Surgical devices are often marketed before there is good evidence of their safety and effectiveness. Our paper discusses the ethical issues associated with the early marketing and use of new surgical devices from the perspectives of the six groups most concerned. Health Canada, which is responsible for licensing new surgical devices, should amend their requirements to include rigorous clinical trials that provide data on effectiveness and safety for each new product before it is marketed. Industry should comply with all Health (...) Canada requirements to obtain licenses for new products. Until Health Canada requires effectiveness and safety data, industry should cooperate with physicians in appropriate studies before releasing new products and should make balanced presentations of all the available evidence. Surgeons should, before using a new surgical device, assess the evidence on its effectiveness and safety and ensure they are properly trained and competent in using the device. Surgeons should provide their patients with an evaluation of the available evidence and inform them about possible complications and the surgeon's level of experience with the new device. Patients, who should be given an honest evaluation of the available evidence, possible complications, and the surgeon's experience, should be encouraged to evaluate the evidence and information to their own satisfaction to ensure that fully informed consent is given. Health institutions, responsible for regulating practice within their walls, should review new devices for safety, effectiveness, and economic impacts, before allowing their use. They should also limit the use of new surgical devices to surgeons trained and competent in the new technology. Professional societies should provide guidance on the early adoption of new surgical devices and technologies. We urge all those involved in the development, licensing, and use of new surgical devices to aim for higher ethical standards to protect the health and safety of patients requiring surgery. The lowest acceptable ethical standard would require device manufacturers to provide surgeons with accurate and timely information on the efficacy and safety of their products, allowing surgeons and patients to evaluate the evidence (and the significance of information not yet available) before surgery. La teoría de los valores, la axiología, a veces suele pasar muy inadvertida en los análisis que se hacen de la obra filosófica de Mario Bunge, o autores que siguen su línea de investigación como Gustavo Esteban Romero. En este artículo voy a repasar las principales concepciones básicas en teoría de valores de los dos filósofos citados (aunque se intentará no caer en un mero análisis escolástico), centrándome en las diferencias y coincidencias con tal de lograr luego una tentativa síntesis. Son pertinentes y acertados los principios mencionados sobre el bien global del paciente y el respeto a la vida de toda persona, sin discriminación, como parte esencial del ethos hipocrático. Es innegable la necesidad del uso de criterios objetivos en la asignación de asistencia mecánica respitatoria. Para ello, en la disciplina de los cuidados críticos se dispone de las herramientas soportadas en la evidencia, de gran valor práctico y como es obvio en el uso de elementos de diagnóstico y terapia, también con sus limitantes, como sucede con las limitaciones de valores predictivos de las mismas. Encuentro que el uso del concepto “preservar la mayoría de los años de vida”, por parte de Jakie Powder del Jhon Hopkins Center of Bioethic, se puede prestar a equívocos, pues podría entenderse como un intento de reducción de criterios utilitaristas para la asignación de recursos de ARM; el autor se hace cargo del tema e indica que “cabe aclarar que ‘preservar la mayoría de los años de vida’ no significa hacer un triage que excluya de la AMR a pacientes que sobrepasan una cierta edad, sino que no se incluya a pacientes cuya prolongación de la vida solo resulte precaria y penosa”. En el ámbito académico-filosófico de la disciplina de la bioética se encuentran en contradicción esencial dos visiones: la utilitarista materialista y la realista; es de difícil conciliación racional el intento de cuantificación objetiva de “calidad de vida”, pues ello conduciría a posibles