The rise of non-fungible tokens (NFTs) has been astonishing, in particular for the arts and creative industries. The dominant discourse both in mainstream media and in academia today focuses predominantly on what this new technology can do for the art market rather than art itself. However, framing NFTs in art in the context of money and markets draws attention away from the more subtle and creative role of NFTs. Consequently, this article asks: What is the role of NFTs in (...) art, beyond the market? This research complements existing empirical work, by conducting a case study and interviews with members of DADA, a historic NFT art project which is particularly critical towards the role of the art market. The findings foregrounded five roles that NFTs play in art: as (1) a tool for systemic change, (2) a new way to community, (3) a ritual artefact, (4) a means for preservation and (5) a new medium. This paper approaches the question of terraforming—the changing of extraterrestrial environments to be capable of harboring earth-based life—by arguing for a novel conception of moral status that accounts for extraterrestrial bodies like Mars. The paper begins by addressing pro-terraforming arguments offered by James S. J. Schwartz before offering the novel account of moral status. The account offered builds on and modifies Keekok Lee’s No External Teleology Thesis (NETT), while defending a proposed Non-Fungibility Thesis (NFT). The NETT is modified and defended (...) with specific reference to Lee’s work on artifactuality and transgenic organisms. The NFT builds on work around objectification and irreplaceability, offering an account that recognizes the importance of bearers of value above and beyond the mere value they purportedly possess. Finally, the plausibility of the account is established by an overview of its applicability to other possible candidates for moral status. (shrink)

Owned objects are typically viewed as non-fungible-they cannot be freely interchanged. We report three experiments (total N=312) demonstrating this intuition in preschool-aged children. In Experiment 1, children considered an agent who takes one of two identical objects and leaves the other for a peer. Children viewed this as acceptable when the agent took his own item, but not when he took his peer's item. In Experiment 2, children considered scenarios where one agent took property from another. Children said the (...) victim could take back her own property from the perpetrator, but that she could not take an identical object belonging to the perpetrator. Finally, in Experiment 3A and 3B, children considered scenarios where a teacher could give a child either of two objects to play with-an object that the child had recently played with, or another object that looked the same. Children were more likely to say that the teacher should give the object recently played with when it belonged to the child, compared with when it belonged to the teacher. These findings are informative about the basis of judgments that property is non-fungible, and about young children's representation of ownership rights. They show that children's representation of ownership rights is not limited to principles protecting owners from being deprived. Our findings instead suggest that ownership rights are viewed as pertaining to individual objects. (shrink)

Aura & Transvestment is a transmedia project consisting of a series of generative images, an experimental form of cryptomedia and a video essay. By describing its own powers and contradictions, the work explores notions of value, ownership, authenticity, artificial scarcity and abundance in the digital realm. The project is a critical analysis of non-fungible tokens used as proof of ownership for digital art, taking Walter Benjamin’s concept of aura as a starting point. It argues that, for tokenized art, cryptography (...) serves as an artificial source of auratic power that reverts the political potential of reproducibility falling back to a magical and ritual notion of aura. This time around the ritual performed is that of property, authenticity, ownership, markets and commodification. Finally, the article outlines alternative uses of cryptography and distributed ledger technologies to support artistic labour and proposes transvestment as a temporary counter-action for the reallocation of value from capitalist forms of production and into commons-based models of social coordination. Digital organizations form part of the new wave of blockchain technologies, following Bitcoin and related cryptocurrencies. “Utopia ofion” offers an analysis of the utopian promise of digital organizations through a reading of one such project, Colony. We provide a critique of the ideology of Colony's white paper, supplemented by readings of pages from its website, as a member of a genre of texts that promote their products through seemingly neutral, technical descriptions. Colony's texts suggest an abstract, contextless and scaleless organizational (...) solution—powered by smart contracts on a blockchain—that, according to its proponents, might be applied to any social situation, from small firm to state-level governance. For its users, this organization combines a promise of sovereignty removed from