In 2017, Michael Nair-Collins formulated his Transitivity Argument which claimed that brain-dead patients are alive according to a concept that defines death in terms of the loss of moral status. This article challenges Nair-Collins’ view in three steps. First, I elaborate on the concept of moral status, claiming that to understand this notion appropriately, one must grasp the distinction between direct and indirect duties. Second, I argue that his understanding of moral status implicit in the Transitivity Argument is faulty since (...) it is not based on a distinction between direct and indirect duties. Third, I show how this flaw in Nair-Collins’ argument is grounded in the more general problems between preference utilitarianism and desire fulfillment theory. Finally, I present the constructivist theory of moral status and the associated moral concept of death and explain how this concept challenges the Transitivity Argument. According to my view, brain death constitutes a valid criterion of death since brain death is incompatible with the preserved capacity to have affective attitudes and to value anything. (shrink)

According to the mainstream position in the bioethical definition of death debate, death is to be equated with the cessation of an organism. Given such a perspective, some bioethicists uphold the position that brain-dead patients are dead, while others claim that they are alive. Regardless of the specific opinion on the status of brain-dead patients, the mere bioethical concept of death, according to many bioethicists, has the merit of being unanimous and univocal, as well as grounded in biology. In the (...) present article, we challenge such a thesis. We provide evidence that theoretical biology operates with a plurality of equally valid organismic concepts, which imply different conclusions regarding the organismal status of a brain-dead patient. Moreover, the theoretical biology concepts of an organism are very distant from the view on an organism that appears by way of bioethicists theorizing on death. We conclude that if death is to be understood as the cessation of an organism, there is no single correct answer to the question of whether a brain-dead patient is alive or dead. (shrink)

The mainstream concept of death—the biological one—identifies death with the cessation of an organism. In this article, I challenge the mainstream position, showing that there is no single well-established concept of an organism and no universal concept of death in biological terms. Moreover, some of the biological views on death, if applied in the context of bedside decisions, might imply unacceptable consequences. I argue the moral concept of death—one similar to that of Robert Veatch—overcomes such difficulties. The moral view identifies (...) death with the irreversible cessation of a patient’s moral status, that is, a state when she can no longer be harmed or wronged. The death of a patient takes place when she is no longer capable of regaining her consciousness. In this regard, the proposal elaborated herein resembles that of Veatch yet differs from Veatch’s original project since it is universal. In essence, it is applicable in the case of other living beings such as animals and plants, provided that they have some moral status. (shrink)