decisiones injustas. Creo que es pertinente reconocer que el ejercicio práctico de la medicina se enmarca, generalmente -no solo en situación de pandemia- en un entorno de escasez de recursos. Estos, por supuesto, siempre han de asignarse dentro del marco de la racionalidad, la proporcionalidad terapéutica y la justicia, pero es pertinente reconocer que existen variables que determinan resultados fatales y que no pueden ser atribuibles a los procesos de decisión del clínico, quien no ha de ser obligado a lo imposible cuando el volumen y complejidad de las circunstancias de triage son apremiantes. Ello no deroga el imperativo racional hipocrático del respeto a la vida de todos como inspiración del quehacer”. Aim: The presence of noise in urban environments is rarely considered a factor that causes damage to the environment. The primary generating source is transportation means, with vehicles being the ones that affect cities the most. Traffic noise has a particular influence on the quality of life of those who are exposed to it and can cause health alterations ranging from annoyance to cardiovascular diseases. This study aims to describe the relationship between the traffic noise level and the perceived annoyance (...) in the inhabitants of a city on the Northern Border of Mexico. The work carried out in a city represents the vulnerability characteristics: economic, social, and migratory of its sizable portion of the inhabitants. Due to that, it is impossible to identify precisely the number of residents as the number of vehicles in circulation.Methods: The streets and avenues with an annual average daily traffic of more than 1,000 vehicles were considered for the measurement of traffic noise. The equipment used was a vehicle gauge with non-invasive speed radar; type I integrating sound level meters, with their respective gauges and tripods. A questionnaire was applied to people living within 250 m of the streets and avenues in which the noise was measured.Results: The noise measurement found a parameter of LAeq estimated for 12 h during the day, exceeding 70 dBA. The data received from the questionnaire were statistically tested by using Pearson's correlation tests. A total number of 2,350 people were participated, of whom 1,378 were women and 972 were men. The age of participants is ranged from 18 to 75 years. The overall perception of traffic noise annoyance identified that 1,131 participants responded “Yes” as they considered the noise annoying. Participants who responded “No” as well as those who responded “Do not know” resulted in a total of 1,219 people.Conclusion: The results show that the population is desensitized to traffic noise and does not perceive it as an annoyance. The flow of vehicles and the type of vehicles are the significant factors for the propagation and increase in the traffic noise levels. Women present a considerable appreciation of traffic noise perception instead of younger people who demonstrate a higher tolerance to high-level exposure. This reflects the lack of information of the population around the noise problem and its effects. (shrink)

RésuméCet article explore les liens entre le recours à la véracité de Dieu et les notions de certitude «métaphysique» et «morale» chez Descartes. Pour cela, je montre le rôle qu'elles jouent dans sa preuve de l'existence du monde extérieur, sa position sur l'existence d'autres esprits et celle sur l'«animal-machine». Descartes se sert de la véracité de Dieu dans le premier cas, maispas dans le deuxième ni le troisième. Je suggere que c'est parce que faire à nouveau appel à la véracité (...) de Dieu dans le cas des autres esprits aurait mis en péril sa doctrine de l'animal-machine. Je conclus en me penchant sur des passages de Descartes qui pourraient sembler incompatibles avec l'inter prétation que je fais du rôle important quejoue la certitude morale dans sa philosophic. In Zoopolis, Donaldson and Kymlicka argue that intervention in nature to aid animals is sometimes permissible, and in some cases obligatory, to save them from the harms they commonly face. But they claim these interventions must have some limits, since they could otherwise disrupt the structure of the communities wild animals form, which should be respected as sovereign ones. These claims are based on the