that of the state, as well as implied financial returns. Our reading of Colony echoes the critiques of scholars arguing that cyberlibertarianism is a dominant politic of blockchain technologies. Furthermore, drawing on critiques of code as law and the elision of the social in smart contracts, we argue that Colony's vision presents a model of technical organization that substitutes for the state in the context of waning popular sovereignty. We ultimately suggest an understanding of digital organizations reminiscent of the settler colonial situation: the assumption of an empty social space to be filled, and the promise of sovereignty and riches for those occupying it. Analysis of these logics is relevant as hype increases around non-fungible tokens, Web3, and the corporate metaverse as well as data practices more widely. (shrink)

Building on Pietz’s speculation about the construction of a “history of the fetish’ that might be related to, yet stand apart from the fetish as a historical construct, this paper asks if there might be novel yet unmarked contemporary fetish-formations. Taking the later chapters of Pietz’s volume, which focuses on capital and techno-political infrastructures, this essay suggests that non-fungible tokens, or “NFTs,” might be thought of as failed fetishes, objects that work to occlude the material infrastructure that supports blockchain, (...) yet do not cohere because due to contemporary technology, they lack the sensuous materiality required by Pietz’s phenomenologically-shaped understanding of Marxism. Regardless of the correctness of this speculative claim about NFTs, this discussion suggests that Pietz’s original, groundbreaking argument on the fetish still has relevance to, and a great deal of creative promise for, analysis in the current day. In this article, I advance a theory of gendered money and demonstrate how couples give special symbolic meaning to men’s money in domestic exchanges. Unlike previous perspectives on gender and money such as resource theories and gender performance, this framework acknowledges money as a prop and tool that couples use to construct gender boundaries and signal normalcy in the marital relationship. Integrating concepts from economic sociology with Hochschild’s insights on the symbolism of domestic labor, I find that Ukrainians use money (...) as a token and symbol of value, not as a commodity with which to obtain desired outcomes. Drawing on in-depth interviews with 56 married and cohabiting individuals, I discover that couples subvert market meanings of money to enact a Soviet-style gender ideology. By spending men’s money on “necessary” items and avoiding accessing women’s money in the household, couples construct men’s money as both visible and valuable while rendering women’s money non-fungible. These practices highlight the primacy of culture and ideology over relative income, and can help explain the reproduction of male privilege in the household, despite gains in women’s employment and earnings. John Searle has argued that all perceptual experiences are token-reflexive, in the sense that they are constituents of their own veridicality conditions. Many philosophers have found the kind of token-reflexivity he attributes to experiences, which I will call _causal_ token-reflexivity, unfaithful to perceptual phenomenology. In this paper, I develop an argument for a different sort of token-reflexivity in perceptual (as well as some non- perceptual) experiences, which I will call _temporal_ token-reflexivity, and which ought to (...) be phenomenologically unobjectionable. According to the Multiple Realizability Argument, a higher-level property typically has many physical realizers, so it cannot be type-identical to any one of them. This enables the non-reductive physicalist to claim that some higher-level properties are type-distinct from physical properties. The reductive physicalist can counter with the Disjunctive Strategy: nothing prevents us from type-identifying the higher-level property with the disjunction of its realizers. Developing a powers-based ontology of properties, Shoemaker and Wilson present responses to the Disjunctive Strategy, wherein higher-level property (...) instances are token-distinct from their realizers, while instances of disjunctions are not. In this paper, I argue that such responses to the Disjunctive Strategy can be reasonably resisted, either by denying token-distinctness, or by insisting that exhaustively overlapping disjunctive properties are also token-distinct from the realizers. This secures the Disjunctive Strategy as a core component of the argument for reductive physicalism. (shrink)

