The paper presents different clustering approaches in legal judgments from the Special Civil Court located at the Federal University of Santa Catarina. The subject is Consumer Law, specifically cases in which consumers claim moral and material compensation from airlines for service failures. To identify patterns from the dataset, we apply four types of clustering algorithms: Hierarchical and Lingo, K-means and Affinity Propagation. We evaluate the results based on the following criteria: entropy and purity; algorithm's ability in providing labels; legal expert’s (...) evaluation; and experimental complexity. The results demonstrate that the most advantageous approach is Hierarchical Clustering, since it has the best entropy and purity numbers, as well as the least difficulty for the expert to analyze the clusters, and the least experimental complexity. The main contribution of the paper is to show the advantages and disadvantages of each approach, especially to identify labels in unstructured and non-indexed legal texts. (shrink)

Tout le film est toujours une microphysique du pouvoir, en potence, d’être étudier. Aujourd’hui l'augmentation des productions d'horreur et son public ont fait le film d'horreur une «contreculture» dominante, mais toujours sous l'effet négatif du pouvoir et du savoir qui disqualifient les discours, matérialisée dans ces films, ce qui les rend illégitime et exiler en soi espace filmique, transformée en un lieu adapté pour interdite et marquée par certaines pratiques discursives avec certains dispositifs d'exclusion. Paradoxalement, les types marginaux qui apparaissent (...) dans l'ordre de ces productions occupent les positions de sujets à exercer le pouvoir dans l'horreur et dans le même temps le renforcement de leur marginalité et de son objectivation. Ces aspects et les spécificités qui caractérisent les productions d'une part, nous ont amenés à identifier les pratiques de l'objectivation qui transforment corps dans les sujets dans l'horreur; d'autre part, de démontrer que ces films constituent une nouvelle technologie de contrôle social des corps, mais l'objectif principal de cette étude est d'analyser les relations de pouvoir à travers l'antagonisme des stratégies dans ce discours, qui est, pour savoir ce que cela signifie d'avoir un corps libre, nous examinons ce qui se passe sur le corps subjugué dans les films d'horreur, prenant l'archeogenealogie de Foucault comme base théorique. Cette questionhypothèse aurait un autre groupe: d'où pourrait faire une telle histoire? Nous supposons que dans les moments de crise, les films d'horreur ont beaucoup à prouver, donc nous avons opté pour un très similaire à celui qui Foucault a été invité par les experts de la revue Cahiers du cinéma pour discuter des conditions pour les productions cinématographiques comme Le Chagrin et la Pitié (1969), Portier de nuit (1974) et Lacombe Lucien (1974), quand on a regardé le déclin du gaullisme et l’ascention de Valéry Giscard d'Estaing , le vainqueur de la présidentielle de 1974, avec le soutien de l'ancien droit Tardieu et petainistes, anciens alliés de l'occupation du Führer Hitler de la France, entre 1940 à 1943. Maintenant, les conditions de production sont ceux qui marquent la fin des gouvernements socialistes de Mitterrand et Chirac, et le retour au pouvoir de la droite, à l'ascension politique de Nicolas Sarkozy. Au milieu de la crise économique de l'Union Européenne, flotte dans l'air la peur terrifiante de risque que l'arrivée de l'extrême droite au pouvoir. La présence croissante d'immigrants est aussi dans l'ordre d'une nouvelle crise de l'identité française. Ce sont les conditions de production de À l'intérieur, Frontière (s),Martyrs, Ils, La Meute, Captifs et Derrière les murs et, des films qui font partie de notre corpus. À la methodologie, nous développons les trois concepts opérationnels: le dispositif filmique de la mémoire, de la vérité et de l'objectivité pour traiter la mémoire populaire, recodé dans ces films et soi-disant perçu par nous comme l'un des principaux modes de contrôle des corps d’horreur; la notion d’intericonicité est encore utilisée pour indiquer des images qui renvoient à d'autres, mais tout en réalisant que chaque image a dans sa juxtaposition afin de utopies des hétérotopies. Donc, nous avons décidé de donner une nouvelle forme à cette notion, y compris l'utopique juxtaposés à des espaces hétérotopiques, sous l'influence de la discussion faite par Foucault dans le Corps utopique et Les hétérotopies. In this article, we first review the development of clinical ethics in pediatrics in the United States. We report that, over the last 40 years, most children’s hospitals have ethics committees but that those committees are rarely consulted. We speculate that the reasons for the paucity of ethics consults might be because ethical dilemmas are aired in other venues. The role of the ethics consultant, then, might be to shape the institutional climate and create safe spaces for the discussion of (...) difficult and sometimes contentious issues. Finally, we report how pediatric clinical ethics has evolved differently in a number of other countries around the world. (shrink)

