and political perspective that is, at best, implicit in his work. The recent salutary turn in philosophy toward taking history seriously has shown how the apparently timeless problems of supposedly generic subjects arose out of historically specific circumstances. These essays shed light on the task of feminist theorists—along with postcolonial, queer, and critical race theorists—to "rotate the axis of our examination" around whatever "real need[s]" might emerge through the struggles of modernity’s Others. In an earlier work I developed an argument favoring one view of persistence (viz., perdurance) over its rivals, based on considerations of the relativity of three-dimensional spatial shapes of physical objects in Minkowski spacetime. The argument has since come under criticism (in the works of Theodore Sider, Kristie Miller, Ian Gibson, Oliver Pooley, and Thomas Sattig). Two related topics, explanatory virtues and explanatory relevance, are central to these critical discussions. British art historian Charles Harrison presumes the existence of a patriarchal world with power in the hands of men who dominate the representation of women and femininity. He applauds the ground-breaking work of feminist theorists who have questioned this imbalance of power since the 1970s. He stops short, however, of accepting their claims that all women have been represented by male artists as images of “utter passivity” (p. 4), routinely reduced by the male gaze to the status of exploited sexual (...) objects, or that women’s subjectivity is eroded by the visual treatment they receive at the hands of male artists such as Manet and Picasso. He wants to show that what is depicted in the picture plane by the (typically male) artist and enjoyed by the (typically male) spectator is more nuanced than just a simple privileged understanding between two men. He adds a third (and possibly fourth or more) party to the mix when he significantly redefines and expands our concept of the gaze: “A gaze may also be conceived of as a function of a painting’s represented content” (p. 9). In other words, a gaze may be “addressed outward by a represented figure,” and regardless of who and where, “the assumption conveyed by the term [‘gaze’] is that some differential and usually asymmetrical relation will be at stake in any exchange between one who directs the gaze and another at whom it is directed. In fact, it is just this difference—in age, in sex, in class, in interest, in power —that the operation of the gaze tends to mark” (p. 9). Referring to a woman depicted within the picture plane, he asks us to consider, “What does it feel like to look like this?” (p. 21) in order to entertain our many emotional responses and interpretations. When he adds, “What does it feel like to whom?” the sexual difference of the spectator also clearly comes into play. (shrink)

Nelson Goodman's acceptance and critique of certain methods and tenets of positivism, his defence of nominalism and phenomenalism, his formulation of a new riddle of induction, his work on notational systems, and his analysis of the arts place him at the forefront of the history and development of American philosophy in the twentieth-century. However, outside of America, Goodman has been a rather neglected figure. In this first book-length introduction to his work Cohnitz and Rossberg assess Goodman's lasting contribution to (...) philosophy and show that although some of his views may be now considered unfashionable or unorthodox, there is much in Goodman's work that is of significance today. The book begins with the "grue"-paradox, which exemplifies Goodman's way of dealing with philosophical problems. After this, the unifying features of Goodman's philosophy are presented - his constructivism, conventionalism and relativism - followed by an discussion of his central work, The Structure of Appearance and its significance in the analytic tradition. The following chapters present the technical apparatus that underlies his philosophy, his mereology and semiotics, which provides the background for discussion of Goodman's aesthetics. Peg Rawes examines a "minor tradition" of aesthetic geometries in ontological philosophy. Developed through Kant’s aesthetic subject she explores a trajectory of geometric thinking and geometric figurations--reflective subjects, folds, passages, plenums, envelopes and horizons--in ancient Greek, post-Cartesian and twentieth-century Continental philosophies, through which productive understandings of space and embodies subjectivities are constructed. Six chapters, explore the construction of these aesthetic geometric methods and figures in a series of "geometric" texts by Kant, Plato, Proclus, Spinoza, Leibniz, Bergson, Husserl and Deleuze. In (...) each text, geometry is expressed as a uniquely embodies aesthetic activity because each respective geometric method and figure is imbued with aesthetic sensibility and geometric sense (rather than as disembodies