In his (1977) "Anomalous Monism and Kripke's Cartesian Intuitions," Colin McGinn argues that Donald Davidson's anomalous monism is untouched by Kripke's (1980) argument against the identity theory. The type-identity of the physical with the mental may very well fall at the feet of Kripke's powerful arguments, but a token identification, argues McGinn, is left standing due to the simple fact that token physicalism countenances a kind of imagined separation of token mental states with their corresponding token (...) physical states. If McGinn is correct, a full-blooded physicalism is consistent with Kripke's Cartesian intuitions regarding the non-identity of the mental and the physical. But I think McGinn is mistaken. In particular, McGinn misunderstands the nature of an "epistemic counterpart" of a token pain. So contrary to McGinn, token physicalism does not seem to be able to defend against Kripke after all. The third and final installment of this book-length contribution to the Common Knowledge symposium “Contextualism—the Next Generation” treats two further writers in seventeenth-century England whose work is not representative of any stance or discourse that contextualist historians have recognized as available in that era. In Aemelia Lanyer's poetry, we find a resistance to established perspectives that is related to her sense that divine signification is always incomplete and that, therefore, the diffidence of female cognition is superior, when approaching religious texts, (...) to the assertive mentality that she associates with men. Despite his sex, however, and his reputation for theological and political radicalism, Milton too explicitly contends that the interpretation of scripture should always be “non-committal” because its signification is always incomplete. The “very magnitude” of the “great mystery” of the Incarnation, Milton argues in De Doctrina Christiana, should encourage the reader's mind to stand on “guard from the outset” against the tendency to make “rash or hasty assertions.” The urge to tamper with, pry into, add to, or hasten to understand the signifiers of divine meaning is shown, in Paradise Lost, to be the original sin of the first human couple. As much as for Lanyer, then, sex is for Milton bound up with hermeneutics—and, for both poets, the individual's relationship with God is a consuming passion, about which one may report a phenomenology of affects but can offer no contentions or arguments. The thesis of "token identity" or "token physicalism" advanced by fodor and others attempts to reconcile materialism with a non-Reductionist view of the special sciences. However, I argue that since the individual events or "tokens" of any science are only designated according to its general types, The former cannot be specified physicalistically while the latter are not. Though attempting to combat a positivistic view of the sciences, Fodor's thesis rests on a positivistic opposition of token and type.

I argue that an adequate account of non-reductive realization must guarantee satisfaction of a certain condition on the token causal powers associated with (instances of) realized and realizing entities---namely, what I call the 'Subset Condition on Causal Powers' (first introduced in Wilson 1999). In terms of states, the condition requires that the token powers had by a realized state on a given occasion be a proper subset of the token powers had by the state that realizes it (...) on that occasion. Accounts of non-reductive realization conforming to this condition are implementing what I call 'the powers-based subset strategy'. I focus on the crucial case involving mental and brain states; the results may be generalized, as appropriate. I first situate and motivate the strategy by attention to the problem of mental causation; I make the case, in schematic terms, that implementation of the strategy makes room (contra Kim 1989, 1993, 1998, and elsewhere) for mental states to be ontologically and causally autonomous from their realizing physical states, without inducing problematic causal overdetermination, and compatible with both Physicalism and Non-reduction; and I show that several contemporary accounts of non-reductive realization (in terms of functional realization, parthood, and the determinable/determinate relation) are plausibly seen as implementing the strategy. As I also show, implementation of the powers-based strategy does not require endorsement of any particular accounts of either properties or causation---indeed, a categoricalist contingentist Humean can implement the strategy. The schematic location of the strategy in the space of available responses to the problem of mental (more generally, higher-level) causation, as well as the fact that the schema may be metaphysically instantiated, strongly suggests that the strategy is, appropriately generalized and instantiated, sufficient and moreover necessary for non-reductive realization. I go on to defend the sufficiency and necessity claims against a variety of objections, considering, along the way, how the powers-based subset strategy fares against competing accounts of purportedly non-reductive realization in terms of supervenience, token identity, and constitution. We present a novel reductive theory of type-identity physicalism, which is inspired by the foundations of statistical mechanics as a general theory of natural kinds. We show that all the claims mounted against type-identity physicalism in the literature don’t apply to Flat Physicalism, and moreover that this reductive theory solves many of the problems faced by the various non-reductive approaches including functionalism. In particular, we show that Flat Physicalism can account for the appearance of multiple realizability in the special sciences, (...) and that it gives a novel account of the genuine autonomy of the kinds and laws in the special sciences. We further show that the thesis of genuine multiple realization, which is compatible with all forms of non-reductive approaches including functionalism, implies what we call token-dualism; namely the idea that in every token there are non-physical facts, which may either be non-physical properties or some non-physical substance. In other words, we prove that non-reductive kinds necessarily assume non-reductive tokens, i.e., token dualism. Finally, we show that all forms of non-reductive approaches including functionalism imply a literally multi-leveled structure of reality. (shrink)

