Although the issue of consent in medical practice has grown immensely in recent years, and it is generally believed that historical cases are unknown, our research amongst original ancient Greek and Byzantine historical sources reveals that it is a very old subject which ancient philosophers and physicians have addressed. Plato, in ancient Greece, connected consent with the quality of a free person and even before him, Hippocrates had advocated seeking the patient's cooperation in order to combat the disease. In Alexander (...) the Great's era and later on in Byzantine times, not only was the consent of the patient necessary but physicians were asking for even more safeguards before undertaking a difficult operation.Our study has shown that from ancient times physicians have at least on occasion been driven to seek the consent of their patient either because of respect for the patient's autonomy or from fear of the consequences of their failure. The attitudes of the Greeks, a Mediterranean population, to the issue of telling the truth to the patient have been studied. There is no clear answer to the question: 'Do the Greeks wish to be informed of the nature of their illness?'. The answer is: 'It depends'. It depends on age, education, family status, occupation, place of birth and residence and on whether or not they are religious people. However, it does not depend on their sex--men and women have similar (...) reactions to the issue of truth-telling. Although the present study shows lower percentages of those who wish to know the truth than studies on other populations, the conclusion is that, emphasising the need for good communication between doctors and patients, doctors should not lie, but should disclose to their patients the part of the truth they are ready to accept. The philosophical thought of Nicolas Malebranche (1638-1713) does not constitute two aspects of a spirit or a man that is that of the man of God and that of the man of letters. Malebranche, as a successor of Descartes in the history of European philosophy, although God is not the wise for him but He is wisdom and science Himself. For Malebrache, God is the reason of the world. God, as a substantial source, is able to create the ideas of (...) the spirit of man and motivate his body. However, there is an archetypal idea of soul which comes in front of the body. According to the mentioned metaphysical definition, God is not doubtable in soul which is related to his Word. Malebranche introduces a rationalism emerging the mathematical values to provide an accurate and justifiable idea for Godbecause the continuous search of truth within sciences and our fear of a false existence can find answers in the system of arithmetic and algebra. Therefore, Malebranche’s thought constitutes “an intellectual mystic” denoting the connection of logic and belief. (shrink)

An enduring ethical dispute accompanies prenatal screening and testing (PST) technologies. This ethical debate focuses on notions of reproductive choice. On one side of the dispute are those who have supported PST as a way to empower women’s reproductive choice, while on the other side are those who argue that PST, particularly when made a routine part of prenatal care, limits deliberate choice. Empirical research does not resolve this ethical debate with evidence both of women for whom PST enhances their (...) choices but also persistent evidence of recurrent problems between PST and women’s autonomous decision-making. While there have been attempts to remove challenges to reproductive choice, it has been argued that these challenges cannot be removed entirely. In this paper I provide a historical review of PST technologies’ development and in doing so provide a detailed insight into the root causes of this tension between the opposing sides of this debate. This historical account provides evidence that those who championed the early use of these technologies did so in order to achieve a number of wholly different goals other than women’s choice and empowerment. These different aims focus on scientific discovery and eugenic goals and, I argue, areirreconcilablewith women’s choice and empowerment. It thus may not be surprising that the resulting practice of PST continues to resist compatibility with women’s choice and empowerment. Ultimately, by understanding the historical foundations of PST we can more effectively assess how toreconcilewomen’s reproductive autonomy with routine prenatal screening. (shrink)

We study the impact of social capital and perceptions about corporate ethical behaviour on the use of collateral in corporate borrowing. Using a dataset of more than 17,500 firms operating in over 100 transition and developing countries, we find evidence that country-level social capital and better perceptions about corporate ethical behaviour are negatively associated with the likelihood to pledge collateral. In addition, these country-level characteristics influence the value of collateral relative to the loan value.