scientific methods). An ontology of aesthetic geometric methods and figures is therefore traced from Kant’s Critical writings, back to Plato and Proclus Greek philosophy, Spinoza and Leibniz’s post-Cartesian philosophies, and forwards to Bergson’s "duration" and Husserl’s "horizons" towards Deleuze’s philosophy of sense. Shoma Morita, M.D. was a Japanese psychiatrist-professor who developed a unique four stage therapy process. He challenged psychoanalysts who sanctioned an unconscious or unconsciousness that resides inside the mind. Significantly, he advanced a phenomenal connection between existentialism, Zen, Nature and the therapeutic role of serendipity. Morita is a forerunner of eco-psychology and he equalised the strength between human-to-human attachment and human-to-Nature bonds. This book chronicles Morita's theory of "peripheral consciousness", his paradoxical method, his design of a natural therapeutic setting, and (...) his progressive-four stage therapy. It explores how this therapy can be beneficial for clients outside of Japan using, for the first time, non-Japanese case studies. The author's personal material about training in Japan and subsequent practice of Morita's ecological and phenomenological therapy in Australia and the United States enhance this book. LeVine's coining of "cruelty-based trauma" generates a rich discussion on the need for therapy inclusive of ecological settings. As a medical anthropologist, clinical psychologist and genocide scholar, LeVine shows how the four progressive stages are essential to the classic method and the key importance of the first "rest" stage in outcomes for clients who have been embossed by trauma. Since cognitive science took hold in the 1970s, complex consciousness theories have lost footing in psychology and medical science. This book reinstates "consciousness" as the dynamic core of Morita therapy. The case material illustrates the use of Morita therapy for clients struggling with the aftermath of trauma and how to live creatively and responsively inside the uncertainty of existence. The never before published archival biographic notes and photos of psychoanalyst Karen Horney, Fritz Perls, Eric Fromm and other renowned scholars who took an interest in Morita in the 1950s and 60s provide a dense historical backdrop. Katy Deepwell calls for a vital and visible "new" feminist criticism in 1997 amidst a pessimistic overview of the state of feminist art and criticism in Britain, Canada, and the U.S. As an update to this review, I note that Deepwell took decisive and effective action on her pessimism and for the past twenty years (as of this writing in July 2017) created an online feminist journal--n.paradoxa: international feminist art journal--that has published over 550 articles by 400 writers and artists (...) from more than 80 countries. In ‘The Authorship of Sister Peg', David Raynor relies on circumstantial evidence, unsubstantiated hypotheses, and subjective analysis in an effort to dispute my article ‘Let Margaret Sleep' and claim the authorship of Sister Peg for David Hume. This reply focusses instead on the large body of documentary and testimonial evidence that has surfaced during the past forty years, which overwhelmingly and convincingly supports the attribution of Sister Peg to Adam Ferguson. New documentary evidence includes Ferguson's emendations in Sir Walter Scott's (...) copy of Sister Peg, an 1809 letter from Ferguson to Alexander Fraser Tytler and Tytler's response to it, and information about the early publishing history of the work – as well as a letter by Hume himself about his preoccupation with another project when Sister Peg was written. While no new contemporary testimonials alleging Hume's authorship have been discovered since the publication of Raynor's edition of Sister Peg in 1982, at least nine contemporary testimonials naming Ferguson as the author are now known. This reply refutes Raynor's attempts to discredit the most famous of these testimonials – the account of Ferguson's authorship in the memoirs of Alexander Carlyle – and shows that the others cannot be reduced to Carlyle’s influence. Most artists who are familiar with the contemporary art scene—especially the New York City scene—know that “beauty” is not especially hip. Unless, that is, it serves a “deeper” purpose, e.g., it helps to make a conceptual or political point. Danto’s influence, it would seem, pervades and persists (31). But, as Brand points out in her introduction, in the past twenty years or so, the philosophical study of beauty has been making a comeback; she lists over fifty titles that have been (...) written on the subject since the nineties. Brand’s book, Beauty Unlimited, promises to add to the feminist oeuvre on the subject. The book is comprised of twenty essays, with a foreword by Carolyn Korsmeyer and an introduction by Brand. Although the majority of the essays are interdisciplinary, they are primarily written by trained philosophers.