ABSTRACT This article concerns the ways in which Afropessimist Calvin Warren misuses and overextends both Wynter’s historiography of the Human and Hartman’s concept “fungible commodity.” First, Calvin Warren flattens the ontology of the political subject described in Wynter’s concept “genres of Man” to argue that the contemporary Black US person exists as “being,” that is, non-being. Second, Warren misaligns with Wynter’s account of the period of historical rupture between the Human and nonhuman. Whereas, for Wynter, this rupture was constituted (...) by the colonial encounter in the Americas, Warren cites chattel slavery as the event wherein the Human and Other, specifically the Black Other, were torn apart. Third, Warren’s use of “fungible commodity” when referencing the contemporary Black lacks a historiographical framework that would account for the continued non-being of Black existence as commodity post-emancipation. Propertarian justifications of intellectual property postulate the appropriation of various entities, often called patterns, designs, or technologies. These must be immaterial and should not be confused with material structures that embody them. Hence two classes of objects are distinguished. It is convenient to refer to them as types and tokens. The type must involve a condition defining which material structures should be considered its tokens. For an IP regime to be economically meaningful one must necessarily appropriate types in a way (...) which restricts access to wide classes of similar, non-identical material structures. Therefore, type conditions must be general. They must define, with a margin of tolerance, only certain aspects of the structure, leaving others unspecified. Consequently, the relationship between such types and tokens is of many-to-many variety. The recognition of these facts leads to four problems in justifying intellectual property on propertarian grounds. The first problem is to demonstrate possession of the type in the pre-legal situation. The second one is to explain, why boundaries of an appropriated type should be placed in a particular location. The third problem is to avoid claim deadlocks resulting from conflicts of rights generated by separate overlapping types. The fourth problem is to justify why ownership of the type should entail the control over other separate entities—that is tokens. In the propertarian framework grounded in the pre-legal state of nature, satisfactory solutions do not seem to have been proposed for any of these four problems. (shrink)

SummaryHow can the immense amount of suffering and waste inherent in the evolutionary process be reconciled with the existence of a perfectly good and omnipotent God? A widely embraced proposal in the area of “evolutionary theodicy” is the so-called “Only Way”-argument. This argument contends that certain valuable goods – in particular, creaturely independence and human freedom – can only come about through a genuinely indeterministic and partly uncontrolled process of evolution. In a previous article, I have argued that the “Only (...) Way”-argument can be defeated by a “Twin Earth”-thought experiment: If God is omnipotent, he could have created – directly, without evolution – creatures that are molecule-for-molecule identical to those that he actually created through evolution. If the creatures that he actually created have freedom and independence, there is no valid reason to deny that the non-evolved “twin creatures” would also be free and independent. Recently, Eikrem and Søvik have suggested a way of blocking my Twin Earth-argument by appealing to the distinction between type-values and token-values. While ES admit that the Twin Earth-argument shows the non-necessity of evolution for the existence of certain type-goods, they argue that an evolutionary creation can be justified by appeal to valuable token-goods that could not have existed without evolution. In this article, I respond to ES’s token-goods argument by showing that it is incompatible with a basic presupposition of “Only Way” evolutionary theodicies, namely the claim that the evolutionary process is genuinely indeterministic and partly uncontrolled. Can physicalism (or materialism) be non-reductive? I provide an opinionated survey of the debate on this question. I suggest that attempts to formulate non-reductive physicalism by appeal to claims of event identity, supervenience, or realization have produced doctrines that fail either to be physicalist or to be non-reductive. Then I treat in more detail a recent attempt to formulate non-reductive physicalism by Derk Pereboom, but argue that it fares no better.

