In 2014 Jennifer Cramblett, a white lesbian, filed a Complaint for Wrongful Birth alleging that the Midwest Sperm Bank mistakenly provided sperm from an African–American donor. In this article, we trace the complex and overlapping lines of legal and social inheritance that have conditioned not only the possibility of such a lawsuit, but also the legal language and arguments within the Complaint itself. First, we trace the racial politics of homonormativity, which set the conditions of possibility for an out, white (...) lesbian to bring this case forward. Second, we trace the inheritance of wrongful birth tort law, reviewing its prior race and disability-related uses, and its basis in feminist reproductive rights. Third, we trace how disability, race and sexuality interlock within the eugenic inheritance of both ‘wrongful birth’ and reproductive technologies. Finally, we follow traces of racial inheritance, namely, the loss of white property and proximity to whiteness. (shrink)

This article discusses two well‐known texts that respectively describe learning and teaching, drawn from the work of Freud and Plato. These texts are considered in psychoanalytic terms using a methodology drawn from the philosophy of Luce Irigaray. In particular the article addresses Irigaray's approach to the analysis of speech and utterance as a ‘cohesion between the source of the utterance and the utterance itself’ (Hass, 2000). I apply this approach to ask whether educational tradition has fractured the relationship between pedagogy (...) and the body of the teacher/pupil. Teaching and learning are re‐addressed in ways that challenge the gender‐neutral representation of pedagogy as a systematic technique. (shrink)

John Stuart Mill worked for the East India Company in London for thirty-five years (1823-58), drafting many hundreds of dispatches for the guidance of British administrators in India. Historians have long been aware of Mill's involvement in British Indian government. This comprehensive effort brings together different strands of scholarship on Mill to determine the character of his role based on analyses of his draft despatches and comparisons of their practical and theoretical concerns with the broad themes of Mill's major writings (...) on political philosophy and economics. The essays in this collection explore specific aspects of Mill's approach to Indian issues, including religion, law, education, and security, and also place him within the broader currents of utilitarianism. The fact that humans are responsible for climate change is certain. But the meaning of the fact of human responsibility is not disclosed by stating the fact: there is a distinction between the two principles, de facto and de jure, the right to state a fact and the right to assert the meaning of the fact. This distinction must be preserved in order that humans may interpret the nature of our responsibility, as a form of justice. In fact, the nature (...) of human responsibility can never be exhaustively determined. To recognise the fact of human responsibility for climate change may only lead us to acknowledge that climate change coincides with the plundering and exploitation of the earth as a natural resource, together with the industrial pollution which fouls our atmosphere. It is something else again to know precisely what must be done, how to think and write and interpret the science, or even what can be achieved before it is too late to prevent the worst effects of global warming. In this essay I analyse the central claims of proponents of the idea of the Anthropocene, arguing that they are arrogant and perhaps even naïve: in particular, the suggestion that humanity and nature have now fused to become a geological force is shown to be theological in its orientation. The essay also exposes Anthropocenology as a form of pedagogy, meaning that rather than opposing the neoliberalism that it attacks, Anthropocenology joins itself to the biopolitical institutions of education, seizing power in order to govern a totalized human population all the more effectively. The gradual development of European Union (EU) immigration and asylum law has been characterized by two related, ongoing tensions: the conflict between EU competence in this field and national sovereignty, and the friction between immigration control and the protection of human rights. The EU's approach to resolving the two key tensions in this area are assessed by examining the four key subjects addressed by immigration law: visas and border controls, irregular migration, legal migration, and asylum. The European Union has been (...) more active in the fields of visas and border controls than in any other area of immigration and asylum law owing to the early development of a legal framework, originally in the form of the Schengen Convention. As for irregular migration, the European Union's initial piecemeal approach has been supplemented by the adoption of the fairly comprehensive Returns Directive. (shrink)

L'assimilation des images à une attitude chrétienne correcte fut le résultat d'un long débat sur la nature du culte chrétien. Les icones n'excluaient pas d'autres approches comme la vertu chrétienne , mais elles faisaient désormais partie inextricablement d'une éthique chrétienne complète. Les hagiographies de Théodore Stoudite, de Photios, de Nicéphore ont contribué à la diffusion du culte des images comme une pratique chrétienne acceptable. L'exemple miraculeux de Michel au sanctuaire d'Eusèbe intervient également dans la mise en place d'un consensus.