widespread assumption that ecosystemic processes ensure that animals have good lives in nature. However, this assumption (...) is, unfortunately, totally unrealistic. Most animals are r-strategists who die in pain shortly after coming into existence, and those who make it to maturity commonly suffer terrible harms too. In addition, most animals do not form the political communities Zoopolis describes. The situation of animals in the wild can therefore be considered analogous to one of humanitarian catastrophe, or to that of irretrievably failed states. It matches closely what a Hobbesian state of nature would be like. This means that intervention in nature to aid nonhuman animals should not be limited as Donaldson and Kymlicka argue. (shrink)

The purpose of this book is to initiate a new discipline, namely a formalized epistemological method drawn from the cognitive strategies practised in the most effective among the modern scientific disciplines, as well as from general philosophical thinking. Indeed, what is lacking in order to improve our knowledge and our domination of the modes which nowadays are available for the generation and communication of knowledge, thoroughly and rapidly and with precision and detail? It is a systematic explication of the epistemological (...) essence encrypted in the specialized languages and algorithms of the major modern scientific approaches, a systematic cross-referencing of the explicated results, and a final elaboration of a new coherent whole. Quantum mechanics, like a diver, can take us down to the level of the very first actions of our conceptualization of reality. And starting from there, it can induce an explicit understanding of certain fundamental features of the new scientific thinking. A formalized epistemology should not be mistaken for a crossdisciplinary or a multidisciplinary project. The latter projects are designed to offer to nonspecialists access to information, to results obtained inside specialized disciplines, as well as a certain understanding of these results; whereas a formalized epistemology should equip anyone with a framework for conceptualizing himself in whatever domain and direction he or she might choose. A formalized epistemology should not be mistaken either for an approach belonging to the modern cognitive sciences. These try to establish as neutrally as possible descriptions of how the human body-and-mind work spontaneously when knowledge is generated; whereas a method of conceptualization should establish what conceptual-operational deliberate procedures have to be applied in order to represent and to achieve processes of generation of knowledge optimized accordingly to any definite aims. This book addresses philosophers of science, physicists, mathematicians, logicians, computer scientists, researchers in cognitive sciences, and biologists, as well as any intellectual who is interested in scientific and philosophical thinking. Die Wissenschaft besteht aus einzelnen Behauptungssätzen, aus Kausalsätzen, aus Naturgesetzen, die in mathematischen Formeln ausgedrückt werden, aus Regeln und Ableitungen; aus Hypothesen, Verifikationsmethoden, Verifikationen, beziehungweise Falsifikationen; aus Konstatierungen über die Verwendung sprachlicher Zeichen. All das wird mit dem gemeinsamen Namen "Wissenschaft" bezeichnet. Wir bemerken, dass hierdurch heterogene Satztypen zusammengefasst wurden und wir wollen nach dem gemeinsamen "Durchschnitt" aller erwähnten Satzarten suchen, damit wir den gemeinsamen Namen rechtfertigen und das Verhältnis dieser Zusammenfassung zu einer andern Zusammenfassung, die man als Religion bezeichnet, (...) untersuchen können. Die Religion umfasst überlieferte Erzählungen (historische Behauptungssätze), Kausalsätze. Wir bemerken hier aber etwas Neues: das Auftreten von Normen (von allgemeinen Befehlssätzen) wie auch von Wertungen, die einen integrierenden Bestandteil der Religion bilden. Es kommen auch Mahnungen und Vorwürfe vor. Es erscheint nun zweckmässig zu sein, das Auftreten der letzterwähnten Satztypen als charakteristisch anzusehn, um die Verschiedenheit der zwei Sphären mit ihrer Hilfe zu formulieren. Die Wissenschaft ist dadurch gekennzeichnet, dass ihre Sätze richtig oder unrichtig, wahr oder falsch sind, dass sie aber nicht fordern und nicht werten. Auch