This paper argues that the propositions “S knowing how to Φ entails that S has the ability to Φ” and “S knowing how to Φ does not entail the ability to Φ” can both be true and non-contradictory when true, so long as one distinguishes between Φ as an action-type and Φ as an action-token. In order to defend this claim, recent work by Young, Levy, and Gaultier is discussed with a view to integrating into a coherent and novel (...) position certain commonalities within their respective views. As a consequence of this integration, a revised version of Young’s type-token action clause is suggested that provides comprehensive support for the assertion that knowing how to Φ both does and does not necessitate the ability to Φ, depending on whether one is talking about action types or action tokens. This article reports a study of both the forms and functions of such tokens in a corpus of American English conversations. These sounds appear not to be lexical, in that they are productively generated rather than finite in number, and in that the sound–meaning mapping is compositional rather than arbitrary. This implies that English bears (...) within it a small specialized sub-language which follows different rules from the language as a whole. The functions supported by this sub-language complement those of main-channel English; they include low-overhead control of turn-taking, negotiation of agreement, signaling of recognition and comprehension, management of interpersonal relations such as control and affiliation, and the expression of emotion, attitude, and affect. Sometimes, people who are otherwise eligible to donate blood are unduly deferred from donating. “Unduly” indicates a gap where a deferral policy misstates what exposes potential donors to risk and so defers more donors than is justified. Since the error is at the policy-level, it’s natural and understandable to focus criticism on reformulating or eliminating the offending policies. Policy change is undoubtedly the right goal because the policy is what prevents otherwise safe eligible donors from donating needed blood. But focusing (...) exclusively at the policy-level passes over a largely undiscussed question: if policy change takes time and there is an urgent need for blood now, then what should unduly deferred donors do in the meanwhile? Blood banks and federal agencies recommend that deferred donors donate their time or money until they become eligible, but blood is a non-fungible good: donated cash or volunteered time cannot replace a transfusion. Further, this request ignores that otherwise eligible donors could safely donate their blood in addition to their time and money. Here is the central question I will focus on in this paper: is a donor morally justified in lying on a questionnaire to donate blood if they justifiably believe that their blood poses no risk to a recipient and knows that honestly answering a donor questionnaire would unduly defer them from donating? In recent analytic literature on the Trinity we have seen a variety of "social" models of the Trinity. By contrast there are few "non-­‐social" models. One prominent "non-­‐social" view is Brian Leftow's "Latin Trinity." I argue that the name of Leftow's model is not sufficiently descriptive in light of diverse models within Latin speaking theology. Next, I develop a new "non-­‐social" model that is inspired by Richard of St. Victor's description of a person in conjunction with my appropriating insights about (...) indexicals from David Kaplan and John Perry. I point out that the copula in tokens of statements like, "I am the Father," is an ambiguous term and when used by a certain divine person a different proposition is affirmed. Central to this model is the claim that the copula bears the "is of identity" and the "is of numerical sameness without identity." Further, I show that Leftow's model employs two concepts of "person," a Lockean one and a Boethian one, and mine employs Richard of St. Victor's. I describe Leftow's model as a "hard non-­‐social" model and mine as a "soft non-­‐social" model that is nearer to some social models. I conclude that Leftow's model is not the lone candidate among "non-­‐social" models and that the variety of "non-­‐social" models has yet to be exhausted. (shrink)