This investigation focuses on analysing one-sided laughter in academic presentations — a form of ‘institutional talk’ defined here as goal-oriented talk about and for the business at hand, and given at structural settings of certain formality as the lecture theatre in this case. The analytical tool employed is a partial adoption of Partington’s laughter classification/categorization drawing on the theories of ‘Politeness’ and ‘Face’. This is a rather new approach which, nonetheless, contributes positively to the field of laughter analysis since these (...) theories are ‘much less examined in relationship to institutional settings’. The data analysed for this purpose is David Nunan’s presentation entitled ‘Action Research and Professional Growth’, given at the JALT First Joint Conference in Japan. The findings suggest that one-sided laughter is a communication strategy of mainly rhetorical nature capable of revealing the underlying meaning of the interaction: its hidden ideology, purpose and goal. Empirical data can be an extremely powerful and influential tool in bioethical research. However, when researchers or policy makers look for answers to ethical questions by engaging with empirical research, there can be a tendency (conscious or unconscious) to shape, report, and use empirical research in a way that confirms their own preferred ethical conclusions. This skewing effect - what we call ‘normative bias’ - is often so subtle it falls short of clear misconduct and thus can be difficult to (...) call out. However, we argue that this subtle influence of bias has the potential to significantly influence debate and policy around highly sensitive ethical issues and must be guarded against. In this paper we share the lessons we have learned through a journey of self-reflection around the effect that normative bias can have when reporting on and referring to empirical data relating to ethical issues. We use a variety of papers from our area of the ethics of routine prenatal screening to illustrate these subtle but often powerfully distorting effects of bias. Our aim in doing so is not to criticise the work of others, as we recognise our own normative bias, but to improve awareness of this issue, remind the need for reflexivity to guard against our own biases, and introduce a new criterion - the idea of a ‘limitation prominence assessment’ - that can work as a practical way to evaluate the seriousness of the limitations of an empirical study and thus, the risks of the study being misread or misinterpreted through superficial reading. Egg freezing can allow women to preserve their eggs to avoid age-related infertility. The UK's recent extension of elective egg freezing storage has been welcomed as a way of enhancing the reproductive choices of young women who wish to delay having children. In this paper, I explore the issue of enhancing women’s reproductive choices, questioning whether there is a more significant aspect overlooked in egg freezing. While increasing storage limits expands reproductive choices for some women, focus on this extension alone, (...) I argue, misses a fundamental issue with egg preservation that often remains ignored; the importance of effective information on egg freezing and the effect this has on women’s reproductive choices. Ultimately, I highlight the crucial role of balanced information in enhancing women’s choices regarding egg freezing and argue that focusing on extending and increasing provision may obscure this real opportunity to empower women and their authentic reproductive choices. Our study examines the expression and position of subjects in L2 acquisition, two phenomena that are studied within the framework of the Interface Hypothesis. The first version of the IH predicts that interface properties involving syntax and another cognitive domain may not be fully acquirable in a second language. The second version of the IH predicts that formal properties involving the syntax-semantics interface are unproblematic to acquire in L2 grammars compared to the vulnerable properties integrating syntax with the higher level (...) of pragmatics. We test these IH versions in L2 Spanish as acquired by L1 Greek speakers, a language combination understudied in the literature. Both languages share the null subject parameter, but still the IHs predict incomplete command at the syntax-pragmatics interface. Two acceptability judgment tasks were designed for Spanish: the first task tested null/overt subjects in referential contexts and the second task tested preverbal/postverbal subjects in informational contexts. Participants were L1 Greek intermediate and advanced learners of Spanish and native speakers of Spanish. In the first task, both experimental groups showed target-like distribution of null/overt subjects in most non-contrastive and contrastive contexts, except for the advanced group in unambiguous referential contexts. In the second task, the respective groups accepted felicitous preverbal subjects with unergative verbs, but diverged from native-like distribution of postverbal subjects with unaccusative verbs in neutral contexts. The L2 groups showed a high preference for unfelicitous preverbal subjects with both intransitive verbs in informational contexts, contrary to the subject inversion patterns of the control group. The results obtained were not consistent with the IH predictions, and other factors such as the type of subject, verb class and context played a role in L2 performance. (shrink)

Aesopic fables constitute an important case in folk and popular literature. This genre went through various stages of development; its plasticity, pedagogical dimension, and mainly its ability to convey messages through an indirect and pleasant way prompted many to take interest in it, reading, adapting, or even creating new fables. As a result, fables became a favorite topic in literature and, especially, children's literature through many and various adaptations, translations, and metanarratives. In this paper, considering fables as an early form (...) of utopic/dystopic discourse, we aim to demonstrate some cases of such references through examples taken from the corpus of Aesopic fables. Although treating the elderly occasion the same kinds of ethical issues as treating other patients, specific problems do arise when making decisions for persons, once competent, who no longer can express their values. I examine the problem of decisional incapacity and offer a critique of the principles, such as substituted judgment, and the instruments, such as advance directives, living wills, other instructional directives, as well as surrogate decision-makers.