Singer claims that there are two ways of challenging the fact that brain-dead patients, from whom organs are usually retrieved, are in fact biologically alive. By means of the first, the so called dead donor rule may be abandoned, opening the way to lethal organ donation. In the second, it might be posited that terms such as “life” and “death” do not have any primary biological meaning and are applicable to persons instead of organisms. This second possibility permits one to (...) acknowledge that brain-dead patients are deceased because they are irreversibly unconscious. In the commentary which follows, I will argue that Singer’s second option is preferable since it provides a higher amount of organs available for transplant, and is better suited to the meaning of “death” which occurs in ordinary language. I will also defend such a concept of death against the objections raised by Michael Nair-Collins in the article Can the brain-dead be harmed or wronged? In their insightful article, Brent Kious and Margaret Battin (2019) correctly identify an inconsistency between an involuntary psychiatric commitment for suicide prevention and physician aid in dying (PAD). They declare that it may be possible to resolve the problem by articulating “objective standards for evaluating the severity of others’ suffering,” but ultimately they admit that this task is beyond the scope of their article since the solution depends on “a deep and difficult” question about comparing the worseness of two possible (...) scenarios: letting someone die (who could have been helped) with not letting someone die (whose suffering could only be alleviated by death). In our commentary, we argue that creating such standards is more difficult than the authors assume because of the many types of deep uncertainties we have to deal with: (1) diagnostic, (2) motivational, and (3) existential. While agreeing with the main conclusion of Dominic Wilkinson and colleagues (Wilkinson, Butcherine, and Savulescu 2019), namely, that there is no moral difference between treatment withholding and withdrawal as such, we wish to criticize their approach on the basis that it treats the widespread acceptance of withdrawal aversion (WA) as a cognitive bias. Wilkinson and colleagues understand WA as “a nonrational preference for withholding (WH) treatment over withdrawal (WD) of treatment” (22). They treat WA as a manifestation of loss aversion (...) and refer to Kahneman and colleagues (1991), which defined this effect as follows: “the disutility of giving up an object is greater that the utility associated with acquiring it” (194). In a previous work, Wilkinson and Savulescu understood nonequivalence between treatment withholding and withdrawal as a reflection of slightly different, although related, phenomena: status quo bias or omission bias (Wilkinson and Savulescu 2012, 130–131). In neither of these two papers do they describe precisely the relation between these well-known psychological effects and WA, nor do they explain why they treat these effects as examples of nonrational preferences, despite the fact that these issues have been the subject of wide-ranging discussions on the intersection of psychology, economy, and philosophy. The article provides a critical overview of the Polish bioethics literature concerning the shortage of organs for transplantation. Problems related to this issue bear, to a considerable degree, on the attempt to answer the question how to increase the number of organs available in ethically acceptable ways. Polish authors have focused, in this respect, on the analysis and assessment of two solutions: an opt out system of acquiring organs and a system that allows the aquisition of organs on a “free (...) market”. Both solutions have been almost unanimously negatively assessed. Apart from the presentation and critique of the positions of Polish bioethicists on this matter, an important part of the text is constituted by a report from a debate, held at the national level, on the criteria and definition of death: for it is only from the deceased donors that unpaired bodily organs, such as heart, can be taken. ABSTRACT:According to the mainstream bioethical stance, death constitutes the termination of an organism. This essay argues that such an understanding of death is inappropriate in the usual context of determining death, since it also has a social bearing. There are two reasons to justify this argument. First, the mainstream bioethical definition generates an organismal superposition challenge, according to which a given patient in a single physiological state might be both alive and dead, like Schrödinger's cat. Therefore, there is no clear (...) answer as to whether organ retrieval from a brain-dead patient is an act of killing or not. Second, when combined with the dead donor rule, the mainstream position in the definition of death might lead to ethically unacceptable verdicts, since there is a discrepancy between terminating an organism and depriving someone of moral status. Biomedical sciences cannot answer the question who should be saved from death if not everyone can be. This is an ethical issue. However, we face exactly this question when deliberating on the criteria for organ allocation. The main aim of this article is to formulate a pluralistic theory of just distribution of organs, which incorporates the tenets of utilitarianism, egalitarianism and sufficientarianism. Each constituent theory adopts a different value as a criterion for organ allocation. For utilitarianism it is a health (...) benefit for the patient, for egalitarianism it is the ratio of deserts and health-related well being, for sufficientarianism what is important is that the candidate for a transplant be situated below the sufficientarian threshold. In the article I justify the acceptability of ex vivo transplantation and I provide the ethical evaluation of trafficking in human organs from the Kantian perspective. Firstly, I refer to passages of Kant's works, where he explicitly states that depriving oneself of one’s body parts for other purposes than self-preservation is not permitted. I explain that the negative ethical evaluation of the disposal of the body parts was given various justifications by Kant. Subsequently, I provide partial criticism of this justification, (...) resulting in the recognition of the admissibility of ex vivo transplantation. Secondly, I analyse the Kantian slippery-slope argument which, as some philosophers believe, supports banning trade in human organs. It turns out, however, that this argument has wider application, namely it applies to all forms of the instrumental treatment of the human body. Using a previously introduced distinction between organs of the first and the second order, I show that the slippery-slope argument is inconclusive. However, I propose a reinterpretation of this reasoning, which results in using this argument as an additional reason to support prohibiting trade in human organs. (shrink)