die sogenannten ethischen Sätze, insofern sie wissenschaftliche Sätze sind, verpflichten nicht zu Handlungen, sondern beschreiben und erklären bestimmte Verhaltungsweisen des Menschen. Wir wollen die Neutralität, den indifferenten Charakter als das Kennzeichen aller wissenschaftlichen Sätze betrachten: sie sind nicht normativ, sie tragen uns keine Handlungen auf und werten nicht. Die Wissenschaft ist sozusagen, "jenseits von Gut und Böse". Die Religion besteht dagegen hauptsächlich aus Normen und Wertungen. Ihrem eigentlichen Wesen nach stellt die Religion keine Dichtung, keinen Mythos und ebensowenig eine blosse Ethik dar, sondern sie ist etwas viel primäreres: die Veranlassung und die Reglung der menschlichen Handlungen und die Erzeugung von Hemmungen durch Normen und Wertsysteme. Ueberall dort, wo eine Motivquelle auf einen Teil der Menschen, beziehungsweise auf alle Menschen, von andauerndem Einfluss ist und irgend ein Gegenstand der Welt dazu ernannt wird, an das Bekennen zu dieser Motivquelle zu erinnern, dort liegt Religion vor. Die Religion umfasst auch Normenund Wertsysteme, die Handlungen und Hemmungen veranlassen, welche nicht im Dienste der menschlichen Gesellschaft stehen und dadurch ist sie von der Morallehre verschieden. Der Glaube an die "Wichtigkeit" der Normen und Werte wie an jene Behauptungssätze über die Welt, welche den tiefsten Wünschen und der Sehnsucht des Menschen entgegenkommen, ist die wichtigste religiöse Handlung. Many people think we should refrain from intervening in nature as much as possible. One of the main reasons for thinking this way is that the existence of nature is a net positive. However, population dynamics teaches us that most sentient animals who come into existence in nature die shortly thereafter, mostly in painful ways. Those who survive often suffer greatly due to natural causes. If sentient beings matter, this gives us reasons to intervene to prevent such harms. This counterintuitive (...) conclusion can be opposed by arguing that we should not care about nonhuman animals; that other values, such as the existence of certain ecosystemic relations or of untouched wild areas, count for more than the interests of sentient beings; or that intervention in nature cannot succeed. There are, however, strong reasons to reject these claims and to support significant intervention in nature for the sake of animals, despite our deep-rooted intuitions to the contrary. (shrink)

Thanks to the stability and elegance of the Church-Turing thesis, the notion of computation defined by these mechanisms is etched in stone as the theoretical essence of computation. A new probabilistic-informational concept, earlier constructed by Mugur-Schächter, is further developed. Associated with Jaynes's principle, this concept permits one to define a measure for the distance between the state of a system evolving under stable constraints and the equilibrium with these constraints. An illustration is given for a gas evolving in a thermostated box. It appears that the free energy of the gas estimates the distance to equilibrium, the estimation being defined in abstract informational-probabilistic terms.

ABSTRACTColin Hay's constructivist institutionalism and Vivien A. Schmidt's discursive institutionalism are two recent attempts to theorize ideas as potential explanations of institutional change. This new attention to the causal role of ideas is welcome, but Hay and Schmidt do not take into consideration the constitutive and structural aspects of ideas. Instead they reduce ideas to properties of individual conscious minds, scanting the respects in which ideas are intersubjectively baked into the practices shared by individuals. This aspect of ideas—arguably, the institutional (...) side of ideas—is developed in post-structuralist thought, which therefore demands a place in ideational research. (shrink)

A new integrated view on the probabilistic organization of quantum mechanics is constructed. It is then proved that for superposition state vectors the theoretical quantum mechanical distribution for the momentum observable is devoid of operational definition, and hence cannot be the source of conditions of compatibility to be imposed upon a researched joint probability concept. A compatible joint probability concept is outlined.