This essay explores the preferences, anticipations and expectations of the elderly regarding the role of family members in making health care decisions for them should they become decisionally incapacitated. Findings are presented from a series of in-depth interviews of men and women aged 67–91 years. Following a discussion of the uncertain legal status of familial surrogate decision-making, we argue that the family unit's autonomy is sufficient to justify the elderly's preferred reliance on their own family. Paper, €38,00.Nicholas of Autrecourt has often seemed to be one of those philosophers doomed to be best known for everything but their own ideas. Famously, if inaccurately, dubbed "the Medieval Hume" by one of his first (...) modern critics, the threat or fear of skepticism has in one way or another shaped most subsequent studies of Nicholas's work. While understandable, this really is unfortunate. Nicholas himself clearly states that his philosophical goal was to avoid the skeptical consequences that he believed were latent in the writings of his scholastic peers. In this excellent new work, the first monograph-length study devoted to Nicholas's thought in nearly 60 years, Christophe Grellard goes a long way towards recovering Nicholas's very real contributions to fourteenth-century intellectual life.Any attempt to interpret Nicholas's thought runs up against one significant problem—few of his works survive. All that remains are a fascinating and lengthy (not to mention, confusing and unfinished) work of natural philosophy, Exigit ordo, and several letters touching on issues in epistemology, cognition, and logic. As a result, even situating Nicholas's thought within the proper intellectual currents of the first decades of the fourteenth century has proven difficult. Whose work influenced him? Who were the objects of his criticism? What were his motives? Until recently, most scholars have attempted to trace the influence of William Ockham on Nicholas's thought. Drawing from recent work on the University of Paris during the fourteenth century, Grellard not only downplays Ockham's influence on Nicholas, but also Nicholas's membership in the faculty of theology. Rather, he stresses Nicholas's ongoing involvement in the arts faculty, where he continued to teach even as he studied for his degree in theology. This has two significant consequences. First, it allows Grellard to treat all of Nicholas's writings as contributions to the practice of natural philosophy. Indeed, in his compelling first chapter, Grellard contends that the initial sections of the Exigit, in which Nicholas famously condemns scholastic Aristotelianism as nothing more than an institutionalized pedagogy of error and untruth, must be read as a plea for a distinction between philosophy and theology, between speculation and faith. Even if Nicholas was not alone at the time in pushing for these distinctions (Ockham and John Buridan had argued along similar lines), Grellard demonstrates that Nicholas's approach was certainly the more radical and extreme. Second, the shift in focus from theology to arts brings with it a shift in Nicholas's most important interlocutors. To begin, Aristotle and Averroes become constant background forces in Nicholas's thought. Moreover, as the final section of Grellard's work makes clear, many of Nicholas's ideas are most usefully understood in light of writings of two other arts masters, John Buridan and Nicole Oresme, rather than in the context of debates among his contemporaries in the theology faculty. [End Page 119]These initial interpretive decisions shape the overall structure of Grellard's book, which moves, in three parts, from a deft analysis of Nicholas's theory of evidence and probability to his account of the objects of cognition and, finally, to a comparison of Nicholas's and Buridan's epistemological theories. Unlike so many prior studies that begin with Nicholas's famous critique of a fellow theologian's cognitive theories, thereby framing Nicholas's project in terms of theological debates concerning the intuitive cognition of non-existents and God's ability to cause false visions, Grellard begins with Nicholas's positive theory of knowledge. This effectively sidesteps the entire question of Nicholas's skepticism, a question Nicholas himself explicitly tried to avoid. Nicholas comes across as a philosopher keenly aware of the limits of human cognition, yet eager to develop a viable and wholly rational epistemology within those limits. Based on an unfinished manuscript by the late philosopher Dallas Willard, this book makes the case that the 20th century saw a massive shift in Western beliefs and attitudes concerning the possibility of moral knowledge, such that knowledge of the moral life and of its conduct is no longer routinely available from the social institutions long thought to be responsible for it. In this sense, moral knowledge--as a publicly available resource for living--has disappeared. Via a detailed survey of main developments (...) in ethical theory from the late 19th through the late 20th centuries, Willard explains philosophy's role in this shift. In pointing out the shortcomings of these developments, he shows that the shift was not the result of rational argument or discovery, but largely of arational social forces--in other words, there was no good reason for moral knowledge to have disappeared. The Disappearance of Moral Knowledge is a unique contribution to the literature on the history of ethics and social morality. Its review of historical work on moral knowledge covers a wide range of thinkers including T.H Green, G.E Moore, Charles L. Stevenson, John Rawls, and Alasdair MacIntyre. But, most importantly, it concludes with a novel proposal for how we might reclaim moral knowledge that is inspired by the phenomenological approach of Knud Logstrup and Emmanuel Levinas. Edited and eventually completed by three of Willard's former graduate students, this book marks the culmination of Willard's project to find a secure basis in knowledge for the moral life. (shrink)