In the article I argue for replacing the opt-out system of organ donation, currently applied in Poland, with the Active Donor Registration system. The basic idea of the ADR system is to send a special form to all adult citizens, which would give them an opportunity to consent or dissent to the removal of organs, or to delegate their decision to their next of kin. Granting priority to declared donors – an additional assumption of ADR – would make it possible (...) for them to acquire better access to transplantation if they ever contract a disease whose effective treatment will require transplantation. I highlight the basic assumptions of both systems and describe the functioning of the Polish opt-out regulations. I also analyze the statistical data illustrating the scale of organ shortage in Poland, and I present and criticize the basic ethical principles of evaluating organ procurement systems and compare the Polish system with the ADR system from the perspective of those principles. The author analyses “The Merchant of Venice” by William Shakespeare, to highlight the transformation of the Christian body and the Jewish soul during the early stages of capitalism. He reveals that the Venice described by Shakespeare is a world without measure, in which money is the only value. People are objects of financial speculation and all of humanity is treated as a commodity, an exchange value. When Bassanio praises the advantages of Portia, he first mentions her ducats, and only after (...) that does he allude to her beauty and virtues of mind. The capitalism that is being formed in the eyes of the viewers mocks significant cultural, ethnic and religious differences. It buries them in heaps of money and then blurs them, forcing a new concept of man, whose existence differs little from plants and animals growing freely. In such a world, a game is the only strategy that allows for survival. In Venice, everyone pretends, wears a mask and lives in hypocrisy. This behaviour is typical of the “carnival” atmosphere. Masks separate people from themselves, covering up their tracks and blurring identities. By wearing them, they can hide behind “someone else”. (shrink)

The present paper constitutes an introduction to a special issue of Diametros devoted to Setting Health-Care Priorities. What Ethical Theories Tell Us by Torbjörn Tännsjö. The book in question states that there are three moral theories which have valid implications in the field of the distribution of medical resources in a healthcare system: utilitarianism, the maximin/leximin view, and egalitarianism. A number of authors have contributed to this special issue with papers which challenge this thesis. Robert E. Goodin argues that, besides (...) general moral theories, some local principles of justice might be valid. Quinn Hiroshi Gibson states that Tännsjö should have considered the Rawlsian view on justice in its contractualist reading. Jay A. Zameska argues that his “revised lexical sufficientarianism” constitutes a more reliable moral view than prioritarianism. Finally, Lasse Nielsen points out that there is more to say about distributive justice than consequentialist theories can grasp. Moreover, he puts forward an argument in defense of prioritarianism. The final article in this issue constitutes Tännsjö’s replies to his critics. (shrink)

We present a dynamical model of interaction between recognition memory and affect, focusing on the phenomenon of “warm glow of familiarity.” In our model, both familiarity and affect reflect quick monitoring of coherence in an attractor neural network. This model parsimoniously explains a variety of empirical phenomena, including mere-exposure and beauty-in-averages effects, and the speed of familiarity and affect judgments.

This volume explores two traditions in practical philosophy: action theory, which concerns the nature of motivation for human action, and praxiology, the study of human action. By bringing different perspectives together, the volume strives to contribute to the international debate on theories of reasons for action as a philosophy of action. The volume consists of three main parts. The first part, “Reasons for Action," bridges the gap between reasons for action theories and praxiology. The second part of the volume, titled (...) “Theories of Action," explores philosophical approaches to action. Finally, in the third part, “Applications," the contributors show several ways of applying praxiological ways of thinking and acting to the problems of reflection assessment, solving action incompleteness, and knowledge management. The ultimate goal of this volume is to broaden the scientific view of action: to establish a perspective on action that is permeated by moral theories on the one hand, and accounts focused on efficiency and economy of action on the other hand. Marxist axiology presupposes the theory of historical materialism: this article is concerned with an adaptive interpretation of the latter. Its concern is reflected in the proposed definition of value: value is the family of classes of states of affairs identified by the relation of preference of an ideal social subject. The article presents the hierarchy of social categories based on the adaptive interpretation of historical materialism: primary classes, secondary classes strata, etc. In the course of argumentation the aforementioned definition of (...) value becomes more and more realistic and permits ever more precise determination of values accepted in a society.