In previous works we have established that the spacetime probabilistic organization of the quantum theory is determined by the spacetime characteristics of the operations by which the observer produces the objects to be studied (“states” of microsystems) and obtains qualifications of these. Guided by this first conclusion, we have then built a “general syntax of relativized conceptualization” where any description is explicitly and systematically referred to the two basic epistemic operations by which the conceptor introduces the object to be qualified (...) and then obtains qualifications of it. Inside this syntax there emerges a general typology of the relativized descriptions. Here we show that with respect to this typology the type of the predictive quantum mechanical descriptions acquires a precise definition. It appears that the quantum mechanical formalism has captured and has expressed directly in a mathematical language the most complex form in which can occur a first descriptional phase that lies universally at the bottom of any chain of conceptualization. The main features of the Hilbert-Dirac algorithms are decoded in terms of the general syntax of relativized conceptualization. This renders explicit the semantical contents of the quantum mechanical representations relating each one of these to its mathematical quantum mechanical expression. Basic insufficiencies are thus identified and, correlatively, false problems as well as answers to these, or guides toward answers. In “The Angel in the Machine” I argue that the substantial concept of mind is heir to a number of consequences not previously appreciated, included among which (but not limited to) are both Solipsism and Atheism. In addition, I suggest that the difficulties I indicate were to some extent already understood by Aristotle who seems to have laid the foundation for two concepts of mind, one associated with human beings, the other with Angels. His distinction is recalled in the Middle (...) Ages, but seems finally to be lost in Descartes who appears to have linked the angel mind-concept to human beings and dispensed entirely with the concept that Aristotle originally reserved for the human. The use of the concept of moral status is commonplace today in debates about the moral consideration of entities lacking certain special capacities, such as nonhuman animals. This concept has been typically used to defend the view that adult human beings have a status higher than all those entities. However, even those who disagree with this claim have often accepted the idea of moral status as if it were part of an undisputed received way of thinking in ethics. This paper (...) argues that the use of this concept, however common, distorts our understanding of how to behave towards different individuals in different circumstances. When moral status is identified with the interest in living or the capacity for well-being, it becomes an arbitrary and irrelevant criterion. When it is used as a synonym of moral consideration or considerability, in a way that is compatible with the principle of equal consideration, it becomes trivial and confusing. When used, instead, to defend the unequal moral consideration of interests of equal weight, it has several implausible implications. In particular, the claim that unequal status is justified because of the value of cognitive capacities implausibly entails that our exercising those capacities should have priority over the promotion of our wellbeing. The idea of full moral status is also problematic as it implies the possibility of status monsters. In addition, its use is based in a misconceived way of what it would really entail to have a full status by virtue of having rational capacities. The paper concludes that we have strong reasons to abandon the concept of moral status altogether. (shrink)

An individual's health, genetic, or environmental-exposure data, placed in an online repository, creates a valuable shared resource that can accelerate biomedical research and even open opportunities for crowd-sourcing discoveries by members of the public. But these data become “immortalized” in ways that may create lasting risk as well as benefit. Once shared on the Internet, the data are difficult or impossible to redact, and identities may be revealed by a process called data linkage, in which online data sets are matched (...) to each other. Reidentification, the process of associating an individual's name with data that were considered deidentified, poses risks such as insurance or employment discrimination, social stigma, and breach of the promises often made in informed-consent documents. At the same time, re-ID poses risks to researchers and indeed to the future of science, should re-ID end up undermining the trust and participation of potential research participants. The ethical challenges of online data sharing are heightened as so-called big data becomes an increasingly important research tool and driver of new research structures. Big data is shifting research to include large numbers of researchers and institutions as well as large numbers of participants providing diverse types of data, so the participants’ consent relationship is no longer with a person or even a research institution. In addition, consent is further transformed because big data analysis often begins with descriptive inquiry and generation of a hypothesis, and the research questions cannot be clearly defined at the outset and may be unforeseeable over the long term. In this article, we consider how expanded data sharing poses new challenges, illustrated by genomics and the transition to new models of consent. We draw on the experiences of participants in an open data platform—the Personal Genome Project—to allow study participants to contribute their voices to inform ethical consent practices and protocol reviews for big-data research. The theory of transference and the centrality of transference interpretation have been hallmarks of psychoanalysis since its inception. But the time has come to subject traditional theory and practice to careful, critical scrutiny in the light of contemporary science. So holds Joseph Schachter, whose _Transference: Shibboleth or Albatross?_ undertakes this timely and thought-provoking task. After identifying the weaknesses and inconsistencies in Freud's original premises about transference, Schachter demonstrates how contemporary developmental research across a variety of domains effectively overturns (...) any theory that posits a linear deterministic relationship between early childhood and adult psychic functioning, including the adult patient's treatment behavior toward the analyst. No less trenchantly, he shows how contemporary chaos theory complements developmental research by making the very endeavor of historical reconstruction - of backward prediction - suspect on logical grounds. Nor, Schacter continues, does the clinical evidence normally adduced in support of transference theory provide the firm bedrock of data that most analysts suppose to exist. What one finds, he holds, are endlessly reiterated claims of identifying determining historical antecedents sustained only by descriptions of current behaviors through a gloss of theory. Less a polemic than a call to order, _Transference: Shibboleth or Albatross?_ is cogently argued and straightforwardly written. It is destined to be a thorn in the side of analysts who resist change and a spur to those who seek to bring analytic theory into closer alignment with contemporary science in the interest of improves treatment efficacy. Longtermism should not be wrongly defined as the view that we should act so that the future is as good as possible for human beings and their descendants; rather, longtermists should be concerned with what the long-term future may be like for all sentient beings. This includes nonhuman animals, as different risks of future suffering may afflict them. Indifference toward their interests could lead to the worsening of their use as resources, quantitatively and qualitatively. En tercer lugar, se indaga la fundamentación del lenguaje y del significado en propiedades ontológicas. A purely probabilistic-informational model of evolutions is sketched, basically free of any assumption concerning the nature and structure of the evolving system but apt to incorporatea posteriori any such assumptions needed for application to a specified evolution. The model produces an abstract extension of the second principle of thermodynamics. It also leads to an outline of a typology of irreversible evolutions.