Their alternative to the usual narrative of Bonhoeffer’s life holds that early in his career, long before the crisis of the Confessing Church and the rise of Nazism, Bonhoeffer made a commitment to [End Page 205] Christian pacifism that endured even through the war years and his resistance to Hitler.To argue for this alternative telling, the authors analyze Bonhoeffer’s three main “ethical” texts: the early “Barcelona lectures,” Discipleship, and finally Ethics. On their telling, while the early ethics lectures were theologically deficient, by the time that Bonhoeffer wrote Discipleship he had developed “integration,” which was “the primary theological catalyst for the ethical transition from Barcelona to Discipleship” (129). Discipleship is, they conclude, the pinnacle of Bonhoeffer’s thought, and anything that comes after it, including Ethics, cannot in any fundamental way differ from it.Alongside this diachronic analysis of Bonhoeffer’s main ethics texts, the authors emphasize two letters that Bonhoeffer wrote in 1935 and 1936. In the first, Bonhoeffer asserts that, because of his theology, he is “sometimes perceived as fanatical” (223). The second he wrote describing his “conversion experience” in 1930, in relation to the Sermon on the Mount and “Christian pacifism.” Read singly, these letters are interesting examples of Bonhoeffer’s thought and life of faith. As the authors present the argument, though, the letters comprise a unified narrative and function as an interpretive lens by which the primary texts should be understood. They think that the “fanaticism” of the first letter refers to the faith brought about in the conversion experience described in the second. The “fanaticism” letter is important because in it he asserts that, “if he were to become more ‘reasonable,’ he would have to ‘chuck [his] entire theology’” (223).Because Bonhoeffer wrote that he would have to “chuck” his theology if he made it more “reasonable,” the authors think that the theology that emerged from the conversion experience has a foundational role in his later works. Whatever Bonhoeffer wrote in Ethics, then, simply cannot disagree with the “fanaticism” that “is most fully articulated in … Discipleship” (223). Because of the importance of the “Christian pacifism” of the conversion and Discipleship, it is thus impossible—or at least highly unlikely—that Bonhoeffer participated in the assassination attempts.Bonhoeffer scholars and nonspecialists alike will find this text provocative and interesting. The conclusions, though, are finally unconvincing. For the authors, the “conversion experience” is the central key to understanding Bonhoeffer, and it is clear that they understand “Christian pacifism” to be of primary importance in the conversion, but they never tell us to what variety of Christian pacifism Bonhoeffer converted. It is very likely that Bonhoeffer’s Christian pacifism was different in kind than the Christian pacifism that the authors seem to endorse. That anachronistic reading alone renders the conclusions of the text suspect.Apart from simple historical questions, the methodology the authors use to construct their hermeneutical lens is also problematic. Hermias of Alexandria wrote down the lectures given on the Phaedrus by his teacher Syrianus, Head of the Neoplatonic School of Athens. In the preserved text the Platonic distinction of madness is presented in a Neoplatonic way. In the first section of the article we discuss Hermias’ treatment of possession. The philosopher examines four topics in his effort to present a Neoplatonic doctrine concerning possession. As he holds that divine possession is evident in all parts of the soul, he first (...) argues that it is primarily applied to the one-in-the-soul. Secondly, he explains that possession is also applied to reason, opinion, imagination, thymos and desire, all the above being distinctive parts of the human soul, but not as important as the one-in-the-soul. The third issue he discusses is whether all causes of possession are identical to the divine. Then, Hermias examines the fact that possession is to be traced not only in the human soul but also in the statues. In the second section of the article Hermias’ analysis of the four kinds of Platonic madness is presented. The philosopher first analyzes the interdependence between all four divine kinds of madness and then describes their function on two levels, inside and outside the soul. The function within the soul is richer and is realized in four fields: the restoration of the soul after its fall, the restoration of the human being as a whole, the Pythagorean mathematical system and the logic processes. The function outside the soul deals with the manifestations of the soul in human society. Under this perspective, Hermias clearly proposes an original classification of the kinds of madness, on the basis of which we encounter poetic madness. After that follow the madness of the seer, the telestic madness, and the madness of love. The whole analysis incorporates Platonic, Aristotelian, Pythagorean and theurgic elements that cover the fields of psychology, logic and metaphysics. (shrink)
