_Introducción_: la Limitación del Esfuerzo Terapéutico (LET) busca reorientar las medidas del acompañamiento terapéutico durante el final de la vida; actualmente existe legislación sobre este tema. _Objetivo: _caracterizar el conocimiento y la claridad conceptual y jurídica del personal de salud del Hospital de San José (HSJ) de Bogotá sobre la LET. _Métodos: _estudio descriptivo transversal usando encuesta de libre preparación. Se estableció claridad conceptual con resultado superior al 70% de respuestas correctas. Datos levantados con cuestionario de selección múltiple vía Formularios (...) Google, tabulados en Microsoft Excel ® y analizados con Stata ® vía estadística descriptiva. _Resultados:_ 36 % de encuestados tuvo claridad conceptual y jurídica sobre LET; el 82,3 % de encuestados diferenciaron LET de eutanasia y el 95,6 %, LET de cuidados paliativos. El 61 % de los encuestados no tuvo conflicto moral/jurídico con LET; el 60 % y el 70 % de los encuestados creen, respectivamente, que suspender el oxígeno y la ventilación mecánica no hacen parte de la LET. Finalmente, el 78,9 % expresó no haber recibido suficiente información sobre el tema. _Conclusiones_: el personal encuestado carece de claridad conceptual suficiente sobre la LET,lo que señala la necesidad de mayor educación al respecto. The aim of the present research was to assess elite student-athletes’ perception of the dual career during the lockdown caused by the coronavirus disease 2019 pandemic, compared with a group of elite student-athletes who could develop their dual career under normal conditions. A total of 150 elite athletes who were also undergraduate or postgraduate students self-completed the “Perceptions of dual career student-athletes ” questionnaire. From them, 78 did it during the mandatory lockdown period due to the state of emergency caused (...) by COVID-19 and 72 completed it in the previous year to Rio 2016 Olympic Games. The COVID-19 group was found to spend a significantly higher number of hours per week studying, while no significant differences were observed between groups in any training time variable. Student-athletes of the COVID-19 group showed better perception of whether their sport career could help them cope with their academic career and better general perception of remote learning and the use of tasks and videoconferencing as learning support tools. A lower percentage of athletes of the COVID-19 group than of the control group wished to continue with their sport career once they finished their studies. To conclude, student-athletes of the COVID-19 group show adaptations with regard to the organization of their studies and the importance they give to them and to the services provided by dual-career programs, compared with student-athletes from an ordinary pre-Olympic year. In spite of the considerable literature nowadays existing on the issue of the moral exclusion of nonhuman animals, there is still work to be done concerning the characterization of the conceptual framework with which this question can be appraised. This paper intends to tackle this task. It starts by defining speciesism as the unjustified disadvantageous consideration or treatment of those who are not classified as belonging to a certain species. It then clarifies some common misunderstandings concerning what this means. Next, (...) it rejects the idea that there are different kinds of speciesism. Such an idea may result from confusion because there are (1) different ways in which speciesism can be defended; and (2) different speciesist positions, that is, different positions that assume speciesism among their premises. Depending on whether or not these views assume other criteria for moral consideration apart from speciesism, they can be combined or simple speciesist positions. But speciesism remains in all cases the same idea. Finally, the paper examines the concept of anthropocentrism, the disadvantageous treatment or consideration of those who are not members of the human species. This notion must be conceptually distinguished from speciesism and from misothery (aversion to nonhuman animals). Anthropocentrism is shown to be refuted because it either commits a petitio principia fallacy or it falls prey to two arguments: the argument from species overlap (widely but misleadingly known as “argument from marginal cases”) and the argument from relevance. This rebuttal identifies anthropocentrism as a speciesist view. (shrink)