In this article we offer an ontological theorization of care. The article interrogates the self-evident quality of everyday meanings for ‘care’ that might be generated from psychological or biological discourses; we aim to question the way that ‘care’ is applied in a technical or an emotional sense within the field of early childhood education. The article works towards offering a new theorization that does not treat the meaning of ‘care’ as self-evident. If ‘care’ is a way of addressing concern for (...) ourselves as human beings, we think that deepening the theoretical parameters of this concept will add to how we understand the complexity of gender and race relations. By articulating Heidegger’s use of ‘care’ and comparing it to Irigaray’s critique of Heidegger’s work on this concept, we hope to enable professionals and families to view conceptions of ‘care’ outside the familiar definitions applied in everyday discourse. The article treats early childhood education professional practice as an instance of how both gender and race delimit the way in which human relationships can be understood. (shrink)

Could there be a better instance of ethical conflict at the scene of the modern Western university than the case of Martin Heidegger, who in 1933 became a Nazi, arguably to elevate his own standing and career? In this article I examine the opposing ethical forces that animated Heidegger’s brief foray into Nazism, to ask whether the same forces continue to be found in the technocratized university described by Bill Readings. I address Heidegger’s own philosophy as a context in which (...) these conflicting ethical forces are confronted, using metaphorical references to Pollyanna and Cujo. This absorption of literary allusions within a contribution to educational philosophy seeks deliberately to break the stranglehold that empiricism has on the discipline of education. It regards the hegemony of empiricism as an ideological fetishism. I am using the work of Jacques Derrida to deconstruct the idea of the university, with Heidegger’s political opportunism as symptomatic of current patterns of self-marketing, self-promotion, and entrepreneurialism amongst academics. Cette histoire comprend deux parties dont la première relate la construction d'un temple par les argonautes qui rebaptise la place Sosthenion c'est-à-dire la place du salut et dont la seconde parle de la visite du site par Constantin qui aura la révélation de l'identité de la statue de Michel à travers un rêve. Pour l'A. ce (...) récit a une signification réelle au sein de l'oeuvre idéologique de la Chronique. Le lieu de pèlerinage se place dans la continuité de l'histoire du salut instaurée par le Christ et s'élargie sous l'empereur Constantin. Celui-ci joue un rôle essentiel dans la rédemption du sanctuaire païen de Sosthène : l'épisode de son rêve préfigure sa conversion. (shrink)

Prakash Nair has made comments about the kind of spatial planning that educationists should make for the purpose of improving, and refining the architectural model of the school that can be adopted in the twenty-first century. These remarks imply that an “old” and out-dated architectural model needs to be replaced by one that is better suited to the kinds of workers that children will become when they graduate, so that schools can more effectively prepare students for the workforce to come. (...) In this article, I argue that his proclamation that “the classroom is obsolete” should be interpreted in the context of neo-liberalism, alongside similarly hyperbolic claims by Francis Fukuyama in 1989 that the fall of the Berlin Wall signified the “end of history”. By addressing the rhetorical structure of such remarks, I deconstruct Prakash Nair’s promise to build a better future for education. Additionally, I argue that educational researchers may benefit from thinking of the classroom as a fictional place, a “scene” that does not always bear identical and universal attributes, owing to the diversity of cultural and geographical contexts in which classrooms are found. The implementation in 2009–10 of the Early Years Learning Framework (EYLF) spearheaded the efforts of the Australian Commonwealth government to institute a national curriculum. The theme of the new early childhood framework follows three guiding concepts: Belonging, Being and Becoming. In this article, we discuss these three concepts in order to provide a theoretical context to the Early Years Learning Framework and to enrich the debate surrounding its writing and implementation. In particular, we address the significance of posing Belonging in (...) contiguity with the concepts of Being and Becoming. The authors suggest a strategy to cultivate a deeper appreciation of the dialectical relationships between sameness and difference, belonging and nothingness. Our premise is that ‘belonging’ refers essentially to different beings, and implicitly to the prospect of a ‘together-ness’ or identity according to which different beings are located, understood and associated, in order that Becoming can take effect. We offer these commentaries as a means of deepening conversation about the importance of scholarly approaches to philosophy for early childhood research, and especially with respect to curriculum and pedagogy. This article addresses a discourse on visual culture and its comparability to visual arts in school curriculum; it focuses initially on Kevin Tavin’s 2005 history of popular and visual culture in relation to visual-art education.1 In the second part, I also discuss contributions to this discourse by Kerry Freedman2 and Paul Duncum.3 There are two concerns that I raise here about arguments made against visual-arts curriculum in this discourse. This article examines the role the public imagination of the state has in maintaining the current political status quo in Burjatija, an east Siberian Republic. Based on a quantitative and interpretative analysis of Burjatija’s local newspapers, it uses the ‘centre-versus-periphery’ paradigm to identify varying representations of the Republic’s territorial community in government legitimization discourse, before discussing their assimilation into popular newspaper discourse. Multiple narratives of Burjatija and the Russian Federation exist in these newspapers, incorporating various centres and peripheries.