El Foro Global de Bioética en Investigación (GFBR por sus siglas en inglés) se reunió el 3 y 4 de noviembre en Buenos Aires, Argentina, con el objetivo de discutir la ética de la investigación con mujeres embarazadas. El GFBR es una plataforma mundial que congrega a actores clave con el objetivo de promover la investigación realizada de manera ética, fortalecer la ética de la investigación en salud, particularmente en países de ingresos bajos y medios, y promover colaboración entre (...) países del norte y del sur.a Los participantes en el GFBR provenientes de Latinoamérica incluyeron a eticistas, investigadores, miembros de comités de ética y representantes de autoridades sanitarias provenientes de Argentina, Brasil, Chile, Colombia, Ecuador, El Salvador, Guatemala, Honduras, Panamá, Perú, Nicaragua y la República Dominicana. Una legítima preocupación por la protección de las mujeres embarazadas y sus embriones o fetos ha llevado a la mayoría de los países de la Región de las Américas a limitar la realización de estudios con mujeres embarazadas exclusivamente a aquellos estudios específicos sobre el embarazo, y a requerir la exclusión sistemática de las mujeres embarazadas o de las mujeres que quedan embarazadas en el curso del estudio. Ciertamente, a lo largo de la historia de la ética de la investigación, se ha creído erróneamente que proteger a una población es sinónimo de excluirla de los estudios. Se sabe ahora que proceder así implica exponer a riesgos mucho mayores a la población que se busca proteger. El embarazo implica cambios fisiológicos sustantivos e impacta profundamente la manera como el cuerpo metaboliza los medicamentos. Sin embargo, por evitar hacer investigación con mujeres embarazadas, no se ha producido la evidencia científica necesaria para tomar decisiones sobre tratamientos e intervenciones preventivas con dosis eficaces y seguras para ellas y sus embriones o fetos. A manera de ilustración, en el 2001 había en los Estados Unidos apenas más de una docena de medicamentos aprobados para uso en el embarazo (1) y en el 2011 la Food and Drug Administration (FDA) aprobó por primera vez en 15 años un medicamento para su uso en el embarazo (2). Como consecuencia de no haber producido la evidencia necesaria, se pone en riesgo la salud de las mujeres embarazadas cada vez que se les da atención médica. Las mujeres embarazadas se enferman y las mujeres enfermas se embarazan, y no se sabe si los medicamentos que se les da son eficaces o siquiera seguros para ellas y sus embriones o fetos. (shrink)

Medeiros se baseia nas ideias de dois pensadores, Richard Rorty e Roberto Mangabeira Unger, para desenvolver a tese de que há uma espécie de pragmatismo a que se pode chamar de "pragmatismo romântico" - levando em consideração o contexto de levantamento das premissas dos autores base, principalmente de seu espaço e tempo (entre os séculos XX e XXI) -, a fim de lançar um olhar atual sobre a relação entre a filosofia e a política. Nessa busca, tais autores revelariam que (...) o pragmatismo romântico "abrilhanta a democracia com uma compreensão mais otimista, pela qual se pode entrevê-la a soprar ares regeneradores nas sociedades existentes". Daniel Isaacson has advanced an epistemic notion of arithmetical truth according to which the latter is the set of truths that we grasp on the basis of our understanding of the structure of natural numbers alone. Isaacson’s thesis is then the claim that Peano Arithmetic (PA) is the theory of finite mathematics, in the sense that it proves all and only arithmetical truths thus understood. In this paper, we raise a challenge for the thesis and show how it can be (...) overcome. We introduce the concept of purity for theories of arithmetic: a theory of arithmetic is pure when it only proves arithmetical truths. Then, we argue that, under Isaacson’s thesis, some PA-provable truths—including transfinite induction claims for infinite ordinals and some consistency statements—are seemingly not arithmetical in Isaacson’s sense, and hence that Isaacson’s thesis might entail the impurity of PA. Nonetheless, we conjecture that the advocate of Isaacson’s thesis can avoid this undesirable consequence: the arithmetical nature, as understood by Isaacson, of all contentious PA-provable statements can be justified. As a case study, we explore how this is done for transfinite induction claims with infinite ordinals below ε0. To this end, we show that the PA-proof of such claims employs exclusively resources from finite mathematics, and that ordinals below ε0 are finitary objects despite being infinite. (shrink)