Eleven years after Kosovo’s unilateral declaration of independence, Spain’s position vis-à-vis Kosovo has not only not varied, but it has become stronger, turning Madrid into the leader of the Kosovo non recognizers club within the EU. This paper analyses Kosovo-Spain relations in the last eleven years. More specifically, the paper examines the reasons behind the non-recognition of Kosovo and the approach of the Spanish governments toward Kosovo’s statehood. This is followed by a thorough analysis on how Kosovo’s path for self-determination (...) played a major role in Catalonia’s quest for independence in 2017. The empirical research demonstrates that Spain’s main reason not to recognise Kosovo is based on the country’s internal dynamics; namely, Catalonia and the Basque country. Likewise, the paper argues that the Spanish governments throughout the last eleven years have created an analogy between Kosovo and Catalonia; not in their political statements, but in their political decisions, by worsening the almost inexistent diplomatic relations with Kosovo, when the Catalan path for independence was at its highest peak. By the same token, the paper reveals that this position was enhanced and driven by Catalan separatism, that continuously used Kosovo’s unilateral declaration of independence as a model to further their own path for self-determination. The data provided and analysed in this paper as well as the statements made are based on desk research and seven semi-structured interviews conducted in Prishtina, Brussels, Madrid and Barcelona in 2018. : Traditional accounts regard the first-person pronoun as a special token-reflexive indexical whose referent, the utterer, is identified by the linguistic rule expressed by the term plus the context of utterance. This view falls short in accounting for all the I-uses in narrative practices, a domain broader than fiction including storytelling, pretense, direct speech reports, delayed communication, the historical present, and any other linguistic act in which the referent of the indexical is not perceptually accessible to the receiver. I (...) propose a model for the reference of “I” based on the distinction between three functions carried out by indexicals in communication, namely, the anaphoric, perceptual, and phantasmatic functions. The referential mechanism of the phantasmatic “I”, that is, the “I” used in phantasmatic function, is understood as an instance of imagination-oriented pointing exploiting the phantasmatic context, and not the perceptual context relevant in perceptual uses of indexicals. The rule for “I” is revised in light of the perceptual vs. phantasmatic deixis distinction; the resulting rule governing the reference of the phantasmatic “I” allows for a homogeneous treatment of ‘I’-tokens in narrative practices spanning the spectrum from fiction to non-fiction. Il modello per il riferimento di “io” qui proposto si basa sulla distinzione tra tre funzioni svolte dagli indicali nella comunicazione: la funzione anaforica, la funzione percettiva, e la funzione fantasmatica. Il meccanismo referenziale dell’io fantasmatico, ovvero del pronome di prima persona usato in funzione fantasmatica, è inteso come una istanza di deissi orientata dall’immaginazione che sfrutta il contesto fantasmatico, piuttosto che il contesto percettivo rilevante negli usi percettivi degli indicali. La regola per “io” è riformulata alla luce della distinzione tra deissi fantasmatica e deissi percettiva; la risultante regola per il riferimento indicale dell’io fantasmatico permette un trattamento omogeneo delle occorrenze di “io” nelle pratiche di narrazione che pertengono indistintamente alla finzione e alla realtà. The ancient puzzle of the Liar was shown by Tarski to be a genuine paradox or antinomy. I show, analogously, that certain puzzles of contemporary game theory are genuinely paradoxical, i.e., certain very plausible principles of rationality, which are in fact presupposed by game theorists, are inconsistent as naively formulated. ;I use Godel theory to construct three versions of this new paradox, in which the role of 'true' in the Liar paradox is played, respectively, by 'provable', 'self-evident', and 'justifiable'. I (...) also construct in modal operator logic a paradox involving reflexive empirical reasoning. Unlike the paradox of the Liar, the paradox of reflexive reasoning does not depend on self-reference. ;I consider various solutions to the Liar paradox and evaluate how well these solutions cope with the paradox of reflexive reasoning. I then formalize the solution to the paradoxes which I favor: the indexical-hierarchical approach, first sketched out by Charles Parsons and Tyler Burge. In this solution, occurrences of the predicate 'true' in sentence-tokens are contextually relativized to levels of a hierarchy. Drawing also on some brief remarks of Bertrand Russell and Charles Parsons, I develop an account of the kind of schematic generality needed for this theory to be statable. ;Finally, I demonstrate that the principles shown to be paradoxical are in fact presupposed by contemporary game theorists in their reliance on the notion of common knowledge or, more precisely, mutual belief. I create novel analyses of and corresponding solutions to several recalcitrant puzzles within game theory, including the "chain-store paradox". (shrink)