A fines de la Segunda Guerra Mundial sedebilita el espíritu vanguardista que caracterizó la modernidad. En esta coyuntura nace la posmodernidad como una respuesta a la canonización del movimiento moderno, como una nueva sensibilidad y una reacción que transformó los modelos estéticos y los esquemas vitales. Su influencia fue muy amplia, afectó diversos aspectos de la vida social y modificó la percepción que se tenía de la historia y del tiempo, como el valor que tenía la noción de progreso y (...) la idea de perfectibilidad como un dinamizador de la actividad del hombre hacia el futuro. Fue un movimiento que cuestionó los ideales de la modernidad, la universalización de los gustos, el racionalismo y el pragmatismo que inspiraba la función social del arte, como la funcionalidad que imponía en algunas de las artes un estilo no ornamental. Además, fue un movimiento que desde el eclecticismo borró las diferencias entre las artes, y el abismo que separaba el arte culto y el arte popular. El artículo tiene tres partes: en la primera parte se ocupa de manera general del tema de la posmodernidad, de la ruptura que esta nueva “episteme” generó y de los cambios que se dieron tanto en el pensamiento filosófico como en la forma de entender y asumir la existencia cotidiana, en la experiencia estética como en otros ámbitos de la sociedad. En la segunda parte, de algunas características de la literatura posmoderna. Y, en la tercera, del análisis de dos obras de Elena Poniatowska, “Hasta no verte Jesús mío” y “La noche de Tlatelolco”,que pueden servir de ejemplos o de ilustraciónde algunas de las características ya enunciadas. El presente trabajo trata de hacer una defensa de una particular versión de positivismo jurídico excluyente como teoría que mejor describe el derecho y sus referencias a la moral. Aunque se reivindica la tesis de las fuentes como la tesis iuspositivista por excelencia, el quid de la defensa se asienta sobre un análisis de los diferentes tipos y conceptos de moral que se consideran relevantes a la hora de la identificación del derecho. La posibilidad del error en el descubrimiento de (...) la moral objetiva deja campo abierto para entender que el derecho no puede quedar determinado por otra cosa que no sean hechos sociales. La filosofía moral kantiana ha sido criticada por su compromiso con el rigorismo moral. Esta crítica está basada en la posición kantiana respecto a la mentira; específicamente, se deriva de la afirmación de Kant de que es un deber ser veraces incluso con el asesino que llega a casa preguntando por el paradero del amigo refugiado. Este artículo tiene un carácter enteramente expositivo y tiene el objetivo de reconstruir y examinar la posición de Kant frente a la mentira para determinar (...) si la acusación rigorista está bien fundamentada. Examino tres fuentes: Lecciones de ética (§1.1), “Sobre un supuesto derecho a mentir por filantropía” (§1.2) y Metafísica de las costumbres (§1.3). De este examen comparativo, concluyo que no existe evidencia textual que demuestre que Kant defienda categóricamente el deber de ser veraces en el caso del asesino en la puerta, de manera que la acusación de rigorismo que pesa en contra de la filosofía moral kantiana, al menos en lo que respecta a este caso en particular, no parece estar bien fundamentada. Para defender la tolerancia religiosa, se muestra que no hay razones para considerar que unas religiones son más verdaderas que otras, del mismo modo que no es posible establecer que una religión es verdadera, ya que la creencia religiosa no tiene un valor objetivo absoluto. Se sostiene además que, al no ser posible el establecimiento de la objetividad de la creencia religiosa, solo si esta se funda en la libertad de conciencia es posible defender la tolerancia religiosa.

El presente trabajo busca puntuar algunas características y usos políticos de la noción de sentido común desde el pensamiento de Michel Foucault. A partir de una breve comparación con la perspectiva gramsciana del sentido común, se intenta especialmente atender a dos cuestiones: por un lado, qué estatuto epistémico se le da al conocimiento general presente en la vida cotidiana y, por otro, qué vínculo respecto a él se sostiene, o bien bajo la figura del “intelectual orgánico”, o bien el estilo (...) foucaulteano del “intelectual específico”. Desde allí, se intenta situar alcances y limitaciones de la noción desde una perspectiva foucaulteana. (shrink)

This article tries to define what discrimination is and to understand in particular detail its most important instances: those in which the satisfaction of interests is at stake. These cases of discrimination will be characterized in terms of deprivations of benefits. In order to describe and classify them we need to consider three different factors: the benefits of which discriminatees are deprived, the criteria according to which such benefits are denied or granted, and the justification that such deprivation of benefits (...) may have (or lack). This definition intends to present discrimination as a concept that may be useful not only to examine certain social phenomena, but also, more widely, to ethical theory in general. (shrink)

What is the “conventional sense” of disability, and how do the questions addressed in this special issue of Science, Technology, & Human Values differ from those inspired by Donna Haraway and the cyborg? In industrialized societies, the medical profession has authority over the determination of who should count as disabled while “assistive technologies” enable specific kinds of subject positions. In this special issue of STHV, the focus of the essays as a whole is on the different enactments of disability, as (...) complexity that simultaneously implicates bodies, gender, sexuality, technology, and politics. The study of disability offers scope for refinement and further articulation of many issues of long-standing concern to science, technology, and society. In addition, we hope they will encourage further reflection on our field’s normative engagement. (shrink)

Insofar as development implies economic growth, the term 'sustainable development' appears to some as a contradiction in terms. However, such conclusions still lack a thorough examination of the conceptual structure of the two terms between which there is a purported contradiction. In order to address this issue, the present paper scrutinises some of the assumptions which underwrite the ideologies of sustainability and of development. It is argued that there are key assumptions which both ideas have in common, and that sustainable (...) development is thus perfectly coherent on a conceptual level. It is alternatives which retain either term (such as 'sustainable degrowth') that are embroiled in paradox. The paper then examines two concepts for criticising the ideology of economic growth in other terms: dépense and conviviality. It is argued that the latter is preferable to the former for the purpose of developing post-sustainable critiques of growth. (shrink)

I argue that a standard formulation of hinge epistemology is host to epistemic relativism and show that two leading hinge approaches (Coliva’s acceptance account and Pritchard’s nondoxastic account) are vulnerable to a form of incommensurability that leads to relativism. Building on both accounts, I introduce a new, minimally epistemic conception of hinges that avoids epistemic relativism and rationally resolves hinge disagreements. According to my proposed account, putative cases of epistemic incommensurability are rationally resolvable: hinges are propositions that are the objects (...) of our belief-like attitudes and are rationally revisable in virtue of our overarching commitment to avoid systematic deception in our epistemic practices.