This paper is concerned with the claim that supervaluationist consequence is not classical for a language including an operator for definiteness. Although there is some sense in which this claim is uncontroversial, there is a sense in which the claim must be qualified. In particular I defend Keefe's position according to which supervaluationism is classical except when the inference from phi to Dphi is involved. The paper provides a precise content to this claim showing that we might provide complete (and (...) sound) systems of deduction for supervaluationist consequence in which proofs are completely classical with the exception of a single last step (involving the above mentioned inference). To what degree can language be acquired from linguistic input alone? This question has vexed scholars for millennia and is still a major focus of debate in the cognitive science of language. The complexity of human language has hampered progress because studies of language–especially those involving computational modeling–have only been able to deal with small fragments of our linguistic skills. We suggest that the most recent generation of Large Language Models (LLMs) might finally provide the computational tools to determine empirically (...) how much of the human language ability can be acquired from linguistic experience. LLMs are sophisticated deep learning architectures trained on vast amounts of natural language data, enabling them to perform an impressive range of linguistic tasks. We argue that, despite their clear semantic and pragmatic limitations, LLMs have already demonstrated that human-like grammatical language can be acquired without the need for a built-in grammar. Thus, while there is still much to learn about how humans acquire and use language, LLMs provide full-fledged computational models for cognitive scientists to empirically evaluate just how far statistical learning might take us in explaining the full complexity of human language. The relevance of Martin Heidegger’s thinking to Paul Celan’s poetry is well known. Between Celan and Heidegger proposes that, while the relation between them is undeniable, it is also marked by irreducible discord. Pablo Oyarzun begins with a deconstruction of Celan’s Todtnauberg, written after the poet visited Heidegger in his Schwarzwald cabin. The poem stands as a milestone, not only in the complex relationship between the two men but also in the state of poetry and philosophy in late modernity, (...) in the aftermath of the Holocaust. Discussion then turns to The Meridian, Celan’s acceptance speech for the prestigious Büchner Prize for German language literature. Other issues are insistently addressed—place, art, language, pain, existence, and the Heideggerian notion of dialogue—as Oyarzun revisits several essential poems from Celan’s oeuvre. A rare translation of Oyarzun’s work into English, Between Celan and Heidegger affirms the uniqueness of Celan’s poetry in confrontation both with Heidegger’s discourse on Dichtung (a poetic saying centered in the idea of gathering) and with Western philosophical notions of art, technē, mimesis, poiesis, language, and thinking more broadly. What kind of discourse is likely to build up constitutional norms? How do legal-philosophical insights get along with competing political claims? This book presents the main conclusions from the CITC (Congreso Internacional de Teoria Constitucional) in Cordoba, Argentina. While addressing the very foundations of Constitutional Law, leading scholars from Europe and America got together to debate legal and political issues which impinge upon institutional design and polity assessment, political representation and rights protection. Not to mention other vexing challenges such as (...) the proper latitude of judicial review, the threatening phenomena of untamed emergency powers and the current international dimension of supra-national state-building. Beyond governance and human rights discourse, the core content of this book is concentrated on shedding some light on which theoretical and/or political conditions could better stand and give shelter to civil obedience and constitutional patriotism. La lectio divina es un ejercicio ascético y espiritual usado por la comunicad cristiana en las asambleas litúrgicas. Desde los Padres del Desierto su práctica nunca se ha extinguido como ejercicio espiritual. Ahora parece haber vuelto con fuerza como ejercicio de lectura de la Palabra de Dios. La primera parte del artículo recrea los datos históricos fundamentales, la segunda explica su validez para los cristianos y las comunidades de nuestro tiempo.