Das Wort "Kultur" wird verschiedenartig gebraucht. Wir sagen beispielsweise über ein Volk, das Grosses geleistet hat, dass es ein Kulturvolk sei, während ein anderes, das nicht so viel geleistet hat, nicht als Kulturvolk bezeichnet wird. Dagegen sprechen wir beispielsweise von der Kultur der Steinzeit, obwohl die Menschen der Steinzeit viel primitiver waren, als das Volk, das wir nicht als Kulturvolk ansehen wollten. Wir erhalten eine Bestimmung des Begriffes "Kultur" in derjenigen Bedeutung, die alle Arten und Stufen der Kultur umfasst, und (...) die uns auch in der Bezeichnung "Kulturwissenschaft" entgegentritt, wenn wir den Unterschied zwischen den Dingen, die nicht als Kulturgegenstände bezeichnet werden, und den Dingen, die wir Kulturgegenstände nennen, möglichst richtig formulieren. Der Autor möchte folgende Formulierung vorschlagen: Alle Objekte und Verhaltungsweisen (Handlungen und Dispositionen zu Handlungen) die (infolge ihrer Aenlichkeit mit anderen) als Symptome für das Vorliegen von Symbolen, Erkenntnissen (hauptsächlich kausalen Erkenntnissen) und Zwecken (beziehungsweise Wünschen) zu verwerten sind, gehören zur Kultur. Die Definition des engeren Kulturbegriffes müsste etwa lauten: Zur Kultur gehören Objekte und Verhaltungsweisen, die als Symptome des Schöpferischen (des Grossen und zugleich Neuen) gewertet werden. Es kann hier eine Parallele gezogen werden zwischen den Unterschieden von Mensch und Tier einerseits und Mensch und -- sagen wir -- Uebermensch andrerseits. Das Wesentliche ist das Auftauchen von individuellen und nicht gattungsmässigen Zügen; die Tatsache, dass das Verhalten des genialen Menschen neu ist. In diesem Sinne sprechen wir auch von einem "Kulturvolk" insofern die geschaffenen Werke des betreffenden Volkes und seine Verhaltungsweisen Symptome sind für das Schöpferische der diesem Volke angehörenden Individuen. The aim of this study is to offer a reflection on the theory of knowledge of Francisco Suárez and his nominalism in the light of Sextus Empiricus’ sceptical thought in his Outlines of Pyrrhonism. It is Sextus who allows us to compare the epistemology of Suárez with a dynamic system of knowledge. With this in view, in the first place, I examine Sextus’s scepticism and Suárez’s nominalist ontology. In the second place, I analyse the mental representation as conceived by Sextus (...) in analogy with the formal and objective concepts of Suárez, and I also discuss the concept of relation in both authors. Finally, I proceed to examine the concept of belief inasmuch as certain restrictions in the configuration of our judgements are manifest and recognized. (shrink)