In this paper we investigate a semantics for first-order logic originally proposed by R. van Rooij to account for the idea that vague predicates are tolerant, that is, for the principle that if x is P, then y should be P whenever y is similar enough to x. The semantics, which makes use of indifference relations to model similarity, rests on the interaction of three notions of truth: the classical notion, and two dual notions simultaneously defined in terms of it, (...) which we call tolerant truth and strict truth. We characterize the space of consequence relations definable in terms of those and discuss the kind of solution this gives to the sorites paradox. We discuss some applications of the framework to the pragmatics and psycholinguistics of vague predicates, in particular regarding judgments about borderline cases. (shrink)

Se examinan las “paradojas ónticas” que mi cuerpo inaugura ; se despeja la tesis de dos interpretaciones de las meditaciones primera y sexta ; se discute la “excepción a (...) la metafísica” instaurada por el conocimiento de mi cuerpo ; se arriesga, siguiendo una indicación del autor, la apertura a una dimensión ética que exige examinar ya no la unión de cuerpo y alma, sino la unión por el amor a un semejante y a la comunidad de semejantes -/- The article carries out a critical examination of J.-L. Marion’s latest work, “Sur la pensée passive de Descartes”,whose main thesis is that the problems posed by the union of body and soul confuse two terms: body and my body. This confusion leads to the application to the former of categories inherent to the latter. The paper ex-amines the “ontic paradoxes” that my body (the flesh) gives rise to (a); it clarifies the thesis of two interpretations of the First and Sixth Meditations (b); it discusses the “exception to metaphysics” established by the knowledge of my body (c); and, following an indication by the author, it proposes an opening to the ethical dimen-sion, which demands an examination of the union, through love, with a fellow human being and with the community of human beings, rather than of the union of body and soul (d). -/- Neste artigo, propõe-se um exame crítico da última obra de J.-L. Given the abrupt global disruption caused by SARS-CoV-2, one might think that the COVID pandemic was an unpredictable event. But in the years leading up to the emergence of the COVID pandemic, several documents had already been warning of the increasing occurrences of new disease outbreaks with pandemic potential and lack of corresponding policies to promote pandemic preparedness and response. In this article, we call these documents “early warnings”. We argue that a survey of early warnings can help science communicators (...) to promote the public understanding of evidence-based pandemic preparedness and response policies at local or international level. Our proposal differs from other approaches to pandemic preparedness and response in that it highlights the relevance of documents published before the COVID outbreak. We show that the early warnings did not become outdated after the COVID outbreak, but, rather, that they are even more pressing now. (shrink)

This article reflects on childhood times based on the words chrónos, kairós and aión, which the Greeks use to conceptualize time, in dialogue with different authors, such as Kohan, Pohlmann, Skliar, Kohan and Fernandes. In the pedagogical field, we explore how Pedagogy of Childhood has focused on the importance of childhood temporality and children’s agency, with contributions from Hoyuelos, Parrini, Aguilera et al., Barbosa, Oliveira-Formosinho e Araújo, Oliveira-Formosinho, Pinazza and Gobbi. We reflect on what forms of organizing time are possible (...) when we think about children and their childhoods. Would it be a continuous and chronological time, a time of opportunity for the instant or the timeless intensity of the aiónic? Would it be possible to open spaces in school for other temporalities, given its immersion in chronological time, and its extreme emphasis on routine? We seek a relationship between forms of temporality, philosophy, and early education in order to explore alternative possibilities in the relationship between child and the school context, and conclude that, since the child’s is the aiónic time of intense experience, it is in the heightened dynamic immediacy and the multiple symbolic languages of play that it may be possible to create pedagogical structures that provide a dwelling for childhood temporality. This paper presents and defends a way to add a transparent truth predicate to classical logic, such that and A are everywhere intersubstitutable, where all T-biconditionals hold, and where truth can be made compositional. A key feature of our framework, called STTT (for Strict-Tolerant Transparent Truth), is that it supports a non-transitive relation of consequence. At the same time, it can be seen that the only failures of transitivity STTT allows for arise in paradoxical cases.
